Abstract

This paper focuses on the sovereignty of the state and its influence on the implementation of ASEAN cooperation mechanisms in combating terrorism.State sovereignty tends to obstruct the counter-terrorism effort. The difficulty of gaining consensus has temporarily encouraged member countries to enable bilateral or trilateral framework options, which are less productive of regional insight development efforts. The consensus mechanism causes in any degree the handling of terrorism issues in ASEAN will only be possible if the parties agree. This is what then makes the implementation of the agreement in ASEAN to be slow and even not run.

Abstract

This paper focuses on the origin and development of women’s rights and the principle of gender equality in the perspective of legal philosophy.Women's rights as part of Human Rights were born and developed from thoughts about the importance of protecting and fulfilling the rights of women who belong to vulnerable groups and also to ensure gender equality.Although it has been accommodated in various national and international legal instruments, de facto fulfillment of women's rights must still be ensured by each country.Fulfillment of women's rights in the perspective of legal philosophy seeks to obtain justice as the highest goal of the law itself and ensure the realization of the principle of equality before the law.

Abstract

This paper focuses on ASEAN’s efforts as a regional organization to protect the rights of migrant workers in the Covid-19 pandemic situation. The protection of the rights of migrant workers is part of the protection of human rights regulated in various international legal instruments as well as within the ASEAN framework, especially in the ASEAN Consensus on the Promotion and Protection of the Rights of Migrant Workers (ACPPRMW). Although responding quickly to the impact of the Covid-19 pandemic on the economic and health sectors, ASEAN’s response and efforts in protecting the rights of migrant workers during the Covid-19 pandemic were late and ineffective. This is also an illustration of the ineffective implementation of the system and mechanism for the protection of migrant workers in ASEAN as well as the implementation of other ASEAN human rights legal instruments, due to the main principle that is firmly held by ASEAN, namely the non-interference principle.
