Abstract

Bangun rancang peraturan perundang-undangan yang ideal adalah salah satu senjata utama mencapai pembangunan nasional. Harmonisasi dan koordinasi yang baik merupakan basis utama dalam mewujudkan regulasi yang ideal. Proses pembentukan rancangan peraturan daerah saat ini perlu diselesaikan secara efektif dan efisien. Hal ini tentu ditekankan karena selama ini proses terbentuknya rancangan peraturan daerah masih terhambat oleh koordinasi antar birokrasi dimana pengusul rancangan peraturan daerah harus mendapat pengawasan dan evaluasi oleh Gubernur dan Menteri Hukum HAM sesuai dengan perintah undang-undang. Namun proses hasil evaluasi dan rekomendasi antara dua institusi tersebut berpotensi membingungkan pihak pengusul rancangan peraturan daerah karena rekomendasi perbaikan antara dua institusi tersebut tidak terkoordinasi dengan baik. Penelitian ini menggunakan Jenis penelitian yuridis empiris (empiric legal research).

Abstract

The Constitution guarantees the right for services, so that the government  is obliged to provide protection guarantee and legal certainty to each citizen in the government and public services. Ironically, the right for services is often taken away by the egoism of the state elites and the fading professionality among the government apparatus as the providers of services. Therefore, it is interesting to study a proper design of legal protection to the license service recipients based on one-stop    participatory licensing service standard  after the enactment of the Law on Job Creation. This study employed a juridical normative approach. The results showed that the legal protection to the citizens in providing the licenses is still covered by cost uncertainty, service time, and low satisfaction among the citizens to the licensing service. As  a result, it needs a strategy to strengthen the fulfillment of right for services by encouraging changes regulations into  responsive and progressive ones with  transparency  and professionality of service and accompanied by  cultural formation among the service apparatus ending in the legal protection to the licensing service recipients so that one-stop  participatory service standard may be attained

Abstract

AbstractRegulations as products of a political  process and institution are  often contradicted with public aspirations and interests and potentially break the human right laws, therefore an open door to conduct a judicial review should be created.   The objective of this present study is to describe legal problematic matters arising  as the implication of  the adoption of a dualism testing of regulation in the constitutional system  of the Republic of Indonesia and to find an alternative model design of testing the regulations integratively under the authority of the Constitution Court of the Republic of Indonesia. The research results showed that  in the constitutional system of the Republic of Indonesia, injustice,  unuseefulnes, and uncertainty of law happened. To minimalize the condition, it is necessary to integrate the authority of the regulation under the hand of the Constitution Court through a further ammendment of the 1945 Constitution. However it is still necessary to have a demarcation line through the authority of the Constitution Court in interpreting the Constitution, since it may potentially result in the power abuse. It is indicated by some ultra petita decisions made by the Constitution Court that may potentially cause some new disorders in the political and juridical domains. Independence and accountability of juridical power should go hand in hand. Recruitment and supervision of Constitution Judges should involve the Judicial Commission.Abstrak Peraturan perundang-undangan sebagai produk dari proses sekaligus institusi politik seringkali berseberangan dengan aspirasi dan kepentingan publik, serta berpotensi menabrak norma HAM, sehingga harus terbuka ‘pintu’ untuk dilakukan judicial review. Penelitian dalam artikel ini bertujuan untuk  mendiskripsikan problematika hukum yang timbul sebagai implikasi dari dianutnya dualisme pengujian peraturan perundang-undangan dalam sistem ketatanegaraan Republik Indonesia dan; menemukan desain alternatif model pengujian peraturan perundang-undangan secara integratif di bawah Kewenangan Mahkamah Konstitusi Republik Indonesia. Hasil penelitian menunjukkan in ketatanegaraan Republik Indonesia terbukti menimbulkan ketidakadilan, ketidakmanfaatan, dan ketidakpastian hukum. Untuk meminimalisir kondisi tersebut, diperlukan pengintegrasian kewenangan pengujian peraturan perundang-undangan di bawah Mahkamah Konstitusi melalui perubahan lanjutan UUD 1945.  Namun demikian tetap diperlukan adanya garis demarkasi terhadap kewenangan MK dalam menafsirkan konstitusi, karena berpotensi menciptakan penyelewengan kekuasaan. Hal ini diindikasikan oleh beberapa putusan MK yang ultra petita berpotensi menimbulkan kekacauan baru dalam ranah politis dan yuridis. Independensi dan akuntabilitas kekuasaan kehakiman harus berjalan seiring. Rekruitmen dan pengawasan hakim konstitusi perlu melibatkan Komisi Yudisial.

Abstract

The Job Creation Law has a major influence with the issuance of Government Regulation No. 64 of 2021 on the Land Bank Agency. Through the Perpres, it is hoped that it can create arrangements and management of state land assets, especially abandoned land, so that it can be utilized for the prosperity of the people. Based on this description, this study aims to determine and analyze the regulation and management of state land assets before the existence of Government Regulation Number 64 of 2021 concerning the Land Bank Agency, to determine and analyze the factors that become obstacles in the regulation and management of state land assets so that a Land Bank Agency is needed. and to know and analyze the legal construction of the regulation and management of the Land Bank Agency in the future. The type of research used is normative juridical research using a statutory approach and concept approach. The research results obtained are: First, the regulation and management of state land assets before the Perpres of the Land Bank Agency was carried out by BPN. Second, the regulation and management of state land assets before the existence of Government Regulation Number 64 of 2021 concerning the Land Bank Agency, the management is still carried out by the National Land Agency (BPN), and the legal construction of the regulation and management of state land assets in the future is a way to fill the void of land bank regulations through principles and values in society.
