Abstract

The digital era has rapidly transformed various sectors, including the banking sector. The use of the internet in banking transactions has made transactions easier, faster, and more efficient. However, the efficiency of these transactions comes with risks. The implementation of banking activities in Indonesia is accompanied by the precautionary principle, as the government is obligated to provide direction and guidance on economic growth and create a healthy business climate. Mobile banking has experienced a significant increase in Indonesia, with banks like Bank BRI, Bank BNI, Bank Mandiri, and Bank BCA experiencing significant increases in users. However, the rise in mobile banking users is also accompanied by threats related to data leakage. The banking sector has experienced rampant cyber attacks in 2024, indicating that customer data security is vulnerable to hacking and misuse. This study aims to discuss the nature of legal protection for personal data of banking customers from a human rights perspective and the model of legal protection for banking customer data in Indonesia.

Abstract

The use of natural resources for the implementation of development is closely related to the environment and spatial planning. These two things have so far tended to be unplanned and unsustainable, the result of which is a decline in the quality and function of the environment, including the natural resources within it. Environmental problems are increasing day by day, this indicates that environmental policy has not been successful. The community service activity was carried out on Friday 26 July 2024 at the Subak Sibang Kaja Abiansemal Hall. The problem formulation in this report is firstly, What is the form of community synergy to realize sustainable development in environmental management? and secondly, what are the inhibiting factors in realizing sustainable development? The aim of this report is to find out the synergy of society in realizing sustainable development in environmental management and what factors are obstacles in realizing sustainable development. This implementation method uses socialization where implementation is carried out through lectures given by resource persons with the aim of making the community understand the importance of management. environment .  The results of the first community service activities are in the form of synergy which occurs in the form of cooperation between the community and the government in environmental management such as establishing a waste bank and the first inhibiting factors in sustainable development, lack of public awareness, the absence of legal regulations that provide appropriate sanctions. firm and finally the existence of climate change in an area Keywords: environment; improvement; sustainable developmen.

Abstract

Well-known trademark infringement is a serious problem that threatens intellectual property rights in the era of globalization. Well-known brands, which have wide recognition in the market, are often the target of infringement by irresponsible parties, which can harm brand owners and consumers. Regulation of Brand Regulation in Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Article 21 regulates trademark registration. Several examples of well-known trademark infringement such as the Supermen case between DC Comic and PT Maxing Makmur experienced trademark problems due to duplication in trademark ownership without considering the existence of Article 21 of the MIG Law. Indonesia adopts a trademark registration system with a constitutive system. The occurrence of a trademark violation makes an article entitled "trademark rights violation (case study of the "superman" trademark DC Comics against PT Marxing Fam Makmur)". The problem in this journal is whether the use of the "Superman" brand by PT Marxing Fam Makmur for its wafer products constitutes a violation of the trademark rights owned by DC Comics? What are the legal consequences of the decision Number 29 / Pdt.Sus / Merek / 2019 / PN Niaga Jkt.Pst on the case of PT Marxing Makmur against DC Comics? The purpose of this study is to examine and analyze the brand problems from the case study. This research method is a normative legal research method. The legal research was conducted with a statutory approach, a case approach which was carried out by reviewing cases related to the issues at hand. The results of the study indicate that PT Marxing Fam Makmur violated the superman brand that has been owned by DC Comics since 1934. So that the cancellation of the superman brand in the name of PT Marxing Fam Makmur was granted.

Abstract

Artikel ini membahas tantangan yang dihadapi sistem irigasi tradisional Subak di Bali dalam menghadapi modernisasi pertanian dan dampak perubahan iklim. Subak, yang mencerminkan kearifan lokal dan telah bertahan selama berabad-abad, kini harus menyeimbangkan antara integrasi teknologi modern dan pelestarian nilai-nilai tradisional. Rumusan masalah pertama berfokus pada bagaimana Subak dapat mengadopsi teknologi pertanian modern tanpa mengorbankan keberlanjutan lingkungan dan nilai-nilai lokal. Solusi yang diusulkan meliputi pemilihan teknologi ramah lingkungan, pendidikan petani, dan kolaborasi dengan pemangku kepentingan. Rumusan masalah kedua mengkaji upaya peningkatan kapasitas adaptasi Subak terhadap perubahan iklim, seperti penyesuaian pola tanam, diversifikasi pertanian, dan penguatan kelembagaan. Hasil kegiatan pengabdian kepada masyarakat menunjukkan Subak dapat tetap relevan dan berkelanjutan jika diupayakan integrasi teknologi yang bijaksana dan peningkatan kapasitas adaptasi terhadap perubahan iklim. Saran yang diberikan mencakup pengembangan kebijakan pendukung, pendidikan berkelanjutan, dan pengembangan infrastruktur yang tahan bencana. Dengan demikian, Subak diharapkan mampu terus menjadi sistem pertanian yang kuat dan berkelanjutan di Bali, sekaligus menjaga warisan budaya yang kaya akan kearifan lokal.

Abstract

Increasing the number of accidents every year in Indonesia has forced the government to make efforts to reduce the number of accidents that result in the loss of someone's life. The government, by using the Safety Riding method in driving on the highway, hopes to reduce the number of accidents that occur in the community by paying attention to completeness and safety in traffic on the highway. As for the problems that arise, how is Safety Riding implemented in rescue efforts in society? The aim of community service is through socialization carried out by the community, especially the younger generation, to be able to have awareness of driving on the highway by remembering the importance of safety for themselves and others as well as feeling safe and comfortable when driving. The use of Safety Riding cannot be separated from the role of the Government, Companies and the community in forming synergy in efforts to save traffic. The implementation of Safety Riding is present in society to prevent the number of accidents so that UULLAJ is implemented as a suggestion for legal protection in society.

