Abstract

AbstrakPemanfaatan internet dalam aktivitas manusia menyebabkan keadaan dunia yang tanpa batas (borderless). Banyak kegunaan internet yang dapat dinikmati manusia dalam kehidupannya sehari-hari, namun adanya internet pun tidak luput dari berbagai masalah yang ditimbulkannya. Begitu pula dalam kegiatan bisnis, yang dapat dilakukan secara online atau dikenal dengan istilah E-Commerce. Pada praktiknya aktivitas E-Commerce ini berkaitan dengan perjanjian yang diatur dalam hukum perdata, dan pelaksanaannya seringkali menimbulkan masalah yang menyebabkan kerugian bagi pihak lainnya. Perbuatan yang timbul dan menimbulkan kerugian seperti itu disebut perbuatan melawan hukum. Perbuatan ini secara konvensional telah diatur dalam Pasal 1365 Burgerlijke Wetboek (BW), namun tidak diatur secara eksplisit dalam Undang-Undang Nomor 11 Tahun 2008, padahal salah satu ketentuan hukum yang dapat diterapkan dalam E-Commerce di Indonesia adalah undang-undang temaksud. Kondisi ini menyebabkan banyak terjadi kerugian yang diakibatkan perbuatan melawan hukum tersebut dalam transaksi bisnis secara online, namun Undang-Undang Nomor 11 Tahun 2008 belum dapat mengakomodir masalah tersebut. Keywords : E-Commerce, Perbuatan Melawan Hukum

Abstract

International crimes are acts that are internationally recognized as international crimes. Based on the Rome Statute of 1998 on the International Criminal Court one of the international crimes is genocide that is every act committed with the aim of destroying all or part of a certain national, ethnic, racial or religious group in various ways including: killing the group, causing injury or mental seriously against members of the group, deliberately raising the living conditions of the group calculated to cause physical destruction as a whole or in part, imposing measures intended to prevent birth in the group or forcibly transferring children of that group to other groups.Keywords : Genocide, Transnational Crime

Abstract

Domain names can be obtained through Registration & Decision (Dispute Resolution Service Provider - DRSP). The new ITE Law recognizes the existence of domain names as a result of registration at a Foreign Registrar (Art. 24 paragraph (3)). The ITE Law needs to consider the principles in resolving domain name disputes, including DRSP; therefore, there is a need to harmonize the ITE Law with global regulations and practices. The legal issue that arises is what principles can be considered in resolving domain name disputes under the ITE Law? This research is descriptive-analytical, using the normative juridical method. The data obtained were analyzed using a qualitative juridical approach. The research results show that there are several principles needed to be considered in resolving domain name disputes, including what stated in the DRSP decision, i.e., the principle of legal certainty, the Lawrence Lessig “Architecture” principle, which can be applied regarding the recognition, and implementation of decisions by DRSP domain name dispute resolution service providers, as well as the principle of recognition of the ITE Law. These principles need to be considered to be able to follow the development of best practices in the ICT community related to domain name ownership and the online dispute resolution system by DRSP, which is regulated by ICANN in the UDRP and the Registry Agreement and Registrar Agreement in accordance with the theory of “Code” or “Architecture” of Lawrence Lessig. AbstrakNama domain dapat diperoleh melalui pendaftaran & putusan (Dispute Resolution Service Provider-DRSP). Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) baru mengakui eksistensi nama domain hasil pendaftaran pada registrar asing (Pasal 24 ayat (3)). UU ITE perlu mempertimbangkan prinsip-prinsip dalam penyelesaian sengketa nama domain termasuk DRSP, oleh karena itu perlu adanya harmonisasi regulasi dan praktik global. Permasalahan hukum yang muncul adalah prinsip apa saja yang dapat dipertimbangkan dalam menyelesaikan sengketa nama domain berdasarkan UU ITE. Penelitian ini bersifat deskriptif analitis, menggunakan metode yuridis normatif. Data yang diperoleh dianalisis secara yuridis kualitatif. Hasil penelitian menunjukkan bahwa beberapa prinsip yang perlu dipertimbangkan dalam penyelesaian sengketa nama domain termasuk putusan DRSP adalah prinsip kepastian hukum; prinsip “architecture” Lawrence Lessig yang dapat diterapkan terkait pengakuan dan pelaksanaan putusan penyedia layanan penyelesaian sengketa nama domain oleh DRSP; serta prinsip pengakuan oleh Undang-Undang ITE. Prinsip-prinsip tersebut perlu dipertimbangkan agar mampu mengikuti perkembangan best practices pada masyarakat Teknologi Informasi dan Komunikasi (TIK) terkait kepemilikan nama domain berikut sistem penyelesaian sengketa secara online oleh DRSP yang diatur oleh Internet Corporation for Assigned Names and Numbers (ICANN) dalam Uniform Domain Name Dispute Resolution Policy (UDRP), perjanjian registri, dan perjanjian registrar sesuai dengan teori “code” atau “architecture” dari Lawrence lessig.

