Abstract

Customary law is religiously functional law, so that customary law fulfills a social function or social justice. Thus, the community and its members carry out these normative orders without seeing them as coercion, but because they assume they are as such. The aim of the law is justice, expediency and legal certainty, and these three elements constitute an inseparable unity. Justice is the moral foundation of the law and, at the same time, the benchmark for a positive legal system. In other words, justice has always been the basis of the law. Without justice, a rule can not be called a law. The highest possible justice to be achieved in the mediation of sanctions is the agreement of the parties involved in the criminal case.

Settlement and construction of space has have jurisdiction since regulation ofsettlement of space number 24/1992. with space regulation, we hope that civilization materialized,compfortable, productive and sustainable. But, the most of frame above, not solid yet. Withthe result that, we need some regulations to accommodate. In year 2007, the government wascreate regulation number 26/2007. with this regulation can making regulation of space work.It will be run if all of civil society and stake holder involve in.

Abstract

Law Number 1 of 2011 in Article 98 paragraph (3) concerning Housing and Settlements, it is explained that the regional government has the authority to conduct arrangements and determine the location of slum housings and urban slums. This is what underlies the Regional Government of Siak Regency to have a role in identifying various local wisdoms in its region. The existence of the local wisdom of the indigenous people of Siak can be viewed from the legal aspect of structuring the location of housing and slums as mandated by legislation and implemented in the Letter Regent Decree Number 523/HK/KPTS/2014 concerning Determination of Slum and Slum Housing Locations in Siak Regency and Regent Decree Number 302/HK/KPTS/2017 concerning Slum and Slum Residential Housing Locations in Siak Regency. The result is the existence of the local wisdom of Indigenous people of Kampung Buatan II, Koto Ghasib Subdistrict did not work optimally, because it had not maximized the role of the Riau Malay Customary Institution in Siak Regency. However, the noble values of local wisdom in Malay indigenous communities in structuring the location of housing and slums are known from their ancestors expressed in a proverb or customary expression in preserving nature around us to create a clean, healthy life by understanding the meaning of development, understanding the ins and outs of religion and culture and the social norms of the people, so that development is truly beneficial for all levels of society.

Abstract

This study aims to identify local wisdom in the Meranti Islands Regency. The method used in this research is a juridical-normative research which focuses on library data research. The normative juridical approach, namely the method used by adhering to the juridical aspects, by carrying out an inventory of positive laws relating to the problems studied. Juridically, local governments have the authority to increase the capacity of local wisdom or traditional knowledge and the rights of local wisdom or traditional knowledge related to the environment in the regencies/cities. Local wisdom in Meranti Islands Regency, there are approximately 300 types of local wisdom. Of these, they can be grouped into 5 (five) major groups. Namely, local wisdom related to agriculture, local wisdom in the culinary field, local wisdom in the natural resource management sector (peat), local wisdom in the field of traditional games and sports, and local wisdom in the field of fisheries and marine affairs.

Abstract

The customary legal system of the Mamak Tribe community with a matrilineal kinship system. The division of the inheritance system according to the customary law of the talak mamak tribe adheres to the matrilineal system and the combination between the individual inheritance system and the collective inheritance system. The division of inheritance is done by ninik mamak of the heirs. First, high estate, low estate (livelihood / livelihood) should be separated from the property of the husband and wife, after which the division of this inheritance property can be distributed to the heirs. When a dispute arises, it is first resolved as a family through deliberation. Dispute Resolution on the Rights of the Mamak Tribe Women According to the Dispute over the rights of the Mamak Tribe Women will be brought to a deliberation within the Talang Mamak Tribunal if no agreement is found in the family, then a resolution is requested in the Mamak Tribal Tribal Customs procedure. The parties involved in resolving the dispute over the women's rights of the Talang Mamak Tribe include: the Head of the Tribe, as well as all the customary leaders in the institution.

Abstract

AbstractThe authority of the government and regional governments to carry out marine management for the greatest prosperity of the people through the utilization, and exploitation of marine resources by using blue economy principles. This approach aims to improve sustainable marine management, and marine conservation, and coastal resources, and their ecosystems in order to realize economic growth with the principles of community involvement, resource efficiency, minimizing waste and multiple revenue streams. Rupat island, as the outermost island of Indonesia, has local wisdom potential that must be identified in order to be declared to support sustainable development goals. This research aims to find out the local wisdom of coastal communities that have the potential to be a blue economy in order to achieve the sustainable development goals. This research isnormative legal research, using data from literature studies, interviews, and observations. This is descriptive research that aims to provide a detailed and clear description of the problem to be studied. The results of the identification of the local wisdom of coastal communities that have the potential for blue economy are the rituals and processes of fishing procedures and the use of traditional fishing gear, wise management of mangroves and local community cultural arts that support marine tourism. AbstrakKewenangan pemerintah dan pemerintah daerah melakukan pengelolaan kelautan untuk sebesar-besarnya kemakmuran rakyat melalui pemanfaatan dan pengusahaan sumber daya kelautan dengan menggunakan prinsip blue economy. Pendekatan ini bertujuan meningkatkan pengelolaan kelautankerkelanjutan serta konservasi laut dan sumber daya pesisir beserta ekosistemnya dalam rangka mewujudkan pertumbuhan ekonomi dengan prinsip-prinsip keterlibatan masyarakat, efisiensi sumber daya, meminimalkan limbah, dan multiple revenue. Pulau Rupat sebagai pulau terluar Indonesiamemiliki potensi kearifan lokal yang harus diidentifikasi untuk dapat dinyatakan mendukung sustainable development goals. Penelitian ini bertujuan untuk mengetahui kearifan lokal masyarakat pesisir pantai yang berpotensi blue economy dalam rangka pencapaian sustainable development goals. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan data hasil studi literatur, wawancara dan observasi. Sedangkan sifat penelitian ini adalah penelitian deskriptif yang bertujuan memberikan gambaran secara rinci dan jelas tentang permasalahan yang akan diteliti. Hasil identifikasi kearifan lokal masyarakat pesisir pantai yang berpotensi blue economy adalah ritual dan proses tata cara penangkapan ikan serta penggunaan alat tangkap ikan tradisional, pengelolaan mangrove secara arif dan seni budaya masyarakat lokal yang mendukung wisata bahari.