Abstract

This study examines the adaptation of customary law in the digital era and the legal protection of indigenous digital rights. Despite constitutional recognition in Article 18B(2) of the 1945 Constitution, the absence of specific regulations on communal digital data ownership exposes indigenous communities to risks of exploitation and marginalization. Using a normative legal method with statutory, conceptual, and comparative approaches, this study analyzes national and international legal frameworks, including UNDRIP (2007) and ILO Convention No. 169, while comparing regulatory models from Canada, New Zealand, and Australia. Findings indicate that while digitalization facilitates the preservation of customary law, it also enables unauthorized data use and limits indigenous participation in digital policymaking. Solutions such as blockchain-based documentation and community-driven licensing offer potential legal safeguards. This study concludes that legal reforms are needed to ensure explicit recognition of communal digital rights, integration of indigenous dispute resolution in digital law, and stronger indigenous participation in digital policymaking, reinforcing legal pluralism in the digital era.

Abstract

Penelitian ini bertujuan untuk menganalisis pelanggaran hak ekonomi dalam hak cipta lagu pada acara konser musik dengan berlandaskan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UUHC). Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum primer yang digunakan meliputi UUHC, PP Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Lagu dan Musik, serta Permenkumham Nomor 9 Tahun 2022. Bahan hukum sekunder diperoleh dari literatur akademik, jurnal, dan kasus aktual seperti sengketa antara Ahmad Dhani dan Once Mekel yang menjadi sorotan dalam industri musik nasional. Hasil penelitian menunjukkan bahwa secara normatif aturan hukum mengenai perlindungan hak ekonomi pencipta sudah cukup jelas dan komprehensif. Namun, terdapat kesenjangan signifikan antara aturan hukum dan praktik di lapangan. Penyelenggara konser masih banyak yang tidak memenuhi kewajiban pembayaran royalti, LMKN menghadapi keterbatasan dalam pengelolaan serta transparansi, dan penegakan hukum terhadap pelanggaran masih jarang dilakukan. Kondisi ini menyebabkan hak ekonomi pencipta sering diabaikan, yang pada akhirnya mengurangi motivasi berkarya dan melemahkan industri musik nasional. Penelitian ini menyimpulkan perlunya perbaikan implementasi melalui integrasi pembayaran royalti dalam perizinan konser, peningkatan kapasitas kelembagaan LMKN, penggunaan kontrak yang tegas, serta penegakan hukum yang konsisten.

Abstract

Democracy is a fundamental principle within the Indonesian state system as reflected in the 1945 Constitution (UUD 1945), where political parties play a key role as a pillar in bridging the people and the government. The constitutional responsibility of political parties within the Indonesian constitutional system encompasses not only compliance with the law but also moral and ethical aspects in realizing a clean, transparent, and accountable government. This study aims to examine the regulation of the constitutional responsibility of political parties from the perspective of Indonesian constitutional law, as well as the relationship between this responsibility and the quality of democracy that is fostered. The research method used is normative legal research with legislative, conceptual, and documentary study approaches. The analysis is conducted qualitatively to explore the understanding of the implementation of the constitutional responsibility of political parties and its impact on the quality of democracy. The findings indicate that, although clear legal provisions exist regarding the role of political parties, their implementation still faces significant challenges, such as the practice of money politics and the pragmatic tendencies of parties. Therefore, stricter supervision is necessary to ensure that political parties fulfill their constitutional responsibilities effectively, thereby improving the quality of democracy in Indonesia. This study is expected to contribute to the development of constitutional law theory and practice, as well as strengthen the role of political parties in reinforcing Indonesia's democratic system.

Abstract

Desa Taro di Kabupaten Gianyar tahun 2018 mendapat penghargaan berupa Kalpataru oleh Pemerintah Indonesia yang merupkan salah satu bentuk penghargaan yang diberikan pemerintahan akan usaha penyelamatan akan lingkungan. Hal ini merupakan salah satu stimulus yang bagus dalam pengembangan Objek Wisata dan Desa Wisata dalam menarik kunjungan wisatawan untuk datang ke desa taro yang melihat bahwa adanya inisiasi penyelematan lingkungan sehingga menampakan wajah desa yang bersih dan lingkungan yang lesatri sebagai daya pikat yang terjadi. Permsalahan yang terjadi bagaimana peran masayarakat menjaga lingkungan agar tetap lestari? Pengharaang kalpataru merupakan salah satu bentuk yang diberikan dalam penyelematan lingkungan baik individu maupun kelompok dalam menjaga lingkungan agar tetap ajeg lestari di tengah banyaknya permasalahn lingkungan yang terjadi dalam di dalam masyarakat seperti pembuangan sampah tidak pada tempatnya, penumpukan sampah, pencemaran lingkungan dan penebangan liaran. Adanya sosialisasi ini diharapkann dapat menumbuhkan kesadaran pada masyarkat pentingnya menjaga lingkungan. Perlunya integrasi antara masyarakat dan pemerintah dalam bekerjasama dalam menjaga lingkungan agar tetap asri dimana lingkungan bersih mampu membuat masyarakat terhindar dari penyakit dan menarik pengunjung bagi pelaku wisata.
