Abstract

Adanya kesamaan (equality) hak dalam berbagai aspek sosial, tanpadiskriminasi/membedakan jenis kelamin (gender) merupakan konsep yang ada didalam negara hukum. Di Indonesia, sebagai negara hukum memilikihakkonstitusional warga negara yang meliputi hak asasi manusia dan hak warga negarayang dijamin dalam Undang-Undang Dasar Negara Republik Indonesia Tahun1945 berlaku bagi setiap warga negara Indonesia. Penelitian ini mencoba menguraisejauhmana konsekuensi pelaksanaan aturan perundang-undangan di tingkatpemerintah daerah yang meminimalisir adanya diskriminasi terhadap perempuandan melibatkan perempuan di dalam berbagai sektor pembangunan. Terdapatbeberapa program di tingkat pemerintah daerah yang telah dilaksanakan, hanya sajadi dalam pelaksanaannya masih terdapat beberapa hambatan. Untuk mewujudkanpenghapusan diskriminasi terhadap perempuan, kerjasama antara berbagai dinas didalam pemerintahan daerah sangat diperlukan, begitu juga kerjasama antarapemerintah daerah bersama legislatif dan beberapa lembaga non pemerintah(NGO).Kata Kunci: Diskriminasi, Kebijakan, Perempuan

Abstract

AbstractArticle 9 paragraph (2) of UUPA gives equality for Indonesian men and women, one of them is related to ownership, utilization of HAT whether for men or women who is given the equality in family by the law.  However in fact the wife often finds difficulties in the ownership and utilization of the land rights, especially the property and its causing factor, such as the gender inequality of the social and cultural values , which commonly gives more priority to the men than the women (patriarchal ideology);  Most of the constitutional regulation still takes the part of one gender, in other words, it does not reflect the gender equality;  Moreover the interpretation of religious lessons that are less comprehensive, contextual and holistic, or inclined to be textual and partially understood also very influence the mindset that the ownership, utilization of HAT  for women is different from the men.Keywords: wives’ rights, HAT & Collective Property Abstrak Pasal 9 ayat (2) UUPA memberi kedudukan yang sama bagi laki-laki maupun perempuan warga negara Indonesia, salah satunya berkaitan dengan kepemilikan, pemanfaatan  HAT baik laki-laki maupun perempuan yang diberi kedudukan sama oleh hukum di dalam keluarga. Tetapi di dalam kenyataannya seringkali isteri kesulitan dalam kepemilikan dan pemanfaatan hak atas tanah khususnya harta bersama faktor penyebabnya, diantaranya kesenjangan gender dalam tata nilai sosial budaya masyarakat, umumnya lebih mengutamakan laki-laki daripada perempuan (ideologi patriarki). Kebanyakan peraturan perundang-undangan yang ada masih berpihak pada salah satu jenis kelamin dengan kata lain belum mencerminkan kesetaraan gender. Selain itu, penafsiran ajaran agama yang kurang komprehensif atau cenderung tekstual dan kurang kontekstual, cenderung dipahami parsial kurang holistic juga sangat berpengaruh terhadap pola pikir bahwa kepemilikan, pemanfaatan  HAT perempuan memang berbeda dengan laki-laki.Kata Kunci: Hak Istri, HAT & Harta Bersama

Abstract

This research’s aim is to study woman discrimination in Indonesian policy especially in Surakarta region. This study uses law sociology approach with both observation and interview as method to gather the data, while for the data analysis, it utilizes Miles & Huberman’s Interactive model that include data display, drawing conclution, and verifying. The result shows that Sukoharjo authority empowers woman through policy by establishing Dinas Pengendalian Penduduk, Keluarga Berencana dan Pemberdayaan Perempuan dan Perlindungan Anak. Eventhought this special taskforce is established, the authority still facing drawbacks and one of them is the lack of stakeholders’ participation which lead to its slow development.

Abstract

This study aimed to provide an overview of the sociology-economic conditions of the people in Debegan village of Mojosongo, Surakarta after receiving training on miniature craft and aircraft using styrofoam materials from the IAIN Surakarta Research and Service Institute (LP2M) team. The study was expected to provide access to create economic empowerment for village communities. As previously known, the city of Surakarta is a vocational city promoting the community uniqueness to be managed in the form of social, cultural and economic activities. The method used in this study is Participation Action Research (PAR). Participatory Action Research (PAR) is a research method carried out in a participatory manner among citizens in a lower level community whose spirit is to encourage transformative actions. The findings and results of the study showed that this activity received relatively good enthusiasm from the people of Debegan village, Mojosongo, Surakarta City. The level of attendance and frequency of the attended meeting was always more than 20 out of 30 participants. This shows that the 80% target audience attendance was reached successfully. This activity requires further follow up to the training that has been given, with the hope that the community will not only be skilled in making crafts from Styrofoam waste but also have marketing and network skills.

