Abstract

Seorang istri yang menjadi korban kekerasan dalam rumah tangga dengan pelaku adalah suaminya sendiri menunjukkan adanya ketidakseimbangan hak dan kewajiban antara suami dan istri dalam menjalani kehidupan berumah tangga, padahal hak dan kewajiban suami istri sudah diatur secara tegas dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Sebagai pelaku tindak kekerasan dalam rumah tangga maka suami tidak dapat lepas dari sanksi pidana yang sudah ditentukan dalam Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga, oleh sebab itu istri sebagai korban yang mengalami kerugian dari terjadinya kekerasan dalam rumah tangga harus berani untuk mengadukan tindakan suaminya ke pihak kepolisian agar bisa diproses secara hukum dengan harapan apabila sudah dijatuhkan sanksi pidana bisa memberi efek jera pada pelaku sehingga tidak akan mengulangi lagi perbuatannya dan tujuan perkawinan bisa tercapai.Domestic violence perpetrated by a husband to his wife reflects the absence of balanced rights and obligations in the household as stipulated in Law No. 1 of 1974 on Marriage. Although it occurs within the domestic sphere, the husband who perpetrates domestic violence does not escape from the threat of criminal sanctions as stipulated in Law No. 23 of 2004 on the Elimination of Domestic Violence. Therefore, a wife who becomes a victim of domestic violence should not hesitate to file a report with the relevant police department concerning her husband’s abusive action so that legal proceedings are performed andultimately criminal sanctions conferred. It is expected that the criminal sanction provides a deterrent effect. Hopefully, the perpetrator will not repeat his actions and thus the purpose of creating a happy family in a marriage can be achieved.

Abstract

AbstractViolence against children is a violation of children's rights, especially if the abuser is the child's own parents, this is called domestic violence. The government had ratified legislation governing child rights and protection of children in Indonesia with sanctions for perpetrators  who violate, but sanctions are more focused on criminal sanctions, when in fact it could be the imposition of civil penalties by filing a compensation  lawsuit against the perpetrators based on Article 1365 of the Code of Civil Law concerning unlawful act that is broadly defined, not only violate the law but also violated decency and public order.Keywords: Violence, Children, VictimsIntisariKekerasan pada anak merupakan pelanggaran hak anak, apalagi jika pelaku kekerasan ini adalah orang tua anak itu sendiri, hal ini disebut kekerasan dalam rumah tangga. Pemerintah sudah mengesahkan peraturan tentang hak-hak anak dan perlindungan bagi anak di Indonesia dengan adanya sanksi bagi pelaku yang melanggar, namun sanksinya lebih berfokus pada sanksi pidana, padahal sebenarnya bisa juga sanksi perdata dengan mengajukan gugatan ganti rugi pada pelaku berdasarkan Pasal 1365 Kitab Undang-Undang Hukum Perdata tentang perbuatan melawan hukum yang diartikan secara luas, tidak hanya melanggar undang-undang namun juga melanggar kesusilaan dan ketertiban umum.Kata Kunci : Kekerasan, Anak, Korban

Abstract

In marriage between husband and wife disputes often occur not infrequently accompanied by violence perpetrated by one party and led to divorce. One of the reasons that lead to divorce in Article 19 of Government Regulation No. 9 of 1975 was particularly severe cruelty or mistreatment to harm others. When one of the victims of domestic violence and can show strong evidence in the trial as well as husband and wife can not live together in a household, then the divorce petition can be granted court pursuant to Article 39 paragraph (1) of Law No. 1 of 1974. Dalam perkawinan antara suami dan istri sering terjadi perselisihan yang tidak jarang disertai dengan kekerasan yang dilakukan oleh salah satu pihak dan mengakibatkan terjadinya perceraian. Salah satu alasan yang menyebabkan perceraian dalam Pasal 19 Peraturan Pemerintah Nomor 9 Tahun 1975 adalah salah satu pihak melakukan kekejaman atau penganiayaan berat yang membahayakan orang lain. Ketika salah satu korban kekerasan dalam rumah tangga dan dapat menunjukkan bukti yang kuat dalam persidangan serta suami dan istri tidak bisa hidup bersama dalam sebuah rumah tangga, maka permohonan perceraian dapat diberikan sidang pengadilan berdasarkan ketentuan Pasal 39 ayat (1) UU No. 1 Tahun 1974.

