Abstract

Building the legal product of a regional regulation on mineral and coal mining is the authority of regional governments. In implementing their authority, they are required to apply Pancasila and embrace the 1945 Constitution of the Republic of Indonesia. Pancasila consisting of five precepts is a legal ideal that should be incarnated in the legal product of a regional regulation on mineral and coal mining. The incarnation of the legal ideal of Pancasila through the legal product of a regional regulation on mineral and coal mining will have the implication on mineral and coal mining management based on the legal ideal of Pancasila. Therefore, building the regional regulation on mineral and coal mining must be based on the normative-juridical aspect as the basis for the making of laws and the theoretical aspect based on the legal ideal of Pancasila.

Abstract

This study discusses Batak customary marriage focusing on the prohibition of same-clan marriage and the practice of same-clan marriage in Batak custom. The main problem studied is the prohibition of intermarriage in Batak society from a fiqh perspective in relation to modern times. This study used a qualitative approach, i.e., a humanistic approach that places humans in research as the main subject in social events. The study was a type of field research, which involves direct observation and examination of facts in the research site, taking the data as primary sources. The findings of this study reveal that the concept of marriage in Batak custom is exogamy, which prohibits marriages between people of the same clan. In Batak custom, people of the same clan are blood relatives or descendants from the father’s line. Batak people who violate this customary law will be subject to customary sanctions. In the current context, the decline in customary values has been influenced by urbanization and higher education, which prioritize modern thinking over traditional one. Education provides certain values for humans, e.g., opening people’s minds, accepting new ideas, and thinking scientifically. Education teaches humans to be able to think objectively, which will give them the ability to assess whether or not their community’s culture can meet the needs of the times. Further, from the perspective of fiqh munakahat, not all family ties are forbidden to marry. Only those related to the provisions of muabbad (permanent prohibition) and ghairul muaabad (temporary prohibition) are prohibited. People from the same clan who have no kinship relationship are still lawful to marry.

Abstract

Indonesia possesses a rich cultural heritage consisting of both tangible and intangible artifacts that continue to exist in the present day. This cultural heritage has significantly contributed to the advancement of human civilization, encompassing economic, social, and scientific dimensions. This study seeks to examine the state's involvement in safeguarding cultural assets in Bone Regency, located in South Sulawesi, Indonesia. The article employs an empirical research methodology that applies both the constitutional law and the Islamic law. Data were gathered by comprehensive interviews, direct observation, and the collection of relevant documents. The sources for the study included the tourism office, members of the People's Representative Council (DPR), as well as religious and community leaders. The investigated papers consisted of legal regulations, including laws, regulations, and relevant journal articles. The findings indicate that the government plays a crucial role in the protection of the cultural assets in Bone Regency. Within the realm of the constitutional law, the government has enacted Law No. 11 of 2010, which pertains to Cultural Heritage. Similarly, the Bone Regency government has also enacted Regional Regulation No. 7 of 2020, which concerns the Preservation and Management of Cultural Heritage. To enforce this protection, many cultural legacies have been designated, such as the burial grounds of the Bone monarchs and significant cultural and historical locations. Within the framework of the Islamic law, the preservation of cultural assets is considered advantageous. The advantages derived from cultural heritage include the reinforcement of national identity and character, historical education, the promotion of tourism attractions, and the provision of a religious lesson for present and future generations.