Abstract

Pemanfaatan lagu dan musik secara komersial di kafe tanpa membayar royalti kepada pemegang hak cipta merupakan permasalahan yang banyak terjadi, termasuk di Kecamatan Sail, Kota Pekanbaru. Penelitian ini bertujuan untuk mengkaji tanggung jawab pembayaran royalti kepada pemegang hak cipta lagu dan/atau musik oleh pelaku usaha kafe di wilayah tersebut serta upaya yang dapat dilakukan untuk meningkatkan kepatuhan mereka. Metode penelitian yang digunakan adalah yuridis empiris dengan melibatkan wawancara dan studi kepustakaan. Hasil penelitian menunjukkan bahwa tanggung jawab pembayaran royalti belum terlaksana dengan baik karena minimnya pemahaman dan kesadaran pelaku usaha kafe tentang perlindungan hak cipta dan kewajiban membayar royalti. Upaya yang dapat dilakukan adalah meningkatkan sosialisasi dan edukasi tentang hak cipta serta memberikan dukungan bagi para musisi dalam mengelola hak cipta atas ciptaan. Kesimpulannya, diperlukan komitmen dan sinergi dari berbagai pihak untuk mewujudkan kepatuhan pembayaran royalti demi menghormati karya intelektual dan mendukung keberlanjutan industri musik.

Abstract

Introduction: The implementation of the fulfillment of workers' rights in mobile phone shops in Dumai City is often not in line with applicable regulations such as the provision of inadequate wages, workers' working hours that are not in accordance with working hour regulations and the right to leave that workers rarely get. Purposes of the Research: The purpose of this research is to find out how the fulfillment of workers' rights at cellphone stores in Dumai City, how obstacles and efforts in fulfilling workers' rights at cellphone stores in Dumai City. Methods of the Research: The type of research used is sociological legal research that wants to see the correlation between law and society, so as to reveal the effectiveness of the application of law in society. Results Originality of the Research: This research found that the only rights that have been implemented are the rights to get work breaks. Meanwhile, other rights have not been fulfilled. Constraints in the fulfillment of workers' rights are due to the absence of wage increases, working hours that exceed the time limit, unclear rights and obligations, and the lack of ability of employers to fulfill workers' rights, difficulty in obtaining work leave, absence of social security, absence of education and job training. Efforts can be made in the form of counseling and education, work scheduling so that schedules are more flexible, providing written agreements, applying appropriate wages, training and skills development, and social security.

Abstract

Munculnya Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019 dan Putusan Mahkamah Konstitusi Nomor 2/PUU-XIX/2021 menyebabkan tata cara pelaksanaan eksekusi suatu objek jaminan fidusia mengalami perubahan. Setelah munculnya putusan tersebut harus ada kesepakatan antara kedua belah pihak bahwa si debitur telah melakukan wanprestasi dan tidak mau memberikan objek jaminannya secara sukarela, maka pihak kreditur tidak bisa mengeksekusi secara paksa objek jaminan tersebut, melainkan harus ada permohonan penetapan eksekusi dari pengadilan. Penelitian dilakukan terhadap salah satu lembaga pembiayaan di Pekanbaru apakah pengaturan tersebut sudah diterapkan. Tujuan penelitian skripsi ini yakni bagaimanakah pelaksanaan eksekusi objek jaminan fidusia dan apa saja faktor hambatan yang terjadi dalam eksekusi objek jaminan fidusia setelah keluarnya putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019 dan Putusan Mahkamah Konstitusi Nomor 2/PUU-XIX/2021. Jenis penelitian ini adalah penelitian hukum sosiologis yaitu penelitian yang dilakukan terhadap keadaan sebenarnya atau keadaan nyata yang terjadi di Masyarakat. Teknik pengumpulan data yang digunakan dalam peneltian ini ialah menggunakan metode wawancara dan kajian kepustakaan. Penelitian ini menggunakan metode kualitatif penelitian yang menghasilkan data deskripsi, yaitu apa yang dinyatakan secara tertulis. Hasil penelitian ini menunjukkan bahwa pelaksanaan eksekusi objek jaminan fidusia bertentangan dengan adanya Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019 dan Putusan Mahkamah Konstitusi Nomor 2/PUU-XIX/2021, tidak adanya perubahan mekanisme eksekusi yang terjadi pasca putusan tersebut dengan tetap mengeksekusi langsung suatu objek jaminan fidusia tanpa adanya campur tangan dari pengadilan. Pihak kreditur yaitu perusahaan pembiayaan harusnya menerapkan pelaksanaan eksekusi suatu objek jaminan fidusia sesuai dengan peraturan yang telah berlaku yaitu Putusan Mahkamah Konstitusi sehingga bila terjadi eksekusi dan debitur tetap tidak mau menyerahkan objek jaminannya maka dapat diselesaikan dengan cara menempuh jalur melalui pengadilan.
