Abstract

The government has issued the Job Creation Law. In the Job Creation Law, micro and small businesses can establish a legal entity company. This company is called a sole proprietorship. The establishment of a sole proprietorship is still difficult to distinguish from establishing a limited liability company based on the Law of the Republic of Indonesia Number 40 of 2007. One thing that becomes the attention of stakeholders is the responsibility of sole proprietorships with limited liability. Stakeholders include creditors of financial institutions. This research uses a normative judicial method. This research object is aims to discuss the disadvantage of sole proprietorships compared to limited liability companies to creditors of financial institutions. The research result is find the differences between a sole proprietorship and a limited liability company. This research concludes that a sole proprietorship with limited liability is the same as that of a limited liability company to creditors of financial institutions. Shareholders are not responsible for ties to individual companies. The board of directors is not personally accountable for respective companies' obligations. A particular company is responsible for relations made on its behalf as a legal entity. Any responsibility includes a credit agreement between the company and a financial institution.

Abstract

This study aims to discuss the impact of employer-forced layoffs on employees. Industrial interactions between employees and employers are sometimes a source of contention. In a country's economy, the financial industry plays a critical role. Both parties need each other, yet their tactics are very different. The government is the only party with authority to settle labor-management disputes. Employer-initiated layoffs (PHK) harm the economy, particularly in the country's financial sector and socio-political life. Unemployment will rise as a result of layoffs, causing national instability. Unemployment can lead to riots and other social problems. This discussion is based on the Manpower Law's normative. This research employs a normative legal approach. Forced layoffs or revisions to worker resignations, according to this study, violate the Manpower Act. The rights of workers who wish to resign and workers laid off differ significantly. Instead of layoffs, companies might save money on severance pay by having employees retire. The company's responsibility to give compensation in severance pay and other workers' rights will be eliminated if employees depart. Dispute resolution forums can help workers and employers work out their differences.

Abstract

Pandemi Covid-19 telah melanda Indonesia sejak 1 Maret 2020. Perekonomian Indonesia mengalami penurunan signifikan. Kebijakan pemerintah khususnya pembatasan sosail berskala besar (PSBB) telah menghentikan beberapa kegiatan ekonomi, kecuali 11 kegiatan atau industri yang diperbolehkan. Selain itu, kurs rupiah juga melemah terhadap mata uang dollar Amerika Serikat hingga mencapai Rp. 16.644,- pada tanggal 3 April 2020. Dan indeks harga saham gabungan mencapai di bawah 4000 pada tanggal 23 Maret 2020. Dengan adanya penurunan indikator ekonomi ini, maka peranan Bank Indonesia sangat dharapkan terutama dalam hal menjaga kurs rupiah terhadap mata uang asing. Karena pelemahan nilai rupiah akan memiliki implikasi yang lebih luas terhadap perekonomian Indonesia. Bank Indonesia bisa melakukan peranan dalam hal kebijakan moneter seperti kebijakan nilai tukar dan kewenangan dalam pengelolaan devisa. Peranan bank sentral akan mengalami perubahan yang signifikan dengan adanya pengembangan teknologi keuangan yang baru dan semakin berkembang sejalan dengan kejadian pandemi covid-19 ini.

Abstract

ABSTRACT The agreement contains a contract that ensures equity and justice for both parties, and no party should be harmed. A contract is a written agreement that governs a business activity. This training is presented to students in order to learn more about a business contract agreement. Webinars will be used to deliver the training. Webinars are online training seminars that use video. The implementation technique includes training or seminars as well as questions and answers about the topic of discussion. Following a webinar, students understand the relevance of contractual agreements. A business student will learn more than just the theory of contract law. The sharing of experience and expertise from business professionals will increase the general public's and business students' knowledge of contract law. Participants in this webinar learned about the importance of a business agreement after attending this event. ABSTRAK Perjanjian merupakan kontrak yang menjamin pemerataan dan keadilan bagi kedua belah pihak, dan tidak boleh ada pihak yang dirugikan. Kontrak adalah perjanjian tertulis yang mengatur kegiatan bisnis. Pelatihan ini diberikan kepada mahasiswa untuk lebih mengenal perjanjian kontrak bisnis. Webinar akan digunakan untuk menyampaikan pelatihan. Webinar adalah seminar pelatihan online yang menggunakan video. Teknik pelaksanaannya meliputi pelatihan atau seminar serta tanya jawab seputar topik pembahasan. Mengikuti webinar, siswa memahami relevansi perjanjian kontrak. Mahasiswa bisnis akan belajar lebih dari sekedar teori hukum kontrak. Berbagi pengalaman dan keahlian dari para profesional bisnis akan meningkatkan pengetahuan masyarakat umum dan mahasiswa bisnis tentang hukum kontrak. Peserta webinar ini mengetahui mengenai pentingnya sebuah perjanjian bisnis setelah mengikuti acara ini.

