Abstract

Setiap peserta didik memiliki kesiapan, potensi, kemampuan, karakter, dan gaya belajar yang berbeda-beda. Perbedaan-perbedaan di dalam diri peserta didik membutuhkan pembelajaran atau perlakuan yang berbeda pula untuk mengoptimalkan potensi yang dimiliki. Pembelajaran berdiferensiasi menjadi jawaban bagi guru untuk memberikan pembelajaran sesuai dengan kebutuhan dan karakteristik peserta didik. Namun, kenyataannya di lapangan masih banyak guru yang belum memiliki pemahaman yang komprehensif terkait pembelajaran berdiferensiasi dan penyusunan asesmennya dan pemahaman antar guru masih sering terjadi perbedaan penafsiran. Kegiatan pengabdian ini bertujuan untuk meningkatkan pemahaman atau literasi guru terkait pembelajaran berdiferensiasi dan penyusunan asesmennya, serta bertujuan untuk meningkatkan keterampilan guru dalam menerapkan pembelajaran berdiferensiasi serta penyusunan asesmennya. Kegiatan dilaksanakan dalam bentuk sosialisasi, pelatihan dan pendampingan terhadap 72 guru di korwilcam Bancak, Kabupaten Semarang dan beberapa guru di Malaysia. Hasil dari kegiatan pengabdian masyarakat ini yaitu pemahaman guru terkait pembelajaran berdiferensiasi menjadi meningkat dari yang awalnya sebelum pelatihan guru yang paham hanya 20% dan setelah pelatihan guru-guru 100% menjadi paham dengan rincian 88% menyatakan sangat paham, 10% menyatakan paham, dan 2% menyatakan cukup paham. Selain itu, guru-guru juga menyatakan keterampilannya meningkat dari yang awalnya sebelum pelatihan guru yang terampil hanya 20% dan setelah pelatihan guru-guru 100% menjadi terampil dengan rincian 85% menyatakan sangat meningkat, 12% menyatakan meningkat dan 3% menyatakan cukup meningkat. Para guru juga menyatakan bahwa buku panduan pembelajaran berdiferensiasi sangat bermanfaat dalam meningkatkan pemahaman guru terkait pembelajaran berdiferensiasi, dimana sebesar 95% guru menyatakan sangat bermanfaat dan 5% guru menyatakan bermanfaat.

Abstract

This community service program aimed to improve lecturers’ competence in developing a local wisdom-based Islamic Religious Education (PAI) quality assurance module at STAI Ibnurusyd Kotabumi. The program employed a participatory mentoring approach involving 10 participants, consisting of PAI lecturers, the Quality Assurance Institute (LPM), study program leaders, and a local community representative. Activities were conducted through socialization, training, workshops, intensive mentoring, and evaluation, with data collected using participant observation, interviews, and document analysis, and analyzed qualitatively. The main problem addressed was the existing quality assurance module, which was normative, culturally non-contextual, and lacked operational quality indicators. The results showed an increase in lecturers’ conceptual understanding of local wisdom-based quality assurance, reflected in the successful formulation of contextual quality indicators integrating values of cooperation, deliberation, politeness, and religiosity. The main output of the program was a locally developed, wisdom-based PAI quality assurance module, validated by LPM. Practically, the module serves as an institutional reference for planning, implementing, and evaluating PAI learning, strengthens lecturers’ professionalism, and supports the development of a culturally responsive quality culture in Islamic higher education, particularly in the socio-cultural context of North Lampung.

Abstract

Advances in information technology have driven the use of electronic contracts, one of which is the clickwrap agreement, which is widely used in modern digital transactions. However, this form of agreement raises legal issues regarding its validity and the application of the principle of freedom of contract, particularly due to its inherently one-sided nature and limited room for negotiation. This study aims to analyze the validity of clickwrap agreements from the perspective of the principle of freedom of contract and to examine the challenges and implications within Indonesian contract law. The research method employed is normative legal research using a legislative and conceptual approach. Legal materials were collected through literature review and analyzed using the syllogistic method with deductive reasoning. The results of the study indicate that clickwrap agreements are valid and meet the requirements for a valid contract under Article 1320 of the Civil Code. However, the application of the principle of freedom of contract has not been optimal due to the lack of room for negotiation for users. The challenges that arise include an imbalance of power between the parties, a lack of user understanding of the contract’s contents, the potential for clauses that are detrimental to users, and regulatory ambiguity. The implications of these conditions relate to legal certainty, the status of the parties, consumer protection, law enforcement, and the development of contract law.