Abstract

Persetujuan pasien atau keluarga pasien sangat dibutuhkan dokter sebelum dilakukannya tindakan medis oleh dokter, namun sebelumnya pasien atau keluarga pasien membutuhkan informasi dari dokter atau disebut informed consent terkait tindakan medis tersebut. Transaksi terapeutik yang dilakukan dokter bisa terjadi setelah informed consent diterima oleh pasien. Hal ini menjadi bagian dalam hukum Perdata karena terjadinya transaksi terapeutik berdasarkan dari perjanjian yang akhirnya menimbulkan hak dan kewajiban pada dokter dan pasien sebagaimana diatur dalam Pasal 1330 KUHPerdata.Kata Kunci : Dokter, Pasien, Tindakan Medis.

Abstract

Tingkat kematian akibat kecelakaan lalu lintas di Indonesia cukup tinggi. Pengemudi ojek online sebagai salah satu pengguna jalan raya perlu diberikan edukasi terkait dengan pentingnya menerapkan keselamatan dalam berkendara. Dalam Peraturan Menteri Perhubungan maupun Kode Etik telah mengatur mengenai hal-hal yang harus dilakukan oleh pengemudi ojek online (mitra) diantaranya adalah 5K yang terdiri dari Keselamatan, Keamanan, Kenyamanan, Keterjangkauan dan Keteraturan. Namun pada kenyataannya masih banyak mitra yang belum sepenuhnya menerapkan hal tersebut. Hal ini dibuktikan bahwa dalam setiap harinya selalu ada mitra yang mendapatkan sanksi baik berupa akun yang di non aktifkan sementara hingga pemutusan hubungan kemitraan. Oleh karenanya, perlu adanya edukasi secara langsung untuk mensosialisasikan 5K tersebut. Diharapkan dengan adanya sosialisasi atau penyuluhan tingkat mitra yang mendapatkan sanksi dari penyedia jasa layanan transportasi online semakin rendah begitu pula dengan tingkat kecelakaan yang terjadi akibat kelalaian mitra dalam berkendara.

Abstract

The potential of natural resources in a region that is well managed and provides economic benefits to the local communities deserves protection for geographical indications. It is part of intellectual property rights as it relates to the protection of the identities of producer regions that are affected by both human and natural factors. The provision of protection for geographical indications, that adopts a constitutive registration system, put emphasis on the potentials of the certain region because the distinctiveness of a product from the region cannot be found in the others. The protection of geographical indications granted for an unlimited period of time protects not only the producer regions but also the reputation, quality, as well as characteristics of their products. To provide protection of geographical indications means also to protect the consumer rights; consumers that purchase or use certain products are supplied with correct information on the production sites, quality and being protected from the potentially harmful effect of the products.

Abstract

While the Indonesian government has passed the Law on Child Protection to ensure the fulfillment of children's rights, there remain a substantial number of children who are victims of sexual violence. In fact, the cases reached 14,517 in 2021. For that reason, this paper aims to discuss the imposition of criminal sanction against sexual abusers and law protection for child victims of sexual abuse. This paper is a normative legal research that puts emphasis on the legal approach, especially the Child Protection Law. Regulations on procedures for imposition of sanction against sexual offenders are already included in the Child Protection Law, despite the fact that sanctions are not explicitly defined since there are minimum and maximum criminal sanctions. Therefore, it is perceived that judges can impose minimal criminal sanctions, including chemical castration, which is one of the additional sanctions as regulated in Law Number 17 of 2016. For those categorized as child victims, psychological advocacy is important to recover their mental condition and to move on from past trauma. This has been regulated as special protection that takes the forms of reproductive health education, inculcation of religious values and decency; social rehabilitation; psychosocial advocacy toward healing; and protection and advocacy at every stage of trial, from investigation, prosecution, up to examination in court. Imposition of criminal sanctions against the offender and advocacy for child victims of sexual abuse must be optimally implemented to ensure their optimal growth and development to become this country’s future generation that succeed in making their dream come true.

