Abstract

Klatak satay is a unique satay and can only be found in Yogyakarta. The klatak satay, typical of Bantul Regency, is made from chunks of goat meat skewered with an iron rod. The meat is covered in a special simple concoction of spices such as garlic and salt. After that, satay grilled over charcoal is a culinary variation that is present in the midst of a culture in Bantul Regency. The author conducted qualitative research with a descriptive approach that aims to explore data related to community strategies in developing sate klatak culinary tourism in Bantul Regency. The informants in this study are visitors, sellers, and the local government. Collecting data in this study using three ways, namely, observation, interviews, and documentation. The results of the research from the trader's strategy in developing culinary satay klatak, which is a creative strategy by finding promoting ideas on social media, showing the advantages of oyster products based on arts and crafts, and highlighting tourism based on natural beauty. The impact of the roasted oyster seller strategy in Bantul Regency is the economic impact.

Abstract

This article explores the critical role of trade secrets in enhancing the sustainability of Micro, Small, and Medium Enterprises (MSMEs) in the culinary sector. It emphasizes the confidential nature of corporate information, essential for shielding against unauthorized access by the public or even employees. Given the significant economic value of Indonesia's local products, legal safeguards are imperative to protect these assets from unfair competitive practices in the market. Utilizing a normative juridical method, this study conducts a comprehensive literature review to investigate the legal framework surrounding trade secrets and its implications for MSMEs. The findings underscore a prevalent lack of awareness among MSMEs regarding intellectual property laws, highlighting the necessity for concerted efforts from various stakeholders to ensure effective implementation of these legal protections.

Abstract

Intellectual Property Rights (IPR) is one form human wealth resources that are intangible and are the result of human intellectual ability mindset. Basically, Property Rights Intellectual Property Rights (IPR) is an exclusive right given to someone which has produced works, arises as a result of intellectual abilities humans in various fields who produce a process or product which is beneficial to humans and can be enjoyed economically by man himself. The aim of this research is to determine the patent system in mastering science and technology in Indonesia. The research method used is normative juridical with analytical descriptive research specifications. The results of the research are that the government must have a good patent information service system for patents that have become public domain, so that when the patent expires, the technology that has become public domain can be widely used by the Indonesian people. Law enforcement and patent protection are very important to create a fair and competitive business. This not only helps innovation and investment, but also protects intellectual property rights that greatly influence Indonesia's technology and economy. By collaborating between sectors and protecting intellectual property rights, Indonesia can continue to progress in the future

Abstract

Intellectual Property Rights in the form of geographical indications play a role in optimizing products with local regional wisdom, so that these products have economic value that can help the local communities. One of them is through Geographical Indication-based Agrotourism. However, the realization of a geographical indication application is complicated, takes a long time and is expensive. Good planning and management programs are also needed after obtaining geographical indications. This research aims to explore geographical indication policies in Indonesia, as well as elaborating on the potential of geographical indications as a key instrument in developing agricultural tourism areas. This research uses a normative approach with analytical descriptive. The data source used is secondary data consisting of primary legal materials in the form of Law Number 20 of 2016 concerning Trademarks and Geographical Indications and secondary legal materials. This research provides an overview of the history of geographical indication regulations in Indonesia. The geographical indication policy is expected to provide legal protection for products with reputation, quality and special characteristics due to geographical factors in the region of origin. To realize geographical indication-based agrotourism, awareness is needed from all parties, both the government and the community protecting geographical indications. Good governance and careful planning need to be prioritized. It is necessary to strengthen the environment, social and culture in society to build tourism-friendly areas.   Hak Kekayaan Intelektual berupa indikasi geografis berperan dalam optimalisasi produk dengan kearifan lokal daerah sehingga memiliki nilai ekonomi yang dapat memajukan kesejahteraan masyarakat setempat. Salah satunya melalui Agrowisata berbasis Indikasi Geografis. Namun realiasasi permohonan indikasi geografis ini rumit, membutuhkan waktu lama, dan mahal. Perencanaan dan program pengelolaan yang baik juga diperlukan pasca perolehan indikasi geografis. Penelitian ini bertujuan untuk menggali terkait kebijakan indikasi geografis di Indonesia, serta mengelaborasi potensi indikasi geografis sebagai instrumen kunci dalam pengembangan kawasan wisata pertanian. Penelitian ini menggunakan pendekatan normatif yang bersifat deskriptif analitis. Sumber data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer berupa Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan bahan hukum sekunder. Penelitian ini memberikan gambaran mengenai historis pengaturan indikasi geografis di Indonesia. Kebijakan indikasi geografis diharapkan dapat memberikan pelindungan hukum terhadap produk dengan reputasi, kualitas dan karakteristik khusus karena faktor geografis daerah asal. Untuk mewujudkannya agrowisata berbasis indikasi geografis perlu kesadaran dari semua pihak baik pemerintah maupun masyarakat pelindung indikasi geografis. Tata kelola yang baik serta perencanaan dari hulu hingga hilir yang matang perlu di prioritaskan. Untuk membangun daerah ramah wisata maka penguatan lingkungan, sosial dan budaya dalam masyarakat menjadi komponen penting

