Abstract

To make connection between fiqih and humanism is often judged as a subversive. Religion is convinced the only source of morality, then rationality tendency to discover morality – such as humanism - never get a proportional place. Whereas at a certain point religioun is meaned totalitarianly by his follower, there’s potency to exploit religion for political and partisan interest that will kill humanistic values. In this context, the existence of religion is important to be reflected in a humanization process, namely a process to place and treat human being more human. From the above frame work, this assignment will explain the Abou El Fadl’s conception of humanistic fiqih related to pluralism, democracy, and social justice. These three conceptions are “par excellence” humanistic values that often being campaigned by Abou El Fadl. Abou El Fadl is a scholar who has great attention to establish link between Islam, fiqih and morality.

Abstract

This paper intends to study towards a humanistic orientation of fiqh study. The study of fiqh based humanistic orientation aims to study fiqh with more emphatic on values and morality rather than legal-formal aspects. on the other side, this study will be the counter-part of the theocentric orientation of fiqh study. The theocentric orientation is shown to lose its elan vital, because it is more preoccupied with the issues of authenticity rather than social problems. This paper is attributed to Abou El Fadl, most noted for his scholarly approach to fiqh from moral point of view.

Abstract

This paper is intended to elaborate the anthropocentric paradigm in the study of Islamic law which is done for two reasons. The first is the increasing trend of theocentricism within various puritan communities. This trend rejects the contextualization of Islamic law and has the potential to produce radical movements in the name of religion. The second is that, Islamic law studies is still rarely associated with the issues of legal paradigms, even though they are considered as the foundation in the establishment of Islamic law. Thus, this paper is written as an attempt to make the prophetic social science paradigma an analytical tool for puritans’ Islamic law epistemology. This study reveals that the epistemological demystification is very important for the study of contemporary Islamic law. There are two steps in carrying out epistemological demystification: the first is the transformation of the basic structure of Islamic law. This transformation requires a shifting issue from theocentric to the anthropocentrism. The transformative theoanthropocentric paradigm as the basic legal structure has the capability to contextualize Islamic law which is not only relevant to the Muslim community, but also to the community as a whole. The second is the development of a theoretical framework. Concerning with this, Kuntowijoyo offers analytic-synthetic theories which accommodate a demystified vision as a link to a transformative theological foundation.

Abstract

Penelitian ini ingin menguak bagaimana kontruksi human agent di­kembang kan oleh Abou El Fadl dalam rangka membangun relasi hukum Islam dan moralitas, dan apa sandaran teologis dan epistemologis Abou El Fadl dalam mengidealisasikan human agentdalam tradisi hukum Islam. Jawaban­jawaban terhadap pertanya an ini menurut penulis sangat penting karena paling tidak dua hal: pertama, karena masih relatif keringnya wacana moralitas dalam kajian hukum Islam. Hal ini dikarenakan keyakinan bahwa ke daulat an hukum secara mutlak ada di tangan Tuhan, dan tiada pilih  an bagi manusia kecuali ketaatan secara harfiyah terhadap teks hukum. Kedua, perlunya mengaitkan hukum Islam dengan basis teologis untuk menunjukkan pentingnya interkoneksi hukum Islam dengan keilmuan lain untuk menunjukkan pada the body of knowledge yang komprehensif dan utuh tentang Islam. Penelitian ini merupakan penelitian kepustakaan dengan menjadikan buku­-buku Abou El Fadl sebagai referensi primer. Dengan paradigma verstehen dan interpretative understanding, dan pendekatan teks, serta teori human agent, data akan diolah, dianalisa dan ditafsirkan sesuai rumusan masalah penelitian. Penelitian ini menyimpulkan: per tama, hukum Islam menurut Abou El Fadl dimediasi oleh human agency (perwakilan manusia atau khalifatullah). Dalam konteks hukum Islam human agencybersifat kolektif sebagaimana tidak ada institusi ke pendetaan dalam Islam. Human agency dalam konteks hukum Islam lebih banyak dibawa oleh Abou El Fadl pada moral agency. Kedua,Persepsi teologis Abou El Fadl sebagai bangunan dasar pemikiran hukum Islamnya lebih dekat dengan paham teologis Mu?tazilah sebagaimana kecenderungannya pada rasionalitas dan ke bebas an bertindak.

