Abstract

Knowledge integration in higher education institutions is a crucial topic for advancing academic and practical outcomes. This study investigated the implementation of knowledge integration at UIN Jakarta, focusing on its policies, practices, and philosophical foundations. Using qualitative methods such as document analysis and interviews, the research examines how UIN Jakarta integrates religious and secular knowledge within its academic framework. The findings reveal that UIN Jakarta has established a robust philosophical basis for knowledge integration, emphasizing an open-minded and dialogic approach to learning. Additionally, the university has enacted various policies at both institutional and faculty levels to support this initiative. However, limitations include the lack of comprehensive policies across all faculties and minimal emphasis on community service programs related to knowledge integration. In conclusion, this study provides valuable insights into the challenges and opportunities associated with knowledge integration in Islamic higher education institutions, highlighting the need for further research and evidence-based practices to enhance these efforts.

Abstract

Wacana gender merupakan isu yang memiliki tantangan tersendiri dalam kajian keislaman. Di samping lahir dari dunia Barat, wacana ini dipandang kurang linier dengan kajian keislaman. Kesan ini cenderung didasarkan atas pemahaman yang kurang proporsional. Gender bukanlah memperlakukan seseorang atas dasar jenis kelamin, tetapi atas kompetensi seseorang. Jika pendekatan jenis kelamin itu bersifat biologis-kodrati dan tidak dapat diubah, maka pendekatan gender bersifat konstruksosial, bukan kodrati, dan dapat diubah. Sumber primer Islam, seperti Alquran Hadits, memastikan dalam persoalan kedudukan, ibadah, dan hukum antara lakilaki dan perempuan memiliki posisi yang sama. Namun, sebagian dari aspek fiqhiyah sebagai implementasi atas pemahaman sumber primer itu dipandang masih bias. Perbedaan pemikiran, budaya masyarakat, dan tantangan yang dihadapi oleh para imam fiqh berkontribusi atas bias gender.

Abstract

The research results show that cases of dowry payments using high proceeds from harato pusako tinggi in the Luhak Agam area, especially in Manggopoh. The highest use of harato pusako tinggi in Manggopoh is only in the form of cultivation results from harato pusako land, such as rice fields and plantations. Harato pusako tinggi in this case still belongs to the clan (kaum). Traditionally, in this case there is no problem, according to the results of interviews with traditional leaders, if emergency conditions are permitted by customary law to cover the shame of the community and family. According to Islamic law, the use of assets resulting from the cultivation of harato pusako tinggi is by Islamic law because the conditions for the validity of the dowry are fulfilled, namely private property (milk al-tam). Previously, community-owned harato pusako had been turned into private property through community permission. It contains hifzh al-nasab (protecting the family) because maintaining the kaum's good name in Islamic law is the same as maintaining the honour and good name of the family. Moreover, in it, there is hifzh al-mal (protecting assets), where the giving of harato pusako tinggi in Manggopoh does not take the form of giving lands such as rice fields and plantations. However, what is given is in the form of harvests from land cultivated and managed from harato pusako tinggi. Keywords: Dowry, Harato Pusako Tinggi, West Sumatera

Abstract

The consent of the bride and groom is one of the issues still being discussed in Shafi'i fiqh. This study examines the issue of spousal consent in two books from different eras. The book Kanz al-Ragibin is a classical Shafi'i fiqh text written by al-Mahalli, while the book Al-Mar'ah fi al-Hadarah al-Islamiyyah is a contemporary Shafi'i text written by Ali Jum'ah. This research method is qualitative in nature, using a gender approach, with the selected perspective being Islamic Gender. Data collection techniques involve interviews and documentation studies. The results of this study indicate that, according to al-Mahalli, the consent of the bride and groom is not a valid requirement for marriage, whereas according to Ali Jum’ah, the consent of the bride and groom is a requirement that must be considered in marriage. This difference stems from the existence of the right of ijbar. The right of ijbar existed and was implemented during al-Mahalli’s time, whereas during Ali Jum’ah’s time, it was not widely implemented. Nevertheless, both share the same legal principle that a father will protect his child. Al-Mahalli uses the concept of mafhûm al-mukhâlafah in the hadith “al-tsayyib ahaqqu bi nafsihâ min waliyyihâ,” while Ali Jum’ah uses a textual understanding (mantûq) of the hadith. Additionally, during Al-Mahalli's time, women tended to be socially passive in public, often staying at home without interacting with any men. In contrast, during Ali Jum'ah's time, women had more freedom in public spaces. They achieved legal equality in almost all aspects. When viewed from a gender perspective, the opinions of al-Mahalli and Ali Jum’ah align with the concepts of justice and gender equality of their respective eras. This study also indicates that Ali Jum’ah’s perspective on the consent of both spouses reflects a progressive legal approach that is appropriate as a reference and guideline for contemporary marriage.
