Abstract

This study aims to analyze the role of local values in the sustainable management of peatlands in Dayun Village, Siak Regency, Riau Province. The research applies a descriptive qualitative method using a normative-empirical approach. Findings indicate that although formal customary law structures are no longer present, local communities continue to apply traditional values in land management. Activities include sustainable watermelon farming, batik training using watermelon leaves, and processing agricultural products into local goods such as juices and watermelon-based snacks. Furthermore, educational tourism initiatives emphasize Malay cultural preservation, environmental awareness, and social revitalization. Community activities such as group exercises, outbound games, forest fire prevention education, and crafts training are led by the local tourism awareness group (Pokdarwis). These reflect a transformation of local values into tangible actions supporting ecological sustainability and community economic growth. The study also highlights the importance of local leadership and external collaboration in implementing these grassroots initiatives successfully.

Abstract

Customary land is an integral part of the identity and survival of customary law communities, including in the Kampar region, Riau Province. However, along with increasing investment and development, there have been various forms of takeover of customary land rights that have triggered disputes between customary communities and third parties, such as private companies and the government. This study aims to analyze the mechanism for resolving disputes over the takeover of customary land rights in the Kampar region using customary law and national law approaches. The method used is a combination of normative and empirical juridical, data obtained through legal document studies, interviews with authorized local customary leaders. The results of the study show that customary communities in Kampar still rely on customary resolution mechanisms. Meanwhile, in resolving litigation, they often experience administrative and economic obstacles, while non-litigation channels such as multistakeholder mediation and administrative recognition by the local government are more effective if supported by policies that support them. In conclusion, synergy between customary law and national law is absolutely necessary to create fair protection for the rights of indigenous peoples, and it is hoped that there will be strengthening of customary institutions, acceleration of recognition of customary areas through regional regulations, and preparation of integrated mechanisms for resolving disputes based on local culture and national legal certainty.

Abstract

Perkembangan industri perbankan menempatkan nasabah pada posisi yang rentan terhadap asimetri informasi dan klausula baku. Penelitian ini bertujuan untuk menganalisis pelaksanaan perlindungan hukum nasabah dalam pelayanan perbankan pada PT Bank Tabungan Negara (Persero) Tbk di Kota Pekanbaru (KC Pekanbaru, KCP Panam, dan KCP Rumbai) serta mengidentifikasi hambatan dalam implementasinya. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan sosiologi hukum. Data primer diperoleh melalui kuesioner kepada nasabah Bank BTN di Kota Pekanbaru, sedangkan data sekunder diperoleh dari studi kepustakaan, peraturan perundang-undangan, dan literatur hukum. Hasil penelitian menunjukkan bahwa Bank BTN di Kota Pekanbaru secara umum telah menerapkan prinsip-prinsip perlindungan konsumen berdasarkan Peraturan Otoritas Jasa Keuangan (POJK). Hal ini tercermin dari tingginya pemahaman nasabah terhadap produk, transparansi kontrak, dan jaminan keamanan data pribadi. Namun, masih terdapat hambatan berupa kurangnya pemahaman nasabah mengenai jalur resmi pengaduan (mekanisme redress) dan adanya perubahan biaya administrasi/suku bunga secara sepihak yang kurang disosialisasikan. Diharapkan Bank BTN dapat meningkatkan edukasi berkala mengenai tata cara pengaduan guna mewujudkan perlindungan hukum yang optimal.

Abstract

Perubahan ketentuan upah minimum dalam Undang-Undang Ketenagakerjaan di Indonesia sejak diberlakukannya Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja telah menciptakan berbagai dinamika, baik dari sisi tujuan pembentukan maupun dampaknya terhadap tenaga kerja. Penelitian ini bertujuan untuk membandingkan ketentuan upah minimum dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dengan Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja, dan menganalisis implikasinya terhadap pekerja di Indonesia. Penelitian ini menerapkan yuridis normatif dengan pendekatan legislatif dan penelitian kepustakaan, melalui analisis data sekunder berupa undang-undang, buku, jurnal, dan artikel ilmiah yang kemudian dipelajari secara deskriptif-analitis. Hasil penelitian menunjukkan bahwa pergeseran formula penetapan upah dari orientasi kebutuhan hidup layak menuju variabel pertumbuhan ekonomi dan inflasi berpotensi menyebabkan upah riil pekerja tertinggal dari kenaikan biaya hidup aktual, sehingga daya beli pekerja rentan melemah. Di sisi lain, penghapusan upah minimum sektoral menyebabkan sistem pengupahan tidak lagi mempertimbangkan perbedaan karakteristik antar sektor, sehingga pekerja dengan tingkat keahlian tinggi maupun risiko pekerjaan besar berpotensi tidak memperoleh upah yang proporsional dengan beban kerjanya. Oleh sebab itu, antara kepentingan pekerja dan dunia usaha diperlukan penguatan regulasi yang lebih seimbang, disertai pengawasan yang lebih ketat, guna menjamin kesejahteraan dan hak tenaga kerja secara optimal.

