Abstract

   General election or what is often abbreviated as Election is the process of selecting people to fill certain political positions. These positions are varied, ranging from president, people's representatives at various levels of government, to village heads. At the local level, the means of implementing democracy are called regional head elections or pilkada. Beginner Voters are the basis of voters who use their rights for the first time in the 2020 simultaneous elections. In this community service, the aim is to provide socialization to Wisnuwardhana Malang High School students about the 2020 Beginner Voters "Pilkada in the Middle of the Covid-19 Pandemic". The method used in this study is an empirical legal research method, namely by looking for data obtained directly from the community as the first source through field research, which is carried out either through observation (observation), interviews, or distributing questionnaires in SMA-SMK Wisnuwardhana Malang. The participants of this socialization were 26 students. The result of this community service is that there is a socialization of local election novice voters in the midst of the Covid-19 pandemic which was carried out at the Wisnuwardhana High Schools. . While the level of achievement in this program is 90%.

Abstract

Pancasila as an Open Ideology carries the meaning that it is capable of adapting to the changing times. The fundamental values of Pancasila, which are inherent in the Pancasila ideology, must be firmly held and cannot be altered. The openness pertains to the implementation's elaboration, which can be adjusted to the needs and real challenges faced by the Indonesian nation in each period. This study aims to understand the development of the Pancasila ideology in the era of globalization. The method used in this research is normative juridical research. The results of the study show that globalization cannot be avoided, but the Indonesian nation must take action, establish a determination to build independence with the spirit of modernization in the global era, while still adhering firmly to the Pancasila ideology.

Abstract

The amendments to the 1945 Constitution have brought about quite basic changes to the general election system and regional heag elections in Indonesia. Reform is a democratic step that was born in Indonesia. The law has regulated general election of general elections and regional head regulation of general elections and regional head elections, there are still many obstacles. For this reason, the writer formulates the problem as follows: How are the Effective Regulations for General Elections and Regional Head Elections after the Amendment to the 1945 Constitution?. The method that bases its analysis on legislation with a historitical approach. The conclusion of this study is that in the general election there is a change in statutory arrangements in general it can be said that the general election is actually centered on the “sovereignty of the people’’ as the legal owner of power in democracy. While in the regional head election, one of the changes is related to filling the position of regional head as regulated in Article 18 paragraph (4) of the 1945 Constitution of the Republic of Indonesia which states that the Governor, Regent dan city governments  are elected. Democratically which menas that elections are carried out directly by the people and representatives. Both the general election and regional head elections will run effectively if the are carried out on the principles of being direct, general, free, confidential, honest and fair. If this principle is implemented properly, the Indonesian state will become a democratic legal state

Abstract

Upaya Pemerintah dalam melakukan pemindahan Ibu Kota Negara dari Jakarta ke Kalimantan Timur diwujudkan dalam Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara, sehingga menimbulkan polemik di masyarakat, ada yang Pro dan ada yang Kontra. Tujuan Pemerintah melakukan pemindahan Ibu Kota Negara adalah dalam rangka percepatan pembangunan yang lebih baik. Pada era pemerintahan Presiden Soekarno wacana pemindahan Ibu Kota Negara sudah ada sampai saat ini kembali ditegaskan oleh Presiden Jokowi. Presiden menyampaikan pemindahan Ibu Kota Negara dari Provinsi DKI Jakarta ke Provinsi Kalimantan Timur pada tanggal 26 Agustus 2019. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Penelitian hukum normatif mempunyai makna suatu penelitian hukum yang dikonsepsikan sebagai apa yang ditulis dalam peraturan perundang-undangan atau konsepsi dari kaidah atau norma yang menjadi patokan dalam berperilaku di masyarakat terhadap apa yang seharusnya dilakukan. Sedangkan pendekatan yang digunakan adalah pendekatan perundang-undangan (statute approach), dengan mengkaji Undang-Undang No. 3 Tahun 2022 tentang Ibu Kota Negara. Hasil Penelitian Ini menunjukkan bahwa Pemindahan Ibu Kota Negara ke Kalimantan Timur membutuhkan upaya yang sangat besar dari pemerintah dalam mewujudkannya, dan pasti akan berpengaruh pada lembaga-lembaga negara, kantor lembaga negara ini pastinya ikut berpindah pada Ibu Kota Negara baru. Diundangkannya UU IKN dinilai cacat formil sebab tidak melibatkan partisipasi masyarakat sebagaimana yang dimuat dalam Pasal 27 ayat (1) dan Pasal 28C ayat (2) UUD Tahun 1945 sehingga dinilai tidak menghiraukan prinsip kedaulatan rakyat. The Government’s efforts to move the National Capital from Jakarta to East Kalimantan are manifested in Law Number 3 of 2022 concerning the National Capital, which has caused polemics in society, some are Pro and some are Con. The Government’s goal in moving the National Capital is to accelerate better development. During the era of President Soekarno’s administration, the discourse on moving the National Capital has existed until now, it has been reaffirmed by President Jokowi. The President conveyed the transfer of the National Capital from DKI Jakarta Province to East Kalimantan Province on August 26, 2019. The method used in this study is normative legal research. Normative legal research has the meaning of legal research that is conceptualized as what is written in laws and regulations or the conception of rules or norms that are the benchmark for behaving in society regarding what should be done. While the approach used is the statute approach, by examining Law No. 3 of 2022 concerning the National Capital. The results of this study show that the relocation of the National Capital to East Kalimantan requires a great deal of effort from the government to realize it, and will certainly affect state institutions, the offices of these state institutions will certainly move to the new National Capital. The enactment of the IKN Law is considered formally flawed because it does not involve public participation as stated in Article 27 paragraph (1) and Article 28C paragraph (2) of the 1945 Constitution, so it is considered to ignore the principle of people’s sovereignty.

