Abstract

Tujuan penelitian ini adalah menganalisis pengelolaan zakat produktif dalam bentuk program kantin kontainer oleh Dompet Dhuafa untuk pembangunan di Lampung. Metode yang digunakan dalam penelitian ini adalah kualitatif deskriptif dengan melakukan mekanisme pengumpulan data melalui wawancara dan literatur review guna mendukung analisis dalam penelitian ini. Hasil penelitian bahwa zakat produktif yang dilakukan oleh dompet dhuafa Lampung dalam program “kantin kontainer” menekankan pada pendidikan, berupa beasiswa dan sarana yang dibutuhkan mahasiswa serta memberikan pelatihan untuk menciptakan pola pikir yang baik dengan adanya pengetahuan dan ilmu yang diterima. Penyaluran zakat ini telah sesuai dengna hukum ekonomi Syariah. Pengelolaan zakat produktif yang telah diuraikan dapat ditarik benang merah bahwa zakat produktif mampu memberikan berbagai bentuk positif dalam mencapai pembangunan berkelanjutann, yaitu bentuk zakat dengan pengelolaan usaha. Mekanisme tersebut sejalan dengan tujuan dari adanya zakat produktif yang mampu memeberikan perubahan dimasa yang akan datang.

Abstract

Penelitian ini bertujuan untuk memahami dan menganalisis faktor penyebab penolakan klaim oleh PT Allianz yang diajukan nasabah bernama Ifranius yang mana dibenarkan menurut hukum. Berdasarkan hasil penelitian dapat disimpulkan bahwa penolakan klaim oleh PT Allianz yang diajukan Ifranius karena PT Allianz tidak mengakui polis asuransi yang bersangkutan dengan meminta persyaratan yang bertentangan dengan peraturan yang berlaku, selain itu juga membebankan kepada PT Allianz untuk mengganti kerugian serta terjerat dalam kasus pidana karena tidak adanya i’tikad baik dari penanggung untuk menerima pengajuan klaim.

Abstract

This study explores the implementation of the Smart Village program in the digitalization of administrative services in Bangun Rejo Village, Central Lampung, through the lens of fiqh siyasah and the principles of good governance. The program represents a governmental initiative aimed at enhancing public service delivery through the use of information technology. Employing a descriptive qualitative method, data were collected through observation, interviews, and documentation. The findings reveal that the program encounters several challenges, particularly in technological infrastructure, human resource capacity, and community engagement. Nevertheless, from a fiqh siyasah perspective, the initiative reflects the responsibility of ulil amri (legitimate authority) to promote public welfare. In conclusion, the success of the Smart Village program relies significantly on strengthening digital literacy, fostering multi-sector collaboration, and implementing governance practices rooted in Islamic ethics that emphasize participatory and responsive principles.

Abstract

This research reveals the changing sounds of articles in the Job Creation Law and analysis according to Maslahah Mursalah. The purpose of this research is to find out the parts of the Job Creation Law in Indonesia that are detrimental and have a bad impact on one of the parties (labor). Indonesian government has simplified through an omnibus law in which there are several laws that have been trimmed to make it more efficient. The concept of this omnibus law is in the form of a job creation law that has 11 clusters, one of which regulates employment. Then socialization and study are needed to avoid these conflicts and losses. This research uses a normative juridical approach method, namely research by examining library materials (library research). The conclusion of this study is that changes in the regulations of several articles contained in the Job Creation Law still have a bad impact on workers or workers if applied to the company and its employees. This is inconsistent with the theory of maslahah mursalah, which is to attach importance to the lives of many people or more of detriment than benefits to labor.Key words: Maslahah Mursalah, Job Creation Law, Labor Protection

Abstract

The current progress of the economic sector has resulted in a high level of community needs, thus encouraging business actors to be more creative in creating businesses. One of them can be seen by the number of processed food traders in Bandar Lampung City, especially in Kota Baru Village. However, in running their business, the majority of food traders have not realized the importance of fulfilling halal standards for the products sold and also implementing protection for consumers. So to provide legal certainty, Law number 33 of 2014 concerning Halal Product Assurance was promulgated. The guarantee of the implementation of halal products aims to provide comfort, security, safety, and certainty of the availability of halal products for the public in consuming and using products, as well as increasing added value for business actors to produce and sell halal products. The study is focused on the discussion of how the form of protection of Muslim consumers against the inclusion of halal labels that are not registered with BPJPH for MSMEs in the culinary sector in Kota Baru Village, Bandar Lampung City.with a comparative analysis research method with Sampling Techniques In this study with the sampling technique used, namely, Non-probability sampling with purposive sampling techniques. The results of the study show that there are still many MSME actors who have included their halal labels and have been running their business activities but have not been registered with BPJPH because the cost aspect that must be incurred by MSME actors in the process of applying for halal certification is also an obstacle for them. As well as the lack of knowledge from business actors about the importance of registering halal certification on their processed products.Keywords: Muslim Consumer Protection; Halal Products; MSMEs

