Abstract

This study aims to investigate the application of the Contextual Teaching and Learning (CTL) learning model in improving the learning outcomes of Hajj and Umrah materials in class VI students of SD IT Sairussalam. The research method used is qualitative research with a case study approach. The research participants involved 30 grade VI students who were studying hajj and umrah material. Research data was collected through class observations, interviews with teachers, and documentation of student learning outcomes. Data analysis was carried out through the process of data reduction, data presentation, and drawing conclusions. The results of the study show that the application of the CTL model effectively improves the learning outcomes of Hajj and Umrah materials in class VI students. In applying the CTL model, the teacher uses a contextual approach that pays attention to the real-life context of students in presenting hajj and umroh material. Teachers also integrate various relevant learning resources and involve students in interactive and collaborative learning activities. In addition, the teacher provides regular feedback to students to help them improve their understanding and skills in hajj and umrah material.

Abstract

This study aims to: 1) Know the concept of fostering the character of tolerance for students of SMP N 1 Sultan Daulat, Subulussalam City. 2) Knowing the implementation of tolerance character building for students of SMP N 1 Sultan Daulat, Subulussalam City. 3) Find out the follow-up of tolerance development for students of SMP N 1 Sultan Daulat, Subulussalam City. In this study, researchers used a qualitative research approach. Data collection techniques used are: Observation, Interview, Study documentation, Focus groups, Participation. The results of this study are: The results of this conclusion are: 1) The concept of fostering the character of tolerance which is applied in SMP Negeri 1 Sultan Daulat, includes: Values Education, Interreligious and Intercultural Dialogue, Project-Based Learning joint problem groups, Simulations and Games Roles between students, Community Service Program, Development of Social Awareness, Collaborative Learning by Encouraging students to work together among students in groups, Excellence-Based Learning. 2) The application of tolerance character development for SMP N 1 Sultan Daulat students is not an obstacle in the application of the values of religious education. Teachers have a high awareness to respect students' religious differences and try to understand their needs in learning. Teachers also strive to create an inclusive and welcoming environment for all students, regardless of their religion or background. 3) Follow-up to fostering the character of tolerance for students of Sultan Daulat 1 Public Middle School can be carried out through several steps and activities, including: Implementation of Tolerance Values in the Curriculum, Formation of Tolerance Committees, Teacher Training Providing training and coaching to teachers, Extracurricular Activities and Projects Tolerance, Conducting outreach and campaigns in the school environment, Leadership Development, Conducting periodic evaluations of the results and impacts of tolerance character building carried out.

Abstract

This research discusses the importance of the application of religious rights protection for children based on the perspective of Islamic Law and legislation in Indonesia. Religious rights are human rights that must be guaranteed and protected, especially for children as a vulnerable group. This study examines the norms of Islamic Law that emphasize the need to protect children's religious rights from an early age. The study also analyzes the relevance between Islamic teachings and national legal provisions related to the protection of children's religious rights. This understanding is directed at efforts to prevent potential violations of religious rights that may occur in the context of everyday life. In addition, this study evaluates the effectiveness of existing legal and regulatory mechanisms in Indonesia in providing guarantees and protection of children's religious rights.The research method used includes analysis of legal literature, normative studies, The results of this study are expected to contribute to an in-depth understanding of the implementation of religious rights protection for children in the context of Islamic law and legislation in Indonesia. The implications of the findings of this research can provide a basis for the development of more effective policies in ensuring children's religious rights in the future.

Abstract

In the banking world there is a tendency for standard contracts, in the form of contracts that have previously been determined and determined unilaterally in terms of the content and form of the contract with the intention of being addressed to the public with the same clauses, are continuous and are usually printed and detailed and cannot be negotiated. Likewise, what applies to Bank Aceh Syariah, the contents of the contract are deliberately left blank to give the customer the opportunity to negotiate and are filled in after an agreement is reached. This kind of contract limits the customer and does not provide a balanced position for either party, who basically has the same opportunity to determine what is desired in the contract. The application of the principles of al-hurriyah, fairness and balance between parties in contracts has been limited in banking. For this reason, this writing aims to find out how the process of making a murâbahah contract/agreement is, the position of the customer and the Aceh Syariah bank in formulating the murâbahah contract and the application of the principle of freedom of contract in the process of making the murâbahah contract according to a review of Islamic law at PT. Bank Aceh Syariah Sub-Branch of UIN Ar-Raniry Banda Aceh. This research is categorized as qualitative research based on data collection methods through Library Research and field research. Based on the studies that have been carried out, the results show that the process of making a murabahah contract/agreement at PT. Bank Aceh Syariah does not fully involve the customer, the customer only has the opportunity to read the contract which has been fully prepared by the bank, so that the position of the customer and the bank is not equal. The bank is in a stronger position and can unilaterally determine the contents of the contractual clauses agreed upon, while the customer is in a weak position and must accept all the contents of the clauses that have been determined by the bank. A position like this shows that the principles of freedom, justice and balance in contracts cannot be fully applied in the process of making murabahah contracts/agreements at PT. Bank Aceh Syariah Capem. UIN Ar-Raniry Banda Aceh.

