Abstract

The purpose of writing in this article is to find out and analyze the effect of law enforcement in the implementation of good government. The approach method used in normative legal research used in this study uses modern legal concepts. The research result states that the concept of good governance can be realized if governance is organized in a transparent, responsive, participatory manner, obeying legal provisions, oriented to consensus, existence of togetherness, accountability and having a strategic vision. Governance is said to be good if the common goal is carried out well, paying attention to the decision-making process, carrying out regulatory functions, exercising power properly and orderly institutions. Good governance is implemented in the context of democratizing the life of the nation and state. One of the conditions for democratic life is the existence of law enforcement that is just and implemented without a reed perspective. As the first step in creating good governance is to build a sound legal system, both software, hardware, and human resources who run the system.

Abstract

The establishment of UMP/UMK based on PP on wage is accomplished in a simple way without making survey on price. The minimum wage is determined on this PP is made by using the formula of minimum wage calculation in KHL in accordance with the productivity and economic growth. With this calculation, the rise of minimum wage could be estimated either by the employee / labor, or the entrepreneurs every year. Furthermore, it will give warranty to the entrepreneur in their entrepreneurship.  The presence of PP on wage, in fact, triggers many rejections from employee/labor because it is in contradictory with the Act of Employment which results disadvantages for employee/labor because the determination of UMK/UMP will be made without the Union of Labors but it will be decided directly by the governor without any recommendation from the regent/mayor. Keyword : Sensitivity Pp 78 Year 2015 On Wage

Abstract

According to the 1945 Constitution, Pilkada is not an electoral regime, but it is included in the regime of local government. Therefore, the addition of the Constitutional Court's authority to adjudicate cases of election result disputes is unconstitutional. Decision of the Constitutional Court Number 97/PUU-XI/2003 read out on May 19, 2014 has canceled the Constitutional Court's authority to resolve election disputes. In its decision the Constitutional Court declared that Article 236C of Law no. 12 Year 2008 on Regional Government and Article 29 paragraph (1) letter(e) of Law no. 48 Year 2009 on Judicial Power is declared contradictory to Article 18 and Article 22E of the 1945 Constitution and has no binding legal force. Furthermore to resolve election disputes formed special court as regulated in Law no. 10 of 2016 on the Second Amendment to Law Number 1 Year 2015 Concerning the Stipulation of Government Regulation in Lieu of Law No. 1 of 2014 on the Elections of Governors, Regents, and Mayors Becoming Laws.

Abstract

This research is a normative juridical study supported by empirical juridical research. This research is analytical descriptive, that is, describing an object or event without an intention to draw conclusions that are generally accepted. The data source of this research consists of primary data and secondary data, in the form of primary, secondary and tertiary legal materials. The analysis used in this study is qualitative data analysis. Based on the research results obtained, the regulation of incest in a variety of laws currently in force still emphasizes the form of incest committed by a child. Whereas incest is based on the agreement of both parties for those who are adults has not been specifically regulated. The role of the Satreskrim Polrestabes Medan women's and child protection unit in providing legal protection for victims of incest, by seeking the rights of victims. Obstacles to the Protection Unit of Women and Children of the Satreskrim Medan District Police in terms of legal handling of incest in the case of sexual intercourse in the absence of synergic relations between the existing institutions.

Abstract

Menurut UUDNRI Tahun 1945 Pilkada bukan merupakan rezim pemilu, akan tetapi termasuk dalam rezim pemerintah daerah. Oleh karena itu penambahan kewenangan MK untuk mengadili perkara perselisihan hasil pemilu adalah inkonstitusional. Putusan MK Nomor 97/PUU-XI/2003 yang dibacakan pada tanggal 19 Mei 2014 telah membatalkan kewenangan MK untuk menyelesaikan sengketa pemilukada. Dalam putusannya MK menyatakan bahwa Pasal 236C UU No. 12 Tahun 2008 tentang Pemerintah Daerah dan Pasal 29 ayat (1) huruf (e) UU No. 48 Tahun 2009 tentang Kekuasaan Kehakiman dinyatakan bertentangan dengan Pasal 18 dan Pasal 22E UUDNRI Tahun 1945 dan tidak mempunyai kekuatan hukum mengikat. Selanjutnya untuk menyelesaikan perselisihan pilkada dibentuk peradilan khusus sebagaimana diatur dalam UU No. 10 Tahun 2016 tentang Perubahan Kedua Atas Undang-Undang Nomor 1 Tahun 2015 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2014 Tentang Pemilihan Gubernur, Bupati, Dan Walikota Menjadi Undang-Undang.