Abstract

The Dompet Umat Institution is a non-profit organization, researchers asking for help to find out more about raising funds conducted by the social organization Dompet Ummat in Pontianak. Therefore, researchers want to discuss more deeply about how the strategy of the Dompet Ummat Institute in raising funds in the city of Pontianak. With the formulation of the problem (1) What is the fundraising strategy of the Dompet Ummat Institution in looking at opportunities in the field? (2) How does the Dompet Ummat Institute in Formulating fundraising strategies for proposing existing benefits? (3) How does the Dompetku Institution implement the fundraising strategy? (4) How does the Dompet Ummat Institute conduct monitoring and evaluation after conducting a fundraising strategy? In conducting this research the writer will use a descriptive method, which this study will discuss, describe and describe the investment strategy of fundraising for the Dompet Ummat Institution. It can be concluded that (1) the Dompet Institute looks at the opportunities that exist in the field by using various media tools both from online and online media that support to search for any type of opportunity in the field. (2) The Dompet Institute in formulating fundraising strategies by making programs and then designing from the program as interesting as possible can awaken potential donors. (3) Dompet Ummat Institution in implementing the fundraising strategy by providing donation shuttle services. The Dompet Ummat Institution in monitoring and evaluating ongoing programs follows these programs, those who participate in controlling all parties of the Fundraising team itself. Abstract

AbstractThis research proposed to identify consumer weakness in solving of dispute with businessman; identify and describe consumer effort in solving of dispute with businessman. It was empirical research which used qualitatively and descriptively method. This research used primary data perceived from interview result and secondary data perceived from act, literature, document and Lp2K’s brochure. Data collection was done by field observation and bibliography. And then, the datum would analyzed by qualitatively and interactively model. The result of the research showed some conditions influenced consumer weakness when faced businessman. Firstly, when faced businessman from State-Owned corporation and Local corporation: (1) because State-Owned corporation stronger than consumer; (2) State-Owned corporation and Local corporation always dodged to give compensation to consumer when they were loss out; (3) businessman was represented by their staff and could not make direct decision; (4) businessman always prolonged time to construct team for compensation investigation; (5) businessman usually recovery, continue and live on without give compensation according the agreement. Secondly, when faced private businessman: (1) businessman compensated lowest amount only; (2) businessman said that only their rule was obedient. consumer endeavor could run by two sides: Firstly, from consumer themselves: (1) improvement of legal communication among consumer; (2) improvement of legal understanding generally; (3) understanding of Consumerism Law. Secondly, influence of outsider: (1) legal extension; (2) talk show; (3) letters from readers; (4) consumer education; (5) seminar about consumerism law; and (6) press broadcast.Keywords: consumer endeavor, solving of dispute.AbstrakPenelitian ini bertujuan untuk mengidentifikasi ketidakberdayaan konsumen dalam menyelesaikan sengketa dengan pelaku usaha serta mengidentifikasi dan mendeskripsikan upaya-upaya yang dapat ditempuh oleh konsumen dalam rangka penyelesaian sengketa dengan pelaku usaha. Penelitian ini merupakan penelitian empiris dengan metode kualitatif yang bersifat deskriptif. Penelitian menggunakan data primer yang diperoleh dari hasil wawancara dengan informan, maupun data sekunder yang diperoleh dari peraturan perundang-undangan, literatur, dokumen-dokumen dan brosur-brosur dari LP2K. Pengumpulan data dilakukan dengan penelitian lapangan dan kepustakaan. Selanjutnya data akan dianalisis secara kualitatif dengan model interaktif. Hasil penelitian menunjukkan, terdapat beberapa kondisi yang menyebabkan konsumen tidak berdaya ketika berhadapan dengan pelaku usaha. pertama, ketika berhadapan dengan pelaku usaha BUMN dan Perusahaan Daerah : (1) karena posisi BUMN lebih kuat dibandingkan dengan konsumen, (2) BUMN dan Perusda selalu berkelit untuk memberi ganti rugi kepada konsumen apabila terjadi kerugian yang menimpa konsumen, (3) pelaku usaha hanya diwakili oleh stafnya sehingga tidak berani memutus secara langsung, (4) pelaku usaha selalu mengulur waktu bahwa ia akan membentuk tim pengkaji ganti rugi, (5) pelaku usaha biasanya hanya sanggup memperbaiki, menyambung atau menghidupkan lagi tanpa mau mengganti sesuai perjanjian. Kedua, ketika berhadapan dengan pelaku usaha swasta : (1) pelaku usaha hanya mau mengganti kerugian sekecil mungkin, (2) pelaku usaha berdalih bahwa aturan yang dibuatnya itulah yang harus dipatuhi. Upaya pemberdayaan konsumen dapat ditempuh melalui dua sisi, pertama, dari diri konsumen : (1) perlunya peningkatan komunikasi hukum konsumen, (2) peningkatan pemahaman hukum secara umum, (3) pemahaman Undang-undang Perlindungan Konsumen. Kedua, pengaruh pihak luar : (1) penyuluhan hukum, (2) acara dengar pendapat (talkshow), (3) surat pembaca, (4) pendidikan konsumen, (5) seminar hukum perlindungan konsumen, dan (6) siaran pers.Kata Kunci : pemberdayaan konsumen, penyelesaian sengketa.

