Abstract

ABSTRAK             Penelitian ini mengangkat masalah bagaimana Koreografi Tari Cangklak di Sanggar Rampoe Kota Banda Aceh. Tujuan penelitian ini adalah mendeskripsikan Koreografi Tari Cangklak di Sanggar Rampoe Kota Banda Aceh. Pendekatan penelitian yang digunakan adalah kualitatif dan jenis penelitian deskriptif. Subjek penelitian ini adalah koreografer sanggar Rampoe, ketua sanggar Rampoe, penari dan pemusik sanggar Rampoe. Objek dalam penelitian ini adalah tari Cangklak. Teknik pengumpulan data yang digunakan adalah teknik wawancara, observasi dan dokumentasi. Analisis data dilakukan dengan reduksi data, penyajian data dan verifikasi data. Dari hasil penelitian menunjukkan bahwa koreografi tari Cangklak termasuk ke dalam tari kreasi yang berpola tradisi. Indikator dari koreografi tari Cangklak ini adalah menentukan tema, eksplorasi dan improvisasi gerak, komposisi dan evaluasi gerak, menentukan musik pengiring tari dan merancang tata busana dan tata rias tari. Tema tari Cangklak ini diambil dari bahasa Aceh yang artinya centil. Eksplorasi atau penjelajahan gerak dilakukan dengan melihat kebiasaan sehari-hari wanita Aceh yang dikaitkan dengan beberapa properti yang sering digunakan dalam kehidupan sehari-hari oleh seorang wanita, seperti payung, kipas, gelang kaki dan sapu tangan serta improvisasi gerak dilakukan secara spontan dan gerak yang belum biasa dilakukan oleh wanita dalam penggunaan properti tersebut. Setelah eksplorasi dan improvisasi gerak dilakukan, maka gerak yang telah didapatkan akan dievaluasi jika ada gerak yang dirasa tidak nyaman akan diganti atau dibuang jika dirasa gerakan tersebut tidak cocok. Tata busana yang dikenakan telah disesuaikan dengan tema tarian oleh koreografer tari yaitu memakai pakaian Aceh serta dilengkapi dengan berbagai accesoris yang menunjang tari agar sesuai dengan tema. Tata rias yang digunakan adala tata rias cantik sesuai dengan tema penggambaran pesona wanita Aceh.Kata Kunci: koreografi, tari Cangklak

Abstract

The issue of abortion in Indonesia has a strict and clear legal regulation. Formally, abortion is not justified in Indonesia, so anyone who has been proven to have an abortion will be treated with a criminal penalty in exchange for their actions which violate the law. The decision on the legality of abortion in Indonesia is only to protect morality and to try to evaluate the basic values of life. Therefore, how can a nation be considered civilized if immoral acts – such as abortion – are still scattered in different places. In fact, abortion and its law will only lead to an increase in the number of perpetrators, even will be done openly, and consequently anyone who wants to do an abortion will not hesitate because the law provides a guarantee.

Abstract

As an implementation of the conditions for istita'ah, for person who want to register pilgrimage, the government requires paying amount of money called Biaya Penyelenggaraan Ibadah Haji (BPIH). The accumulated funds have reached untill trillions of rupiah, this accumulation has potential to be developed. Currently, there is debate about the permissibility of using BPIH outside the direct interests of pilgrims such as government infrastructure investment. This research uses normative juridical research. This study also uses a statutory approach and a comparative approach. The results of this study indicate the pilgrimage fund can be invested. However, in terms of the ability to use the pilgrimage funds for investment in government infrastructure, there must be permitted by people who want to go on pilgrimage, or can be used in infrastructure that is directly related to the pilgrimage.

