Abstract

This study analyzes the legal implications of the Constitutional Court Decision Number 18/PUU-XI/2013 on Indonesia's birth certificate registration, particularly for late registrations exceeding one year. Prior to this decision, late registrations required a court decree from the District Court, creating a significant burden for the public. The Court's ruling eliminated the need for a court decree, transferring full authority to the Civil Registry Office (Disdukcapil) for issuing late birth certificates. This decision introduces a fundamental shift in the registration process, simplifying administrative procedures and improving public access to civil registration services. However, it also presents challenges related to the validity of documents issued by Disdukcapil. The study finds that Disdukcapil must enforce rigorous verification procedures to ensure the legitimacy of birth certificates and prevent misuse. The findings indicate that the Court's decision positively impacts public access to essential services but highlights the necessity for strict oversight and enhanced service quality at Disdukcapil. These measures are crucial for ensuring that the decision effectively delivers fair and reliable legal protection for all citizens.

Abstract

The development of the relationship between constitutional law and human rights is fundamental in a rule of law state. Constitutional law is oriented towards regulating and simultaneously striving for the optimal protection of human rights. This research aims to examine the integration between constitutional law and human rights by conducting a comparative legal study between Indonesia and South Africa. This research is a normative legal study emphasizing historical, conceptual, legislative, and comparative legal approaches. The research findings indicate that the strengthening of human rights norms and the role of the Indonesian Constitutional Court have become crucial points, particularly the role and authority of the Indonesian Constitutional Court through its rulings aimed at protecting human rights. Similar developments also occurred in South Africa after the end of apartheid, with the establishment of the Constitutional Court and constitutional reforms as important steps in upholding the rule of law and human rights. The Constitutional Courts of Indonesia and South Africa both face issues such as weak implementation of rulings, political pressure, and slow legislative processes that accommodate the Constitutional Court's decisions. This research recommends that the integration of constitutional law and human rights should be optimized by strengthening the authority of the Constitutional Court, including the authority to ensure that Constitutional Court decisions are obeyed and implemented optimally to protect human rights.

Abstract

Penelitian ini membahas tentang pemenuhan hak aksebilitas pelayanan peradilan bagi penyandang disabilitas. Tujuan penelitian untuk mengetahui dan memahami peran sejauh mana Pengadilan Negeri Watampone Kelas 1A dalam memenuhi hak aksesibilitas penyandang disabilitas serta faktor pendukung dan penghambat dalam realisasinya. Penilitian ini merupakan penelitian yuridis empiris dan dianalisas menggunakan pendekatan struktural fungsional. Hasil penelitian menunjukkan bahwa segala jenis peraturan perundang-undangan telah mengakomodir pemenuhan hak-hak penyandang disabilitas di wilayah peradilan. Namun, tidak terealisasi sepenuhnya di Pengadilan Negeri Watampone Kelas 1A

Abstract

The purpose of this study was to determine the divorce rate during the Covid-19 pandemic in Kolaka Regency between 2019-2021 at the Kolaka Religious Court and what factors caused the COVID-19 pandemic at the Kolaka Religious Court. The results obtained fromthis study are divorce during the covid 19 pandemic in Kolaka Regency increased by 58 cases, divorce increased related to the covid 19 pandemic, as for the factors that caused divorce during the covid 19 pandemic, namely the moral crisis factor, forced marriage factor, the responsibility factor, the domestic violence factor, the prison sentence factor, the household disharmony factor, the apostate factor and the economic factor, while the main factor in the occurrence of divorce during the pandemic at the Kolaka Religious Court was due to economic factors.

