Abstract

Penelitian ini akan mengaji tentang bagaimana peluang dan tantangan dalam penerapan delik obstruction of justice. Keberadaan obstruction of justice juga terdapat dalam penegakan hukum tindak pidana korupsi. Metode penelitian yang digunakan adalah metode peneltiian normatif melalui pendekatan perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan kasus (case approach). Hasil penelitian menemukan bahwa d memunculkan kerancuan dalam penerapannya dikarenakan ketidakjelasan rumusan unsur pasal. Khususnya dalam frasa sengaja mencegah, merintangi, atau menggagalkan secara langsung atau tidak langsung sehingga problematik dalam penerapannya. Sebagai jalan keluar dari problematik penerapannya, maka delik Obstruction of Justice perlu direvisi sehingga dapat dirumuskan dengan jelas dan memenuhi kaidah asas legalitas dimana dalam pengaturan hukum pidana harus memenuhi ketentuas lex certa dan lex stricta.

Abstract

The threat of drug abuse in the Philippines has prompted President Rodrigo Duterte to intensify a campaign to combat it, through the War on Drugs, a program to neutralize drug abusers. However, the implementation of the policy is allegedly loaded with serious human rights violations in the form of extrajudicial killings committed against civil society. This research aims to analyze whether extrajudicial killings carried out in the War on Drugs Policy during the administration of President Duterte were qualified as gross human rights violations and the application of international court jurisdiction over the situation. The research method used in this research is doctrinal research. The results showed that extrajudicial killings in the Philippines met the elements of crimes against humanity so that they could qualify as gross violation of human rights. The International Community has rightly sought to enforce the law on this situation through the International Criminal Court with President Duterte as the individual who must be held responsible.

Abstract

This research is motivated by the fact that there are still many Correctional Institutions in several countries that experience overcapacity of residents caused by the orientation of the application of imprisonment. This normative research aims to find out the best form of handling related to the overcapacity of prisons in several countries and whether the best treatment in several countries can be applied in Indonesia to reduce the overcapacity of prisons in Indonesia. The research method used in this research is doctrinal law research. The results found from this study indicate that the increase in the overcapacity of prisons in several countries is due to the practice of imprisonment. Therefore, it is necessary to develop and increase the effectiveness of alternative criminals, and it is necessary to reform the criminal law legislation for certain types of crimes.

Abstract

ABSTRACT Today ,Advances in technology and transportation are not only have a positive impact for the development of a country, but also a negative impact on their lives. With progress on the one hand it can provide for someone who wants to break away lawsuits. With the transportation advancement he could go to a single country to another country, mainly to neighboring countries which were located near to their home countries, which purpose is to break away lawsuits. For example Malaysia-Indonesia geographic and cultural factors might criminals to escape. Based on the background that the perceived need for a treatment between Indonesia and Malaysia regarding the transfer of criminals who fled. The agreement set forth in the form of Extradition Treatment, an agreement regarding the transfer of a person who has committed a criminal act to another country which is have right for judgment. The agreement stipulated in law No.9 of 1974, and this agreement has prompted Indonesia to ratify and develop national legislation on extradition, namely Law No. 1 of 1979.

Abstract

This study aims to examine the application of dismissal as a criminal sanction against members of the Indonesian National Armed Forces (Tentara Nasional Indonesia), both through court rulings and administrative procedures. In addition, it analyzes judicial considerations in imposing dismissal sanctions in cases of sexual misconduct, particularly in relation to Article 50 of Law Number 48 of 2009 concerning Judicial Power and the imposition of additional punishment in the form of demotion, as reflected in the Military Court Decision of Balikpapan No. 33-K/PM.I-07/AD/VII/2023. This research employs a socio-legal approach to provide a comprehensive understanding of both legal norms and their practical implementation. The findings indicate that dismissal can serve as an alternative sanction, balanced by the imposition of additional punishment in the form of demotion, especially when the defendant has never received disciplinary sanctions in the military. However, the implementation of demotion faces challenges due to the absence of clear procedural regulations, resulting in legal uncertainty in its application. Keywords: Military Criminal Law; Dismissal; Additional Punishment.