Abstract

The conflict between Palestine and Israel has led to a boycott of pro-Israel products. Several countries, including Indonesia through MUI Fatwa No. 83 of 2023, promoted the boycott of products affiliated with Israel as a form of support for Palestine which has caused good and bad impacts, especially for companies associated with Israel, especially in the United States, so the issuance of this fatwa has encouraged Muslims to take a boycott stance with stronger conviction. That is why it is worth studying in the maqāṣid al-sharī’ah study. The type of research method used in this research is qualitative research. This research in collecting data uses the library research study method (Library research). The result of this research shows that the influence of MUI fatwa Number 83 of 2023 for Muslims on the boycott of pro-Israel products, especially in Indonesia, has a strong Sharia foundation because the Muslim community already knows that Israel's actions are colonialism against Palestine. While in the maqāṣid al-sharī’ah review, the boycott of pro-Israel products is to help fellow Muslims to realize the objectives of sharia to achieve the welfare of fellow Muslims and weaken the power of Islam's enemies.

Abstract

Abstract: This study examines the potential of e-commerce cashback coins as zakat objects from an Islamic legal perspective. In the digital era, cashback is an incentive in the form of a virtual money refund after a transaction, generally in the form of coins that can be used for subsequent transactions and have a value equivalent to currency. These cashback coins have economic value and can be considered as assets owned, so it is necessary to review whether these coins meet the requirements for zakat. Using a qualitative approach through literature study, this study describes how cashback coins have the potential to become zakat objects. The results of the analysis show that cashback coins are categorized as income zakat (zakat al-mâl al mustafad). Cashback coins can be subject to zakat if they meet the criteria of nisab and full ownership (tamlik). First, cashback coins are considered full property when the user has control over their use, either for transactions or cashed out. Second, the accumulated value of cashback coins can reach a nisab equivalent to 85 grams of gold or equivalent to one-twelfth of 85 grams of gold, so a significant amount of cashback has the potential to be subject to zakat. With a zakat rate of 2.5% of the total value of the coins collected, the payment mechanism can be done monthly or annually without having to meet the haul requirements. Keywords: Cashback Coins; E-commerce; Zakat.   Abstrak: Penelitian ini mengkaji potensi koin cashback e-commerce sebagai objek zakat dalam perspektif hukum Islam. Di era digital, cashback adalah insentif berupa pengembalian uang virtual setelah transaksi, umumnya dalam bentuk koin yang dapat digunakan untuk transaksi berikutnya dan memiliki nilai setara mata uang. Koin cashback ini memiliki nilai ekonomi dan dapat dianggap sebagai harta yang dimiliki, sehingga diperlukan tinjauan apakah koin ini memenuhi syarat zakat. Dengan menggunakan pendekatan kualitatif melalui studi pustaka, penelitian ini mendeskripsikan bagaimana koin cashback berpotensi menjadi objek zakat. Hasil analisis menunjukkan bahwa koin cashback dikategorikan sebagai zakat penghasilan (zakat al-mâl al-mustafad). Koin cashback dapat dikenakan zakat apabila memenuhi kriteria nisab dan kepemilikan penuh (tamlik). Pertama, koin cashback dianggap sebagai harta milik penuh ketika pengguna memiliki kontrol atas penggunaannya, baik untuk bertransaksi atau dicairkan. Kedua, akumulasi nilai koin cashback dapat mencapai nisab yang setara dengan 85 gram emas atau setara seperduabelas dari 85 gram emas, sehingga jumlah yang signifikan dari cashback berpotensi diwajibkan zakat. Dengan kadar zakat sebesar 2,5% dari total nilai koin yang terkumpul, mekanisme pembayaran dapat dilakukan bulanan atau tahunan tanpa harus memenuhi syarat haul. Abstract