Abstract

This paper deals with the issue of the marriage of a pregnant woman fromadultery as one of contemporary contemporary issues. Marriage of pregnantadultery is one of the issues that provoked a dispute between the scholars of oldand recent, some of them allow the marriage of pregnant adultery, and some ofthem do not permit. Then they differed as to whether the marriage was adulterywith it or not, even the consequences under it. There have been many questionsabout this issue in our contemporary society. In this study, the researcher uses adescriptive approach comparing the views of the scholars in the ruling on themarriage of a pregnant woman with adultery and its effects, especially amongthe five schools of thought. After the analysis and comparison of the scholars'opinions, the researcher concluded that it is permissible to marry a pregnantwoman from adultery with a zina, and that it is permissible for a non-adultererto contract a pregnant woman before adultery before she puts her pregnancy, butit is not permissible for the husband to take her until she puts her pregnancy.Among the effects of this marriage in the child is: In terms of descent, the child isnot attributed to the adulterer by agreement of the jurists if his mother was a bed,and is not attributed to the most likely if his mother is not a bed. In terms ofinheritance, the child does not inherit from the adulterer, nor to the adultererwho is related to the adulterer. In contrast, neither the adulterer nor the child'sheir is inherited, because his ratio is cut off from the adulterer. And theinheritance of the child only from his mother's side, because he is related to it,inherited from it and inherited it and whoever made it. In terms of alimony, thischild should not be obliged to pay zakaah on his father, and the adulterer mustnot pay zina for his son.

Abstract

This study uses a production organization perspective on the process of creating content in the form of fatwas on Instagram accounts in Indonesia. During the rise of “online muftīs” through various social media platforms, this study describes the process of producing and disseminating fatwa content published by “online muftīs” on islami.co, bincangsyariah.com, and rumasyho.com. This research combines field research methods and content analysis as analytical methods. In the research, the writer acts as a follower to observe, reconstruct dialogue, describe, and document information and activities virtually. Then the results of the analysis are described descriptively. This study concludes that the creation of digital content in the form of online fatwas released by islami.co, rumaysho.com, and bincangsyariah.com on Instagram is motivated by several factors, namely the manager’s background, methodology for taking fatwas, and questions asked by followers in the media. social. The leaders and editors of the three media outlets issue fatwas by adapting, simplifying, and restating existing ulema’s fatwas to be published on social media in the form of short videos or infographics.

Abstract

Islamic law permits Muslims to engage in activities that bring them enjoyment, such as playing online games. However, this is subject to the rules and regulations established by Sharia, which aim to ensure that all aspects of a Muslim's life adhere to Islamic principles and do not violate them. This research aims to analyze the ruling on playing electronic games according to Islamic fatwas, taking into account the impact of technological developments on Islamic societies. The study addresses scholars' opinions on the legal aspects of online games, including conditions for permissibility and prohibitions, as well as potential risks and benefits. An analytical approach was used, wherein research describes the ruling on gaming in Islam and analyzes data from jurisprudential sources, the Quran, and Hadith literature. The findings indicate that the basic ruling on playing online games is permissibility, provided it is not associated with any legal violations and does not lead to any harmful consequences. This permissibility may extend to other legal rulings based on the relevant context; however, it pertains to two matters: the contents of the game and its outcomes, such as player behavior and the resulting effects.

Abstract

Legal issues regarding contraception and population control efforts to limit births and reduce overcrowding have not been without controversy. Differences in using naqli arguments and scientific, medical, and even political arguments make the discourse on family planning still hotly debated. This research will identify how Betawi Ulama's response in the XXI century to the law on the use of contraceptives and birth control through population control, along with the arguments and legal methods, they used to analyze the factors behind it and collect theoretical and empirical data related to social impacts/implications, from the Betawi Ulama's response to enacting the law on contraception and population control. The conclusion of this study will explain the positions, thoughts, and religious perspectives of Betawi Ulama in understanding various problems of Islamic law. Tend to think that is exclusive, inclusive, or moderate, especially in addressing the controversies of family planning law? This study took the capital city of DKI Jakarta as the sampling location, considering that the densest population in the country is in Jakarta, and it is very heterogeneous in terms of diversity and community characteristics. Population census data in 2010 shows that the capital city of DKI Jakarta is the largest city with the most populous population in Indonesia, around 9.6 million people. This research uses logical thinking, analysis with logic, induction, deduction, analogy, comparison and the like. The data in this study will be obtained through observation techniques, in-depth interviews with resource persons, and documentation.

