Abstract

With the new advances in the Industrial Revolution 4.0 era, which were initiated by artificial intelligence coupled with genetic engineering and nanotechnology, changes will occur in a very fast period of time and result in an impact on the economic industry and also governance in the presence of new business that was born of innovators to create strategies through digital platforms. In Indonesia, digital innovation is not only in one area, but also in the fields of education, food, health, which is also used as a new law in government that supports the Industrial Revolution 4.0 era. These developments also affected the world industry. The birth of the term Industrial Revolution 4.0 was a continuation of the previous industrial revolution. The Industrial Revolution 4.0 is an amalgamation of an optimized manufacturing industry with the latest internet technology.

Abstract

The implication of Information and Communication Technologies (ICT) convergence toward national legislation in the framework of ICT development requires understanding of basic principles in tec-hnology, industrial, and regulation aspects. The importance of establishing legal convergence con-cept is aimed at anticipating the implication of ICT convergence in regard to support Indonesian development in accordance with the role of technology in modern era especially for human life and its implication to their environment. This understanding will encourage the process of establishing legislation which governs all concerns which is closely relevant to regulated sectors or issues in such legislation particularly in telecommunications sector, in which such legislation becomes a regulation in accordance with the function of law. The legislation approach, regulation approach, and self-regulatory approach might be used to anticipate the ICT convergence implications. Keywords: convergence, regulation, telecommunications

Abstract

Abstract Amid the development of technology, the use of social media is increasing. Information on social media can be easily obtained including a person's personal data and privacy matters. This certainly triggers the misuse of personal data when interacting between social media users. Even though personal data are part of human rights that should be protected. This study aims to analyze the extent to which the government provides legal protection for personal data against misuse of personal data on social media platforms based on the ITE Law and how legal actions can be taken by victims for misuse of personal data on social media platforms. The author uses the normative juridical research method through the review of invitations to settle upon the matter. Based on the results of the study, the government has not provided maximum legal protection for personal data for the society against the misuse of personal data, especially those that occur on social media platforms. The establishment of a clear and comprehensive law is needed to determine definite steps in the process of using personal data in order to provide legal certainty to protect personal data of society. Legal actions that victims can take for misuse of personal data on social media platforms provided by the law are still limited to carrying out lawsuits and demanding administrative sanctions. Keyword: Legal Protection, Personal Data, Privacy, Social Media.

Abstract

Over-The-Top Services are a concrete form of technological developments whose existence makes it easier for people to carry out daily activities, for example to watch a movie and communicate. The phenomenon related to Over-The-Top Services that recently emerged due to the COVID-19 pandemic is watch party, which is an activity of watching movie together virtually with the help of Over-The-Top Services. This activity has the potential to violate Copyright because it can be categorized as the implementation of the economic rights of the creator or copyright holder of films that are watched without permission. On the other hand, watch party can also be categorized as acts that do not violate Copyright if they meet the fair use requirements based on Law Number 8 of 2014 on Copyright. This research was conducted with the aim of finding answers to these questions. This research was conducted using a normative juridical approach and a qualitative juridical analysis method, in which the author examines in depth the related primary, secondary, and tertiary legal materials. The results of the study indicate that the watch party activity is a form of announcement of creations and includes fair use because it is carried out without commercial purposes.

Abstract

Pada saat ini perilaku digital di Indonesia semakin berkembang sehingga industri teknologi informasi dan komunikasi mengarah kepada suatu konvergensi. Perilaku digital di Indonesia mengarah kepada konvergensi pada perangkat mobile, ditandai dengan semakin menguatnya penggunaan layanan menggunakan internet seperti layanan Over The Top (“OTT”). Melihat dari penjelasan definisi dari OTT, dapat dilihat bahwa OTT memberikan layanan nya melalui jaringan internet yang disediakan oleh operator telekomunikasi. Maka, OTT dalam hal ini dapat dikatakan “menumpang” pada jaringan internet yang dimiliki operator telekomunikasi karena tidak adanya bentuk kerjasama yang resmi antara media OTT dan operator telekomunikasi. Kasus yang terjadi antara Netflix v. PT Telkom-Telkomsel menunjukkan bahwa di Indonesia ini pengaturan terkait media OTT masih hanya melalui satu lembaga saja. Lalu, penulis akan melakukan perbandingan regulasi dengan metode yuridis normatif dengan regulasi yang ada di Korea Selatan yaitu Telecommunication Business Act of South Korea 2021. Kenyataannya, regulasi telekomunikasi di Indonesia saat ini belum ada yang mengatur secara rinci terkait media OTT. Hasil dari perbandingan di Korea Selatan, mereka menerapkan charges of compliances untuk menertibkan media OTT. Diharapkan melalui penelitian ini segera dibuatnya regulasi terkait media OTT dan solusi untuk penertiban nya yaitu charges of compliances