Abstract

Divorce is a legal and social phenomenon that has a significant impact on family Divorce is a legal and social phenomenon that has a significant impact on family integrity and the psychological stability of the parties involved, particularly women and children. One of the mandatory efforts in resolving divorce cases in court is mediation, as regulated in Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures in Court. Mediation aims to encourage reconciliation between husband and wife before the examination of the main case proceeds. In practice, the implementation of mediation in divorce lawsuit cases (cerai gugat) at the Religious Court of Teluk Kuantan still faces various obstacles, resulting in a relatively low mediation success rate. The issues examined in this study are: (1) How is the implementation of mediation stages in divorce lawsuit cases at the Religious Court of Teluk Kuantan based on Supreme Court Regulation Number 1 of 2016? (2) What factors and obstacles cause the failure of mediation in divorce lawsuit cases at the Religious Court of Teluk Kuantan? This study aims to determine the implementation of mediation stages in divorce lawsuit cases at the Religious Court of Teluk Kuantan and to identify the factors that contribute to unsuccessful mediation. This research applies an empirical or sociological legal research method, which focuses on the application of law in society. The study is descriptive in nature, aiming to clearly describe the mediation process in handling divorce lawsuit cases. Primary data were obtained through interviews with the Head of the Religious Court, judge mediators, non-judge mediators, community leaders, and parties involved in divorce lawsuit cases. Secondary data were collected from laws and regulations, literature, scientific journals, legal doctrines, and relevant previous studies. The findings show that the implementation of mediation in divorce lawsuit cases at the Religious Court of Teluk Kuantan has generally been carried out in accordance with Supreme Court Regulation Number 1 of 2016, starting from the pre-mediation stage, the mediation process, to the reporting of mediation results. However, mediation remains procedural and has not been fully effective in achieving reconciliation. This condition is reflected in the low number of successful mediations, namely 12 cases in 2022, 7 cases in 2023, 3 cases in 2024, and 1 case from January to April 2025. Factors contributing to mediation failure include the strong desire of the parties to divorce, prolonged marital conflicts, lack of good faith, technical obstacles such as distance of domicile, and limited internet access in conducting online mediation. Limited time availability of mediators and socio- cultural factors within the community also influence the effectiveness of mediation, resulting in mediation often failing to produce a peaceful settlement agreement.

Abstract

Although regulated under the Job Creation Law, the practice of unilateral termination of employment that disregards workers’ rights still frequently occurs in Indonesia. The primary focus of this analysis is on the case of PT. Duta Sarana Perkasa, where workers under Fixed-Term Employment Contracts (PKWT) face issues of non-compliance with labor laws. The failure to implement the provisions of the Job Creation Law (Law No. 6 of 2023) results in workers being entitled to the status of an Indefinite-Term Employment Agreement (PKWTT). Through a literature review approach, this analysis demonstrates that the terminations that occurred did not comply with applicable legal procedures and disregarded workers’ rights, including severance pay and service awards. This analysis underscores the importance of protecting workers’ rights during the layoff process and the need to effectively enforce regulations. Consequently, the Supreme Court overturned a previous ruling that did not recognize the workers’ employment status and ordered the company to pay the workers’ violated rights, although the final decision still leaves unresolved issues regarding the exclusion of wages during the process. This analysis concludes that existing regulations are not yet fully effective in protecting workers’ welfare, underscoring the need for stricter legal oversight to ensure fairness in labor relations between employers and workers in Indonesia.
