Abstract

Environmental issues have been increasingly recognized as significant challenges facing Indonesia, as a developing country with a rapidly growing population and a rapidly expanding economy. In recent years, environmental degradation and natural resource depletion have become more acute, resulting in increased pressure on the government to take stronger action to protect the environment. Despite the existence of environmental laws in Indonesia, environmental degradation continues to occur, highlighting the need for better enforcement and stronger legal protections. One of the major environmental problems in Indonesia is deforestation, which is driven by the expansion of agricultural land, mining activities, and logging. This has resulted in significant habitat loss and biodiversity decline, as well as increased greenhouse gas emissions from the loss of forest cover. Additionally, Indonesia’s coastline and marine ecosystems are threatened by pollution from industrial activities and plastic waste, which has adverse effects on marine life and human health. Environmental laws in Indonesia include a range of regulatory measures, such as the Environmental Impact Assessment (EIA) and Forest Law Enforcement, Governance and Trade (FLEGT) programs. However, the implementation of these laws is often inadequate, with weak enforcement and a lack of effective penalties for non-compliance. Moreover, corruption and lack of political will have been identified as key factors that hinder the effective implementation of environmental laws in Indonesia.

Abstract

Indonesia is one of the world's megabiodiversity countries, with a high level of biodiversity, including various endemic plant species that play a crucial role in ecosystems. However, uncontrolled mining exploration poses a serious threat to biodiversity conservation, particularly for plant species that lack legal protection. Exploration activities can lead to habitat degradation, landscape changes, and disruption of pre-mining ecosystems. Normatively, Indonesian regulations govern environmental protection in the mining sector, yet they do not explicitly require holders of Exploration Mining Business Licenses (IUP Exploration) to conduct conservation efforts for affected plant species. Consequently, there is no adequate mitigation mechanism at the exploration stage. This study employs a normative juridical method with a literature study approach to analyze existing regulations and identify legal gaps related to plant conservation in pre-mining areas. The findings indicate the need for more comprehensive policies, including the implementation of ex-situ conservation and vegetation mapping prior to exploration. Strengthening regulations and strict supervision are strategic steps to maintain ecosystem balance and support sustainable mining practices.

Abstract

This study examines the legal implications of Minister of Health Regulation Number 3 of 2025 in relation to the principles of legal certainty and the hierarchy of laws and regulations in Indonesia. The analysis focuses on provisions regulating professional disciplinary violations, particularly Article 4 paragraph (2), which grants the Minister of Health broad discretion to determine or add categories of disciplinary violations without clear limitations or explicit delegation from higher legal instruments, namely Law Number 17 of 2023 on Health and Government Regulation Number 28 of 2024. Such regulatory construction indicates an exercise of authority that exceeds delegated technical–operational functions and introduces new substantive norms, thereby constituting an ultra vires act within the framework of authority theory and normative hierarchy. Drawing on Hans Kelsen’s theory of the hierarchy of norms, the study argues that the validity of ministerial regulations depends on their conformity with higher norms. Moreover, from Gustav Radbruch’s perspective on legal certainty, norms that confer unlimited authority create ambiguity and unpredictability for medical professionals as subjects of law, undermining the law’s function as a clear and reliable guideline. The study concludes that regulatory provisions exceeding delegated authority pose serious risks to legal certainty and the coherence of the legal system, and therefore require revision to restore normative consistency and protect professional discipline within a rule-of-law framework.

Abstract

Indonesia is still heavily dependent on fossil fuels, particularly coal and petroleum. With declining oil reserves, Indonesia is faced with an energy shortage by 2046, prompting the need for alternative solutions. However, suboptimal regulations can be an obstacle to the maximum utilization of renewable energy potential. Renewable energy is considered vital not only as an alternative to fossil energy but also as a strategic measure to maintain long-term energy supply security. Although Indonesia has large renewable energy potential, such as geothermal, wind, and solar, its utilization is still limited and not optimal. Regulations, including Presidential Regulation No. 112 of 2022, reflects the government's commitment to expand the use of renewable energy. This research uses a normative legal research method with a literature study approach. Secondary data used includes primary legal materials, secondary legal materials, and non-legal materials. Data analysis is carried out qualitatively and presented descriptively. In the discussion, the article discusses the potential of renewable energy in Indonesia, involving resources such as water, solar, wind, geothermal, and bioenergy. Regulations related to renewable energy in Indonesia are explained, including Government Regulation No. 79/2014 on National Energy Policy. There is a strong commitment from various parties, such as Commission VII of the House of Representatives, to support the development of renewable energy. The important role of regulations and policies in supporting the development of renewable energy in Indonesia. This energy transition is key to protecting natural resources, improving general welfare, and educating the nation's life, according to the objectives of the State of Indonesia as stated in the Preamble of the 1945 Constitution.

Abstract

The acceleration of the Battery Electric Vehicle (BEV) program constitutes an integral part of Indonesia’s national strategy to reduce greenhouse gas emissions and to support the transition toward cleaner and more sustainable energy. Although regulated under Presidential Regulation No. 55 of 2019 and its implementing regulations, the existing legal framework governing BEVs remains sectoral in nature and has not been able to adequately address the complex environmental and economic challenges that arise, particularly those related to nickel mining as the primary raw material for batteries, the management of end-of-life battery waste, and the dependence of charging infrastructure on fossil-based energy sources. This article aims to analyze the urgency of establishing a specific law on BEVs as a comprehensive and integrated regulatory framework. This study employs normative legal research using statutory and conceptual approaches. The findings indicate that the absence of a specific law on BEVs may lead to legal uncertainty, increased environmental risks, and suboptimal achievement of national energy transition targets. Therefore, the establishment of a specific law governing BEVs is an urgent necessity to ensure legal certainty, environmental protection, and the sustainability of green economic development in Indonesia.

Abstract

Pembangunan Underpass Simpang Joglo di Kota Surakarta ditujukan untuk meningkatkan kelancaran lalu lintas perkotaan, namun dalam pelaksanaannya menimbulkan dampak lingkungan berupa gangguan sistem drainase, banjir lokal, penurunan kualitas lingkungan permukiman, serta ketimpangan beban ekologis bagi masyarakat sekitar. Permasalahan penelitian ini adalah bagaimana dampak lingkungan pembangunan underpass tersebut ditinjau dari Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup serta asas keadilan ekologis, dan bagaimana upaya penyelesaiannya pasca pembangunan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa pembangunan Underpass Simpang Joglo belum sepenuhnya menerapkan asas pencegahan dan keadilan ekologis secara optimal. Oleh karena itu, diperlukan penguatan pengawasan, evaluasi pasca konstruksi, serta pemulihan lingkungan guna menjamin keberlanjutan infrastruktur dan perlindungan hak masyarakat atas lingkungan hidup yang baik dan sehat.