Abstract

The Ratu Nahrasiyah Women's Farmers Group (KWT) was recently founded with a simple organizational structure due to a lack of insight into the law in organizing. This is an obstacle in the continuity of the organization at KWT. One of the programs that is a priority for KWT is the use of KWT members' home land by cultivating vegetables in the context of food security at the household level. The obstacle faced by most KWT members is that the vegetable plants they cultivate cannot grow optimally. The solution offered is to improve the skills of KWT members in crop production in home gardens and provide assistance regarding the law and legality of an organization to strengthen the knowledge and insight of KWT members in running the organization. The implementation method is through training, mentoring and practice for KWT members. Training and assistance in plant production by creating vegetable cultivation demonstration plots. Training and assistance in managing organizations as well as understanding the basics of organizational law. The results obtained from training in vegetable cultivation techniques for KWT members are an increase in the knowledge and skills of KWT members in vegetable production. Most of the harvest is sold within the KWT member area, so that the turnaround of small-scale businesses has been successfully implemented. The result of training and assistance in organizational governance is that KWT administrators and members are able to prepare basic budgets/household budgets. Increasing the active role of KWT members in organizations is important for the sustainability of the existence of an organization.ABSTRAKKelompok Wanita Tani (KWT) Ratu Nahrasiyah belum lama didirikan dengan struktur organisasi yang sederhana karena minimnya wawasan tentang hukum dalam berorganisasi. Hal ini menjadi kendala dalam kelangsungan organisasi di KWT. Salah satu program yang menjadi prioritas KWT adalah pemanfaatan lahan rumah para anggota KWT dengan budidaya sayuran dalam rangka ketahanan pangan di tingkat rumah tangga. Kendala yang dihadapi sebagian besar anggota KWT adalah tanaman sayuran yang dibudidayakan tidak dapat tumbuh optimal. Solusi yang ditawarkan yaitu meningkatkan skill anggota KWT dalam produksi tanaman di lahan pekarangan dan memberikan pendampingan tentang hukum dan legalitas suatu organisasi untuk memperkuat pengetahuan dan wawasan anggota KWT dalam menjalankan organisasi. Metode pelaksanaan melalui pelatihan, pendampingan, dan praktek kepada anggota KWT. Pelatihan dan pendampingan produksi tanaman dengan pembuatan demoplot budidaya sayuran. Pelatihan dan pendampingann mengelola organisasi serta pemahaman dasar-dasar hukum berorganisasi. Hasil yang diperoleh dari pelatihan teknik budidaya sayuran kepada anggota KWT adalah peningkatan pengetahuan dan keterampilan anggota KWT dalam produksi tanaman sayuran. Sebagian besar hasil panen dijual di lingkungan anggota KWT, sehingga perputaran usaha skala kecil telah berhasil dilaksanakan. Hasil dari pelatihan dan pendampingan tata kelola organisasi adalah pengurus dan anggota KWT mampu menyusun anggaran dasar/anggaran rumah tangga. Peningkatan peran aktif anggota KWT dalam berorganisasi penting untuk keberlanjutan berdirinya sebuah organisasi

Abstract

Negara Demokrasi merupakan negara yang kekuasaan tertinggi berada ditangan rakyat. Dengan pemahaman bahwa rakyat akan melahirkan sebuah aturan yang menguntungkan dan melindungi hak-haknya. Penelitian kualitatif merupakan sebuah penelitian yang dilakukan oleh peneliti dengan mengumpulkan data, mengolah, data, menganalisis, dan menafsirkan hasil data penelitian yang sebelumnya diperoleh melalui beberapa teknik, di antaranya melakukan observasi, interview atau wawancara, analisis isi, serta metode lain yang sesuai dalam menggali dan menemukan data. (Setyosari: 2016). Peneliti melakukan penelitiannya didasarkan pada strategi, paradigma, serta implementasi secara kualititif. Pasal 8 UU PPPU juga mengenali peraturan perundang-undangan lainnya yang diakui keberadaannya dan mempunyai kekuatan hukum mengikat sepanjang diperintahkan oleh peraturan perundang-undangan yang lebih tinggi atau dibentuk berdasarkan kewenangan. Keterlibatan berbagai lembaga sangatlah penting dalam menyesuaikan peraturan yang sedang disusun dengan kebijakan nasional yang telah ditetapkan oleh Presiden. Terdapat catatan yang perlu dipertimbangkan pada tahap mana keterlibatan tersebut, yakni sejak awal penyusunan atau setelah dilakukannya harmonisasi oleh Kemenkumham.Penerapan omnibus law di Indonesia menimbulkan beberapa implikasi.