Abstract

The goal of government intervention is to protect society's interests. The government acts in accordance with prevailing laws and regulations. The goal of economics is to earn as much money as possible. As a result of government intervention, corporate players' incomes will be reduced. The research aim is to examine the impact of government intervention in the form of laws and regulations on economic principle. This study employs a normative legal approach. The result shows that the profit maximization principle, which claims that business actors should maximize profits, does not apply to commodities or important societal requirements. Conditions influence the community's basic requirements. Masks and Covid-19 medications are essential items for the community during the Covid-19 pandemic. The government's intervention must be based on prevailing law and regulations. When it comes to market circumstances, government involvement isn't always effective.

Abstract

This study aims to determine the accountability of financial institutions to employees who have been negligent in providing services to customers and examines the triangular relationship between financial institutions, employees, and customers. This normative juridical research is combined with empirical data. The results indicate that if the negligence of an employee is per the standard operating procedures (SOP) set by the authorities in the financial institution, the financial institution must be responsible for the loss of the customer. This responsibility is based on Articles 1365, 1366, and 1367 of the Civil Code. If the employee's negligence is not according to the SOP, then the employee must be personally responsible. A single legal event may result in different ways of settling in the relationship of these three parties.

Abstract

The economy of a country cannot be separated from the financing in the economic ecosystem of the nation. On the opposite, overly excessive funding will cause the economy of a country to become overheated. An overheated economy can harm the country's overall system. This research analyzes the variables that determine the distribution of financing by the financial services industry to private sectors. This research studies five variables as independent variables and private credit disbursement as the dependent variable. The independent variables are inflation interest rate, exchange rate, gross domestic product, and gross domestic product per capita. This research investigates the 31-year historical data collected from 11 countries in Asia. This study uses a balanced panel data model and E-views to process the data. The data is obtained from the World Bank website. This research concludes that inflation, gross domestic product, and exchange rate to United State Dollar have a significant influence on the distribution of private credit. Moreover, the gross domestic product per capita and interest rate does not influence the private credit distribution.

Abstract

Illegal financial institutions have repeatedly appeared and disappeared in the community. Illegal banks or savings institutions disguise their businesses as travel agents or public fund savings institutions called arisan. At the moment, there have been emerging illegal online loan institutions (Pinjol). In 2021, illegal online loans (Pinjol) become a trending topic in Indonesia. Illegal lending has become a long-standing issue in society. The authorities have carried out the eradication of illegal lending. However, illegal borrowing is never completely eradicated and is always present in the community. Illegal borrowing has also caused a lot of community problems. This research aims to examine the illegal borrowing in the midst of society. This research uses a normative juridical method. This research concludes that eradicating illegal lending is the responsibility of the police, not the responsibility of the Indonesian Financial Services Authority (OJK). Even though illegal lenders operate in the financial industry, the Indonesian Financial Services Authority has no authority over the illegal financial industry. The authority of the Indonesian Financial Services Authority has been confirmed in Law of the Republic of Indonesia Number 21 of 2011. The illegal financial industry does not only exist in the financial technology industry, but has also emerged repeatedly in the conventional financial industry, such as illegal banks, fraudulent investments, and credit unions.

Abstract

Economic expansion has been accompanied by a tremendous increase in personal wealth in recent decades. As people’s wealth increases, so do their investment demands. The number of illegal investment cases is likewise rising quickly. Along with technological advancements, gambling has become more prevalent in addition to incidences of unlawful investment. Ponzi scheme-based online gaming is expanding quickly throughout society. The purpose of this study is to compare unlawful investment to gambling from a legal and economic standpoint. The normative juridical method is employed in this study. This study employs a secondary legal method and utilizes associated rules as secondary legal materials. The study’s findings suggest that unlawful investing and gambling have some similarities. Gambling and illegal ventures both provide high profits. Owners of funds run the risk of losing money through unlawful investments and gambling. Along with gaming, the legislature needs to control unlawful investment—enforcement of the law against illicit gamblers.

Abstract

This study seeks to discuss the most effective ways to resolve conflicts in the North Natuna Sea. China has repeatedly violated the North Natuna waters. The Indonesian government has carried out security in the North Natuna waters. This dispute resolution has not found the best way for Indonesia or China. Indonesia claims North Natuna waters governed by the Law of the Sea Convention of the United Nations (UNCLOS 1982) while China claims North Natuna waters unilaterally based on the nine-dash line. The Natuna dispute has become a national issue in Indonesia. A normative legal methodology is employed in this study. The research discussion does not only focus on disputes but also on the relationship with the environment. This study concludes that the sea is a very important source of biological life. Every country has an interest in marine waters. Biological resources in the sea are always moving and sometimes their rights and authority are transferred to other countries. Biological marine resources have an ecosystem of living life. The Indonesian government must take a prudent stance on the dispute over the North Natuna waters with the Chinese government. North Natuna waters have strategic value for many countries, not only Indonesia.
