Abstract

Adultery issue has been regulated in Article 284 of the Indonesian Criminal Code. However, in its implementation, vigilantism is more widely used by the community in response to the suit. In short it can be said that Article 284 of the Criminal Code is not effective in combating the crime of adultery. Article 284 of the Criminal Code, both legally and philosophically opposed to the values contained in Article 29 Paragraph (1) of Indonesian Constitution. In juridical, adultery prohibition in the norms of religion in Indonesia not only in people who already tied a marital relationship. In philosophy, the prohibition of adultery in the norms of religion in Indonesia is not only to provide protection to the institution of marriage, but also protect the sanctity of sexual relations, nasab, individual honour and even social honour. It can be said that the prohibition of adultery in religious norms is a form of protection against social honor as well as protection against "social values of sexual morality".

Abstract

The aim of this study is to find exact formulation of the offense of adultery. Problems in the research: 1) how Indonesian muslim society understand and act toward adultery, 2) why muslimsociety solve adultery without taking 284 Criminal Code, 3) why reconstruction of adultery law is needed, The research designs are qualitative tradition, constructivism paradigm, socio legal methodology, while its approaches are hermeneutics, philosophy and phenomenological approach. Its analyzing data technique are inductive analysis through data reduction and triangulation.The results show that Indonesian muslimsociety in sanctioning toward people committing intercourse without any legal marriage. In sanctioning is based on local custom and Islamreligion believed by major local community, with its priority on justification principle, between human as individual and as social creatures, and its justification between the victim’s need and the actor’s importance.The conclusion is that adultery criteria based on society is every intercourse without legal marriage, in accordance of religion and state, both is done by heterogeneous gender or homogenous gender. The value on 284 Criminal Code clause does not suit on the believed value by society since it only protects marriage institution. Meanwhile, in the values of Islamreligion, ones whom are protected is not only marriage institution but also the values of sexual moral society, so muslimsociety does not use 284 Criminal Code clause to take an action toward adultery actor.In progressive law, if law has problem therefore it needs to be reconstructed, and it is not the people to be insisted in adopting toward the law, then 284 Criminal Code clause must be reconstructed, because it is not effective and cannot create proper justice for Indonesian society. In the concept of Legal Pluralism, to reconstruct the clause must based on religious law, local custom and state Law, to create perfect justice.

Abstract

Pelacuran merupakan gejala sosial yang sangat memprihatinkan. Di Indonesia pelacuran berkembang mengikuti perkembangan kehidupan masyarakat itu sendiri. Hal tersebut merupakan suatu ironi di negara Indonesia yang religius, yang menjunjung tinggi nilai-nilai agama.Pada saat ini belum ada payung hukum (undang-undang) yang melarang pelacuran. Penanggulangan pelacuran menjadi semakin sulit dengan pola pikir aparat penegak hukum Indonesia yang berdasar pada paham legalistik formal dan paham positivistik. Akibatnya pelacuran dibiarkan tumbuh, bahkan di beberapa daerah pelacuran diberi tempat tertentu atau dilokalisir. Dianutnya paham tersebut juga mengakibatkan hukum tidak memiliki kemampuan untuk merespon perkembangan masyarakat, termasuk kemajuan IPTEK.Hukum merupakan refleksi dari nilai-nilai moral yang ada di dalam masyarakat. Nilai-nilai religius lebih diyakini kebenarannya oleh masyarakat dan lebih mengikat masyarakat untuk ditaati. Oleh sebab itu seharusnya hukum dibangun berdasarkan pada nilai-nilai religius dalam masyarakat.Konsep penanggulangan pelacuran perlu diperbaharui karena selama ini penanggulangan pelacuran hanya menitikberatkan pada upaya menciptakan ketertiban umum, bukan pada pelarangan inti perbuatan pelacuran (zina). Pelacuran bertentangan dengan nilai-nilai hukum yang hidup dan nilai moral bangsa Indonesia, sedangkan peraturan yang digunakan untuk menanggulangi pelacuran tidak berdasar pada nilai-nilai hukum yang hidup dalam masyarakat Indonesia.Bentuk aplikasi dari nilai-nilai religius dalam pembaharuan konsep penanggulangn pelacuran adalah dengan menjadikan nilai-nilai religius sebagai dasar dalam menjadikan pelacuran sebagi suatu tindak pidana/delik. Dalam nilai-nilai religius terkandung asas keseimbangan, oleh sebab itu dalam memfomulasikan tiga masalah pokok dalam hukum pidana, yaitu mengenai perbuatan yang dilarang, pertanggungjawaban pidana dan pidana harus mencerminkan asas keseimbangan, antara kepentingan individu dan masyarakat dengan kepentingan bangsa dan negara.

