Abstract

This study aims to determine whether Indonesia’s nickel ore export restriction policy is in accordance with the principles of international economic law. It is because Indonesia’s actions in implementing quantitative restrictions on the export of nickel ore are deemed to have violated one of the principles in the General Agreement on Tariffs and Trade, namely the principle of prohibiting quantitative restrictions. This principle is contained in Article XI: 1 GATT. Data was collected through library research techniques. Namely by collecting and analyzing writings and literatures that are closely related to the problems that are being researched by the author, and analyzing data with descriptive analytical techniques, so that Indonesia can analyze their export restriction policies with juridical provisions in international trade law. The results shows that Indonesia’s action is in accordance with Article XI: 2 (a), which regulates the exception to Article XI: 1, with certain conditions which is a dispensation from the principle of quantitative restriction. Indonesia’s nickel ore export restrictions were also implemented to protect the environment in order to prevent scarcity and to encourage the battery industry in Indonesia to improve the economy. So that Indonesian policy is valid and can be justified by international law.

Abstract

ABSTRACTCourt verdict analyzed in this article concerns on the case of crime of corruption. The focus is about the interpretation of the judge over the case through the trial process. The conclusion of the examination in general is that, it is of necessity to expound and interpret a rule the judges complying with before applying it to any particular case. They also have to consider all the aspects of the case. In the case this article discussed, the judges are not able to make a distinction between a conduct of corruption and a business transaction. It appears that the judges were perceived to be incapable of making the right interpretation to apply in the case. And the judges mistakes in interpreting resulted in futile decisions which could not reflect a substantive justice.Keywords: state loss, corruption, illicit enrichment.ABSTRAKPutusan hakim yang dianalisa dalam artikel ini terkait dalam kasus korupsi. Fokus dalam kajian ini terkait dengan penafsiran hakim selama proses persidangan ini berlangsung yang dapat disimpulkan bahwa secara umum dengan mengurai dan menafsirkan peraturan dimana muncul kasus yang spesifik dalam tindak pidana korupsi. Oleh sebab itu, hakim dalam memutuskan perkara perlu dipertimbangkan kasus tersebut dari berbagai aspek terlebih dahulu. Dalam kasusini, pengambil keputusan tidak dapat membedakan antara perilaku korupsi dan transaksi bisnis karena kurang mampu membuat penafsiran yang digunakan dalam membedah perkara ini. Selain itu, hakim juga melakukan kesalahan dalam menafsirkan yang pada akhirnya melahirkan putusan yang tidak merefleksikan keadilan substantif.Kata kunci: kerugian negara, korupsi, memperkaya diri.

Abstract

Data pribadi menjadi hak privasi seseorang yang wajib dilindungi dari berbagai aspek kehidupan. Konsep perlindungan data mengisyaratkan bahwa individu memiliki hak untuk menentukan apakah mereka akan membagi atau bertukar data pribadi mereka atau tidak. Hakikat pemenuhan dan perlindungan hak asasi manusia ialah menjaga eksistensi martabat manusia melalui keseimbangan, termasuk keseimbangan antara kepentingan individu dan kepentingan umum. UU Perlindungan Data Pribadi merupakan upaya negara untuk memenuhi hak privasi warganya. Desa Mekarsari Kabupaten Kubu Raya, sebagai Desa Konstitusi, menjadi tempat implementasi sosialisasi peningkatan pemahaman perlindungan data pribadi sebagai bagian dari HAM yang dijamin dan diatur oleh Kontitusi (UUD 1945). Metode kegiatan yang akan dipergunakan dalam kegiatan ini adalah penyampaian materi sosialisasi serta dialog interaktif dalam bentuk penyuluhan hukum.Berdasarkan hasil evaluasi yang dilakukan, kegiatan sosialisasi tentang perlindungan data pribadi sebagai bagian dari HAM yang khususnya di Desa Mekarsari, Kabupaten Kubu Raya, yang telah diakui sebagai Desa Konstitusi telah berhasil meningkatkan pemahaman masyarakat mengenai pentingnya perlindungan data pribadi sebagai bagian dari HAM.

Abstract

Under ordinary circumstances, someone who enters other countries shall be provided with travel documents and required visa as entry permit. On the other hand, if they enter to the territory of another country because of feeling well-founded fear, such as their safety are threatened; and the country of their origin occurs social unrest or war. Therefore, the person may not have complete travel documents and visas. Movement of people who want to enjoy the protection of another country because they feel unsafe in their own country can be filed a request for refugee status. International refugee problem (Refugee) has existed since 1921, the prior international community responded to such events to the preparation of the 1951 Convention and the 1967 Protocol on the Status of Refugee. Nowadays, many countries have ratified them. In both these legal instruments, these contained provisions on international protection standards to international refugees for the states parties. For the countries that are not a party to the Convention and the Protocol, such as the Indonesian state, is not bound to the provisions of these legal instruments. Indonesia as well as other countries that have not ratified, then they have only a moral obligation or humanitarian responsibility. Based on the principle of humanity in the entire country, although they have not yet ratified, there is no a reason to refuse in protecting the refugees.

