Abstract

This article discusses the role of Bank Indonesia in maintaining monetary and payment system stability as an important part of national economic resilience. Monetary stability is understood as an effort to control inflation, maintain the value of the rupiah, and ensure that the amount of money in circulation is at a level appropriate for economic needs. The development of financial technology and the digitalization of payment systems have also influenced these stabilization mechanisms, requiring Bank Indonesia to adjust its policies to structural changes in the financial system. This research uses a normative legal method with a statute and conceptual approach, and is sourced from primary legal materials such as Article 23D of the 1945 Constitution, Law No. 23 of 1999, and Law no. 6 of 2009, as well as supported by secondary literature from books and scientific journals. The analysis results show that Bank Indonesia implements monetary stabilization through the BI-7DRR interest rate policy, open market operations, exchange rate intervention, and macroprudential instruments to maintain inflation and the stability of the rupiah's value. At the same time, BI's role in the payment system is realized through strengthening digital infrastructure such as QRIS and BI-FAST, improving cybersecurity, and regulations aimed at reducing systemic risk. Research findings also indicate that challenges in the digital age include cybercrime threats, infrastructure inequality, cryptocurrency developments, and the need for regulatory harmonization between institutions. Therefore, the future strategy requires BI to strengthen policy adaptation, increase digital financial literacy, and expand institutional synergies to ensure the sustained maintenance of monetary and payment system stability.

Abstract

Law No. 9 /2016 on the Prevention and Resolution of Financial System Crises regulated principles in the prevention and handling of financial system crises that were not previously regulated. Therefore, this study will analyze the implementation of bail in principle and, interconnectedness in the prevention and resolution of financial system crises. This research was conducted using normative juridical method with analytical descriptive approach and data was analyzed by juridical qualitative. Based on the research, the results show that the implementation of bail-in in handling of systemic banks is done by optimizing bank capability through capital surcharge. The interconnectedness between the financial services sector requires a macro prudential policy complementary to micro prudential policy, and integrated supervision of the financial services sector.

Abstract

Pengangkutan barang yang diasuransikan melibatkan hubungan hukum yang kompleks antara pengirim, pengangkut, penerima barang, dan perusahaan asuransi. Permasalahan sering muncul ketika terjadi kerugian barang akibat ketidakjelasan pembagian tanggung jawab hukum, terutama dalam penggunaan surat berharga sebagai dasar pembuktian dan pengalihan hak. Penelitian ini bertujuan untuk menganalisis tanggung jawab para pihak dalam penggunaan surat berharga pada pengangkutan barang yang diasuransikan serta mengkaji implikasi hukumnya terhadap klaim dan penyelesaian kerugian. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, konvensi internasional, putusan pengadilan, serta literatur hukum yang relevan. Hasil penelitian menunjukkan bahwa surat berharga memiliki kedudukan strategis dalam menentukan pihak yang berhak atas barang dan ganti rugi asuransi. Namun, belum adanya pengaturan yang terintegrasi antara hukum pengangkutan dan hukum asuransi menyebabkan terjadinya tumpang tindih tanggung jawab serta perbedaan penafsiran dalam praktik. Penelitian ini menegaskan perlunya penegasan norma yang mampu mengharmonisasikan fungsi surat berharga dengan mekanisme pertanggungan asuransi guna menciptakan kepastian hukum dan perlindungan yang seimbang bagi seluruh pihak yang terlibat.
