Abstract

Komisi Nasional Hak Asasi Manusia merupakan salah satu lembaga Negara yang dibentuk dalam usaha memulikan, menegakan, memajukan hak asasi manusia. Namun pada tataran praktis kelembagaan Komnas HAM, belum cukup kuat untuk memajukan, memulikan dan menegakan hak asasi manusia, sebab kewenangan Komnas HAM hanya bersifat rekomendasi atas hasil penyelidikan pelanggaran ham berat yang telah dilakukan oleh komnas ham dan dilimpahkan ke Kejaksaan Agung. Persoalan kemudian adalah, terjadinya tarik ulur dan proses pengembalian berkas penyelidikan dengan berbagai alasan yang membuat mandeg proses penegakan hak asasi manusia. Untuk itu, penting untuk memperkuat kewenagan Komnasham melalui penguatan regulasi atau membuat undang-undang khusus yang mengatur tentang tugas dan kewenangan Komnas HAM. Salah satunya dengan memberikan kewenangan penyidikan dan penuntutan kepada Komnas HAM, agar kerja-kerja Komnas HAM dapat berjalan maksimal dalam konteks pemajuan, pemuliaan dan penegakan hak asasi manusia di Indonesia.

Abstract

This research explores the non-military preventive approach as a solution to human rights violations committed by the Armed Violence Group (KKB) in Papua. Using normative juridical methods, this research examines human rights law regulations in Indonesia, literature studies, and analysis of Gus Dur's speeches and writings on the peaceful approach. The conflict in Papua, fueled by a history of discrimination, exploitation of natural resources, and centralized policies, has been exacerbated by an often ineffective military approach. Comprehensive solutions are needed to address the injustice, poverty and human rights violations experienced by Papuans. This research proposes a strategy based on inclusive dialog, local participation, and respect for Papuan identity. This approach is rooted in the principles of justice, equality and human values upheld by Gus Dur. In addition, efforts to empower the economy, education, and infrastructure development in favor of indigenous peoples are considered important for creating sustainable peace. The results show that conflict resolution in Papua requires not only security solutions, but also strategic steps that prioritize social welfare and human rights protection, thus strengthening national cohesion within the framework of the Unitary State of the Republic of Indonesia (NKRI).

Abstract

This study analyzes the verdict in the Ferdy Sambo case through the lens of Critical Theory and Habermas' deliberative democracy to understand how law operates within power structures. Using a qualitative, critical-legal approach based on Habermas' framework, it examines court decisions, media reports, and institutional dynamics. The findings reveal that law is influenced by political and institutional dynamics rather than being fully neutral. The Supreme Court’s reduction of Ferdy Sambo’s sentence from death to life imprisonment reflects institutional compromise to preserve social stability and the police’s image. Technological manipulation, such as CCTV footage deletion, and public and media pressures during the trial further illustrate how legal communication is distorted by power relations. The study highlights the need for legal reforms beyond procedural aspects, emphasizing more democratic and inclusive communication mechanisms. Referring to Habermas' theory, it stresses that transparency and accountability are crucial to prevent law from merely legitimizing elite interests and to promote law as a means of social emancipation

Abstract

This research aims to analyze the urgency of protecting children from acts of physical and sexual violence in Balikpapan City from a human rights perspective. Violence against children not only damages the victims psychologically and physically but also threatens their future. This research uses empirical juridical methods with a statutory and comparative approach. Data was collected through interviews with stakeholders and analysis of legislation and related literature. The research results show that although existing regulations have run child protection efforts in Balikpapan City, there are still various obstacles, such as low public awareness, limited facilities and infrastructure, as well as challenges in dealing with victims with disabilities. From a human rights perspective, child protection is a state obligation that includes respecting, protecting, and fulfilling children's rights. This research recommends increasing public outreach and education, strengthening digital protection policies, collaborating with religious leaders, and improving assistance services and infrastructure to ensure more effective protection. With integrated and sustainable efforts, children's rights in Balikpapan City are hoped to be better protected, allowing them to grow and develop in a safe and supportive environment

Abstract

The study examined the regulation of party switching among members of Indonesia’s Regional People’s Representative Councils (DPRD) through an integrated analysis of constitutional law, political rights theory, and Indonesian Islamic jurisprudence. It critically evaluated Constitutional Court Decision No. 88/PUU-XXI/2023 to assess how individual political rights are balanced with institutional stability. Employing a normative legal research approach, the study combined statutory, case-based, and conceptual analyses, enriched with comparative insights from Malaysia, Pakistan, India, and South Africa. The findings found out that current legal mechanisms, particularly the Inter-Temporal Replacement (PAW) procedure under Article 193 of Law No. 23 of 2014, disproportionately empower political parties, undermining electoral legitimacy and legislators’ autonomy. By integrating maqāṣid al-sharī‘ah principles, including al-‘adl (justice), al-maṣlaḥah (public welfare), amanah (trust), and ḥurriyyah siyāsiyyah (political freedom), the study proposed normative and practical reforms to enhance proportionality, transparency, and fairness in regulating party switching. The research contributed to scholarship by linking constitutional law, political representation, and Islamic ethical principles, providing theoretical insights and actionable recommendations to strengthen democratic representation, protect political rights, and reinforce institutional legitimacy in Indonesia.
