Abstract

Sampah plastik merupakan masalah yang sangat sulit diatasi oleh karena itu Pemerintah Kota Denpasar telah mengatur tentang Pengurangaan Penggunaan Kantong Plastik. Namun dalam pelaksanaanya masih banyak fenomena sosial yang perlu mendapatkan perhatian yang khusus dari masyarakat yaitu sampah plastik lebih tepatnya kantong plastik karena setiap masyrakat masih banyak menggunakan kantong plastik dalam kesehariannya. “Penulisan article ini bertujuan untuk mengetahui implementasi hukum terhadap Peraturan Walikota Nomor 36 Tahun 2018 pada pelaku usaha di pasar tradisional serta upaya hukum yang dapat ditempuh pemerintah untuk memaksimalkan penerapan Peraturan Walikota Denpasar Nomor 36 Tahun 2018.” Penulisan jurnal ini menggunakan metode penelitian hukum empiris ini menunjukkan bahwa Peraturan Walikota Denpasar Nomor 36 Tahun 2018 masih kurang diterapkan di pasar tradisional oleh karena itu pemerintah diharapkan lebih tegas lagi mengatur tentang pengurangan sampah plastik ini. Abstract

Elections are one of the mechanisms for the transition of power that was born at the same time as democracy. in Indonesia there are three institutions involved in holding general elections (elections), namely KPU, Bawaslu, and DKPP, DKPP officially becomes a state institution in the realm of upholding the ethics of holding elections. The presence of this DKPP is a solution to problems regarding integrity and credibility of election organizers, as well DKPP can be said that this institution is an institution that performs mixed functions (mix-function), namely administrative, regulatory, and punitive functions. DKPP in the decision as referred to in Article 458 paragraph (10) is final and binding. So from the above the presence of the DKPP is very important, and the presence of the DKPP is a solution to problems regarding the integrity and credibility of election organizers, because elections with integrity are still a serious problem, especially in Indonesia. The purpose of this research is to find out and show a paradigm as well as new hopes for the legal system and constitutional law in the future, especially in electoral law. The research method that the author uses is descriptive qualitative, that is, writes down by deciphering the extent to which the development of the findings that the author is doing for that there is data that the author will collect, such as primary and secondary data. The results of this study indicate that one of the DKPP's powers lies in the decisions made by the DKPP namely "final and binding", as stipulated in Article 458 paragraph (13) of Law Number 7 of 2017 the decision produced by the DKPP shows a paradigm as well as a new hope for the legal and constitutional system in the future, and when viewed from the perspective of efforts to realize justice electoral justice) the presence of DKPP is one of the embryos of an independent state institution (state auxiliary agency) that can create integrity and credibility in election organizers which is actually still a serious problem in holding elections in Indonesia

Abstract

preamble of the 1945 Constitution is a very important declaration in the formation of the Indonesian state. This preamble is not only the opening of all articles in the 1945 Constitution, but also reflects the ideals and goals of the Indonesian nation. It contains the basic principles that form the basis of the state, such as independence, unity and social justice. The link between Article 1(2) and (3) of the 1945 Constitution lies in the strengthening of the principle of democracy within the framework of the rule of law. In this case, popular sovereignty (paragraph 2) is not only articulated in the form of elections or political decision-making alone, but must also be implemented within a fair and binding legal framework as stated in (paragraph 3), and political parties play a very important role as infrastructure in a democratic system. As institutions that unite people's aspirations, political parties have a major function in facilitating citizens' political participation. Political parties act as a bridge between the people and the government, by absorbing, organizing, and conveying the interests of the community into public policy.

Abstract

The administration of regional property via usage programs constitutes a source of regional financial Revenue. The administration of regional property is governed by Government Regulation Number 1 of 2014 about the Management of State/Regional Property, subsequently supplemented by Regulation of the Minister of Home Affairs Number 19 of 2016 on the Management of Regional Property. Nonetheless, the regulation of the regional property (Barang Milik Daerah/BMD) sector encounters numerous challenges, particularly regarding the coordination required between the Minister of Home Affairs and the Minister of Finance in developing general and technical policies on regional property, which remains suboptimal. Consequently, the Minister of Home Affairs Regulation Number 19/2016 remains inadequate as a regional reference for formulating Regional Regulations/Regulations of Regional Heads, leading many to directly consult the Minister of Finance, which governs State Property. According to the description above, the subsequent challenges are articulated: Issues in regulating the regional property sector at both central and regional levels. Format for the Reorganization of the Central Regulation of the Regional Public Property Sector. Normative (legal) research methodologies, including statutory, conceptual, and case approaches, are employed to analyze the problem formulation. Findings from this research: Regulatory issues arise from a lack of alignment among ministries in coordinating efforts. The Minister of Home Affairs reports to the Coordinating Minister for Political, Legal, and Security Affairs, whereas the Coordinating Minister for the Economy oversees the Minister of Finance. The organization of rules involves distinguishing between Government rules for state property and regional property, necessitating cross-sectoral harmonization throughout their formulation. This must be accomplished due to the control of regional property under many laws, necessitating harmonization in formulating technical regulations at the governmental level, along with heightened care. Recent legislation must be modified to align overarching policies and their technical execution.