Abstract

AbstractThis artricles aims to examines the problems regarding sanctions or legal consequences that may be imposed on customers who default on the credit agreement at the bank and legal protection measures for the bank as a provider of funds to customers if there is default. This research is categorized as a normative legal research, which is prescriptive. The research approach used in this research is a statute approach. In nature the data used in this research is primary legal materials, secondary legal materials and tertiary legal materials. The data collection technique used in this research is library research and through cyber media. The results shows that sanctions or legal consequences for debtors who are in default, namely compensation in default, cancellation of agreement in default, transfer of risk in default, and paying court fees in default. The legal protection measures for banks to customers if there is default are internal legal protection and external legal protection. Internal legal protection is contained in the credit agreement. As for external legal protection contained in legislations.Keywords: Credit Agreement; Default; Legal Protection.AbstrakArtikel ini bertujuan untuk mengkaji sanksi atau akibat hukum yang dapat dikenakan kepada nasabah yang melakukan wanprestasi terhadap perjanjian kredit pada bank dan bentuk perlindungan hukum bagi bank sebagai pemberi dana kepada nasabah apabila terdapat wanprestasi. Penelitian ini merupakan penelitian hukum normatif yang bersifat preskriptif. Pendekatan penelitian yang digunakan adalah pendekatan perundang-undangan. Sumber bahan hukum adalah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan bahan hukum yang digunakan adalah studi kepustakaan dan melalui cyber media. Hasil penelitian menunjukkan bahwa sanksi atau akibat-akibat hukum bagi debitur yang wanprestasi, yaitu pembayaran ganti rugi dalam wanprestasi, pembatalan perjanjian dalam wanprestasi, peralihan resiko dalam wanprestasi, dan membayar biaya perkara dalam wanprestasi. Bentuk - bentuk perlindungan hukum bagi bank sebagai pemberi dana kepada nasabah apabila terdapat wanprestasi, dibedakan atas perlindungan hukum internal dan perlindungan hukum eksternal. Perlindungan hukum internal terdapat dalam perjanjian kredit itu sendiri. Adapun perlindungan hukum eksternal terdapat dalam Peraturan Perundang-Undangan.Kata Kunci: Perjanjian Kredit; Perlindungan Hukum; Wanprestasi.