Abstract

Bullying is an act that is not commendable and can affect the psychological health of its victims. Currently, bullying cases are often found in schools. School age is vulnerable to the impact of bullying so what should be done to minimize and prevent bullying in the school environment? And how is bullying regulated under Indonesian law? The purpose of this article is to provide education and socialization to school students about the dangers of bullying. The method used is Participatory Action Research (PAR) by conducting a survey of the problems faced by students of SMK Negeri 1 Anggana, Kutai Kartanegara Regency. Education and socialization are given to students so that they understand and understand the dangers of bullying and at the end of the activity a questionnaire is distributed to measure students' understanding of the dangers of bullying.ABSTRAKBullying merupakan suatu perbuatan yang tidak terpuji dan dapat mempengaruhi kesehatan psikis korbannya. Saat ini kasus bullying kerap dijumpai di sekolah. Usia sekolah rentan dengan dampak dari bullying sehingga apa yang harus dilakukan untuk meminimalisir dan mencegah terjadinya bullying di lingkungan sekolah? Serta bagaimana pengaturan tentang bullying berdasarkan hukum negara Indonesia? Tujuan dari artikel ini adalah memberikan edukasi dan sosialisasi kepada siswa sekolah tentang bahaya bullying, Metode yang digunakan adalah Participatory Action Research (PAR) dengan melakukan survey terhadap permasalahan yang dihadapi oleh siswa SMK Negeri 1 Anggana Kabupaten Kutai Kartanegara. Edukasi dan sosialisasi diberikan kepada siswa agar mereka memahami dan mengerti bahaya akan perbuatan bullying serta diakhir kegiatan dilakukan penyebaran kuisioner untuk mengukur pemahaman siswa terhadap bahaya bullying.

Abstract

This study examines the legal basis for Human Rights Protection of Private Military and Security Company (PMSC) employees. Despite frequent violations of their rights, no binding international law currently regulates this matter. The purpose is to identify the existing legal framework and potential measures to enhance protection. This research applies a normative juridical (doctrinal) method by analyzing international humanitarian law, human rights instruments, and comparative approaches. The findings reveal that the absence of binding law leads to legal uncertainty and vulnerability for PMSC employees, with several documented cases of human rights violations. The study concludes that strengthening international instruments and harmonizing national laws are crucial to ensure effective human rights protection for PMSC employees. Keywords: Human Rights; Humanitarian Law; Private Military and Security Company; Workers’ Rights

Abstract

Background: The surge in migration to Europe, particularly to Italy, has prompted bilateral cooperation with Albania through the Italy-Albania Protocol on Extraterritorial Migration and Asylum Management. This protocol aims to reduce Italy’s burden by transferring the asylum status determination process to facilities in Albania. Meanwhile, Indonesia faces challenges related to Rohingya refugees fleeing persecution in Myanmar, making it a transit country for those seeking protection. This study aims to analyze the legality of the Italy-Albania Protocol in the context of fulfilling the human rights of asylum seekers and explore the application of the concept of externalization of asylum control from the protocol in Indonesia to address the Rohingya issue. The method used is doctrinal research with a legislative and comparative approach, as well as an analysis of international legal instruments such as the Universal Declaration of Human Rights and the 1951 Refugee Convention. The results of the study indicate that the substance of the articles in the Italian-Albanian protocol does not explicitly violate human rights and is in line with international principles. The externalization of asylum control is recognized as a global strategy to reduce migration pressure. However, Indonesia faces limitations in facilities, human rights violations, and the lack of ratification of the 1951 Refugee Convention, while Presidential Regulation No. 125 of 2016 has not been optimal in guaranteeing the rights of asylum seekers. Therefore, international cooperation and ASEAN synergy are essential for responsibility-sharing, improving facilities, and public education to support humanitarian principles and compliance with international law.

Abstract

Child molestation is a serious problem that demands special attention from various parties. This study examines profiling techniques as an investigative method in identifying the patterns and characteristics of child molesters in Kota Bangun Sub-district. Whether profiling techniques have the potential to assist law enforcement officials in identifying perpetrators more quickly and accurately. However, limited data, lack of experts, and lack of inter-agency coordination are obstacles in its application. In addition, the victim's fear of reporting and the community's low understanding of child protection rights are also obstacles in preventing and handling cases of sexual abuse. the research uses a descriptive Socio Legal approach and uses a qualitative approach. The types of data used are primary data and secondary data. Data collection techniques in this research use interview techniques and document studies. The data analysis technique uses qualitative data analysis. Based on the results of the research that has been conducted, recommends increasing the capacity of the apparatus in applying profiling techniques, strengthening the crime database system, and educating the public to increase awareness and courage to report. In addition, psychological rehabilitation services for victims need to be optimized to minimize long-term impacts. With a multidisciplinary approach and better coordination, it is hoped that efforts to prevent and handle child abuse can be carried out more effectively.

Abstract

Since 2006 to 2017 the Security Council has passed a resolution on North Korea's nuclear test act. Article 25 of the UN Charter states that Members of the United Nations agree to accept and implement the decisions of the Security Council in accordance with this Charter. North Korea as a UN member state that obtained the UN Security Council Resolution is obliged to implement the sanctions resolution. However, the sanctions contained in the resolution did not make North Korea stop its nuclear program and it shows North Korea's noncompliance with UN Security Council resolutions. Implications accompanying any denial by North Korea against the UN Security Council resolution which in general affects four fields, namely the fields of economy, politics, defense and international cooperation. In addition to non-military sanctions, the Security Council under chapter VII Article 42 of the UN Charter can impose military sanctions where possible, the Security Council can also impose sanctions through the UN General Assembly on its recommendation to suspend the rights of UN membership) and expulsion of a country from UN membership).