Penelitian ini bertujuan untuk mengetahui: (1) Implementasi Pasal 6 Peraturan Daerah Kabupaten Way Kanan Nomor 11 Tahun 2011 tentang Penataan Ruang di Desa Bumi Harjo ditinjau dari Fikih Siyasah Tanfidziyah, dan (2) upaya yang dilakukan pemerintah dan masyarakat dalam menanggulangi kerusakan jalan di wilayah tersebut. Penelitian ini menggunakan pendekatan kualitatif dengan metode penelitian studi kasus. Pengumpulan data dilakukan melalui wawancara mendalam dengan perangkat desa, tokoh masyarakat, dan warga, observasi langsung di lapangan, dokumentasi serta studi pustaka. Instrumen penelitian yang digunakan adalah pedoman wawancara, catatan lapangan, dan lembar observasi. Teknik analisis data menggunakan model Interaktif Miles dan Huberman yang meliputi reduksi data, penyajian data, dan penarikan kesimpulan. (1) Hasil penelitian menunjukkan bahwa implementasi Pasal 6 Peraturan Daerah tentang Penataan Ruang belum sepenuhnya efektif, karena masih banyak ruas jalan yang mengalami kerusakan berat dalam jangka waktu lama. Pemerintah daerah dinilai kurang tanggap terhadap aspirasi masyarakat, dengan keterbatasan anggaran menjadi alasan utama lambatnya perbaikan. (2) Masyarakat menunjukkan partisipasi aktif dengan melakukan gotong royong, memperbaiki sistem drainase, dan mengusulkan program perbaikan melalui Musrenbang desa. Dari perspektif Fikih Siyasah Tanfidziyah, hal ini mencerminkan lemahnya pelaksanaan asas amanah dan kesejahteraan masyarakat oleh pemerintah. Penelitian ini menekankan pentingnya sinergi antara pemerintah dan masyarakat dalam mewujudkan pelayanan publik yang adil dan berkelanjutan sesuai dengan syariat Islam.

Abstract

Abstract: Indonesia, as a country with the largest Muslim population, the need for halal products is crucial. The only basis of the halal product trust system in Indonesia is halal certificates and labels, carried out by producers who obtain halal label permits through LPPOM MUI and BPJPH. So, specific information is only for business actors and institutions that know the status and process of halal products. However, many cases of non-transparency are still needed to increase public trust in halal products, so the authenticity of halal certification and consumer trust is sometimes questioned. The role of blockchain technology is crucial to provide transparent information to every actor and consumer in the supply chain. The research method used is qualitative research, which is library research. The data analysis technique is descriptive analysis. The data used are primarily in the form of books, journals, laws and regulations, articles, and other references. The potential of blockchain as a data storage technology can help ensure transparency and security in the supply chain of halal products. Blockchain also can potentially reduce fraud and counterfeit products in halal markets, as consumers can check the product's journey from start to finish and verify that the product is completely halal and free from haram contamination. However, the application of this technology in Indonesia faces various challenges, such as limited infrastructure, unsupportive regulations, and high implementation costs. Keywords: Blockchain, Halal, Consumer, Supply Chain. Abstrak: Indonesia sebagai negara dengan populasi muslim terbesar, kebutuhan produk halal menjadi penting. Satu-satunya dasar sistem kepercayaan terhadap produk halal di Indonesia yaitu sertifikat dan label halal, yang dikeluarkan oleh produsen yang tlah mendapat izin label halal. Jadi, informasi spesifik hanya pelaku usaha dan lembaga yang mengetahui status dan proses kehalalan produk. Namun masih banyak kasus mengenai tidak transparansi yang sebenarnya penting untuk meningkatkan kepercayaan konsumen atau masyarakat terhadap adanya produk halal sehingga keaslian sertifikasi halal dan kepercayaan konsumen terkadang dipertanyakan. Agar dapat memberikan informasi yang jelas serta transparan kepada semua pihak dan konsumen dalam rantai pasokan halal, peran Blockchain menjadi sangat penting. Metode penelitian yang digunakan yaitu berupa penelitian kualitatif. Jenis penelitian ini penelitian pustaka atau library research. Teknik analisis data bersifat deskriptif analisis. Data yang digunakan adalah data primer berupa buku, jurnal, peraturan, dan artikel serta referensi lainnya. Hasil penelitian menunjukkan potensi blockchain sebagai teknologi penyimpanan data, memastikan transparansi dalam rantai pasokan produk halal. Teknologi ini memungkinkan pencatatan informasi yang tidak dapat diubah, sehingga dapat memberikan kepercayaan lebih bagi konsumen. Blockchain juga memiliki potensi untuk mengurangi kasus penipuan dan produk palsu di pasar halal. Meskipun demikian, penerapan teknologi ini di Indonesia menghadapi berbagai tantangan, seperti infrastruktur yang terbatas, regulasi yang belum mendukung, dan biaya implementasi yang cukup tinggi. Oleh karena itu, diperlukan kolaborasi antara pemerintah, lembaga sertifikasi, dan pelaku industri untuk menciptakan ekosistem halal berbasis blockchain yang kuat di masa depan.
