Abstract

Hadith is the second source used in making legal decisions based on Islamic law (istinbath). The purpose of this study is to discuss the contextualization of the Prophet's hadith understanding of usury. This research uses a qualitative type through literature study by applying content analysis. This research shows that it is true that religious arguments have accommodated the prohibition of usury including the hadith of the Prophet, but detailed explanations about the types of behavior related to usury are openly not found but only qiyasan-qiyasan from the musyarrih hadith. Next, the prohibition of usury, as a legal status, cannot be denied from various aspects, ranging from religious, historicity, and humanity aspects, all of which accommodate that usury is a prohibited act since before the arrival of Islam to the religious literature that reaches us today.

Abstract

Until now Pondok Modern Darussalam Gontor (PMDG) is still surviving, sustainable, and quality with several national and international recognition. Behind the readiness and success of PMDG, there is an initial motivation of the Trimurti founder of Gontor (hereinafter referred to as Trimurti) which is quite interesting to be studied as The Lessons Learned, especially for other pesantren Kiai. This study aimed to reveal the secrets of intrinsic and extrinsic motivation of Trimurti and its implications for PMDG. This study was a qualitative type, where data was collected using mixed techniques, namely field research and literature research. The data was written in descriptive, analytical, and historical methods through five stages, namely; selection of topics, heuristics, verification, interpretation, and 'historiography'. This research relies on five theories, namely; the Theory of Anatomy of Human Motivation, the Theory of Implications, the Trimurti Theory, the Kiai Theory, and the Modern Pesantren Theory. This study found that the intrinsic motivation of Trimurti includes the local and regional microscale, and their extrinsic motivation includes the national mesoscale and global macroscale which has positive implications in the form of selective protection actions of three pesantren systems and projections of four modern systems in PMDG that contribute extraordinary to the nation, the country, even the world. The author considers Trimurti to be the time to become the Role Model of Lessons Learned and receive the National Hero Title award in the momentum of a century of PMDG (1926-2026).

Abstract

Indonesia, a Muslim-majority country, strives to optimize its social welfare programs. While the 1945 Constitution guarantees social rights and Islamic principles provide guidance, there is a gap in exploring how these can be better aligned. This research aims to explore how social rights in the 1945 Constitution (Chapter XIV) can be aligned with the Dharuriyat al-Khams (five essential human needs) by Shatibi to strengthen social welfare programs. The research employed a qualitative approach using a literature study and thematic analysis method by Miles and Huberman, encompassing data collection, data reduction, data display, and conclusion/ verification of primary and secondary data. The research findings demonstrate that the 1945 Constitution, particularly Chapter XIV, guarantees social welfare rights and obligates the government to fulfill them, the Dharuriyat al-Khams, introduced by Imam Shatibi, is part of the maqashid shariah (objectives of Islamic law) that aims to achieve social welfare by fulfilling five basic human needs, substantively, these two concepts synergize and can be effectively integrated to strengthen social welfare programs in Indonesia. This research enriches the discourse on Islamic economics in strengthening programs and addressing social welfare issues, particularly concerning essential human rights in Muslim-majority countries.