Abstract

Kleros blockchain arbitration presents a promising solution for faster, more cost-effective, and more secure arbitration in digital environment. However, it comes with significant challenges; confidentiality and impartiality. Arbitration is often chosen due to its confidentiality. Examining Kleros’ blockchain arbitration, it becomes apparent that the platform lacks of confidentiality regime and therefore raising a number of probable issues. The anonymity of Kleros jurors complicates the matters, makes it challenging to establish trust, legally bind jurors, monitor compliance, and address potential jurors’ misconduct. Additionally, jurors’ anonymity prohibits disclosure of pertinent information, which may  rise  justifiable doubts, thereby resulting in jurors’ impartiality are questioned. Therefore, this article advocates for Kleros to reconsider their strict anonymity policy and to introduce confidentiality and impartiality provisions in order to align more with the established legal practices in digital arbitration environment (Lex Digitalis Arbitri).

Abstract

The development of electronic commerce has opened up the possibility of disputes among cross-border traders. Online Dispute Resolution (ODR) is one emerging form of dispute resolution adopted by China through the China International Economic and Trade Arbitration Commission (CIETAC). While Indonesia has regulations such as Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution and BANI Rules 2022 governing the electronic correspondence process of dispute resolution, ODR is not explicitly addressed. This research examines the legal recognition of ODR in Indonesia and explores the urgency of establishing ODR institutions with reference to CIETAC. The research findings indicate that Indonesia has not explicitly recognized ODR, signifying the urgent need to establish ODR platforms and revise arbitration regulations and dispute resolution in Indonesia. China's experience in recognizing ODR through the establishment of platforms and regulatory updates in its arbitration regime can serve as guidance for Indonesia in the future

Abstract

This research aims to analyze the legal protection of personal data subject rights in television broadcast content against violations of privacy right based on Law Number 32 of 2002 concerning Broadcasting (Broadcasting Law) and Law Number 27 of 2022 concerning Personal Data Protection (PDP Law). The approach method used in this research is normative juridical. The data used is primary and secondary data. The collected data is then analyzed using a qualitative juridical method. The result of this research shows that broadcast programs that exploit private life by broadcasting personal information of objects in their content without first providing clear information about the purpose and use of the personal data can be defined as an indicator of privacy violation in television broadcast content when linked to the rights of personal data subjects based on the PDP Law. In addition, legal protection of personal data subject rights in television broadcast content against violation of privacy right is designed to provide legal certainty to personal data subject in television broadcast content. Victims of privacy violation in television broadcast content who are data subject now have their right strengthened, including the right to sue and receive compensation.

Abstract

Transformasi digital yang masif telah memberikan pengaruh terhadap berbagai bidang termasuk ekonomi. Berkembangnya fitur Pay Later sebagai metode pembayaran berbentuk pinjaman online secara instan memberikan kemudahan bagi Pengguna dalam melakukan transaksi pada e-commerce termasuk Shopee. Akan tetapi, dalam pelaksanaanya tidak sedikit menimbulkan dampak negatif yaitu pelanggaran terhadap data pribadi Pengguna. Maka dari ini, penelitian ini bertujuan untuk mengkaji posisi hukum para pihak pengguna aplikasi Shopee terkait fitur Pay Later dan bagaimana regulasi terkait pelindungan data pribadi pengguna aplikasi Shopee di Indonesia. Penelitian ini dilakukan menggunakan metode pendekatan yuridis normatif dan analisis data kualitatif. Hasil penelitian menunjukan bahwa dalam penggunaan fitur Pay Later menurut Undang-Undang Nomor 8 Tahun 1999 tentang Pelindungan konsumen terdapat keterlibatan tiga pihak yaitu Pengguna akun, Platform penyedia layanan, dan Fintech serta regulasi terkait Pelindungan Data Pribadi saat ini secara regulatif telah diatur dalam Undang-Undang Nomor 2022 tentang Pelindungan Data Pribadi dan dasar pemrosesan data pribadi milik Shopee sudah sesuai dengan regulasi yang berlaku hanya saja terdapat kewajiban yang tidak dilaksanakan oleh Pengendali Data Pribadi. Penelitian ini diharapkan dapat memberikan pemahaman mengenai pelindungan terhadap data pribadi Pengguna aplikasi Shopee terkait Fitur Pay Later.