Abstract

Selama Pandemi Covid-19 membuat masyarakat menjadi lebih banyak beraktivitas di rumah, terutama anak-anak yang bersekolah secara online yang membuat orang tua harus lebih berperan besar dalam proses pembelajarannya. Terhitung sejak pandemi covid 19 terjadi peningkatan kekerasan pada anak yang dilakukan oleh orang tuanya sendiri. Hal ini dikarenakan orang tua kesal terhadap anak yang sulit untuk diajari saat belajar online. Kegiatan penyuluhan tentang perlindungan hak anak korban kekerasan orang tua selama pandemi covid 19 melalui social service webinar dilakukan dengan tujuan untuk meningkatkan pemahaman masyarakat dengan adanya keberlakukan Undang-Undang Perlindungan anak tersebut. Kegiatan terlaksana dengan menggunakan 4 tahapan, yaitu tahap pengisian pre test, tahap pemaparan materi, tahap tanya jawab, dan tahap pengisian post test. 4 tahapan ini dilakukan sebagai rangkaian untuk bisa mencapai tujuan dilakukannya kegiatan pengabdian masyarakat. Berdasarkan hasil pemaparan narasumber dan memperhatikan hasil jawaban pre test dan post test, maka diketahui adanya peningkatan pemahaman dari peserta dalam social service webinar tentang ketentuan Undang-Undang Perlindungan Anak yang mengatur tentang hak-hak anak yang dilindungi dan sanksi bagi pelaku yang melanggarnya, dengan demikian diharapkan ada peran serta dari masyarakat dalam penyelenggaraan perlindungan anak.   Counseling for The Protection of Children's Rights Victims of Parental Violence During the Covid 19 Pandemic Through Social Service Webinar. During the Covid-19 pandemic, people have become more active at home, especially children who go to school online, which makes parents have to play a bigger role in the learning process. Since the COVID-19 pandemic, there has been an increase in violence against children by their own parents. This is because parents are annoyed with children who are difficult to teach when learning online. Counseling activities regarding the protection of the rights of children victims of parental violence during the COVID-19 pandemic through the social service webinar were carried out with the aim of increasing public understanding with the enactment of the Child Protection Act. The activity was carried out using 4 stages, namely the pre-test filling stage, the material exposure stage, the question and answer stage, and the post-test filling stage. These 4 stages are carried out as a series to be able to achieve the goal of doing community service activities. Based on the results of the speakers' presentations and paying attention to the results of the pre-test and post-test answers, it is known that there is an increase in the understanding of participants in the social service webinar regarding the provisions of the Child Protection Law which regulates the rights of children being protected and sanctions for perpetrators who violate them. It is hoped that there will be participation from the community in the implementation of child protection.

Abstract

Sexual violence in Indonesia still occurs, especially sexual violence against children. In fact, in this case children also have the same rights as adults which are protected by the constitution. This happens because the provision of sexual education to children is still very taboo in Indonesia, therefore children's knowledge of sexuality and the things that lead to sexual violence have not been understood properly and clearly. Even though in this case, there are already legal arrangements related to sexual violence, in fact it is still not enough if it is not with the fulfillment of sexual education for children given by parents and teachers in schools. Therefore, it is not only the role of the government that is needed in preventing these crimes from occurring, but the community and families must also play a role in preventing these crimes. Therefore, in this study, it is hoped that parents and other communities will know that they must also play an active role in preventing sexual violence against children by providing proper and proper sexual education to children. Giving sexual education to children properly and appropriately turns out to also have a positive impact on children, not a negative impact as is thought by most people who think it is vulgar. Children who have been given sexual education will understand about the parts of the body that other people should not touch, the way they behave and the restrictions on the opposite sex, and how to refuse invitations from other people who have the intention of sexually assaulting them.