Abstract

ABSTRAK Pendaftaran dan putusan merupakan dasar hukum terbitnaya nama domain. Dalam Undang-Undang ITE hanya mengakui eksistensi Nama Domain (ND) hasil pendaftaran pada Registrar Asing (Ps. 24 ayat 3). Teknologi informasi membuka ruang baru yang dinamakan cyberspace. Nama domain termasuk dalam cyberspace yang kepentingannya melibatkan seluruh pengguna internet akan tetapi tidak semua negara mempunyai regulasi yang sesuai dengan perkembangan teori dunia maya. Metode yuridis normatif yang digunakan dalam penelitian ini dengan spesifikasi yang bersifat deskriptif analitis. Teori “Code” atau “Architecture” Lawrence Lessig dapat diterapkan terkait pengakuan dan pelaksanaan putusan penyedia layanan penyelesaian sengketa nama domain yang melibatkan pihak Warga Negara Indonesia. Konsep pengaturan hukum terkait pengakuan dan pelaksanaan putusan penyedia layanan penyelesaian sengketa nama domain asing di Indonesia, adalah yang mampu mengikuti perkembangan best practices pada masyarakat TIK terkait kepemilikan nama domain berikut sistem penyelesaian sengketa secara online yang diatur oleh ICANN dalam UDRP dan dalam Perjanjian Registri dan Perjanjian Registrar sesuai dengan teori “Code” atau “Architecture” dari Lawrence lessig. Kata kunci: putusan arbitrase asing; nama domain; sengketa kepemilikan ABSTRACT Registration and sentence are the legal basis for issuing domain names. In the ITE Law, it only recognizes the existence of domain names as a result of registration at the Foreign Registrar (Art. 24 paragraph 3). Domain names are included in cyberspace whose interests involve all internet users but not all countries have regulations that are in accordance with the development of cyber theory. juridical normative used in this research with descriptive analytical specifications. Lawrence Lessig's "Code" or "Architecture" theory can be applied regarding the recognition and implementation of decisions of domain name dispute resolution service providers involving Indonesian citizens. The concept of legal arrangements related to recognition andimplementation of decisions of foreign domain name dispute resolution service providers in Indonesia, are those that are able to follow the development of best practices in the ICT community related to domain name ownership and the online dispute resolution system regulated by ICANN in the UDRP and in the Registry Agreement and Registrar Agreement in accordance with the theory of "Code Or “Architecture” by Lawrence lessig. Abstract

One of the government's policies to accelerate development is to pave the way for investment from within the country and from abroad. Investors from abroad expect to own a house with a clear ownership status with the aim of ensuring the security of their investment, while the legal instruments governing home ownership by foreigners still lead to multiple interpretations. The research is descriptive analytical, using normative juridical methods and the resulting data is analyzed in a qualitative juridical manner. The results obtained from this study indicate that the land provisions are regulated in Government Regulation Number 103 of 2015 but in this regulation there are still controversies in its application. The government as a policy maker has an obligation to clearly regulate home ownership by foreigners as an effort to ensure legal certainty for foreign investors in investing in the country. The regulation must also protect the community by upholding a balanced justice between the community, businessmen and authorities

Abstract

Standard clauses are agreements determined by one party, usually a business actor. Standardized clauses are always part of e-commerce agreements, and this can be considered legal because it implements the principle of freedom of contract. This research aims to determine standard clauses in e-commerce in terms of civil law in Indonesia. The study is descriptive and utilizes normative juridical research through a legislative approach. Subsequently, secondary data collection techniques were employed using a literature review. The acquired data were then subjected to qualitative analysis. Based on the analysis in this research, it is known that standard clauses embody the principle of freedom of contract as regulated in Article 1338, paragraph (1) of the Code of Civil Law. However, they must still fulfill the legal requirements of the agreement as regulated in Article 1320 of the Code of Civil Law.