Abstract

The developmental of legal culture of Indonesia experienced a shift away fromnature, personality and identity of the Indonesian nation,.Legal cultural development of Indonesia at this time was very down. Shifting of the Indonesian legal culture is influenced by internal and external factors. Internal factors related to the morals understanding of Indonesia, while the external factors associated with the development of technologies and ideas or thoughts from a foreign culture. The condition of the legal culture is one factor that resulted in his chaos of law in Indonesia because the legal culture is one of the most influential law component, both in the establishment of law and in law enforcement. The establishment of law and law enforcement is a form of legal development, it can be said with the collapsed culture of law it will have a negative impact on the development of the law.

Abstract

This research study aims to determine the factors behind the low legal awareness of Troso weaving craftsmen in recording creations and to examine this legal awareness using the approach of Law Number 28 of 2014 and the Sharia Economic Law. The type of method used in this research is sociological juridical based on a qualitative approach. The data sources used are primary data (interviews) and secondary data. The research results show that the legal awareness dimension of some Troso weaving craftsmen in recording creations is still relatively low. The low legal awareness of craftsmen is influenced by factors, namely cognitive and affective. Cognitive is closely related to the level of understanding of the procedures for requesting creation registration, and effectiveness is related to an attitude that tends to be apathetic and skeptical is caused by a mindset pragmatic that is only oriented towards production or sales. The reality of legal awareness shows its application Law Number 28 of 2014 in society has not been fully effective, and if viewed from Sharia Economic Law, the reality of low awareness in recording creations is a form of non-compliance in implementing the principles of benefit and written principles in Islamic law. It is hoped that the results of this research can contribute to raising full awareness of Troso weaving craftsmen in recording their creations so that every work they create in the form of woven motifs will have legal protection and their exclusive rights will not be denied. Kajian penelitian ini bertujuan untuk mengetahui faktor-faktor yang melatarbelakangi rendahnya kesadaran hukum pengrajin tenun Troso dalam pencatatan ciptaan serta menelaah kesadaran hukum tersebut dengan pendekatan Undang-Undang Nomor 28 Tahun 2014 dan Hukum Ekonomi Syariah. Jenis metode yang digunakan dalam penelitian ini adalah yuridis sosiologis dengan basis pendekatan kualitatif. Sumber data yang digunakan berupa data primer (wawancara), dan data sekunder. Hasil penelitian menunjukkan bahwa dimensi kesadaran hukum sebagian pengrajin tenun Troso dalam pencatatan ciptaan terbilang masih rendah. Rendahnya kesadaran hukum pengrajin tersebut dipengaruhi oleh faktor yaitu kognitif dan afektif. Kognitif erat kaitannya dengan tingkat pemahaman terhadap prosedur permohonan pencatatan ciptaan, dan afektif berkaitan dengan sikap yang cenderung apatis dan skeptis yang disebabkan mindset pragmatis yang hanya berorientasi pada produksi atau penjualan. Realitas kesadaran hukum tersebut menunjukkan penerapan Undang-Undang Nomor 28 Tahun 2014 di masyarakat belum sepenuhnya berjalan efektif, dan apabila ditinjau dari Hukum Ekonomi Syariah realitas rendahnya kesadaran dalam pencatatan ciptaan merupakan bentuk ketidakpatuhan dalam pengamalan prinsip kemaslahatan dan prinsip tertulis dalam hukum Islam. Hasil penelitian ini diharapkan dapat berkontribusi menumbuhkan kesadaran penuh pengrajin tenun Troso dalam pencatatan ciptaan sehingga setiap karya ciptaannya berupa motif tenun nantinya memiliki perlindungan hukum dan hak eksklusifnya tidak teringkari.