Abstract

Penelitian ini ingin melihat bagaimana paradigma dan teori penafsiran hukum Fazlur Rahman dan Abdullah Saeed. Teori penafsiran Rahman (double movement) dan Saeed (teori kontekstual), penulis hipotesakan mempunyai sandaran paradigmatis yang mapan. Dalam konteks inilah, tulisan ini juga ingin menelisik bagaimana relasi paradigma dan teori penafsiran hukum mereka berdua. Hal ini penting karena telah terjadi krisis paradigmatis dalam studi hukum Islam, yakni terpisahnya wacana teologi sebagai basis paradigmatis hukum dengan wacana hukum Islam itu sendiri. Tulisan ini berbentuk kajian pustaka terhadap pemikiran Rahman dan Saeed. Sebagai alat analisis, penulis memakai teori paradigma sebagaimana digagas oleh Thomas Kuhn dan yang dikembangkan oleh pemikir lain semisal Kuntowijoyo dan Hans Kung. Tulisan ini menyimpulkan, pertama, paradigma Rahman dan Saeed berporos pada visi teologis yang telah bergeser dari teosentris atau antroposentris ke teoantroposentris. Pergeseran visi teologis tersebut adalah dari keimanan tauhidi yang abstrak ke yang fungsional, dari keadilan formal ke keadilan yang substantif, dari peran akal sebagai the logic of justivication and repetition ke the logic of discovery, dari keterbelengguan manusia (fatalisme) ke kebebasan (freedom). Kedua, konsisten dengan paradigma di atas, Rahman dan Saeed merumuskan teori double movement (gerakan ganda) dan teori kontekstual. Teori kontekstual Saeed adalah pengembangan lebih lanjut dari teori gerakan ganda Rahman. Saeed memperjelas bentuk teori gerakan ganda dan merumuskan hirarki nilai. karena itu penulis mensintesakan teori keduanya sebagai penalaran reflektif hukum berbasis nilai maqa>s}id.   This study wants to see how the paradigm and the theory of law interpretation of Fazlur Rahman and Abdullah Saeed. The theory of Rahman (double movement) and Saeed's interpretation (contextual theory), the hypothesis writer has an established paradigmatic backrest. In this context, this paper also wants to explore how the relations of paradigms and the theory of legal interpretation both of them. This is important because there has been a paradigmatic crisis in the study of Islamic law, namely the separation of theological discourse as a paradigmatic basis of law with the discourse of Islamic law it self. This paper takes the form of a literature study of the thoughts of Rahman and Saeed. As an analysis tool, the author uses paradigm theory as initiated by Thomas Kuhn and developed by other thinkers such as Kuntowijoyo and Hans Kung. This paper concludes, first, that the paradigm of Rahman and Saeed pivots on the theological vision that has shifted from theocentric or anthropocentric to theoanthropocentric. The theological vision shift is from the tauhidi faith which is abstract to the functional, from formal justice to substantive justice, from the role of reason as the logic of justification and repetition to the logic of discovery, from human reluctance (fatalism) to freedom. Second, consistent with the paradigm above, Rahman and Saeed formulated the theory of double movement and contextual theory. Saeed's contextual theory is a further development of Rahman's double movement theory. Saeed clarified the form of double movement theory and formulated a value hierarchy. Therefore the author synthesizes the second theory as a value-based legal reflective reasoning.

