The emergence of an economic impact analysis in the decision of the price fixing cartel case in Article 5 of the UULPM which should use the approach in that article is Per se Illegal, including Decision No. 08/KPPU-L/2018, Decision No. 04/KPPI-I/2016, Decision No. 32/KPPU-L/2008, Decision No. 26/KPPU-L/2007, and Decision No. 02/KPPU-I/2003 by analyzing the use of a single Per se Illegal approach in the decision of the price fixing cartel case in ensuring legal certainty. The approach in this study uses doctrinal research. From the results of the analysis of the decision related to the price fixing cartel in the consideration of the commission assembly, it has been found in the form of economic evidence/economic analysis which is a characteristic of the Rule of Reason approach to the reasons for the emergence of the economic analysis not being explained explicitly and clearly by the commission assembly, regarding the assessment that can be made. carried out by the KPPU regarding the agreement in Article 5 of the UULPM, economic evidence may appear if the requirement to prove the agreement is difficult to find. Legal considerations using the Per se Illegal approach as the sole approach in the KPPU's decision related to price fixing cartels in ensuring legal certainty, this has been in line with what is positively regulated in Article 5 of the UULPM wherein the provision contains the phrase "prohibited" on behavior and the resulting impact. must be wrong or illegal so that it does not need further analysis. One of the forms of transfer of regional property is through a grant with the approval of the regent. However, civil servants as recipients of land grants in 2008 and 2014 have not been able to issue them as Certificates of Ownership. This study aims to identify the inhibiting factors for the issuance of Property Rights Certificates, as well as to analyze legal certainty regarding land and building ownership for buyers and to find out the forms of efforts that can be taken by grantees. This study produces and proposes the following findings: First, the inhibiting factors in the issuance of certificates of property rights at the Korpri Griya Mutiara Indah housing estate in North Penajam Paser are the legal substance factor and the legal factor. second, the legal certainty of land and building ownership for the buyer in the form of Building Use Rights on the land of Management Rights which is still a regional asset and the efforts that can be made by the recipient of the land grant for the Korpri Griya Mutiara Indah Housing in North Penajam Paser can be done first. through the Regional Finance and Assets Agency, which then develops regional property in the form of land with management rights, approval from the DPRD is needed so that civil servants can apply for an upgrade to a Certificate of Ownership to the land office of North Penajam Paser Regency.

Masyarakat hukum adat adalah entitas yang memiliki otonomi dengan hak-hak konstitusional yang harus dilindungi. Namun, pada kenyataannya, pengakuan terhadap masyarakat hukum adat sebagai subjek hukum sering kali masih lemah. Oleh karena itu, jurnal ini bertujuan untuk menggambarkan hambatan dalam implementasi pengakuan terhadap masyarakat hukum adat serta menjelaskan mekanisme pemerintah dalam melindungi hak-hak masyarakat hukum adat melalui peraturan perundang-undangan. Penelitian ini menggunakan pendekatan metodologi hukum normatif kualitatif yang menjelaskan permasalahan hukum berdasarkan undang-undang sebelumnya yang relevan dan melalui kajian pustaka. Hasil penelitian menunjukkan bahwa masyarakat adat di Indonesia memiliki otonomi dalam mengatur kehidupan mereka yang berkembang bersama komunitasnya. Namun, pengakuan terhadap keberadaan masyarakat hukum adat masih menghadapi hambatan struktural, terutama dalam proses legislatif yang lambat dan rumit. Keterlambatan dalam pengesahan undang-undang yang mengakui dan melindungi masyarakat adat menyebabkan berbagai masalah, termasuk pelanggaran hak individu dan kolektif masyarakat hukum adat. Oleh karena itu, pemahaman dan pengakuan terhadap masyarakat hukum adat di Indonesia sangat penting untuk memastikan keberlanjutan, keadilan, dan harmoni dalam masyarakat. Tindakan konkret dari pemerintah, lembaga legislatif, dan lembaga negara terkait lainnya diperlukan untuk secara efektif menangani masalah perlindungan dan pengakuan masyarakat hukum adat

The decision to build a new capital on the Kalimantan Island called Nusantara caused various conflicts, such as the neglect and marginalization of indigenous peoples and the ignoring of their certainty of access and meaningful participation. This paper explains how the substance of the Nusantara Capital development regulation is to provide full protection to Indigenous peoples or vice versa, how it impacts the protection of Indigenous people's rights, as well as how the affirmative action model fulfills the rights of Indigenous peoples in the Nusantara Capital area. Through a socio-legal approach as the method, the results of the study found that the constitution has regulated the recognition of indigenous peoples, but in the substance of regulations related to the Nusantara capital, the phrases that regulate are very weak. The phrases used do not explicitly ensure the protection of the rights of indigenous peoples, which has an impact on various neglect of the existence of indigenous peoples. As a result, a model of affirmative action is needed for indigenous peoples in the regulation of the Nusantara capital. This includes ensuring access for indigenous peoples to be involved in policymaking. Furthermore, transparency of information in the development of the Nusantara capital is important to formulate policies that accommodate the protection and fulfillment of the rights of indigenous peoples. It is important to ensure the recognition of indigenous peoples and their living space through an affirmative action model regulated by the head of the Nusantara capital authority.