Abstract

Correctional institutions are undergoing a transformative shift from punitive spaces to acknowledging the humanity of inmates. This study delves into Indonesian correctional facilities' religious-based coaching programs prioritizing inmate protection, reintegration, and dignity. Analyzing these through Islamic law and Maqasid al-sharahprinciples, it explores personality development models and identifies limitations in current approaches. While initial findings showcase positive outcomes—behavioural changes and reduced distress—the study highlights the predominance of lecture-based programs, signalling the need for more comprehensive Islamic law-based models. Different inmate categories, especially those in serious crimes, display varying spiritual indicator weights. Spiritual development correlates positively with behavioural adjustments. Overcapacity issues in certain facilities, like Salemba and Jakarta Women's Correctional Institutions, pose severe challenges—from limited resources to inadequate staff ratios and hindrances in providing proper medical and psychological support, notably impacting drug abuse victims. The study underscores the urgency of restorative justice in sentencing, emphasizing rehabilitation and societal reintegration.

Abstract

The legality and validity of sharia banks still somehow lead to some problems, including a negative view of the use of murâbahah contract at the level of practice in the field. Is it true that the application of the sale and purchase agreement of sharia banks, in this case the contract of murâbahah, salam and istisnâ’, is essentially a sale and purchase process? This is a critical question in this research. This is a critical question in this research. Such a miserable view not only emerged in the country, but also voiced in several other Muslim countries. This type of research is a qualitative descriptive method with content analysis of qualitative / inductive data. Data sources are the results of interviews with Sharia Commercial Banks (BUS) BNI, Sharia Business Units (UUS) Permata Syariah and Sharia People's Credit Banks (BPRS) Al-Salam. This research shows that sharia banks which are still dominant in using murâbahah contracts are not appropriate. Judging from the aspect of sharia maqâsid, the position of shariah banks is basically outwardly not acting as a provider of goods. Sharia banks do not have a stock of goods as a meaning of the use of contracts based on exchange or sale and purchase transactions. In fact, the position and position of a sharia bank is essentially only as an institution mediating financial service providers and not sellers. However, from the perspective of jurisprudence the practice of murâbahah in Sharia Financial Institutions (LKS)  has fulfilled the pillars and conditions, but in the absence of stock of goods, the sale and purchase transactions of sharia banks seem still as al-makhârij al-shar'î (sharia solutions). Legalitas dan keabsahan bank syariah masih menyisakan masalah. Termasuk pandangan negative tentang penggunaan akad murâbahah pada tataran praktek di lapangan. Benarkah bahwa aplikasi akad jual beli bank syariah, dalam hal ini akad murâbahah, salam dan istisnâ’, secara hakiki telah terjadi jual beli?.  Inilah pertanyaan kritis dalam penelitian ini. Pandangan miris ini tidak hanya muncul di tanah air, tapi juga disuarakan di beberapa negara muslim lainnya. Jenis penelitian ini adalah deskriptif kualitatif dengan metode content analisis terhadap data-data yang bersifat kualitatif/induktif. Sumber data adalah hasil wawancara kepada Badan Usaha Syariah (BUS) BNI, Unit Usaha Syariah (UUS) Permata Syariah,  dan Bank Perkreditan Rakyat Syariah (BPRS) Al-Salam. Penelitian ini menunjukkan bahwa bank syariah yang saat ini masih dominan menggunakan akad murâbahah adalah kurang pas. Dikaji dari aspek maqâsid syariah, posisi bank syariah pada dasarnya secara lahiriyah tidak bertindak sebagai  penyedia barang. Bank syariah tidak memiliki stock barang sebagai pemaknaan terhadap penggunaan akad-akad yang berbasis pada transaksi tukar-menukar atau jual beli. Sebenarnya, kedudukan dan posisi bank syariah hakekatnya adalah hanya sebagai institusi mediator penyedia jasa keuangan dan bukan penjual. Namun, dari sudut fikih praktek murâbahah di Lembaga Keuangan Syariah (LKS) sudah memenuhi rukun dan syarat, tapi dengan tidak adanya stock barang, maka transaksi jual beli bank syariah terkesan masih sebagai al-makhârij al-shar'î  (solusi syariah).