Abstract

This study aims to find the impact of the implementation of the Independent Campus, Freedom to Learn programme on academic policies in higher education, especifically the Faculty of Law, Indonesian Computer University so that this programme can be implemented more optimally in the future. The study conducted by the author is descriptive analytical with a normative juridical approach. The resulting data is analyzed in a qualitative juridical manner so that the hierarchy of laws and regulations can be considered and can guarantee legal certainty. Based on the results of the study, it can be seen that the Independent Campus, Freedom to Learn programme organized by the Unikom Faculty of Law has met the expectations of both the institution and its partners, although there are still shortcomings in its implementation practice, including internal policy alignment. The increasing competence of students participating in the Independent Campus, Freedom to Learn programme is a factor that needs to be followed up by the program, as well as the need to expand collaboration with various parties/partners to provide wider opportunities for students. The Independent Campus, Freedom to Learn programme at the Faculty of Law, Unikom, still has obstacles, namely related to the addition of new partners, curriculum adjustments and adjustments to the Academic Information System that accommodates the Independent Campus, Freedom to Learn programme. This research is a media for searching for problems, analyzes and solutions needed in the implementation of the Independent Campus, Freedom to Learn programme at the UNIKOM Faculty of Law, so that appropriate solutions can be found for these problems, especially related to internal policies within the UNIKOM Faculty of Law relating to with the implementation of the Independent Campus, Freedom to Learn programme.

Abstract

This study aims to provide in-depth knowledge for partners/community of Margahayu District, Bandung Regency through legal advocacy related to the use of Simadu (Integrated Village Management Information System) as a means of public service. The method used is the lecture method and legal advocacy related to the legal aspects of online-based public services through Simadu as well as participatory methods to explore various problems found in the field. Legal advocacy to village and sub-district officials in the Margahayu District, Bandung Regency because the use of Simadu does not rule out the possibility of legal problems, so that all village and sub-district officials really need legal advice to anticipate and resolve legal problems that arise due to the use of Simadu such as related data personal.

Abstract

Abstrak Tujuan penelitian ini dilakukan untuk mengetahui akibat hukum dari peredaran narkoba lintas batas sebagai kejahatan transnasional. Penelitian ini bersifat deskriptif analitik, dengan menggunakan pendekatan yuridis normatif dan data yang diperoleh dianalisis secara yuridis kualitatif, dalam hal ini analisis dilakukan dengan mempertimbangkan hierarki peraturan perundang-undangan agar suatu peraturan perundang-undangan tidak bertentangan dengan peraturan perundang-undangan lainnya. Berdasarkan hasil penelitian peredaran narkoba tidak hanya dilakukan secara konvensional, namun telah melewati batas negara sehingga dianggap sebagai kejahatan transnasional. Dengan demikian peredaran narkoba saat ini menjadi masalah hukum global karena tidak hanya melibatkan satu negara tetapi juga melibatkan beberapa negara dengan sistem hukum negara tersebut. Dampak dari penelitian ini menggambarkan perlunya penegakan hukum terhadap peredaran narkoba lintas batas sebagai kejahatan transnasional. Kesimpulannya, akibat hukum perdagangan narkoba sebagai kejahatan transnasional dapat dituntut tidak hanya berdasarkan peraturan perundang-undangan Indonesia tetapi juga internasional karena Indonesia telah meratifikasi Convention Against Gelap Traffic In Narcotic Drugs And Psychotropic Substances 1988. Abstract The purpose of this research is to conducted to determine the legal consequences of cross-border drug trafficking as a transnational crime. This research is descriptive analytic, using a normative juridical approach and the data obtained is analyzed juridically qualitatively, in this case the analysis is carried out by considering the hierarchy of laws and regulations so that a statutory regulation does not conflict with other laws and regulations. Based on the research results drug trafficking is not only carried out conventionally, but has crossed national borders so that it is considered a transnational crime. Thus the circulation of drugs is currently a global legal problem because it does not only involve one country but also involves several countries with that country's legal system. The impact of this study illustrates the need for law enforcement for cross-border drug trafficking as a transnational crime. The conclusion is that the legal consequences of drug trafficking as a transnational crime can be prosecuted not only based on Indonesian legislation but also internationally because Indonesia has ratified the Convention Against Illicit Traffic In Narcotic Drugs And Psychotropic Substances 1988.

Abstract

The purpose of this study is to find out and analyze the legal actions that can be taken against perpetrators of spreading komputer viruses via email (cyber spamming) based on applicable law. The research is descriptive analytical, using a normative juridical approach, through laws and regulations related to information technology, then the data obtained are analyzed in a qualitative juridical manner. The results of the study show that the act of spreading komputer viruses via email (cyber spamming) can be applied to the provisions of Article 30 paragraph (2) in conjunction with Article 46 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions, provided that it must be proven that the actions taken by the perpetrators fulfill the subjective and objective elements of the article. The conclusion obtained from this research is that the act of spreading komputer viruses via email (cyber spamming) is a violation of the law as regulated in the Electronic Information and Transaction Law and the perpetrators must be given legal sanctions according to applicable regulations. The impact of this research is that the government must always supervise the development of information technology and violations that occur so that they are always accommodated by existing regulations, besides that the public must always be careful in using internet-based information media.
