Abstract

Abstrak Lahirnya Undang-undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak memberi peneguhan terkait dengan perlindungan terhadap anak di Indonesia. Undang-undang inilah yang memperkenalkan konsep diversi yang bertujuan untuk memberikan perlindungan terhadap anak yang berkonflik dengan hukum, anak yang menjadi korban tindak pidana, dan masyarakat pada umumnya sebagai sebuah bentuk pengalihan penyelesaian perkara anak dari proses peradilan ke proses di luar peradilan pidana demi mewujudkan keadilan restoratif (restorative justice). Berdasarakan latar belakang tersebut, perumusan masalah dari penelitian ini adalah apakah faktor penyebab anak berkonflik dengan hukum di Kota Lhokseumawe dan bagaimana peran lembaga adat dalam Penerapan Restorative Justice Terhadap Anak Yang Berkonflik Dengan Hukum Di Kota Lhokseumawe. Teori yang digunakan dalam penelitian ini menggunakan teori relatif (deterrence), teori ini memandang pemidanaan bukan sebagai pembalasan atas kesalahan si pelaku, tetapi sebagai sarana mencapai tujuan bermanfaat untuk melindungi masyarakat menuju kesejahteraan. Dari teori ini muncul tujuan pemidanaan sebagai sarana pencegahan. Dan metode yang digunakan adalah metode penelitian empiris dengan pendekatakan kualitatif. Tujuan dari penelitian ini adalah untuk memberikan pengetahuan dan pemamaham tentang faktor penyebab anak berkonflik dengan hukum di Kota Lhokseumawe dan untuk memberikan pengetahuan tentang peran lembaga adat dalam Penerapan Restorative Justice Terhadap Anak Yang Berkonflik Dengan Hukum Di Kota Lhokseumawe

Abstract

The existence of Panglima Laot in Aceh apart from being a social leader of the customary community legal alliance, is also an Alternative Dispute Resolution (APS) institution. The juridical basis of its position is contained in Law No. 11 of 2006 concerning the Government of Aceh, its implementing regulations are in the form of Aceh Qanuns such as Aceh Qanun No. 9 of 2008 concerning the Guidance of Customary Life and Customs, and Aceh Qanun No. 10 of 2008 concerning Customary Institutions . Based on the description on the background above, in this legal research it can be formulated how the position of Panglima Laot as a marine dispute resolution institution in the legal system in Indonesia and whether Panglima Laot is optimal as an institution in maritime dispute resolution in Lhokseumawe City . This research is an empirical legal research with a qualitative approach that uses primary data and secondary data. In obtaining primary data, respondents and informants were determined. The new positive law will have an effective force if it contains, or is in harmony with the laws that live in society. The focal point of legal development is not in laws, judge decisions, or legal science, but in society itself.

Abstract

The crime of corruption is a special offense which is regulated separately in the criminal law book. In the process of handling corruption cases, the principle of priority or precedence in the settlement process applies. This is in accordance with Article 25 of Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, which states that investigations, prosecutions, examinations in court in corruption cases take precedence over other cases for prompt settlement. This study aims to determine the application of material criminal law to the crime of livestock budget corruption in the case of decision Number 1/Pid.Pra/2019.Pn.Lsm, and to find out how the judge's considerations in making a decision on the crime of corruption in the livestock budget in decision Number 1/ Pid.Pre/2019.Pn.Lsm. This study uses a descriptive normative legal research method. Sources of primary and secondary legal materials, data collection techniques are library research, while the analysis of legal materials used in this study is qualitative analysis. Based on the results of the study, it is known that the application of material criminal law to perpetrators of corruption in the livestock budget in the case of decision number 1/Pid.Pra/2019.Pn.Lsm is that in its development, pretrial arrangements are regulated in Article 1 number 10 Jo. Article 77 of the Criminal Procedure Code, there is often treatment of law enforcement officials who are not really serious in reaching the material truth so that the person concerned does not get real legal protection from the state. For that obtain real legal protection from the state. For this reason, such developments can be accommodated through whether or not the determination of suspects is legal and whether the seizure is legal or not, it has been recognized as being the area of pretrial authority, so as to minimize arbitrary treatment by law enforcement officers. It is recommended that law enforcement officers, whether prosecutors, lawyers and judges, must have good knowledge of legal science, especially regarding the criminal law of corruption. If his actions are based on the proper application of criminal law from law enforcement, a sense of justice can be felt for all people.