Abstract

Domestic violence in its various forms occured, yet often victims of violence are reluctant to separate from their perpetrators. Reasons such as social, economic, and religious considerations to maintain the household make some victims of domestic violence withdraw their reports and forgive the perpetrators for the sake of household continuity. This research aims to answer what is the perspective of restorarive jastice in Islam and Indonesian national law in domestic violence cases? This research was conducted using a literature research method that explores relevant data in relation to this topic. This research used juridical-normative approach, which then analyzes the data using the concept of restorative justice in Islam and Indonesian national law.The results show that based on the restorative justice system, both in Islam and Indonesian national law, both provide opportunities for perpetrators and victims to restore conflict. The difference is that the concept of restorative justice in Islam emphasizes God's rights and human rights.So that the output can be in the form of victim forgiveness, as well as diyat (fine) sanctions for the perpetrator. Meanwhile, in the restorative justice system of Indonesian state law, it no longer focuses on the concept of imprisonment. Furthermore, this regulation aims for preventive, protective, repressive, and consolidative efforts. This article is limited to an overview of the comparison of restorative justice systems in Islam and Indonesian national law in handling domestic violence cases theoretically.[Kekerasan Dalam Rumah Tangga (KDRT) dalam berbagai bentuknya sering terjadi, namun seringkali korban kekerasan enggan untuk berpisah dengan pelaku. Alasan seperti kebutuhan sosial, ekonomi, dan pertimbangan agama untuk mempertahankan rumah tangga membuat beberapa korban KDRT mencabut laporan mereka dan memaafkan pelaku demi kelangsungan rumah tangga. Penelitian ini bertujuan untuk menjawab bagaimana perspektif restorarive jastice dalam Islam dan hukum nasional Indonesia dalam kasus kekerasan domestik?. Penelitian ini dilakukan dengan menggunakan metode penelitian pustaka yang menggali data relevan sehubungan dengan topik ini. Penelitian ini mengadopsi pendekatan yuridis-normatif secara umum, yang kemudian menganalisis data dengan menggunakan konsep restorative justice dalam Islam dan hukum nasional Indonesia. Hasil penelitian menunjukkan bahwa berdasarkan sistem restorative justice, baik dalam Islam dan hukum nasional Indonesia, sama-sama memberikan kesempatan bagi pelaku dan korban untuk memulihkan konflik. Bedanya, dalam konsep restorative justice Islam lebih menekankan pada hak Tuhan dan Hak manusia. Sehingga outputnya dapat berupa pemaafan korban, maupun sanksi diyat (denda) bagi pelaku. Sedangkan dalam sistem restorative justice hukum negara Indonesia, tidak lagi fokus pada konsep pemenjaraan. Lebih jauh, peraturan ini bertujuan untuk upaya prefentif, protektif, represif, dan konsolidatif. Artikel ini terbatas pada gambaran mengenai perbandingan restorative justice sistem dalam Islam dan hukum nasional Indonesia dalam menangani perkara kekerasan domestik secara teoretis.]

Abstract

The Settlement of Domestic Violence Cases (KDRT) Based On Islamic Values and Local Wisdom. This research explores the conflict resolution of domestic violence (KDRT) cases based on Islamic values and local wisdom. The aim is to find alternatives to solving legal problems without having to go through legal channels (litigation). Although the Government has passed Law No. 23/2004 aimed at suppressing cases of domestic violence, the regulation is still not effective in overcoming the problem. It is proven that such cases still appear in public spaces and stick out like an iceberg. The main factor causing the difficulties was due to the kinship between the victim and the perpetrator. After examining both ”al-sulh”, the methodology for resolving conflicts based on Islamic values, and “Musyawarah”, the method based on local wisdom, this research finds out that the above-two alternative solutions have several advantages compared to legal channels. The two models of the resolution, therefore, can be used as alternatives for resolving conflicts in the household, especially those accompanied by violence.

Abstract

The pak ponjen’s marriage tradition in Pasuruhan Lor Village, Kudus, is an interesting example of how Islamic law interacts with local traditions. With its strong symbolic and social values, this tradition unites the families of the bride and groom, and strengthens the social bonds of the community. The research aimed to study the meaning, usage, and legal status of the pak ponjen tradition, as well as how this tradition adapts to modern developments and globalization. This study used a qualitative field-based approach and involves seven informants from community leaders and local residents. This study found that parents express gratitude to Allah SWT for their ability to marry off their youngest child. Pak ponjen’s tradition includes sungkeman, ubengan, dulangan, giving bags, and prayers. The fact, this tradition is adapted to Islamic principles, such as the recitation of salawat and prayers, which shows a balance between customs and Islamic law. This tradition falls into the ‘urf sahih in Islamic law because it does not contradict the sharia and is beneficial to the community. Therefore, the tradition of pak ponjen not only serves as a symbol of cultural identity but also as a heritage that must be preserved while adhering to Islamic principles.