Abstract

Penelitian ini membahas mengenai perbandingan penegakan hak konstitusional melalui constitutional question serta relevansinya dengan negara hukum Pancasila.Penelitian ini bertujuan untuk mengetahui penegakan hak konstitusional melalui constitutional question di negara Jerman, Kroasia, dan Rusia begitu pula relevansi constitutional question dalam negara hukum Pancasila. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan perbandingan (comparative approch) dan konseptual (conceptual approach). Hasil penelitian menunjukkan mekanisme constitutional  question  oleh negara Rusia dan Jerman telah diadopsi dan terlembagakan dalam konstitusi federal mereka. Sedangkan Kroasia, hanya mengaturnya dalam undang-undang Mahkamah Konstitusinya. Di Indonesia, walaupun secara kelembagaan terdapat Mahkamah Konstitusi namun mekanisme constitusional  question tidak diakomodir, baik didalam UUD 1945 sebagai konstitusinya maupun dalam undang-undang Mahkamah Konstitusi. Padahal, mekanisme constitutional question memiliki relevansi dengan konsep negara hukum Pancasila dengan penduduk yang majemuk

Abstract

Penelitian ini mengkaji tentang political will pemerintah daerah dalam mewujudkan bantuan hukum bagi masyarakat miskin.  Penilitian ini merupakan penelitian yuridis normati dengan menggunakan pendekatan perundang-undangan dan analisis. Data diperoleh melalui studi literatur yang kemudian dianalisis menggunakan tehnik deskriptif kualitatif.  Hasil penelitian menunjukkan bahwa pemerintah daerah kabuapten Bone masih setengah hati dalam mewujudkan bantuan hukum bagi masyarakat miskin di wilayahnya. Hal ini tercermin dari peraturan bupati yang tidak kunjung diterbitkan sebagai aturan pelaksanaan terkait pemberian bantuan hukum.

Abstract

Climate change constitutes a multidimensional environmental and constitutional challenge that demands coherent legal frameworks capable of guiding state responsibility in mitigation and adaptation efforts. This study examines Indonesia’s climate governance through the lens of climate constitutionalism, focusing on how constitutional norms, legal institutions, and policy structures shape the state’s climate obligations. Employing a normative-empirical approach, the research analyzes constitutional provisions, statutory regulations, judicial decisions, and international climate agreements, complemented by institutional reports and selected case studies. The findings reveal that although Indonesia’s Constitution recognizes the right to a good and healthy environment, fragmented legal frameworks, institutional layering, and weak inter-sectoral coordination undermine the effective realization of substantive climate rights. The absence of an explicit constitutional interpretation linking climate obligations to fundamental environmental rights further limits state accountability and constrains the integration of intergenerational and ecological justice into national policy. This study argues that strengthening climate governance does not require a formal constitutional amendment but rather a reinterpretation of constitutional duties through the lens of climate justice. By articulating climate constitutionalism as a normative and institutional pathway, this research contributes to the broader discourse on constitutional environmentalism and offers a context-sensitive model for Global South countries seeking to align domestic legal systems with climate imperatives. Future reforms should prioritize institutional coherence, enhanced judicial engagement, and meaningful public participation to ensure that constitutional environmental commitments translate into enforceable and measurable climate action.

Abstract

The study examined the regulation of party switching among members of Indonesia’s Regional People’s Representative Councils (DPRD) through an integrated analysis of constitutional law, political rights theory, and Indonesian Islamic jurisprudence. It critically evaluated Constitutional Court Decision No. 88/PUU-XXI/2023 to assess how individual political rights are balanced with institutional stability. Employing a normative legal research approach, the study combined statutory, case-based, and conceptual analyses, enriched with comparative insights from Malaysia, Pakistan, India, and South Africa. The findings found out that current legal mechanisms, particularly the Inter-Temporal Replacement (PAW) procedure under Article 193 of Law No. 23 of 2014, disproportionately empower political parties, undermining electoral legitimacy and legislators’ autonomy. By integrating maqāṣid al-sharī‘ah principles, including al-‘adl (justice), al-maṣlaḥah (public welfare), amanah (trust), and ḥurriyyah siyāsiyyah (political freedom), the study proposed normative and practical reforms to enhance proportionality, transparency, and fairness in regulating party switching. The research contributed to scholarship by linking constitutional law, political representation, and Islamic ethical principles, providing theoretical insights and actionable recommendations to strengthen democratic representation, protect political rights, and reinforce institutional legitimacy in Indonesia.