Abstract

The condition of the Covid-19 pandemic requires the country to focus more on the protection of citizens, especially regarding the use of social assistance. Meanwhile, supervision of the distribution of social assistance funds is very important to be improved in order to avoid various practices of irregularities that open loopholes for corruption. The research used in this research is juridical empirical. The results of research related to the supervision of social assistance carried out by the police and the prosecutor's office in this supervision continue to conduct monitoring/monitoring as a form of prevention. Legal counseling and information were carried out in terms of the use of Covid-19 funds as well as the right targeted social assistance distribution mechanism. The next step is to continuously coordinate between stakeholders. The next step is to continuously coordinate between stakeholders. The implication of this research is that cooperation, coordination and harmonization between the central government, regional governments and private institutions are needed to be right on target, effective and efficient and supported by a good, integrated, transparent and accountable system in the distribution of social assistance. There has not been an accurate record of recipients of social assistance, so the monitoring process by both the National Police and the Attorney General's Office is not running optimally. Furthermore, there is still a lack of local government transparency regarding social assistance.

Abstract

This study aims to evaluate the human rights implications of the whipping punishment for adultery cases in Lhokseumawe City, Indonesia. The research methods used in this research are empirical. Data was collected through a combination of fieldwork and libraries. The data were analyzed in a qualitative manner. The result of the study shows that the administration of the whipping punishment for adultery offenders does not violate human rights because it has been founded on Islamic law, specifically the Qur'an and Hadith in Aceh, and has taken into account the safety of whipping convicts. The whipping is considered a violation of human rights if used on innocent individuals. Whipping punishment is carried out in Aceh against convicts after obtaining approval from the Syari'ah Court, and the whipping punishment is conducted based on a court decision ordered with permanent legal effect. It is recommended that the Lhokseumawe Municipality Institution and the authorities strengthen and strictly enforce whipping restrictions so that whipping is produced in accordance with the principles of Islamic Shari'ah. Residents of Lhokseumawe should be more supportive and comply with the established regulations.

Abstract

Tulisan ini mengkaji dan menganalisis Kasus direksi perusahaan yang diduga melakukan tindak pidana penggelapan yang dilakukan terdakwa selaku Direktur yang bertugas di PT. BMS dengan sektor bisnis Hotel BCC. Kasus ini terdapat dalam Putusan Mahkamah Agung R.I. No. 567K/PID/2016. Permasalahannya: 1) Regulasi pengelolaan perusahaan terhadap pemegang saham berdasarkan Undang-Undang No. 40 tahun 2007 tentang Perseroan Terbatas; dan 2) Tanggung jawab pidana atas "Tindak Pidana Penggelapan dalam Jabatan" di perusahaan. Menggunakan metode penelitian hukum normatif, bersifat deskriptif. Sumber bahan hukum diperoleh dari Pengadilan Negeri Batam. Dengan analisis kualitatif, didapat hasil penelitian: Pertama, berdasarkan Undang-Undang Perseroan Terbatas, pengurus perusahaan bertanggungjawab atas pengelolaan perusahaan dalam forum tertinggi perusahaan, yaitu RUPS. Dalam RUPS, direksi dan komisaris sebagai pengelola dan pengawas bertanggungjawab atas semua laporan kegiatan dan laporan keuangan yang muncul dalam pengelolaan dan pengawasan perusahaan. Pemerintah Republik Indonesia, sebaiknya merevisi Undang-Undang Perseroan Terbatas dengan memasukkan upaya hukum terhadap para direktur perusahaan dan/atau dewan komisaris yang tidak melaksanakan pengelolaan dan pengawasan perusahaan berdasarkan prinsip kewajiban fidusia; dan Kedua, tanggungjawab pidana terhadap Tindak Pidana Penggelapan dalam Jabatan di perusahaan terkait dengan kepercayaan (fidusia) yang diberikan para pemegang saham kepada para direktur, sehingga para direktur harus melaksanakan kepercayaan tersebut dengan sangat hati-hati (cermat), penuh tanggung jawab (bertanggung jawab), dan itikad baik. Direkomendasikan kepada Dewan Direksi Hotel BCC, sebaiknya melakukan pengelolaan dan pengawasan perusahaan dengan menerapkan prinsip kewajiban fidusia yang diawasi oleh Dewan Komisaris.

Abstract

This research aims to examine the effectiveness of Panglima Laot's institution authority in the maritim area to resolve sea disputes and to find an ideal dispute resolution model to be used. This research uses qualitative method by sociological juridical approach in the form of descriptive analytical. The Panglima laot's authority in an effort to assist the government in resolving maritime disputes is a formal authority granted by a law which is attributively regulated in Article 28 of Qanun Aceh Number 10 of 2008 concerning Customary Institutions. However, when dealing with certain cases between fishermen where the regulation is not very clear in the Qanun, Panglima Laot seeks to resolve cases by using traditional approaches, religious values, propriety, a sense of justice and human conscience. Therefore, Panglima Laot needs detailed and written instructions for carrying out tasks in the form of Government Regulations or Qanuns. Including dealing with refugees who come from abroad.