Abstract

The regulation of term limits for state institutions is an essential component in building a democratic national political system. In Indonesia, such term limits have been implemented for the President, Vice President, and Justices of the Constitutional Court, but not for members of the House of Representatives (Dewan Perwakilan Rakyat, DPR). The absence of term limit regulations for DPR members is evident in the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945), Law No. 7 of 2017 on General Elections, and Law No. 2 of 2011 on Political Parties. This study aims to examine the urgency of imposing term limits on DPR members as a means to strengthen democratic principles and create a more equitable constitutional system. The research employs a normative legal method, focusing on legal principles, norms, rules, court decisions, agreements, and legal doctrines. The findings indicate that setting term limits for DPR members is crucial to prevent the concentration of power by individuals or groups, uphold equality and fairness in state life, and foster the regeneration of ideas and policy innovation within the legislative body. Through such limitations, it is expected that a legal system more responsive to societal dynamics will emerge, thereby enhancing citizen participation in democratic governance. Consequently, regulating the periodic tenure of DPR members constitutes a strategic step toward establishing a law-abiding society and a healthier constitutional order.

Abstract

This study aims to examine the existence and implementation mechanisms of local wisdom in environmental management within the Tenganan Pegringsingan Traditional Village, Karangasem Regency, Bali, as a form of customary law application contributing to the development of sustainable environmental law. This research is motivated by the increasing challenges to environmental preservation caused by rapid development and tourism, which potentially displace the traditional values of indigenous communities. The study employs a qualitative method using a descriptive approach through stages of observation, in-depth interviews with customary leaders and community members, as well as documentation of awig-awig (customary regulations) and local socio-cultural practices. The findings reveal that Tenganan Village possesses a robust customary legal system, as reflected in awig-awig that strictly regulate the use of natural resources, including prohibitions against cutting trees in sacred forests, restrictions on land ownership, and collective systems for water and forest management. The local wisdom rooted in the Tri Hita Karana philosophy fosters a harmonious and sustainable relationship between humans and nature.

Abstract

Indonesia's creative industry, particularly in the music sector, faces significant challenges in optimizing copyright protection for musicians. This study examines the implementation of Law No. 28 of 2014, focusing on the role of Collective Management Organizations in ensuring fair royalty collection in Denpasar. The research employs a juridical-empirical approach, utilizing field observations and interviews with relevant stakeholders, including musicians, business owners, and legal experts. The findings reveal that many musicians in Denpasar struggle to protect their rights due to a lack of understanding of Collective Management Organizations and royalty collection procedures. Business operators, such as coffee shop owners, often fail to meet their legal obligations regarding royalty payments. The study concludes that enhancing the presence and effectiveness of Collective Management Organizations, along with increased outreach and education, is essential for improving copyright protection for musicians and ensuring compliance with the law.

Abstract

Penelitian ini membahas perlindungan hak privasi korban dalam kasus penyebaran video CCTV bermuatan pornografi di Indonesia, yang menjadi salah satu bentuk pelanggaran hak asasi manusia di era digital. Teknologi pengawasan yang awalnya dirancang untuk meningkatkan keamanan publik kini justru menghadirkan tantangan baru terhadap batas-batas privasi individu. Penelitian ini menggunakan pendekatan hukum normatif dengan analisis konseptual terhadap tanggung jawab negara, pelaku, dan lembaga penegak hukum dalam menjamin hak korban. Hasil penelitian menunjukkan bahwa mekanisme perlindungan yang ada masih bersifat sektoral, reaktif, dan belum menempatkan korban sebagai pusat perhatian. Hambatan utama terletak pada lemahnya koordinasi, ketidakpastian hukum, serta rendahnya literasi privasi di masyarakat. Untuk mencapai keadilan yang substantif, dibutuhkan sistem perlindungan yang berorientasi pada korban dengan memperkuat aspek pencegahan, penegakan hukum yang proporsional, serta pemulihan psikologis dan sosial bagi korban. Kajian ini menegaskan pentingnya reformasi hukum yang sensitif terhadap perkembangan teknologi dan berlandaskan nilai kemanusiaan agar hak atas privasi dapat terlindungi secara efektif di tengah masyarakat digital.
