Abstract

Lembaga peradilan merupakan institusi penyelesaian sengketa litigasi yang selama ini menjadi pilihan utama penggunaannya oleh para pihak yang bersengketa, selaras dengan makin derasnya infiltrasi hukum modern di setiap penjuru dunia. Penelitian ini adalah penelitian hukum non-yuridis empiris/ sosiologis atau penelitian hukum non-doktrinal, yaitu data yang bersifat kualitatif. Sikap mediator dapat dianalisis dari dua sisi, dimana mediator melakukan suatu tindakan semata-mata ingin membantu, dan mempercepat proses penyelesaian sengketa. Pada sisi lain, tindakan mediator dalam melakukan negosiasi tidak seluruhnya dapat memuaskan para pihak yang bersengketa. Keunggulan/kelebihan mediator hakim dalam penyelesaian perkara perdata di Pengadilan Negeri Jepara, antara lain mediator telah memiliki skill, berupa keterampilan komunikasi efektif, melakukan presentasi diri, dan pengelolaan diri. Diperlukan adanya sosialisasi/penyuluhan hukum yang lebih optimal diatur dalam Peraturan Mahkamah Agung Nomor 1 Tahun 2016 guna mengingatkan kepada masyarakat mengenai arti penting penyelesaian sengketa secara damai melalui mediasi.

Abstract

Peranan pemerintah sangat dibutuhkan untuk mengatur regulasi dalam hal penguasaan, pemilikan dan penggunaan tanah untuk kepastian hukum di bidang pertanahan.Badan Pertahanan Nasional (BPN) mengeluarkan produk yang bernama Sertipikat Tanah, sebagai dokumen bukti kepemilikan dan hak seseorang atau badan hukum atas tanah. Salah satunya adalah Hak Guna Bangunan merupakan hak atas tanah yang memiliki jangka waktu tertentu, apabila diperpanjang oleh pemegang haknya sebelum jangka waktu yang ditentukan, maka hak guna bangunan tersebut dapat di perpanjang berdasarkan ketentuan yang ditetapkan oleh Kantor Badan Pertanahan Nasional (BPN). Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap pemegang HGU yang telah berakhir haknya serta berapa lama hak perioritas itu melekat pada bekas pemegang HGU.Pendekatan yang digunakan adalah yuridis empiris yaitu melakukan wawancara dengan Kepala Kantor Pertanahan kabupaten Pati yang kemudian menghubungkan antara norma hukum yang berlaku. Penentuan sampel menggunakan purposive sampling dan pengolahan data secara deskriptif analitis. Hasil penelitian hapusnya hak atas tanah adalah salah satunya berakhirnya jangka waktu, sehingga manakala SHGU jangka waktunya telah berakhir, maka menjadi tanah yang langsung dikuasai oleh Negara. perlindungan hukum kepada bekas pemegang HGU, yang mana pemegang HGU tersebut adalah Badan Hukum yang memperoleh tanah dengan cara pembelian dari beberapa hak atas tanah dan secara fisik dikuasai bekas pemegang hak tersebut. Batas berapa tahun hak prioritas itu melekat kepada bekas pemegang SHGU sementara dalam aturan ditegaskan 2 tahun setelah berakhir, bekas pemegang hak wajib mengajukan pembaharuan hak, kemudian jika itu tidak dilaksanakan maka didalam ketentuan tidak diatur sampai berapa tahun bekas pemegang hak memiliki hak prioritas.

Abstract

The community service activities carried out at the Kudus Religious Court aim to make the members of the Kudus community whose marriages cause problems that lead to divorce proceedings. Before the divorce decision is handed down by the Religious Court Judge, mediation must be carried out by the mediator at the Kudus Religious Court so that it can be agreed that no divorce will occur. The mediator who will mediate the parties who will file for divorce can come from a Judge Mediator or a Non-Judge Mediator.  This service accompanies the disputing parties when mediation is carried out by a non-judge mediator. This is done because there are still many disputing parties who cannot be mediated successfully so that divorce is still ongoing.  The failure of Non-Judge Mediators in the Religious Courts in reconciling the disputing parties (husband and wife) is mostly due to the egos of each one which is difficult to understand the importance of marriage, so that many still end in divorce. Because of these conditions, there is still a need for socialization about marriage in general.

Abstract

The rapid advancement of technology has transformed commercial transactions, enabling consumers to access goods online more easily. However, this convenience has also made consumers increasingly vulnerable to misleading marketing practices, particularly in discount-based sales (obral). This study aims to analyze the legal protection afforded to consumers under Indonesian Law No. 8 of 1999 on Consumer Protection, focusing on deceptive practices in discount sales through online platforms. Utilizing a non-doctrinal legal research method, this study integrates statutory analysis with real-world consumer behavior and marketing phenomena. Data were collected through literature review and legal document analysis, focusing on primary legal materials such as the Indonesian Civil Code and relevant consumer protection laws. The findings reveal that despite clear regulations, particularly Article 11 letter (f) of Law No. 8/1999, many businesses continue to violate legal norms by using misleading discount claims, often resulting in consumer losses. The study highlights a lack of effective enforcement and public legal awareness as contributing factors to these recurring violations. It also emphasizes the urgent need for stronger regulatory supervision and educational initiatives to empower consumers. The implications of this research point to the necessity of integrating legal norms with ethical business practices to ensure a fair, transparent, and just digital marketplace. Recommendations include the enforcement of stricter penalties for violations and the promotion of legal literacy among consumers.

Abstract

This study aims to evaluate the implementation of the parking fee policy on public roads in Kudus city and to identify the factors inhibiting its successful execution. The study uses a qualitative research approach and applies Merilee S. Grindle’s theory, which focuses on two indicators: policy content and the context of implementation. Data were collected through interviews with key stakeholders, including local government officials, parking attendants, and the public. The findings reveal that the policy’s implementation is facing significant challenges, primarily due to the persistence of illegal parking practices and the involvement of unauthorized parking attendants in the city. These issues have undermined the intended outcomes of the parking fee policy, preventing it from achieving its full potential in regulating traffic and generating revenue for public services. The study also highlights factors such as inadequate enforcement mechanisms, insufficient public awareness, and limited coordination between local authorities and enforcement agencies. Based on these findings, it is recommended that the local government strengthen law enforcement, improve public education on the benefits of the policy, and increase collaboration with stakeholders to ensure more effective implementation of the parking fee policy. The research contributes to the understanding of urban policy challenges in managing public resources and offers practical insights for local governments seeking to implement similar policies in urban areas.
