Abstract

Pancasila saat ini memiliki banyak tantangan yang dapat mereduksi hingga menihilkan eksistensi pancasila sebagai dasar dan falsafah negara. Berbagai tantangan yang sedang dan pernah dihadapi oleh pancasila antara lain peristiwa G30/S PKI, pemberontakan DI/TII, serta paham liberalisme. Disisi lain, yang sering luput dalam pembahasan kajian pancasila ialah dalam ranah filsafat, khususnya filsafat postmodernisme. Pada dasarnya filsafat ini mengkritik meta narasi atau grand narrative dan kebenaran absolut. Postmodernisme berkeyakinan jika tidak ada keabsolutan dalam semua realitas yang ada, ringkasnya mereka menganut paham perspektivisme dan relativisme yang menganggap jika semua hal itu bisa didekonstruksi (dirubah, dirombak, dan dibantah). Jika kita meruntut dari penjelasan mengenai pancasila dan postmodernisme diatas, maka dapat dikatakan jika pancasila sebagai ideologi negara, sebagai grundnorm, dan sebagai staats fundamentele norm bisa dirubah atau didekonstruksi dengan menggunakan epistemologi, aksiologi, dan ontologi dari postmodernisme khususnya dekonstruksi yang dicetuskan oleh Jacques Derrida. Pada karya ilmiah ini, penulis menggunakan studi literatur yang bertujuan untuk meninjau secara holistik dan komprehensif mengenai pancasila dan postmodernisme serta sebagai pencarian jawaban apakah pancasila sebagai dasar negara dapat dirubah atau didekonstruksi sesuai dengan filsafat postmodernisme.

Abstract

The narrative about the establishment of Law No. 11 of 2020 has been realized through the ratification of The Job Creation Act on November 2, 2020 by President Jokowidodo. The establishment of The Job Creation Act aims to harmonize legislation that has been considered to hinder the investment and development climate. The number of related legislation causes hipper-regulation regulations so it may be ineffective. The existence of The Job Creation Act combines several instruments of law. One of them is the Law of Environmental Protection and Management (UUPPLH) which was originally regulated in Law No.32 of 2009. As for the substance of environmental issues in The Job Creation Act, some of them have been changed, revoked, and replaced with a new provisions, including provisions on the concept of responsibility in environmental law which known as strict liability. The author takes the description of the case of Lapindo Mud which is the case has not been completed until now as an example of the validity of strict liability principles for businesses whose activities cause environmental damage. This research is a normative juridical research with a statue and case approach. The data used is secondary data. The results showed that the concept of strict liability in The Job of Creation Act experienced a dis-orientation of meaning due to the removal of the phrase "without proof of the element of error". Under The Job of Creation Act, in the case of Lapindo Mud, the party subject to have strict liability is Lapindo Brantas Inc. and the government in this case are also responsible for the disaster, but do not assume to the strict liability.

Abstract

Strict liability is absolute responsibility imposed on perpetrators of environmental violations that result in losses to both the environment and the community around the environment. The research used in this paper is juridical normative and uses a statutory approach, a conceptual approach, and a case approach. The development of strict liability in positive law in Indonesia has experienced development and refinement over time, indicated by the application made in several cases concerning environmental violations by several irresponsible parties. Basically, the implementation of strict liability really helps the aggrieved parties, especially the common people, in enforcing environmental laws in Indonesia.

Abstract

In carrying out environmental protection and management in the context of environmentally sustainable development, it is necessary to pay attention to the level of public awareness and global environmental developments, as well as international legal instruments related to the environment. People's awareness and life towards environmental protection and management has grown to the point where it is necessary to improve ways to achieve sustainable development goals from an environmental perspective. The regulations stipulated in Law no. 32 of 2009 concerning Environmental Protection and Management, especially in Chapter VII, states that hazardous and toxic materials and hazardous and toxic waste must be managed to minimize the waste treatment system, which poses a small risk to the environment, human survival and other organisms. By realizing this, hazardous and toxic materials and their waste need to be protected and managed properly.