Abstract

This research is motivated by the reality that the use of music and songs on the Spotify digital platform is utilized by irresponsible people by pirating. The problem in this study is, first, how is the legal protection of the creators of the collection and distribution of royalties for Spotify digital platform music works. Second, what are the legal remedies if there is no legal protection for the creators of Spotify digital platform royalty collection and distribution This research is a type of normative research. The approach used in this research is sociological. The object of research in this study is the legal protection of creators of musical works on the Spotify digital platform, along with legal efforts. The subject of this research is Bagus Rian as a musician or songwriter on the Spotify digital platform. The data sources used in this research are primary data sources supported by secondary data sources. The data collection techniques used in this research are interviews, document studies, and literature studies. This research uses qualitative juridical analysis. The results of this study state that the legal protection of music and song creators on the collection and distribution of Spotify's digital platform only removes pirated music and song content. The Spotify digital platform has no special provisions or mechanisms related to the economic rights of music creators. The arrangements on Spotify's digital platform are also not in line with the ideals of Indonesian laws and regulations regarding the collection and distribution of royalties.

Abstract

Yogyakarta City is an area known as a tourist destination for tourists who have culinary tourism attractions, one of which is gudeg. Gudeg as an icon as well as a typical culinary of Yogyakarta City is also preserved by the community and supported by the Government with the establishment of gudeg industry centers, including the Wijilan Gudeg Center as a popular gudeg culinary tourism center. Although known as the Wijilan Gudeg Center, the fact is that most gudeg traders in the area have not registered their brands with the Ministry of Law and Human Rights through the Directorate General of Intellectual Property Rights due to the lack of knowledge of gudeg traders regarding the importance of legal protection for gudeg brands. The method used in this study is the empirical juridical method through a statute approach which is then analyzed using descriptive analysis. The results of the study indicate that gudeg traders in the Wijilan Gudeg Center area have the potential to register brands collectively which are used as an alternative to legal protection for brands for gudeg traders according to Law Number 20 of 2016 concerning Brands and Geographical Indications.

Abstract

This research explores the possibility and concept of regulating Artificial Intelligence (AI) as a legal subject in Indonesia. With rapid advancements in AI technology, AI can perform tasks requiring human-like intelligence, raising questions about its legal status. In some countries, AI has been used to assist in resolving legal issues, demonstrating its potential to be considered a legal subject. In Indonesia's positive law, legal subjects currently include humans (natural persons) and legal entities (legal persons). However, since AI can perform actions that resemble or replace human work, AI is considered to have rights and obligations that need to be regulated by legal norms. This study uses a normative juridical method to analyze existing regulations and the potential regulation of AI as a legal subject. The results show that although AI has significant capabilities, regulating AI as a legal subject faces considerable challenges. The study concludes that regulating AI as a legal subject in Indonesia requires in-depth study and multidisciplinary discussion. Appropriate and balanced regulations are needed to protect the rights and interests of society in this digital era, given that AI continues to evolve and has the potential to bring significant changes in various sectors of life.