Abstract

This article is a conceptual study aimed at discussing and analyzing women's leadership from the perspective of Human Rights (HAM) and Maqashid Syariah, namely trying to find laws on women's leadership using a human rights approach and mashlahah theory by referring to texts and contexts. The first is referring to texts. The Qur'an and Hadith, while the second refers to the social reality that occurs in society with all the underlying rules. The text path is taken to bring out laws through what is written in the texts of the Qur'an and Hadith. Meanwhile, what is ghoiru nash is achieved by understanding what is not written in the text by looking at social reality or the democratic political tradition that developed in Indonesia, whose validity is tested by human rights law and mashlahah theory based on the objectives of Islamic law (protection of religion, soul, reason, heredity, and property) and the rules of fiqhiyah, which are based on the political culture of society. This study uses a literature review method, namely searching for valid data sources from library texts that are relevant to the problem topic being researched. The results of this study show that classical commentators tend to place leadership rights on the male side for two reasons: first, because men are considered to have absolute advantages over women, such as physical strength and intellectual intelligence. Second, because men (husbands) bear the economic burden or livelihood of their family members. Women's leadership in the public sphere is a matter that is changeable. Apart from the fact that there are no strong arguments indicating that it is prohibited for women to become leaders, there is also support from the political culture of society, especially in the political context in Indonesia, which adheres to a democratic political system that provides equal political rights between men and women. Men and women both have the right to vote and the right to be elected as political leaders, which is based on statutory regulations, both human rights law and election law. Abstrak Artikel ini merupakan kajian konseptual yang ditujukan untuk membahas dan menganalisis kepempinan perempuan dengan perpektif Hak Asasi Manusia (HAM) dan Maqashid Syariah, yakni berupaya menemukan hukum kepemimpinan perempuan dengan menggunakan pendekatan HAM dan teori mashlahah dengan mengacu pada teks dan konteks yang pertama mengacu teks atau nash Al-Qur’an dan Hadis, sedang yang kedua mengacu pada realitas sosial yang terjadi di masyarakat dengan segala aturan yang mendasarinya. Jalan nash ditempuh untuk memunculkan hukum-hukum melalui apa yang tertulis dalam teks Al-Qur’an dan Hadis. Sedangkan yang ghoiru nash ditempuh dengan cara memahami dari apa yang tidak tertulis dalam nash dengan memandang realitas sosial atau tradisi politik demokrasi yang berkembang di Indonesia yang diuji kesahihannya dengan undang-undang HAM dan teori mashlahah dengan berdasar pada tujuan hukum Islam (perlindungan agama, jiwa, akal, keturunan, dan harta benda) dan kaidah-kaidah fiqhiyah yang bertumpu pada budaya politik masyarakat. Kajian ini menggunakan metode kajian kepustakaan, yakni melakukan penelusuran sumber data yang valid dari teks-teks kepustakaan yang relevan dengan topik permasalahan yang sedang diteliti. Hasil kajian ini menunjukan bahwa para mufasir klasik cenderung meletakan hak kepemimpinan dari sisi jenis kelamin laki-laki karena dua hal: pertama, karena laki-laki dianggap memiliki kelebihan atas perempuan yang bersifat mutlak, seperti kekuatan fisik dan kecerdasan akal. Kedua, karena Laki-laki (suami) menanggung beban ekonomi atau nafkah atas anggota keluarganya. Kepemimpinan perempuan dalam ruang publik adalah perkara yang sifatnya mubah, selain karena tidak ada dalil kuat yang mengindikasikan larangan perempuan menjadi pemimpin, juga adanya dukungan budaya politik masyarakat khususnya dalam konteks politik di Indonesia yang menganut sistem politik demokrasi yang memberikan hak politik yang setara antara laki-laki dan perempuan baik hak untuk memilih maupun hak untuk dipilih sebagai pemimpin politik yang dididasarkan pada peraturan perundangan baik undang-undang HAM maupun undang-undang Pemilu.

Abstract

ABSTRACTThe COD (Cash on Delivery) can impact cash flow due to payment delays, especially for businesses with tight margins. In order to address the issue of business actors' legal protection when using COD as a payment mechanism in the marketplace, this paper seeks a solution. Research on laws and other relevant legal literature is done by the author as part of the normative juridical legal research approach used to write this publication. To make corporate operations more productive and efficient, Marketplace aims to reduce their unnecessary complexity. With the marketplace emerging, everyone may now purchase and sell goods and services with ease, at a low cost, and in a timely manner, as there are no restrictions on location, time, or distance.  There are numerous payment methods available in the marketplace, one of which is COD (Cash on Delivery), which allows customers to pay directly on the spot when they receive the things they ordered. However, in practice, the parties who transact in the Marketplace frequently suffer significant losses, necessitating the existence of legal protection for the parties that transact in the Marketplace, both consumers and business entities, in order to protect their rights.

Abstract

The principle of intergenerational justice and its relationship to the concept of sustainable development in environmental management is an endlessly discussed issue. Considering that the environment is one of the most crucial elements for the survival on Earth, this study constructs the principle of intergenerational justice as an effort towards sustainable development in environmental management, as stipulated in Law Number 32 of 2009 concerning Environmental Protection and Management. This study falls under the category of literature research, examining literature data from law books, journals, legislation, and other relevant references. The research findings indicate that the management and utilization of natural resources between generations should be carried out fairly, meaning that the present generation has an obligation to pass on the environment in a good condition to future generations. Therefore, environmental management and utilization must be based on moral and sustainability principles. The concept of sustainable development embodies the principles of intergenerational justice. In the practice of law enforcement, the principle of intergenerational justice has been implemented by the Philippine government, as exemplified by the Minor Oposa case in 1993, which involved deforestation. In Indonesia itself, the normative principles of intergenerational justice have been accommodated in various principles, as stated in Article 2 of Law Number 32 of 2009 concerning Environmental Protection and Management.

