Abstract

Penelitian ini dilatarbelakangi oleh permasalahan efektivitas hukum terkait dengan pengelolaan sampah di Tempat Pembuangan Akhir (TPA) regional SARBAGITA. Penelitian ini dapat dikualifikasikan ke dalam jenis penelitian hukum empiris. Undang–Undang Nomor 18 Tahun 2008 Tentang Pengelolaan Sampah merupakan payung hukum yang mendasari pengelolaan sampah Indonesia. Menurut undang-undang tersebut, pengelolaan sampah didefinisikan sebagai kegiatan yang sistematis, menyeluruh, dan berkesinambungan yang meliputi penanganan sampah. Pengelolaan sampah di TPA regional SARBAGITA telah diatur dalam Peraturan Daerah Provinsi Bali Nomor 5 Tahun 2011 Tentang Pengelolaan Sampah, Peraturan Gubernur Bali Nomor 100 Tahun 2011 Tentang Organisasi dan Rincian Tugas Pokok Unit Pelaksana Teknis di Lingkungan Dinas Pekerjaan Umum Provinsi Bali, dan Keputusan Bersama Walikota Denpasar, Bupati Badung, Bupati Gianyar, Bupati Tabanan. Peraturan Gubernur tersebut memberikan kewenangan kepada UPT Pengelolaan Sampah untuk mengatur dan mengelola sampah di regional SARBAGITA, sedangkan Keputusan Bersama tersebut memberikan kewenangan kepada Badan Pengelola Kebersihan SARBAGITA (BPKS) untuk mengatur dan mengelola sampah di regional SARBAGITA. Dalam implementasi pengelolaan sampah regional ini, terdapat 2 (dua) faktor penghambat  yaitu kesadaran masyarakat yang masih lemah dan adanya 2 (dua) pihak yang sama-sama dapat mengelola sampah di TPA regional SARBAGITA, yaitu BPKS dengan DKP di masing-masing pemerintahan daerah SARBAGITA.

Abstract

The vast condition of the Unitary Republic of Indonesia made Indonesia have several border areas stretching from Sabang to Merauke. Management of the countrys territories and border areas has been regulated in Law 43/2008 on State Territories. The National Border Management Agency (Badan Nasional Pengelola Perbatasan/BNPP) is the only institution tasked with managing border areas in Indonesia. The Minister of Home Affairs as the Head of BNPP leads and controls the implementation of the duties and functions of BNPP. In this study using Border Management Theory and Authority Theory. This research uses the normative legal research method which is the research conducted referring to the laws and regulations. The management of border areas in Indonesia still faces various problems, therefore the position and authority of the BNPP will be discussed briefly in this paper, along with comparisons in other countries.

Abstract

Democracy is a fundamental principle within the Indonesian state system as reflected in the 1945 Constitution (UUD 1945), where political parties play a key role as a pillar in bridging the people and the government. The constitutional responsibility of political parties within the Indonesian constitutional system encompasses not only compliance with the law but also moral and ethical aspects in realizing a clean, transparent, and accountable government. This study aims to examine the regulation of the constitutional responsibility of political parties from the perspective of Indonesian constitutional law, as well as the relationship between this responsibility and the quality of democracy that is fostered. The research method used is normative legal research with legislative, conceptual, and documentary study approaches. The analysis is conducted qualitatively to explore the understanding of the implementation of the constitutional responsibility of political parties and its impact on the quality of democracy. The findings indicate that, although clear legal provisions exist regarding the role of political parties, their implementation still faces significant challenges, such as the practice of money politics and the pragmatic tendencies of parties. Therefore, stricter supervision is necessary to ensure that political parties fulfill their constitutional responsibilities effectively, thereby improving the quality of democracy in Indonesia. This study is expected to contribute to the development of constitutional law theory and practice, as well as strengthen the role of political parties in reinforcing Indonesia's democratic system.

Abstract

Bali is widely recognized as a world-class tourism destination that relies on its rich natural resources, cultural heritage, and living customary values embedded within its communities. Behind the rapid development of the tourism sector lies serious pressure on the sustainability of customary land, which has long served as the foundation of the cultural and spiritual identity of Bali's traditional village communities. The conversion of customary land into tourism areas has created tensions between economic interests and the sacred values embedded in communal land rights systems. This study aims to analyze the extent to which spatial planning law in Bali provides protection for customary land and to examine the potential for harmonization between spatial planning regulations and prevailing customary legal norms. This research employs a normative legal method, using both statutory and conceptual approaches. The findings indicate that although customary land is normatively recognized in regional regulations and spatial planning policies, its implementation remains limited due to minimal involvement of traditional villages, the dominance of positivist legal paradigms, and a sectoral orientation prioritizing economic interests. Traditional villages and awig-awig as sources of local law have not been fully integrated into the spatial planning process. There is a need for legal policies that embrace the principles of legal pluralism and spatial justice by fostering stronger participatory mechanisms for indigenous communities in shaping development directions and managing their living spaces.

Abstract

This study aims to examine the existence and implementation mechanisms of local wisdom in environmental management within the Tenganan Pegringsingan Traditional Village, Karangasem Regency, Bali, as a form of customary law application contributing to the development of sustainable environmental law. This research is motivated by the increasing challenges to environmental preservation caused by rapid development and tourism, which potentially displace the traditional values of indigenous communities. The study employs a qualitative method using a descriptive approach through stages of observation, in-depth interviews with customary leaders and community members, as well as documentation of awig-awig (customary regulations) and local socio-cultural practices. The findings reveal that Tenganan Village possesses a robust customary legal system, as reflected in awig-awig that strictly regulate the use of natural resources, including prohibitions against cutting trees in sacred forests, restrictions on land ownership, and collective systems for water and forest management. The local wisdom rooted in the Tri Hita Karana philosophy fosters a harmonious and sustainable relationship between humans and nature.