Abstract

Theoretically the existence of restorative justice through mediation of penalties is a new dimension in the Indonesian criminal justice system. However, practically, restorative justice has long been applied in Indonesian society, especially in the scope of customary criminal law. But unfortunately, the settlement of traffic accident cases that have caused serious injuries and death through mediation by the law has not yet been integrated in criminal law. The problems in this study are, how do the legal arrangements and the application of restorative justice as well as the obstacles to the implementation of restorative justice in the settlement of traffic accident cases that cause serious injuries and deaths at the Police Traffic Police Traffic Unit?This type of research is empirical juridical research, while the nature of the study is descriptive analysis. Based on the results of the study, The legal basis for implementing restorative justice in the settlement of traffic accident cases refers to the discretionary authority of the police regulated in Article 18 of the Police Law and Circular Letter of the National Police Chief Number 8 of 2018 regarding the Application of Restorative Justice Justice in the Settlement of Criminal Cases. The implementation of restorative justice in the settlement of cases of traffic accidents that cause serious injuries and deaths at the Traffic Police Traffic Unit of the Coal Police Station has gone according to community expectations. In the case of a traffic accident that results in fatalities, restorative justice cannot be carried out. Barriers to the implementation of restorative justice in the settlement of traffic accident cases that cause serious injuries and deaths at the Traffic Unit of the Coal of Polres are influenced by two factors, namely the legal substance that has not been supported and the legal culture of the community which tends to have a paradigm of material values ​​in determining the size of justice.

Abstract

Pengembangan E-SAMSAT diatur dan disebutkan dalam Pasal 22 huruf f dan huruf g Perpres No.5/2015, yang menentukan bahwa dalam peningkatan kualitas pelayanan Kantor Bersama SAMSAT dapat dilakukan dengan membentuk unit pembantu E-SAMSAT, dan pengembangan SAMSAT lain sesuai dengan kemajuan teknologi dan harapan masyarakat. e-SAMSAT belum mampu meningkatkan kualitas pelayanan publik dan mewujudkan asas-asas umum pemerintahan yang baik. Hal ini dikarenakan dalam pelayanan pembayaran pajak kenderaan melalui program e-SAMSAT masih belum memenuhi prinsip-prinsip dan kriteria kualitas pelayanan publik. Hambatan pelaksanaan e-SAMSAT dalam mewujudkan asas-asas umum pemerintahan yang baik, adalah belum terpenuhinya standar kualitas pelayanan prima pada pelaksanaan pelayanan e-SAMSAT.

Abstract

The process of establishing the Job Creation Law has established a series of principles, both formally and materially. The formation of the Job Creation Law tends to ignore the principles of the formation of laws and regulations, both formal and material principles. The formulation of the problem in this thesis is how the design and ratification of Law Number 11 of 2020 concerning Job Creation is in accordance with Law No. 15/2019 concerning the Establishment of Legislations, what is the position of Law Number 11 of 2020 concerning Job Creation in the perspective of Law No. 15/2019 concerning the Formation of Legislation, how is the impact of the implementation of Law No. 11 of 2020 concerning Job Creation on the prevailing statutory system in Indonesia. The research method used is descriptive analysis that leads to normative juridical legal research, namely research conducted by referring to legal norms, namely researching library materials or secondary materials. Secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials. The results of the study indicate that the process of designing and ratifying Law Number 11 of 2020 concerning Job Creation is not in accordance with Law No. 15/2019 concerning the Formation of Legislations because at the planning and drafting stages it turned out to be Academic Papers and the Basis for Drafting Legislation Programs. National has no legal force. The position of Law No. 11 of 2020 concerning Job Creation in the perspective of Law No. 15/2019 concerning the Formation of Legislation is to have a strong position in the structure and national legal system. The impact of the implementation of Law Number 11 of 2020 concerning Job Creation on the applicable legal system in Indonesia is that the Job Creation Law has procedural defects because in the process the public does not know the standard and official text related to the Job Creation Act, and is not involved directly in the discussion and ratification, which is contrary to the constitutional rights as citizens regulated in the 1945 Constitution of the Republic of Indonesia.

Abstract

The investigation of assets in the crime of money laundering which is the result of a criminal act of corruption by the prosecutor's investigator generally refers to and is guided by the Criminal Procedure Code. The obstacle for the prosecutor's investigator to carry out investigations and confiscation of assets in connection with the crime of money laundering is the difficulty in revealing the whereabouts of the assets owned by the suspect, due to the efforts made by the suspect to hide his assets. The prosecutor's investigator's efforts to carry out investigations and confiscation of assets resulting from corruption related to the criminal act of laundering, namely optimizing the investigation of the assets of corruption suspects. When the suspect's assets are found, then the investigators can confiscate the assets.
