Abstract

This research presents the latest information on the analysis of Islamic law on the practice of fulfilling the rights of wives and children in the household among the Tablighi Jama'ah. This research is presented in a qualitative form with the approach of sociology of law (Islamic law). This study uses Islamic law (mashlahat theory) as an analysis tool in analyzing research data. In the end, this study concluded that the rights and obligations of husband and wife and children in the household among the Tablighi Jama'ah were actually subject to and did not differ from the provisions of Law No. 1 of 1974, KHI and so from the opinion of Imam Shafi'i, although in reality related to the Tablighi Jama'ah policy, especially when selecting members who want to leave the khuruj still needs to be improved so that there are no more members of the jama'ah who are mentally incapable, especially financially making khuruj, so this does not impact on the non-implementation of the obligations of the husband in the household and the poor image of preaching khuruj in the midst of society, especially the city of Medan.

Abstract

Fokus penelitian adalah bagaimana kedudukan anak zina dalam kewarisan sebelum dan sesudah Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, dan paradigma hakim Pengadilan Agama di Sumatera Utara terhadap Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Model penelitian (mode of inquiry) penelitian ini adalah kualitatif. Pada akhirnya penelitian ini menunjukkan bahwa paradigma hakim Pengadilan Agama di Sumatera Utara terhadap Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, jika dimaknai dari sudut perlindungan anak bagi golongan anak sebagai putusan yang progresif sesuai dengan tuntutan rasa keadilan setiap anak, untuk mendapatkan pemenuhan hak keperdataannya jika orang tuanya tidak melakukan pengakuan atau pengesahan terhadapnya. Sedangkan jika dimaknai dari sudut hukum waris, maka Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 dimaksudkan terhadap anak yang dilahirkan dari orang tuanya telah dilangsungkan perkawinan menurut hukum agama dan kepercayaannya, bukan anak yang dilahirkan dari orang tuanya yang belum/tidak pernah terikat perkawinan sama sekali. Sehingga kepada anak zina yang sama sekali tidak memiliki hubungan pernikahan diantara kedua orang tuanya, dan menjadikan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 sebagai dasar agar anak zina tersebut mendapat waris dari ayah biologisnya tidak begitu serta dapat diterima, karena di dalam hukum Islam telah diatur dengan tegas tentang status dan hak dari seorang anak hasil zina, sehingga dengan memberlakukan kewarisan kepada anak zina akan menimbulkan penolakan umat Islam di Indonesia.

Abstract

Abstrak Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal (UU JPH) telah mengatur kewajiban sertifikasi halal bagi produk tertentu di Indonesia. Pelaksanaan ini bertujuan untuk melindungi konsumen, khususnya umat Muslim, dari produk yang tidak sesuai dengan prinsip syariah. Namun, hingga batas waktu implementasi wajib seluruh produk pada Oktober 2024, banyak pelaku usaha, khususnya Usaha (UMKM), belum memenuhi kewajiban sertifikasi halal. Hal ini memunculkan tantangan dalam pelaksanaan kebijakan tersebut, MUI Sumatera Utara memiliki peran penting dalam mendukung implementasi sertifikasi halal, baik melalui ketetapan sertifikasi produk, maupun edukasi kepada Masyarakat, dan pelaku usaha. Terkait dengan itu semua Penelitian ini mengeksplorasi lebih jauh peran strategis MUI Sumatera Utara dalam implementasi kebijakan Jaminan Produk Halal, termasuk tantangan yang dihadapi, seperti keterbatasan sumber daya, rendahnya pemahaman pelaku usaha, serta faktor biaya sertifikasi. Berdasarkan analisis ini, diusulkan rekomendasi untuk memperkuat sinergi antara MUI, pemerintah daerah, dan pelaku usaha dalam memastikan keberhasilan sertifikasi halal yang merata. Hasil penelitian ini diharapkan dapat menjadi referensi bagi pemangku kebijakan untuk meningkatkan efektivitas implementasi UU JPH di Sumatera Utara.

Abstract

The purpose of this research is to find out how the review of the mafq?d husband according to Islamic law and to find out the views of the Ulama of Langsa City regarding the distribution of the inheritance of the mafq?d husband. Based on the results of the research, it is concluded that in Islamic law, a mafqud (missing) husband is considered to have died after a waiting period, generally four years, in accordance with the Shafi'i Mazhab. If the mafqud husband has not been found within this period, then his status is considered legally dead, even though there is no physical evidence of his death. During this waiting period, the mafqud husband's property is still managed with the principle of prudence, and the arrangement and use of the property is done in a way that preserves the rights of the heirs and prevents potential conflicts. Langsa City scholars, such as Abati Salahuddin, Tgk. Syibral Malasyi, Tgk. Hadi Subulana, Abi Rifana, and Walidi Ramli Amri, identified two main situations related to mafqud husbands in the context of inheritance distribution. First, if the mafqud husband is found alive after the waiting period, the property that has been distributed remains the property of each heir in accordance with the provisions that apply at that time. Second, if the mafqud husband is not found within four years and is considered dead, then his inheritance can be distributed to the heirs in accordance with the provisions of Islamic law after the court process establishes the status of his death. They emphasized the need for careful and fair management of the estate during the waiting period as well as the judge's decision to ensure the distribution of the estate in accordance with sharia.
