Abstract

Various laws and regulations that were created as a substitute for the previous rules, have not guaranteed success in eradicating corruption in Indonesia. The existence of several laws that regulate the authority and obligations of each law enforcement officer such as the Police, Prosecutors, Judges and the KPK so that it creates a blurring of their authority or there is an overlap of authority granted by the state creates a wrong perception, for example, the police as investigators feel they are authorized to carry out criminal investigations. corruption in addition to prosecutors and the KPK. The purpose of this study is to analyze the regulation of the authority of police investigators in conducting investigations into cases of criminal acts of corruption and what obstacles are faced by police investigators in conducting investigations into criminal acts of corruption. This research is a normative legal research type with a conceptual approach and a statutory approach. The legal sources used are secondary legal materials. The method of collecting legal material sources used in this study is the categorization of legal material sources. The legal materials that have been collected, then during the discussion will be processed and analyzed with legal interpretations and legal arguments, deductively then poured descriptively. The results of the study indicate that there is no cooperation in the form of legislation between police investigators and other law enforcement parties such as the Prosecutor's Office and the KPK, it is necessary to immediately establish a law that regulates clearly and in detail about the authority, cooperation and coordination in conducting criminal investigations. corruption, this needs to be done in order to be more effective and can be realized.

Abstract

This research discusses about the authority of the Indonesian National Police regarding law enforcement in modifying motorized vehicles that are roadworthy on road. The problem of this research is how is law enforcement enforced against perpetrators who modify motorized vehicles? and what are the criminal sanctions against motorists who modify vehicles that are not roadworthy? The purpose of this research is to find out the authority of the police in enforcing the law and criminal sanctions related to modifying motor vehicles that are unfit for the road. In this research used a normative legal research method, namely by reviewing or analyzing several legal materials from several literatures and statutory regulations that are related. It is hoped that the research carried out by researchers will provide theoretical and practical benefits. Theoretical usefulness means that the results of this research are useful for developing knowledge and the practical usefulness of this research means that it has good benefits for the government, related institutions or society at large. The results of this research are that the police enforcing traffic laws, especially modifying vehicles that do not pass the roadworthy test, are in line with government regulations and the role of the Indonesian National Police in carrying out their duties and obligations to curb traffic violations is in accordance with legislation in Law Number 22 of 2009 on Road Traffic and Transportation. Criminal sanctions in traffic have been regulated in Law Number 22 of 2009 on Road Traffic and Transportation.

Abstract

This article aims to analyze a criminal case, especially one that focuses on murder and robbery, as well as discussing the relevant law applied to the case. This research is normative legal research, which specifically includes examination and analysis of library materials, court decisions, or secondary data. The methods used include legal, factual, conceptual and interpretive approaches. This research focuses on the problems that occurred, first, how to prove the elements of the crime of murder and theft in case Number 81/Pid.B/2023/Pn.Dps? and the second problem is what are the legal implications applied to case Number 81/Pid.B/2023/Pn.Dps? After analysis, it has been proven legally and convincingly by the defendant that they committed murder as stated in Article 339 of the Criminal Code Jo. Article 55 section (1) which concerns criminal acts prior to murder. The legal consequence of this case is that defendant NSP was sentenced to 18 years in prison and R was sentenced to 20 years in prison. R received a longer prison sentence than NSP due to his previous criminal record of repeated theft

Abstract

Children are the nation's next generation and play an important role in nation development. In life, children cannot be separated from perfection in terms of physical or mental life. These physical or mental deficiencies can become material for bullying by other children which can disrupt the child's survival and peace. In enforcing criminal law to stop bullying by children, the government issued Law Number 23 of 2002 concerning Child Protection, and amendments were made to Law Number 35 of 2014 concerning Child Protection to accommodate the increasing number of child crimes. The research method used is normative research which focuses on a legislative approach and a conceptual approach. After collecting the results of this research, it is then developed through an interpretive approach. The conclusion that can be drawn from this research is that bullying is any action or behavior carried out with the aim of causing injury. This harm can be physical, psychological, emotional, or verbal. Bullying behavior combines several criminal acts in the Criminal Code and for children using the Juvenile Criminal Justice System Act. The second conclusion is that children who are accused of bullying are threatened with criminal sanctions. According to the Juvenile Criminal Justice System Law, cases of bullying committed by teenagers can be brought to court and the judicial process will be carried out according to the law for children.

Abstract

The digital era has rapidly transformed various sectors, including the banking sector. The use of the internet in banking transactions has made transactions easier, faster, and more efficient. However, the efficiency of these transactions comes with risks. The implementation of banking activities in Indonesia is accompanied by the precautionary principle, as the government is obligated to provide direction and guidance on economic growth and create a healthy business climate. Mobile banking has experienced a significant increase in Indonesia, with banks like Bank BRI, Bank BNI, Bank Mandiri, and Bank BCA experiencing significant increases in users. However, the rise in mobile banking users is also accompanied by threats related to data leakage. The banking sector has experienced rampant cyber attacks in 2024, indicating that customer data security is vulnerable to hacking and misuse. This study aims to discuss the nature of legal protection for personal data of banking customers from a human rights perspective and the model of legal protection for banking customer data in Indonesia.