Abstract

This study discusses the Analysis of the Success of Human Development Based on the Regional Regulation of Bone Regency Number 11 of 2016 concerning Gender Mainstreaming in Regional Development. The main problem is how to analyze the success of gender-oriented human development based on Gender Mainstreaming (PUG) and how the Human Development Index (IPM) in Bone Regency is in regional development. What is the role of the implementation of PUG institutions in Bone Regency in resolving each gender gap? This study employs normative-empirical research methods, with qualitative research methods described descriptively and employing conceptual approaches, law, sociology of law, and comparative and legal psychology to examine legal aspects in social interactions within government and community, and serves as a support to identify and clarify the findings of non-legal materials for the purposes of research or legal writing.The results of the study show that the existence of a regional regulation that regulates PUG in regional development has proven to be able to solve gender problems and gaps, as seen from the increase in the percentage of the Gender Development Index (IPG) and the Gender Empowerment Index (IDG),  It is also able to contribute to the HDI growth rate in Bone Regency, although it has not been able to shift Bone Regency's HDI ranking from 23rd out of 24 Regencies in South Sulawesi, with PUG implementation starting from every Regency, subdistrict, and village. Keywords:  Awareness Gender , Development Region, Human Development

Abstract

This study aims to analyze the role of local government administration in strengthening and implementing the principles of the Pancasila Law State in Indonesia. The Pancasila Law State, as the ideological and legal foundation of Indonesia, requires all government activities to be based on law and Pancasila values. Through a normative juridical approach, this research examines how local governments, through their policies and actions, can play a key role in realizing the ideals of the Pancasila Law State. The findings indicate that despite a supportive legal framework, there are significant challenges in its implementation, including issues of corruption, nepotism, and bureaucratic inefficiency. Therefore, it is necessary to strengthen the capacity and integrity of local government officials and increase public participation to ensure the effective implementation of Pancasila principles. This study recommends strategic steps to enhance the role of local governments in this context, including improving transparency, accountability, and inter-agency coordination.

Abstract

Local traditions as religious practices in Indonesian society experience dialectic and integration of Islamic teachings. Every ethnicity in Indonesia has socio-cultural mechanisms in dealing with calamities and disasters which are influenced by religion and customs. This then dialectic with the practice of Islamic law. The study seeks to examine songkabala, a tradition of mutual acceptance in the Makassarese society. These traditions are local values that contain Al-Qur’anic teachings. This is an empirical legal study employing an anthropological perspective on Islamic law. In-depth interviews and literature reviews focused on three districts inhabited by Makassarese, namely Maros, Gowa, and Takalar, were employed to collect data. The study indicates that songkabala is the spirit of Al-Qur’anic verses associated to human responses to calamity, including remembrance of Allah, gratitude, and ritualized prayer. Songkabala is a Makassarese folk tradition that contains Al-Qur’anic themes. The verses of the Al-Qur’an indicate that the command to pray and the remembrance of Allah are incorporated into the songkabala ritual. Consequently, there is no incompatibility between the songkabala tradition and the teachings of the Al-Qur’an.

Abstract

The development of the relationship between constitutional law and human rights is fundamental in a rule of law state. Constitutional law is oriented towards regulating and simultaneously striving for the optimal protection of human rights. This research aims to examine the integration between constitutional law and human rights by conducting a comparative legal study between Indonesia and South Africa. This research is a normative legal study emphasizing historical, conceptual, legislative, and comparative legal approaches. The research findings indicate that the strengthening of human rights norms and the role of the Indonesian Constitutional Court have become crucial points, particularly the role and authority of the Indonesian Constitutional Court through its rulings aimed at protecting human rights. Similar developments also occurred in South Africa after the end of apartheid, with the establishment of the Constitutional Court and constitutional reforms as important steps in upholding the rule of law and human rights. The Constitutional Courts of Indonesia and South Africa both face issues such as weak implementation of rulings, political pressure, and slow legislative processes that accommodate the Constitutional Court's decisions. This research recommends that the integration of constitutional law and human rights should be optimized by strengthening the authority of the Constitutional Court, including the authority to ensure that Constitutional Court decisions are obeyed and implemented optimally to protect human rights.
