Abstract

It has been over 72 years since Indonesia proclaimed her independence on 17 August 1945. However, the 350 years of the Dutch colonization is still impacting the lives of the Indonesian people. The difficulties faced by the Indonesian legal system as the government tries to accommodate adat (custom) and religion principles within the national law and the extent to which this legal mechanism affects the everyday life of the Indonesian people. In a nation where customs and religion are so preeminent, setting up an all-inclusive document meant to be the foundation of the state’s legal system at the dawn of independence was no easy task. This paper discusses the practice of legal pluralism in Indonesia and its struggle to implement rule of law and human rights principles after a half-century of authoritarian regimes. The study involves socio-legal research drawing on empirical data. Survey research was conducted between September 2014 and February 2015 at Utrecht University, the Netherlands, as well as in 5 cities in Indonesia (Aceh, Bali, Batam, Medan, and Padang) to collect data. The research reveals that legal pluralism is not helping to strengthen the Indonesian legal system, and that the foreignness of the Western law along with the neglect of the Indonesian customary and Islamic laws, totalitarianism and military involvement in politics, corruption within the state apparatus and unsynchronized laws weaken the legal system in Indonesia and hinder its effort to implement rule of law and human rights principles.

Abstract

The presence of articles on human rights in 1945 affirmed that Indonesia respect of human rights. In order to provide protection and guarantee of human rights, the 1945 Constitution authorizes judicial review to the Constitutional Court. Some  of the verdict of the Court could be used as evidence that the Court conducted to protect and promote human rights. Constitutional Court not only act as guardian of the constitution institutions, but also as the guardian of human rights. Through its judicial review authority, the Constitutional Court appeared as law enforcement agencies that oversee the passage of state power in order not to violate of human rights.

Abstract

Relation between executive and legislative tends to be intricate. Both parties often do not understand the functions and authorities of their respective institutions. At the end, disputes often emerge in playing their roles. This writing tries to discuss the problems concerning two state institutions: the President and the Parliament. The analysis will also address how both institutions manage themselves constitutionally in order not to solely immerse in political interests.

Abstract

The National Guidelines of State Policy known to the Indonesian people as Garis Besar Haluan Negara (GBHN) used to be a set of political, economic and social principles enacted every five years by the People’s Consultative Assembly or Majels Permusyawaratan Rakyat (referred to as MPR hereafter) that had to be followed by both central and regional governments for the prosperity of Indonesia and the Indonesian people. However, since the amendments to the 1945 Constitution (1999-2002), which stripped MPR of much of its power, this national development planning scheme was abolished and decentralization was established throughout Indonesia. Nevertheless, in recent years more voices are being heard demanding the reinstatement of the National Guidelines. This paper discusses the issue of national development planning at the central government level. Drawing on the example of the Indonesian National Guidelines of State Policy, the paper argues that a possible return to the old guideline policy could be counter-productive as it would harm the decentralization process, political freedom, democracy, human rights, and the rule of law in Indonesia.

Abstract

Testing the provision of Article 155 section (2) Law Number 13 of 2003 on Manpower has been decided by the Constitutional Court (CC) through decision Number 37/PUU/IX/2011. Prior to the Constitutional Court decision, there are many various interpretations of undetermined clause. The Constitutional Court firmly states that the undetermined clause must be interpreted as “having a permanent legal force ".This study aims to analyze how the judges dismissed dispute of work termination cases in Indonesia after the decision. The research applied juridical normative method  by using secondary data literature such as legal documents, previous studies and other references which are relevant to the judges' decision within the Supreme Court after the Constitutional Court decision. Based on the analysis temporary result, the judges within the Supreme Court in 3 regions (Padang, Pekanbaru and Jakarta Pusat) and the Supreme Court itself are not practically guided by the Constitutional Court decision. It obviously results in the lack of legal certainty for the parties, especially workers.Keyword: Constitutional Court, Industrial Relation Court, Interpretation, Supreme Court.

Abstract

Abstract   The Corruption Eradication Commission (KPK; Komisi Pemberantasan Korupsi) was a specially-designed institution due to the failures of conventional institutions (public prosecutor and the police) in the eradication of corruption. Such considerations demanded that KPK was not intended to be a temporary institution. In such position, this article explicates basic arguments and legitimacy of the formation of KPK investigators. By law, a series of Laws open the chances or possibilities of non-police investigators. This means that as an institution authorized to conduct investigation, the KPK bears the right to recruit its own investigators. Abstrak Komisi Pemberantasan Korupsi (KPK) merupakan lembaga yang didesain khusus karena kegagalan lembaga konvensional (kejaksaan dan kepolisian) dalam memberantas korupsi. Karena pertimbangan itu, kehadiran KPK tidak dimaksudkan sebagai lembaga yang bersifat sementara. Dalam posisi seperti itu, tulisan ini menjelaskan dasar argumentasi dan legitimasi pembentukan penyidik KPK. Secara hukum, banyak undang-undang membuka kesempatan atau kemungkinan penyidik selain kepolisian. Abstract

ABSTRACTAccording to the Corruption Act, any conducts of the civil servants or public officials who accept gifts from others. The civil servants also certain intention with regard to the recipient do something or not take action on the contrary to their duty, and thus the receipt can be categorized as an element of corruption. The Court Decision scrutinized in this article liberate a regent accused of accepting money from a third party as the costs over the project of natural disaster prevention. This interpretation of the conduct as “on the contrary to their duty” has apparently been barely construed by the judge without considering the officer’s real intentions and his other greater liabilities as a regional leader, to be precise, his obligation to obey the law and regulations.Keywords; corruption, gratification, regional leader ABSTRAKTerkait dengan Undang-Undang Anti Korupsi, terdapat berbagai kasus yang melibatkan pegawai negeri sipil atau pegawai pemerintah menerima hadiah dari pihak lain. Mereka juga dipastikan terkait dengan pihak ketika untuk melakukan atau tidak melakukan kegiatan yang bertentangan dengan kewajibannya sebagai hubungan timbal balik untuk memperoleh pekerjaan termasuk korupsi. Putusan pengadilan yang menjadi kajian ini melepaskan terdakwa dalam perkara Proyek Penanggulangan Bencana Alam dengan pertimbangan tidak dapat dipersalahkanmelakukan perbuatan yang bertentangan dengan kewajibannya. Penafsiran  terhadap ketentuan bertentangan dengan kewajibannya, “on the contrary to their duty” dalam tindak pidana korupsi belum dimaknai secara tepat oleh hakim karena kedudukan terdakwa sebagai kepala daerah tidak sebatas hanya terkait dengan upaya meningkatkan taraf kesejahteraan rakyat, melainkan wajib menegakkan peraturan perundang-undangan. Pejabat negara tidak dapat menggunakan alasan kesejahteraan tersebut dengan melakukan pelanggaran hukum.Kata kunci; korupsi, gratifikasi, kepala daerah.

Abstract

In order to ensure the suffrage of citizens is implemented according to the principle of fair election, regulations on general and local elections may contain various kinds of restriction of suffrage. The rights to vote as well as be voted must be restricted in a way that the process of election may run seamlessly and generate a government capable of exercising the mandate of the people. However, such restriction must be performed in a fair and proportionate manner. The restriction must not cause uncertainty or even distinction of treatment towards the citizens. By means of normative legal research, this research comes to a conclusion that restriction of suffrage in general and local elections have yet been performed fairly. Legal uncertainty in the restriction of suffrage still occurs. Simultaneously, different treatment towards citizens who intend to nominate themselves is still contained in the norms related to the requirements to vote and be voted.