Abstract

This study aims to find out the views of NU and Muhammadiyah kiai in Bangkalan Madura related to Bitcoin law and zakat payment law with Bitcoin. This research was motivated because the pros and cons related to the use of Bitcoin and zakat payments using Bitcoin money until now are still a discussion of scholars until the kiai in Bangkalan Madura also differ in opinion regarding the Bitcoin law, where most of the kiai NU and Muhammadiyah Bangkalan related to Bitcoin law and zakat law with Bitcoin declare haram, because it contains elements of gharar (obscurity ), maysir (gambling), as well as the absence of official regulation from the government. Therefore, zakat with Bitcoin is not allowed. However, there are some scholars who state that the digital money law is halal because digital money like crypto is classified as a "virtual treasure" thus it applies mandatory zakat to Bitcoin money. In addition, there are also differences in regulations between the government and BAPPEBTI, where the government states in Law No. 7 of 2011 concerning currency that it does not accept payment instruments other than Rupiah, while in BAPPEBTI regulations provide protection for Bitcoin users so as not to feel losses. However, obeying government rules is mandatory.

Abstract

Religious moderation is very important because the tendency of excessive or excessive religious experiences often leaves one-sided claims of truth and considers themselves the most right while others are wrong. Based on the above background, the researcher is interested in studying the extent of understanding of religious moderation among Surakarta students and how efforts are made to increase awareness of religious moderation among students. This type of research is field research with a qualitative approach that aims to describe the data obtained in the field regarding students' understanding related to religious moderation. The data sources used in this study are primary and secondary. The data collection techniques used were interviews and documentation. Students' understanding of religious moderation varied greatly from the results of several interviews conducted with 30 students in the Islamic Criminal Law Study Program, 20 students explained that moderation is tolerance and mutual respect between religious people.  This is not wrong, because one of the indicators of religion is tolerance. Meanwhile, the other 10 students have understood that moderation is our perspective or attitude in religion in moderation, understanding and practicing religious teachings that are not extreme. Meanwhile, 30 students of the Law Study Program at the Batik University of Surakarta most of them do not understand what religious moderation is in terms of terminology, but once they are given an understanding and indicators related to religious moderation, they understand. Most of them have been taught in Pancasila and Civic Education courses. Religious moderation can be used as a learning approach so that students can think critically and analyze the courses they are taught, which of course remains based on the principles of religious moderation.

Abstract

The existence of customary law has been less a concern as a source in the law enforcement process for law enforcers. The Tolaki community in Southeast Sulawesi has a custom capable of resolving legal disputes called kalosara. This study aims to examine the customary role of the Kalosara in resolving land disputes to create justice and social order in society. This empirical legal study used the sociological theory of law and benefit in Islamic law. Data were collected by means of in-depth interview and literature review. The results of the study revealed that the Kalosara that has become a customary law or living law in society has played a role in resolving cases through mediation. The Kalosara customarily carried out through a mediation process has been able to mitigate internal cases of the indigenous people. Dispute resolution resolved in terms of land cases has also succeeded in creating social order in society. The philosophical principles in the Kalosara consist of ate pute penao moroha (chastity and justice), the values that are able to bind the parties to the disputes in a customary way to create justice. Theoretically, the social function of the customary law in society is to realize social harmonization so that disputes and conflicts can be avoided. In the context of the Islamic law, creating harmony and social order in society is one of the main goals.

Abstract

This article discusses the structure and culture of negotiating children's rights in sexual violence in Surakarta. This study employed a qualitative research method, collecting data through interviews and document analysis. The research writing was structured by data reduction, data presentation, and conclusions. Empirical and legal-philosophical approaches were applied to analyse the data, revealing significant weaknesses that require further attention. The lack of protection, justice, and recovery for child victims remains an issue, which hampers the functions of law enforcers, including the police, the prosecutor's office, and the judicial system. Justice in the system is procedural and formalistic in the context of the burden of proof, overlooking the best interests of the child and leaving child victims without justice and fair access to justice and restitution, while being burdened by procedural formalities. As studied, the majority of people in Surakarta are not fully aware of this matter. Stigmatisation lays the blame on the victims, while inadequate psychosocial support for child victims silences them. Without properly addressing these issues, many children experience discrimination and pressure that only hinders their recovery. This study concludes that to provide the necessary protection for child victims of violence and neglect, different sectoral responses need to be coordinated more effectively. Key recommendations include developing child-sensitive skills among law enforcement officials and other agencies, increasing public understanding of children's rights, simplifying regulations to eliminate duplication, and improving integrated, community-based victim services.