Abstract

Free Trade Zone area has its own rules in tax collection, including the delivery of taxable service. However, in the implementation of the policy in tax collection, there are still errors that cause conflicts between taxpayers and tax authorities. For example, such as the article in the Regulation of the Minister of Finance Number PMK-62/PMK.03.2012 which gives rise to multiple interpretations for taxpayers. The author will describe the implementation of correct policies in taxable service conflicts in the free trade zone using empirical juridical and normative juridical research methods. In the law there is the principle of lex posterior derogat legi priori which means that the new law (norm/legal rule) nullifies the validity of the old law (norm/rule of law). In addition, the use of the principle of legal fiction which assumes that when a statutory regulation has been promulgated, at that time everyone is considered to know (presumption iures de iure) and the provisions are binding. Thus, the taxpayer should be aware of the latest regulations regarding tax collections that he must pay. In this case, taxpayers can use the latest regulation, Regulation of the Minister of Finance PMK Number 171/PMK.03/2017.

Abstract

On October 5, 2020, the Indonesian government passed the Omnimbus Law which contained various kinds of legislation. Including the environment which is also regulated in the Omnimbus Law. On the one hand, this regulation provides hope for Indonesia's economic growth. However, on the other hand, this regulation has the potential to damage the environment and is not in line with the Indonesian Government's commitment to reduce greenhouse gas (GHG) emissions, which in it weakens instruments for environmental protection and management. Weakening of environmental instruments has the potential to increase greenhouse gas emissions through high-carbon activities and investment in fossil energy. Therefore, this paper will critically analyze how the weakening of environmental instruments in the Omnimbus Law and the Revision of the Minerba Law hampers the fulfillment of Indonesia's greenhouse gas emission reduction targets in the era of restoring national economic stability.

Abstract

Doctor and patient are a legal relationship in a business engagement (inspanning verbintenis) and not a result bond (resultaat verbintenis). Even so, doctors are still responsible for any negligence that brings harm to patients. Until now, there is still confusion in Indonesia, whether medical liability is based on default or unlawful acts, even though as an inspiring verbintenis the basis for a suit that is more appropriate to use is an act against the law. This research was conducted by comparing the law with the statute approach, the conceptual approach and the case approach. Analysis of absolute responsibility cases in Indonesia is very necessary in order to provide justice for the community, especially in health law.

Abstract

Environmental issues have been increasingly recognized as significant challenges facing Indonesia, as a developing country with a rapidly growing population and a rapidly expanding economy. In recent years, environmental degradation and natural resource depletion have become more acute, resulting in increased pressure on the government to take stronger action to protect the environment. Despite the existence of environmental laws in Indonesia, environmental degradation continues to occur, highlighting the need for better enforcement and stronger legal protections. One of the major environmental problems in Indonesia is deforestation, which is driven by the expansion of agricultural land, mining activities, and logging. This has resulted in significant habitat loss and biodiversity decline, as well as increased greenhouse gas emissions from the loss of forest cover. Additionally, Indonesia’s coastline and marine ecosystems are threatened by pollution from industrial activities and plastic waste, which has adverse effects on marine life and human health. Environmental laws in Indonesia include a range of regulatory measures, such as the Environmental Impact Assessment (EIA) and Forest Law Enforcement, Governance and Trade (FLEGT) programs. However, the implementation of these laws is often inadequate, with weak enforcement and a lack of effective penalties for non-compliance. Moreover, corruption and lack of political will have been identified as key factors that hinder the effective implementation of environmental laws in Indonesia.

Abstract

Indonesia is still heavily dependent on fossil fuels, particularly coal and petroleum. With declining oil reserves, Indonesia is faced with an energy shortage by 2046, prompting the need for alternative solutions. However, suboptimal regulations can be an obstacle to the maximum utilization of renewable energy potential. Renewable energy is considered vital not only as an alternative to fossil energy but also as a strategic measure to maintain long-term energy supply security. Although Indonesia has large renewable energy potential, such as geothermal, wind, and solar, its utilization is still limited and not optimal. Regulations, including Presidential Regulation No. 112 of 2022, reflects the government's commitment to expand the use of renewable energy. This research uses a normative legal research method with a literature study approach. Secondary data used includes primary legal materials, secondary legal materials, and non-legal materials. Data analysis is carried out qualitatively and presented descriptively. In the discussion, the article discusses the potential of renewable energy in Indonesia, involving resources such as water, solar, wind, geothermal, and bioenergy. Regulations related to renewable energy in Indonesia are explained, including Government Regulation No. 79/2014 on National Energy Policy. There is a strong commitment from various parties, such as Commission VII of the House of Representatives, to support the development of renewable energy. The important role of regulations and policies in supporting the development of renewable energy in Indonesia. This energy transition is key to protecting natural resources, improving general welfare, and educating the nation's life, according to the objectives of the State of Indonesia as stated in the Preamble of the 1945 Constitution.