Negara memiliki tanggung jawab dalam melindungi segenap hak-hak yang melekat dalam diri warga negaranya, tidak terbatas suku, etnis, hingga agama apapun. Dalam Undang-Undang Dasar pun telah dijamin menganai perlindungan hak dasar yaitu hak untuk hidup serta hak kebudayaan. Lalu bagaimana jika ada kebudayaan yang akhirnya melanggar hak dasar manusia itu sendiri, terlebih lagi ketika kebudayaan ini terletak pada persimpangan antara hukum adat yang menjadi salah satu tonggak dalam system hukum yang berlaku diIndonesia dengan hukum pidana serta Sistem hukum negara yang berlaku menjadi secara nasional. Untuk menjawab hal itu diadopsilah konsep system hukum pluralisme hukum yang kemudian akan menyelesaikan dan memberi jalan dalam penyelesaian permasalahan tersebut. Tradisi Carok yang menimbulkan korban Jiwa, menimbulkan banyak kontroversial dalam penyelesaiannya. Namun sebagai warga negara yang terikat dengan Peraturan Perundangundangan, maka haruslah mengikuti peraturan perundnag-undangan pula. Dan hukum adat serta kebudayaan yang berlaku haruslah pula sejalan dengan tujuan negara dan tidak bertentangan dengan peraturan yang hierarkinya lebih tinggi.

PT. Trubaindo Coal Mining (PT. TCM) dianggap telah melakukan pertambangan ilegal karena telah memanfaatkan tanah ulayat tanpa izin masyarakat adat setempat. Karena itu, penulis membuat jurnal dengan judul “Kontroversi Pertambangan Ilegal Pada Tanah Ulayat Warga Kutai Barat (Studi Kasus Pada PT Trubaindo Coal Mining (TCM))”. Penelitian ini menggunakkan metode pendekatan yuridis normatif. Hasil yang didapati dari penelitian yang dilakukan ialah didapati bahwa penyalahgunaan tanah ulayat ini sering terjadi akibat ketidakjelasan Pasal 135 Undang-undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara. Karena itu, dilakukan penelitian untuk membahas terkait implikasi hukum pertambangan ilegal tersebut serta bagaimana peran pemerintah dalam menindaklanjuti konflik tersebut.

Presidential Regulation No. 78 of 2023 on the Amendment to Presidential Regulation No. 62 of 2018 on the Handling of Societal Impacts in the context of Land Provision for National Development has been enacted. Community social impact in this study is land controlled by the community used for national development, both national strategic projects and non-national strategic projects. This research aims to see the implementation of the regulation on the handling of community social impacts in the Archipelago's capital city and the legal consequences on residents' land rights. The research method used is a social legal reserch approach by considering the contribution of doctrinal research by adding factors outside the norms, namely social facts, legal practices and all that influence them. The results of the study explain that the provision of compensation in Presidential Regulation Number 78 of 2023 concerning Handling Community Social Impacts in the Context of Providing Land for National Development is given to residents who do not have a right base and if there is compensation given in this case there are differences in Law Number 2 of 2012 concerning Land Acquisition for Development for Public Interest. The issuance of Presidential Regulation No. 78 of 2023 on Handling Community Social Impacts that the land rights of residents affected by development do not exist and are not recognised, so this shows that affected residents lose their land rights. The issuance of Presidential Regulation No. 78 of 2023 concerning Handling of Community Social Impacts that the land rights of residents affected by development do not exist and are not recognised, so this shows that affected residents lose their land rights and there is no deliberation to determine the amount of compensation, so there is no agreement in determining the amount of compensation for affected communities. The implementation of Community Social Impact Handling in the Framework of Land Provision for National Development in terms of providing compensation without recognition of land rights has the potential to remove people’s basic rights to land, especially residents affected by development projects run by the government.Keywords: Land Provision; National Development; Compensation

The Independent Self-Supported Transmigration (TSM) program in Tengin Baru Village, Sepaku District, North Penajam Paser Regency is part of Indonesia's broader effort to promote equitable development and social welfare. However, its implementation has triggered land disputes between transmigrant communities and the palm oil company PT. Agro Indomas. The complexity of the conflict has increased due to the area's inclusion within the delineation of the Nusantara Capital City (IKN), which enforces a land freezing policy—restricting the transfer of land rights through various legal instruments. This study adopts a socio-legal research approach to evaluate the effectiveness of existing legal mechanisms in providing legal certainty for landowners and to identify the barriers faced by communities in asserting their land rights. The findings indicate that the land freezing policy is not supported by adequate dispute resolution instruments, resulting in prolonged legal uncertainty and weakening the position of transmigrant communities in claiming their land.Keywords: Disputes; IKN; Legal Certainty; Land Freezing; Swakarsa Mandiri Transmigration