Abstract

The aims of this research is the influence of free trade within the framework of the World Trade Organization-General Agreement on Tariffs and Trade on the environment and natural resources. Nowadays, there are almost no tariff barriers in trade. The research methods used a normative research or library research using qualitative research methods, which does not use statistical measuring instruments. The research results show that the development of globalized trade is due to free trade regulated according to the principles of the General Agreement on Tariff and Trade (GATT)-World Trade Organization (WTO), which encourages free trade aspects with a focus on eliminating barriers to trade, while environmental policy is not as a priority. However, environmental policies are formulated to guarantee the sustainability of trade itself. Typically, environmental pollution stems from the production processes involved in manufacturing goods, the transportation of goods utilizing public infrastructure, and the disposal of waste arising from product packaging or substances that are challenging to decompose naturally. Despite the issuance of environmental policies, these issues often persist without effective resolution.There are only a few countries that have good environmental regulations that can make environmental policies can be effective, which are developed countries that already have Eco-friendly technologies used for environmental control. The efforts that have been made by countries to create a balance between the profits obtained from trade itself and environmental conservation and natural resources are focused on environmental policy at the national level. Countries create environmental standards that are adapted to environmental standards and have been agreed at the international level. Furthermore, various approaches are being implemented to achieve higher environmental standards, through international organizations and multilateral agreements related to preserving the environment and natural resources.

Abstract

In the dynamic landscape of the retail industry, Artificial Intelligence (AI) has become an important catalyst for transformation. The study in this research used a literature review. The research findings show that AI contributes to the personalization of the customer experience, with machine learning algorithms offering personalized product recommendations, increasing engagement, and stimulating sales. In terms of inventory and supply chain management, AI helps optimize stock through accurate forecasting, reduce wastage, and adapt procurement to changing market demands. Automated cashier operations and the use of chatbots effectively reduce waiting times and improve customer service quality. Analysis of the rapid development of consumer behavior through AI allows for more responsive and aspiring marketing strategies.

Abstract

Health is regarded as a basic human need Health is a fundamental right recognized in various international human rights instruments, such as the Universal Declaration of Human Rights and the International Covenant on Economic, Social and Cultural Rights. The World Health Organization (WHO) has declared COVID-19 a global public health pandemic on January 30, 2020. Based on the data collected, there are still members of the community who have not received the Covid-19 Booster vaccine even though it is urgently given as an antiviral. Therefore, as part of an effort to increase the coverage of vaccination, it is necessary to implement a Covid-19 public dedication as the fulfilment of the right to health. The method of community-based participatory research (Community Based Participatory Research, CBPR) is implemented. The results of the vaccination activities carried out at Tanjungpura University Faculty of Law can contribute to the vaccine coverage that exists in the community. As for the number of participants of the activity was 172 (one hundred seventy-two) people consisting of 117 (a hundred seventeen) students and 61 (sixty-one) the general public. In addition, there are students and members of the community who have not received the Covid-19 Booster Vaccine while the delivery is very urgent as an anti-virus, even there are those who have never received the vaccine at all.

Abstract

Kenakalan remaja di Pontianak, yang mencakup pelanggaran aturan sekolah, kejahatan, penyalahgunaan narkoba, dan pergaulan bebas, mencerminkan fenomena sosial dan psikologis kompleks. Penyebabnya meliputi faktor internal seperti perubahan emosional dan sosial, serta faktor eksternal seperti pengaruh lingkungan dan tekanan teman sebaya. Pontianak, dengan ketimpangan sosial dan ekonomi, turut memengaruhi perilaku remaja. Penelitian menunjukkan pentingnya pemahaman psikologis dan sosial dalam mengatasi masalah ini. Pengabdian Kepada Masyarakat (PKM) di SMA 3 Pontianak bertujuan meningkatkan kesadaran tentang kenakalan remaja melalui pendekatan holistik, melibatkan siswa, guru, dan masyarakat. Kegiatan ini mencakup penyuluhan, workshop, dan peningkatan koordinasi antar stakeholder untuk menciptakan lingkungan sekolah yang aman dan mendukung perkembangan positif. Evaluasi dilakukan melalui wawancara dan antusiasme peserta, dengan harapan program ini dapat memberikan dampak jangka panjang dalam mencegah perilaku negatif dan meningkatkan kualitas pendidikan di Pontianak.

Abstract

Abstrak Penelitian ini berfokus pada analisis mengenai peran Direktorat Intelejen dan Keamanan Kepolisian Daerah Kalimantan Barat dalam melakukan deteksi gangguan keamanan dan ketertiban dalam Pemilihan Umum tahun 2024 beserta faktor yang mempengaruhi. Sebagai sebuah penelitian hukum yang bersifat normatif, sumber data dalam penelitian ini adalah data primer dan data sekunder yang dianalisis secara deskriptif dan kualitatif. Dari hasil penelitian ditemukan bahwa Direktorat Intelejen dan Keamanan Kepolisian Daerah Kalimantan Barat dalam melakukan deteksi gangguan keamanan dan ketertiban dalam Pemilihan Umum tahun 2024 telah dilakukan sesuai dengan aturan, prosedur dan mekanisme serta juga sesuai dengan tujuan dan fungsi yang diembannya. Adapun faktor yang mempengaruhi peran Direktorat Intelejen dan Keamanan Kepolisian Daerah Kalimantan Barat tersebut bersifat secara internal maupun secara eksternal. Kata Kunci: Intelejen keamanan; Kepolisian; Pemilihan umum