Abstract

Urgensi pengaturan sistem pemilihan kepala daerah secara langsung menurut undang-undang Nomor 10 Tahun 2016 adalah terdapatnya partisipasi masyarakat untuk terlibat dalam memberikan suara maupun untuk menjadi kandidat sangat terbuka dan disamping itu pula banyak kelebihan dengan adanya pengaturan sistem pilkada langsung. Akan tetapi dengan pilkada langsung ini timbul adanya akibat hukum, perlakuan yang sama untuk setiap daerah tanpa kecuali harus melakukan Pilkada secara langsung tanpa mempertimbangkan situasi dan kondisi daerah tersebut. Seharusnya Pembentuk undang-undang harus dapat melihat situasi dan kondisi setiap daerah diseluruh pelosok tanah air.

Abstract

Social security in Indonesia is contained in the constitution. The content of this social security is regulated in article 28 H paragraph (3) of the 1945 Constitution of the Republic of Indonesia which states "that every person has the right to social security which enables his/her full development as a dignified human being". The Social Security Administering Body or often abbreviated as BPJS plays a very important role in carrying out its duties. One of them is providing social security and improving the welfare of all Indonesian workers in accordance with the Vision and Mission of BPJS Employment. Return to work is one of the new programs from BPJS Employment. The legal basis underlying the Return to work program includes: Government Regulation Number 44 of 2015 concerning the Implementation of Work Accident and Death Insurance Programs, Minister of Manpower Regulation No. 10 of 2016 concerning Procedures for Providing Return to Work Programs as well as Promotional Activities and Preventive Activities for Work Accidents and Work-related Diseases. The aim of this research is to determine the implementation of Return to Work at PT. Steel Pipel Industry of Indonesia (SPINDO) and to determine the inhibiting and supporting factors for the Return to Work program at PT. SPINDO. This research uses empirical legal research methods. Meanwhile, the results of the research show that: 1) PT. SPINDO has implemented the Return to Work Program ; 2) factors inhibiting the return to work program at PT. SPINDO almost doesn't exist. Meanwhile, the supporting factors for this return to work program include: first , socialization has been carried out by BPJS Ketenagakerjaan Karimunjawa to PT. SPINDO. Second , the facilities are adequate at PT. SPINDO is able to support the implementation of the return to work program .

Abstract

Maksud dan tujuan kegiatan pengadian ini adalah memberikan informasi dan edukasi tentang hukum dalam cerdas dan bijak bermedia sosial. Adapun kajian fokusnya adalam memberikan informasi hukum pada Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas UU Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik. Metode yang dilakukan dalam pengabdian berupa identifikasi masalah, pelaksanaan, ceramah, tanya jawab, diskusi interaktif dan evaluasi pemahaman. Kegiatan pengabdian ini merupakan upaya untuk memberi edukasi bahwa pentingnya bijak dan cerdas dalam bermedia sosial. Dalam bermedia sosial ada Undang-Undang yang berlaku di Indonesia yaitu undang-undang Tekhnologi dan informasi (UU ITE). Penggunaan media sosial tidak bisa sembarangan. Diharapkan siswa-siswi SMA-SMK Wisnuwardhana Malang sebagai generasi penerus bangsa menjadi paham dan lebih hati-hati menerima informasiinformasi serta bijak dalam bermedia sosial. Etika-etika saat bermedia sosial juga harus diperhatikan.

Abstract

Violence prevention in schools is very important to create a safe atmosphere for students. Strengthening digital literacy is essential as a preventive measure against verbal violence. The method used in this service  includes lectures, training, and assistance in utilizing digital media as an educational tool. the results of the activity, teachers and students understanding of the impact of violence and how to prevent it will increase, as well as increasing teachers understanding of technology with the output is infographics. The schools can effectively protect children from violence. Pencegahan kekerasan di sekolah sangat penting untuk menciptakan suasana aman bagi siswa. Oleh karena itu, diperlukan penguatan literasi digital sebagai upaya pencegahan kekerasan verbal. Metode yang digunakan dalam pengabdian ini adalah pendekatan yang meliputi ceramah, pelatihan, dan pendampingan pemanfaatan media digital sebagai sarana edukasi. Hasil pada kegiatan ini adalah peningkatan pemahaman guru dan siswa tentang dampak kekerasan, cara pencegahan, dan pemahaman guru dalam pemanfaatan teknologi yang dibuktikan dengan luaran berupa infografis. Dengan demikian, sekolah dapat secara efektif melindungi siswa dari kekerasan.