Abstract

This study is to see the level of acculturation of Javanese and Malay Islams in Javanese community wedding at Selangor Malaysia. According to the theory of culture, each culture has a uniqueness, as a individual uniqueness. The unique culture of Javanese ethnic wedding in Selangor is believed to be a process of negotiation between Malay and Javanese culture.. Acculturation theory is used in this research to explain and understand the reality of that culture. The study concluded that ethnic wedding traditions of Javanese Islam in Selangor pointed to the high level of acculturation. The acculturation leads to a “substitution” and “syncretism”. The substitution refers to the meaning that the Javanese tradition for the most replaced with new cultures (Malay). Acculturation can also be said as a cultural syncretism, the mixing of these two cultures into a new culture that are distinctive.Copyright (c) 2016 by KARSA. Abstract

This paper aims to evaluate puritanism in formulating Islamic laws through the lens of prophetic social science approach. The prophetic social science approach, as an Indonesian historian Kuntowijoyo argues, offers a new perspective in understanding the position of religion in society. It calls for theoanthropocentric, in contrast to theocentric, approach to study religion, thus suggesting a contextualized interpretation of religion. This approach is essential in formulating Islamic laws, while reserving also as a criticism to theocentricism that leads to Islamic puritanism. This article will contribute to the discussion on Islamic legal paradigm as epistemic field as to which theoanthropocentrical reserves as analytical tool to demystify puritanism in formulating Islamic law. In so doing, the article offers to essential elements of formulating Islamic laws: the transformation from theocentric to theoanthropocentric approach and the contextualization of Islamic laws.

Abstract

Abstract: This research would like to see how the instituion of Postgraduate Program (PPs) STAIN Ponorogo to manage about the scholars academic integrity and plagiarism, and how ideal the respond of PPs STAIN Ponorogo about that scholars’ attitude is. This research is quite important because of many things. First, the scientific writing in short paper (makalah) is the entry point of education and teaching in PT. Second, in other side, PPs STAIN Ponorogo is immediately charged to address and respond an indication of plagiarism di the scholars level, and it needs the research as its basis. This research basically is survey quantitatively toward active scholars in Sharia Economic Study amount of 37 scholars. Instrument used is questionnaire with analysis technique of descriptive statistic. This research concludes that as many as 53% of respondents accustomed to cite exactly what words, phrase, sentence say from reference even though not in the context of direct citation (word for word plagiarism). According to it, so the implication of policy can be taken is socialization about academic integrity in any kind and forum, integrating strict rule about plagiarism in the academic guide, shaping an institution “Language Service (Layanan Bahasa)”, and “ Assembly of Academic Consideration (Majelis Pertimbangan Akademik)” which concern about plagiarism and software of plagiarism detector, and no less important is building academic culture which is full of integrity holistically.Abstrak: Penelitian ini ingin melihat bagaimana pengelolaan mahasiswa PPs STAIN Ponorogo terhadap integritas akademik dan plagiarisme, dan bagaimana idealnya respon kebijakan PPs STAIN Ponorogo terhadap sikap mahasiswa tersebut. Penelitian ini dirasa cukup penting karena beberapa hal. Pertama, penulisan karya ilmiah dalam bentuk makalah merupakan ujung tombak pendidikan dan pengajaran PT. Kedua, di sisi yang lain, PPs STAIN Ponorogo dituntut untuk segera menyikapi dan merespon gejala plagiarisme di tingkat mahasiswa, dan ini membutuhkan penelitian sebagai basisnya. Penelitian ini pada dasarnya adalah penelitian survey yang bersifat kuantitatif terhadap mahasiswa aktif Program Studi Ekonomi Syariah yang berjumlah 37 mahasiswa. Instrumen yang dipakai adalah angket dengan teknik analisis statistik deskriptif. Penelitian ini menyimpulkan bahwa sebanyak 53% dari responden terbiasa untuk mengutip secara persis kata, frase dan kalimat dari sumber rujukan walaupun bukan dalam konteks kutipan langsung (word for word plagiarism). Berdasar hal tersebut, maka implikasi kebijakan yang bisa diambil adalah sosialisasi tentang integritas akademik dalam berbagai bentuk dan forum, mengintegrasikan aturan tegas tantang plagiarisme dalam pedoman akademik, membentuk lembaga “Layanan Bahasa”, dan “Majelis Pertimbangan Akademik” yang konsen pada persoalan plagiarisme dan penyediaan software pendeteksi plagiarisme, dan yang tidak kalah penting adalah membangun kultur akademik yang penuh integritas secara holistik.