Abstract

Dalam dunia perbankan terdapat kecenderungan standard contract, berupa kontrak yang sebelumnya telah ditentukan dan ditetapkan isi dan bentuk kontrak secara sepihak dengan maksud ditujukan kepada umum dengan klausul yang sama, bersifat terus menerus dan biasanya tercetak serta datail dan tidak dapat dilakukan tawar menawar. Demikian juga yang berlaku pada Bank Aceh Syariah, isi kontrak sengaja dikosongkan untuk memberi kesempatan negosiasi kepada pihak nasabah dan diisi setelah diperoleh kesepakatan. Kontrak semacam ini telah membatasi pihak nasabah dan tidak memberikan keseimbangan posisi bagi salah satu pihak, yang pada dasarnya memiliki kesempatan yang sama untuk menentukan apa yang diinginkan dalam kontrak. Penerapan prinsip al-hurriyah, keadilan, dan keseimbangan para pihak dalam berkontrak telah dibatasi dalam perbankan. Untuk itu penulisan ini bertuiuan agar dapat mengetahui bagaimana proses pembuatan kontrak/perjanjian murâbahah, kedudukan nasabah dan pihak bank Aceh Syariah dalam perumusan akad murâbahah serta penerapan asas kebebasan berkontrak dalam proses pembuatan akad murâbahah menurut tinjauan hukum Islam pada PT. Bank Aceh Syariah Cabang Pembantu UIN Ar-Raniry Banda Aceh. Penelitian ini dikatagorikan sebagai penelitian kualitatif berdasarkan metode pengumpulan data melalui Library Research dan field research. Berdasarkan kajian yang telah dilakukan diperoleh hasil bahwa, proses pembuatan kontrak/perjanjian murâbahah pada PT. Bank Aceh Syariah tidak sepenuhnya melibatkan pihak nasabah, nasabah hanya berkesempatan untuk membaca kontrak yang sepenuhnya telah disiapkan oleh pihak bank, sehingga kedudukan nasabah dan pihak bank tidak seimbang. Pihak bank berada pada posisi yang lebih kuat dan dapat menentukan secara sepihak isi dari klausula kontrak yang diperjanjiakan, sedangkan nasabah berada pada posisi yang lemah sehingga harus menerima seluruh isi klausula yang telah ditetapkan oleh pihak bank. Kedudukan yang seperti ini menunjukkan bahwa prinsip kebebasan, keadilan dan keseimbangan dalam berkontrak tidak sepenuhnya dapat diterapkan dalam proses pembuatan kontrak/perjanjian murâbahah pada PT. Abstract

This study discusses the legal certainty of electronic criminal trials, particularly the presentation of witness testimony virtually during the COVID-19 pandemic. Guidelines for electronic criminal trials are needed to ensure uniform implementation and to uphold fair trial rights. As a province with the authority of the Syar'iyah Court, Aceh should be able to anticipate the spread of COVID-19 by implementing electronic trials. The research focuses on the regulations related to electronic trials, specifically the presentation of witness testimonies virtually as evidence in criminal cases, and the practices implemented at the Banda Aceh Sharia Court. This research uses a descriptive-analytical method with a qualitative approach. The sources of data for the research are field research and library research. The research results show that the form of legal certainty regarding electronic criminal trials or jinayat during the COVID-19 pandemic is the agreement on cooperation between the Supreme Court, the Prosecutor's Office, and the Ministry of Law and Human Rights on the Implementation of Trials Through Teleconference, which was then established by Supreme Court Regulation Number 4 of 2020 concerning the Administration and Trial of Criminal Cases in Court Electronically. In practice, the Banda Aceh Sharia Court determined that the presentation of witness testimony during the COVID-19 pandemic must be conducted in the courtroom. However, it is still carried out virtually to connect with the defendant in the detention center or prison where he is held.

Abstract

Witchcraft or black magic is still believed to be an act that can cause harm to a person through occult science. The losses caused by witchcraft can be seen directly and clearly in witchcraft victims, but it is difficult to explain medically and scientifically. Although it cannot be proven based on criminal law, the impact of witchcraft can be known based on indications that are widespread in the victim, such as foreign objects found in the victim, causing physical and non-physical suffering for a long time, even causing the victim to die. The focus of this research is on how to resolve witchcraft cases through customary law in the Simeulue community. The method used is qualitative, with data obtained from interviews and supported by literature sources. The results of the study showed that the phenomenon of witchcraft in Langi Village, Teupah Village, and Suka Jaya Village in Simeulue Regency had a motive of displeasure between the perpetrator and the victim. Santet is not always used for evil, but can also be used for good, such as medicine, predicting the whereabouts of a person or lost item (tendung). In general, the people of Simeulue do not accept the presence of witchcraft (for evil) in their lives, but specific individuals still abuse witchcraft as a power to harm people. The abuse of witchcraft that causes others to suffer is not in line with the principles of Islamic criminal law. Witchcraft can be held accountable if proven to have committed a crime that causes harm to others, both physically, psychologically, or socially.
