Abstract

ABSTRAKMarwan, A.Risma, Kedudukan Fungsi Legislasi DPRD Dalam Pembentukan Peraturan Daerah Pasca Amandemen UUD  1945Penelitian ini bertujuan : Untuk menganalisis kedudukan serta mengetahui pelaksanaan fungsi legislasi DPRD dalam Pembentukan Peraturan daerah pasca amandemen UUD 1945.Penelitian ini menggunakan tipe penelitian hukum normatif, yaitu penelitian pada pengkajian peraturan perundang undangan terkait dengan kedudukan Fungsi Legislasi DPRD sebagai fungsi utama dalam pembentukan peraturan daerah.Hasil penelitian ini menunjukkan bahwa kedudukan Fungsi legislasi DPRD pasca amandemen UUD 1945 mengalami pergeseran, hal mana bahwa pembentukan peraturan daerah merupakan kewenangan DPRD, jadi seharusnya DPRD lebih produktif di banding dengan eksekutif, namun demikian fungsi tersebut belum maksimal dijalankan oleh DPRD, sehingga tampak dengan masih rendahnya prakarsa pembentukan  peraturan daerah atas usul DPRD Provinsi Gorontalo periode 2014-2019.Kata Kunci : Kedudukan, Fungsi DPRD, Amandemen UUD 1945                         ABSTRACT  Marwan, A. The Position of Legislation Function of the DPRD about the Regional Regulation Establishment of the Post amendment 1945 Constitution.This study aims; to analyze and to know the position of the implementation of the DPRD legislation function about the regional regulation establishment of the post amendment 1945 constitution. This study uses type of normative legal research. This type of research focuses on legislation study that relates to the position of the legislative function of the DPRD as the main function in establishing the regional regulation.            The result of the study shows that the position of legislative function of the DPRD post amendment 1945 Constitution has shifted. It can be seen that the establishment of regional regulation is the authority of the DPRD. Therefore, the DPRD should be more productive than the executive. However, that function has not been optimally run by the DPRD. As a consequence, the initiative of the regional regulation establishment at the suggestion of the DPRD of Gorontalo Province in the period 2014 – 2019 is still low.  Key words: the position, the function of DPRD, Post Amendment 1945 Constitution

Abstract

The future of the Indonesian nation is very dependent on the condition of today's children. Therefore, future attention to children is the main focus, especially for Correctional Students (ADP) who live in the Special Child Development Institution (LPKA). One of the things that is of concern to children who are behind bars is the right to obtain formal and informal education. The purpose of this study was to analyze and evaluate the implementation of the fulfillment of the right to education for correctional students and to design an ideal model of fulfilling the right to education for children in Class II LPKA Gorontalo. The type of research used in this research is empirical normative legal research. The research results show that the educational process for ADP at LPKA is carried out in accordance with the mandate of Law Number 22 of 2022 concerning Corrections where ADP can pursue formal or informal education. In the implementation of formal learning process activities, there are still obstacles in the form of learning processes carried out outside LPKA, so it is necessary to formulate a learning model that should be made like a child-friendly school within LPKA and supported by educators who are truly competent and experienced in educating children.

Abstract

The aim of this study is to know and to analyze the role of Nazhir in managing the waqf land according to it purpose in the district of Dungingi, Gorontalo City. The result of the study shows that the role of Nazhir in managing the waqf land in the district of Dungingi, Gorontalo City is not maximal yet. This can be seen from the existence of some waqf lands that don’t have a certificate of ownership. Additionally, it only becomes as a place of worship not as a productive waqf.

Abstract

The rapid response to COVID-19 by central and local governments relies on Circular Letters, convenient policy tools requiring no external approval. Despite their ease of use, Circular Letters often trigger debates and legal disputes due to inconsistencies in content and legal status.The research methodology employed is normative legal research, conducted by examining library materials or secondary data. The findings of the study reveal that the existence of Circular Letters, which is a form of policy regulation, results from the discretionary power vested in the government. However, as discussed above, there is a lack of consistency among officials regarding the format and content of Circular Letters, leading to some Circular Letters containing legal norms that are generally binding on the public. In contrast, according to the Regulation of the Minister of State Apparatus Empowerment and Bureaucratic Reform of the Republic of Indonesia Number 80 of 2012 and the Regulation of the Head of the National Archives of the Republic of Indonesia No. 2 of 2014, Circular Letters are classified as administrative document products. Consequently, the implication of this research is that Circular Letters should only serve as internal communication tools, providing notifications within the internal organizational structure.