Abstract

Information technology and its relationship with data protection is a crucial area that needs to be addressed, especially for data flows among different countries. In the majority of jurisdictions, international data transfers are restricted unless specific requirements stipulated by data protection laws are met. However, in the European Union (EU) and the United Kingdom (UK) there are three exceptions, adequacy, appropriate safeguards, and derogations. This paper conducts a comparative legal analysis of the regulations governing the cross-border transfer of personal data in the EU, UK, and Indonesia. The research method is normative, while the approaches employed are statutory and conceptual with an analytical and descriptive research design. The study focuses on the legal framework and the various mechanisms to protect personal data during transborder flows. The research identified both commonalities and disparities in data protection regulations in Indonesia, the EU, and the UK. Notably, differences appeared in the application of appropriate safeguards and the use of criminal sanctions in Indonesia. Finally, the study concludes by providing recommendations for future developments in the legal frameworks for cross-border data transfer in the EU, UK, and Indonesia.Keywords: Adequacy decision, Cross-border data transfer, Derogations, Personal Data Protection Law. Melindungi Data Pribadi Kita yang Paling Berharga: Perbandingan Hukum Aliran Data Lintas Batas Di Uni Eropa, Inggris, dan Indonesia AbstrakTeknologi informasi dan hubungannya dengan perlindungan data merupakan bidang penting yang perlu ditangani, terutama untuk aliran data antar negara. Di sebagian besar yurisdiksi, transfer data internasional dibatasi kecuali persyaratan khusus yang ditetapkan oleh undang-undang perlindungan data dipenuhi. Namun, di Uni Eropa (UE) dan Inggris (UK) terdapat tiga pengecualian, yaitu kecukupan, pengamanan yang sesuai, dan pengurangan. Tulisan ini melakukan analisis hukum komparatif terhadap peraturan yang mengatur transfer data pribadi lintas batas negara di UE, Inggris, dan Indonesia. Metode penelitian yang digunakan adalah normatif, sedangkan pendekatan yang digunakan bersifat perundang-undangan dan konseptual dengan desain penelitian analitis dan deskriptif. Studi ini berfokus pada kerangka hukum dan berbagai mekanisme untuk melindungi data pribadi selama arus lintas batas. Penelitian ini mengidentifikasi kesamaan dan kesenjangan dalam peraturan perlindungan data di Indonesia, UE, dan Inggris. Perbedaan yang terlihat jelas adalah penerapan safeguards yang tepat dan penggunaan sanksi pidana di Indonesia. Terakhir, studi ini menyimpulkan dengan memberikan rekomendasi untuk perkembangan masa depan dalam kerangka hukum transfer data lintas batas di UE, Inggris, dan Indonesia.Kata Kunci: Keputusan kecukupan, Transfer data lintas batas, Derogasi, Undang-Undang Perlindungan Data Pribadi.

Abstract

Penelitian ini membahas mengenai persamaan dan perbedaan perlindungan hukum merek terkenal antara Indonesia dan Spanyol dan faktor yang menjadi penyebab perbedaan perlindungan merek terkenal di Indonesia dan Spanyol.. Penelitian ini menggunakan metode penelitian hukum normatif. Hasil pembahasan dari penelitian terdapat beberapa persamaan antara Undang-Undang Nasional Merek Indonesia dengan Undang-undang Merek Spanyol, seperti pengaturan mengenai pengertian merek, pertama mengajukan, dan ganti rugi dalam gugatan perdata. Politik hukum, sistem hukum, dan budaya hukum menjadi faktor penyebab perbedaan perlindungan hukum Indonesia dan Spanyol.

Abstract

TikTok is one of the most popular social networking applications and music video platforms in the world. TikTok also uses a lot of songs or music from various creators, this creates legal problems, especially in the field of copyright for song or music creators, namely the distribution of copyright- related products without permission/licence. So that it violates the rights related to copyright and the economic rights of the creator. This study uses a juridical-normative legal research method which is a legal research that is literature writing in the form of books, journals, and regulations that have a correlation to the discussion of problems, and with a legal approach and uses a conceptual approach by examining the doctrine of experts related to the legal issues under study. The application's liability to the copyright holder of the song or music is in the form of compensation or termination of the distribution or reproduction of related products whose copyright is violated. The protection given to song or music copyright holders is criminally and civilly against copyright law violations in accordance with Law Number 28 of 2014 concerning Copyright.