Abstract

Law Number 40 of 2007 Concerning Limited Liability Companies, which coincides with the lack of regulation of the legal force of a subholding, which is a holding company in which another holding company owns the dominant stake. The goal is to discover and investigate the regulation about restructuring of the formation of subholdings of PT PLN (Persero), as well as to discover and investigate the impact of restructuring of subholdings of PT PLN (Persero) on their human resources. The normative legal research approach was applied in this study. The findings of this study revealed that the implementation of holding-subholding by PT PLN (Persero) is legally valid because a corporate action carried out in the context of company restructuring and in response to the request of the Minister of BUMN as the government representative as the GMS. The restructuring of Subholding PT PLN (Persero) has no substantial influence on human resources, and theres no legal certainty with the argumentum per analogium technique owing to the lack of Subholding rules in law. A distinct and specific legislative product is required for future company development to govern Holdingization. The government, as a regulator, must be committed to monitoring the execution of industrial relations

Abstract

The use of natural resources for the implementation of development is closely related to the environment and spatial planning. These two things have so far tended to be unplanned and unsustainable, the result of which is a decline in the quality and function of the environment, including the natural resources within it. Environmental problems are increasing day by day, this indicates that environmental policy has not been successful. The community service activity was carried out on Friday 26 July 2024 at the Subak Sibang Kaja Abiansemal Hall. The problem formulation in this report is firstly, What is the form of community synergy to realize sustainable development in environmental management? and secondly, what are the inhibiting factors in realizing sustainable development? The aim of this report is to find out the synergy of society in realizing sustainable development in environmental management and what factors are obstacles in realizing sustainable development. Abstract

Cybercrime, especially hacking, is a major challenge in the digital era, especially when perpetrators operate across countries. This study analyzes the effectiveness of Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE) in combating international hacking crimes and evaluating international cooperation in cyber law enforcement. Using a normative legal approach, this study shows that although the ITE Law provides a strong legal basis, its application to perpetrators abroad faces jurisdictional challenges, differences in legal systems, and limitations in international cooperation. Technical obstacles in identifying and prosecuting perpetrators are also significant. To overcome this problem, it is necessary to strengthen international cooperation through extradition agreements and mutual legal assistance (MLA), as well as participation in international conventions such as the Budapest Convention. Increasing the technical capacity of law enforcement officers is also important to strengthen law enforcement against transnational hacking crimes. This study concludes that legal arrangements in Indonesia need to be improved through regulatory reform and more effective international cooperation so that Indonesia can protect national interests in the increasingly complex digital era.

Abstract

Various rules and regulations enacted to replace prior legislation have not ensured success in combating corruption in Indonesia. The existence of several laws governing the authority and obligations of each law enforcement officer, such as the police, prosecutors, judges, and the Corruption Eradication Committee (KPK), has resulted in ambiguity in their authority or over-lapping authority granted by the state, creating a false perception. For example, the police as investigators believe they are authorized to investigate corruption cases in addition to prosecutors and the KPK. This research focuses on two issues. The first is what is the role of the police in in-vestigating corruption cases? And the second question is what procedures do the police carry out in investigating corruption crimes?  The findings show that there has been no cooperation in the form of laws and regulations between police investigators and other law enforcement agencies such as the Prosecutor's Office and the KPK, so it is urgent that a law be enacted that clearly and in detail regulates the authority, cooperation, and coordination in investigating corruption, so that it becomes more effective and can be implemented.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan kewenangan antara Badan Pengawas Pemilu (Bawaslu) dan aparat penegak hukum dalam menindak tindak pidana pemilu, serta implikasinya terhadap kepastian hukum. Metode yang digunakan adalah penelitian normatif dan deskriptif analitis dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa terdapat ketidakjelasan dalam pembagian kewenangan antara Bawaslu dan aparat penegak hukum, yang mengakibatkan terjadinya tumpang tindih fungsi dan tanggung jawab. Hal ini berpotensi mengurangi efektivitas penegakan hukum dan menurunkan kepercayaan masyarakat terhadap proses pemilu. Penelitian ini merekomendasikan perlunya pengaturan regulasi yang lebih jelas mengenai kewenangan masing-masing lembaga, peningkatan mekanisme koordinasi, serta penerapan prinsip transparansi dan akuntabilitas. Dengan demikian, diharapkan pengaturan kewenangan yang efektif akan meningkatkan integritas pemilu dan memperkuat demokrasi di Indonesia. Penelitian ini memberikan kontribusi signifikan bagi pengembangan sistem pemilu yang lebih adil dan akuntabel, serta menawarkan solusi untuk tantangan yang dihadapi dalam penegakan hukum pemilu  Kata kunci: Bawaslu, Pemilu, Tindak Pidana Abstract This study aims to analyze the arrangement of authority between the Election Supervisory Body (Bawaslu) and law enforcement officers in prosecuting election crimes, as well as its implications for legal certainty. The method used is normative and descriptive analytical research with a qualitative approach. The results of the study indicate that there is a lack of clarity in the division of authority between Bawaslu and law enforcement officers, which results in overlapping functions and responsibilities. This has the potential to reduce the effectiveness of law enforcement and reduce public trust in the election process. This study recommends the need for clearer regulations regarding the authority of each institution, improved coordination mechanisms, and the application of transparency and accountability principles. Thus, it is hoped that effective regulation of authority will improve election integrity and strengthen democracy in Indonesia.
