Abstract

Penelitian ini bertujuan untuk menganalisis penerapan perlindungan hukum di Indonesia terhadap korban kejahatan siber berdasarkan regulasi nasional dan prinsip-prinsip hukum internasional, serta mengidentifikasi kendala yang dihadapi sistem hukum nasional dalam memberikan perlindungan hukum sesuai standar internasional. Metode penelitian yang digunakan adalah penelitian doktrinal dengan pendekatan historis dan perbandingan terhadap instrumen hukum nasional seperti Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik, Undang-Undang Nomor 27 Tahun 2022 Tentang Perlindungan Data Pribadi, dan Konvensi Budapest 2001. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap korban kejahatan siber di Indonesia belum optimal karena lemahnya mekanisme pemulihan korban, belum lengkapnya aturan turunan, serta terbatasnya kerja sama internasional akibat belum diratifikasinya Konvensi Budapest. Oleh karena itu, diperlukan harmonisasi regulasi nasional dengan prinsip-prinsip hukum internasional untuk memperkuat sistem perlindungan korban kejahatan siber di Indonesia.

Abstract

Transfer of Sentenced Persons (TSP) merupakan mekanisme kerja sama hukum internasional yang memungkinkan narapidana menjalani sisa masa pidananya di negara asal. Namun, Indonesia hingga saat ini belum memiliki regulasi khusus yang mengatur prosedur, syarat, dan kewenangan pelaksanaan Transfer of Sentenced Persons (TSP) secara komprehensif. Kekosongan hukum tersebut tampak pada kasus pemindahan Mary Jane, warga negara Filipina yang dijatuhi pidana di Indonesia, tetapi kemudian diakui sebagai korban tindak pidana perdagangan orang. Pemindahannya dilakukan melalui kesepakatan administratif bilateral (practical arrangement), tidak didasarkan pada pengaturan hukum nasional yang komprehensif. Penelitian ini bertujuan menganalisis implikasi kekosongan hukum Transfer of Sentenced Persons (TSP) terhadap kepastian hukum, pemenuhan hak narapidana, dan posisi diplomatik Indonesia dalam kerja sama hukum internasional. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan perbandingan (comparative approach), melalui kajian terhadap undang-undang, instrumen hukum internasional, doktrin, serta praktik Transfer of Sentenced Persons (TSP) di negara lain seperti Australia, Malaysia, dan Thailand. Hasil penelitian menunjukkan bahwa ketiadaan regulasi Transfer of Sentenced Persons (TSP) menyebabkan pemindahan narapidana di Indonesia bersifat ad hoc dan bergantung pada diskresi politik serta hubungan bilateral. Kondisi ini berimplikasi pada lemahnya kepastian hukum, potensi ketidaksetaraan perlakuan antar narapidana, serta terbatasnya posisi tawar Indonesia dalam diplomasi hukum internasional. Oleh karena itu, diperlukan pembentukan undang-undang tentang Pemindahan Narapidana Antarnegara sebagai upaya untuk menjamin kepastian hukum, perlindungan hak narapidana, dan penguatan peran Indonesia dalam sistem pemasyarakatan global.

Abstract

This article examines the reformulation of the application of the best interests of the child principle in judicial decisions concerning cases of violence committed by children against other children. The study focuses on the judicial reasoning adopted by the Samarinda District Court in Decision No. 18/Pid.Sus-Anak/2023/PN Smr, Decision No. 26/Pid.Sus-Anak/2024/PN Smr, and Decision No. 15/Pid.Sus-Anak/2025/PN Smr. This research employs a doctrinal legal method using statutory, conceptual, case, and comparative approaches. Legal materials were analysed qualitatively through an examination of legislation, court decisions, international legal instruments, legal doctrines, and recent scholarly literature. The findings indicate that judicial reasoning has incorporated both juridical and non-juridical considerations concerning child offenders, particularly their age, family background, social environment, behaviour, and recommendations contained in the Community Research Report. However, the circumstances and recovery needs of child victims have not been addressed with equal consideration. This article proposes a reformulated judicial framework comprising an assessment of the circumstances of both children, identification of the impact on the victim, meaningful child participation, victim recovery, rehabilitative measures for child offenders, and a balancing assessment to ensure a more comprehensive application of the best interests of the child principle.

Abstract

This study examines the legal and social issues surrounding the restoration of the rights of child victims of the 2016 Oikumene Church bombing in Samarinda. It aims to analyze efforts to restore victims’ rights and evaluate the accountability of the regional government in protecting affected children. A socio-legal, non-doctrinal approach was employed using primary data collected through purposive interviews with the victim’s family, police officers, prosecutors, and representatives of the East Kalimantan Women and Children Protection Unit (UPTD PPA), complemented by a literature review. Data were analyzed descriptively and qualitatively. The findings reveal that both the central and regional governments have implemented victim recovery measures, but only partially. Court-awarded compensation was limited, overseas medical expenses were borne privately, and educational assistance was provided only once, while medical treatment in Samarinda was funded by the regional government. The East Kalimantan UPTD PPA has played an important role in assisting child victims. Although preventive and repressive legal protection mechanisms exist, preventive efforts through deradicalization remain inadequate. Stronger coordination, transparency, and systematic cooperation among government institutions and law enforcement agencies are essential to ensure comprehensive protection and restoration of child victims’ rights.

Abstract

The proliferation of the online gambling industry in Cambodia has increased the risk of trafficking in persons (TIP) among Indonesian citizens, particularly through fraudulent offers of high-paying employment. This study aimed to analyze the relationship between the online gambling industry and TIP involving Indonesian citizens in Cambodia and to examine the forms of legal protection provided to victims. This study employed a doctrinal legal research method using a statutory approach and a case approach. Primary, secondary, and tertiary legal materials were analyzed qualitatively. The results showed that the online gambling industry in Cambodia is closely associated with TIP practices because it facilitates the systematic exploitation of labor. Legal protection for Indonesian citizens who are victims of TIP has been provided through national and international legal instruments, consular protection by the Embassy of the Republic of Indonesia in Phnom Penh, and bilateral cooperation between Indonesia and Cambodia. However, its implementation continues to face various obstacles, including regulatory differences, the complexity of transnational criminal networks, jurisdictional limitations, and weak cross-border law enforcement. This study emphasizes the need for an integrated, comprehensive, and victim-oriented legal protection model reinforced through international cooperation. These findings highlight the importance of continuously strengthening prevention, law enforcement, victim protection, and victim recovery efforts by the government and relevant stakeholders.
