Abstract

Problematika kekerasan terhadap anak sering terjadi di sekolah, terdapat faktor-faktor yang menyebabkan anak menerima perlakuan berupa kekerasan fisik maupun psikis disekolah sehingga akan diurai berbagai kebijakan non-penal yang dapat diterapkan untuk meminimalisir permasalahan itu. Di sekolah anak sering menjadi objek kekerasan fisik dan psikis, terutama di saat anak melalaikan kewajibannya, atau tidak mematuhi aturan yang ditetapkan di sekolah. Metode penelitian yang digunakan yaitu yuridis normatif. Tujuan penelitian ini yaitu untuk menjawab permasalahan kekerasan terhadap anak yang terjadi di sekolah dengan perspektif hukum. Hasil penelitian menunjukkan bahwa bahwa faktor yang menyebabkan anak menjadi korban kekerasan fisik dan psikis di sekolah dikarenakan anak melakukan kesalahan atau pelanggaran disiplin. Kekerasan dianggap oleh guru sebagai tindakan pendisiplinan anak didik serta mampu menjadikan anak didik yang melakukan pelanggaran disiplin atau kesalahan menyadari kesalahan yang telah dilakukannya dan tidak mengulangi lagi perbuatannya, serta dimaksudkan agar anak didik yang lain, tidak mengikuti melakukan perbuatan yang sama. Rekomendasi dari permasalahan itu, agar berbagai sekolah melakukan langkah preventif terhadap potensi kekerasan pada anak dengan melakukan edukasi kepada guru dan peserta didik.

Abstract

Cybercrime is becoming increasingly complex in today's digital era, one of which is sextortion, which poses a serious threat to the security and privacy of individuals, particularly women and children. Sextortion is a technology-based sexual crime that exploits a victim's intimate data for blackmail. This study aims to determine the form of sextortion crime, to determine legal protection for victims of sextortion crimes and to determine the obstacles in efforts to provide legal protection for victims of sextortion crimes. This type of research uses an empirical legal research approach. The nature of the research used is descriptive analysis. Using the method of legislative approach related to the legal issues being studied. The results of this study indicate that the legal protection provided to victims of sextortion by the police, including: Provision of legal assistance, Confidentiality of victim identity, Arrest of perpetrators with preliminary evidence, Provision of other assistance in the form of health services, Rehabilitation efforts. Legal protection for victims of crime is an effort to restore losses suffered by victims. Legal regulations in Indonesia cover various aspects of community life in Indonesia, one example is the formation of various Government Regulations and Laws that regulate and guarantee the security of the continuity of community life. For the obstacles themselves there are no, but for the difficulty in revealing this case (profiling), investigators find it difficult to communicate with the victim, where the victim feels embarrassed when communicating because of the problems he experiences which cause fear, anxiety and trauma that he feels during this case.

Abstract

Penelitian ini bertujuan untuk menganalisis faktor-faktor penyebab terjadinya kejahatan pencurian kendaraan bermotor di wilayah hukum Polsek Muara Batang Gadis, Kabupaten Mandailing Natal, serta mengetahui peran dan upaya kepolisian dalam penanggulangannya. Metode yang digunakan adalah penelitian kualitatif dengan pendekatan deskriptif, yang menekankan pada kondisi alamiah dan analisis induktif terhadap data berupa kata-kata tertulis maupun lisan. Hasil penelitian menunjukkan bahwa faktor-faktor penyebab utama terjadinya pencurian kendaraan bermotor meliputi faktor ekonomi, sosial budaya, dan lingkungan yang saling berinteraksi. Polsek Muara Batang Gadis menjalankan dua bentuk upaya penanggulangan, yaitu upaya preventif dan represif. Upaya preventif dilakukan melalui kegiatan sosialisasi dan patroli rutin untuk mencegah tindak kejahatan, sedangkan upaya represif dilakukan dengan penangkapan, penahanan, dan pelimpahan perkara ke pengadilan sebagai bentuk penegakan hukum terhadap pelaku

Abstract

Illegitimate children are a social phenomenon that still occurs frequently and raises legal issues, particularly regarding the civil status and inheritance rights of children. Differences in legal systems between countries lead to differences in the treatment of illegitimate children, especially in determining their legal relationship with their parents and inheritance rights. This study discusses the criteria and inheritance rights of illegitimate children according to Indonesian and Thai law through a comparative legal approach. In Indonesian law, the status of children born out of wedlock is determined by their birth outside of a legal marriage and initially only has a legal relationship with the mother, while the relationship with the biological father only arises after recognition or proof of blood relations (Article 43 of Law No. 1 of 1974, Civil Code, and Constitutional Court Decision No. 46/PUU-VIII/2010). Meanwhile, Thai law automatically recognizes children born out of wedlock as legitimate children of the mother (Section 1546 CCC), but legal relations with the father and inheritance rights only arise through strict legitimation (Sections 1547–1548 CCC). This study uses a normative legal research method with a legislative approach, literature review, and qualitative analysis. The results of the analysis show that the main difference between the two legal systems lies in the mechanisms of recognition and legitimation: Indonesia emphasizes proof of descent and recognition to obtain inheritance rights, while Thailand requires formal legitimation for children born out of wedlock to obtain status and inheritance rights equal to legitimate children. Although different, both legal systems seek to protect the inheritance rights of children born out of wedlock.

Abstract

Crime today knows no age, and one of the most alarming forms for society is theft accompanied by violence, which is committed not only by adults but also by children. In such cases, children may be subject to sanctions under the applicable criminal laws in Indonesia. These acts can result in injuries ranging from minor to severe and may even lead to the death of victims or members of the public. This study employs an empirical juridical research method, using primary data, secondary data, and Islamic legal sources. Data collection techniques include interviews conducted at the Binjai Police Resort (Polres Binjai) and documentation studies. Based on the findings, the perpetrators’ modus operandi involves approaching the victim closely, kicking the victim until they fall, and then using a machete to slash or injure parts of the victim’s body. The factors contributing to violent theft committed by children include religious factors, economic conditions, family environment, education, peer influence, drug abuse, and curiosity or experimentation. Efforts to address this issue in Binjai City include pre-emptive measures, such as police outreach programs in schools to educate students not to engage in harmful behaviors like joining motorcycle gangs; preventive measures, including traffic regulation and routine patrols; and repressive measures, such as the arrest of offenders.

Abstract

This article examines the protection of the rights of pregnant and breastfeeding female prisoners within the Indonesian correctional system from the perspectives of law and reproductive justice. Although the rights of prisoners have been regulated in various statutory frameworks, previous studies have largely been dominated by descriptive-normative approaches and have not critically addressed the gap between the legal framework and its implementation, particularly in fulfilling women’s specific reproductive health needs within correctional settings. This study aims to critically analyze the fulfillment of the rights of pregnant and breastfeeding female prisoners and to evaluate the limitations of their implementation in correctional practice. This research employs a normative juridical method using statutory and conceptual approaches, supported by documentary studies of various legal sources and academic literature. The findings indicate that, normatively, the state has established an adequate legal protection framework. However, in practice, there is a significant gap between norms and implementation, as reflected in limited facilities, the lack of comprehensive reproductive health services, and the absence of an optimal gender-responsive approach within the correctional system. This study affirms that existing protections remain at the level of normative compliance and have not fully reflected substantive justice. Theoretically, it contributes by integrating a reproductive justice perspective into correctional law studies, while practically offering directions for policy reconstruction that are more responsive, inclusive, and aligned with global human rights standards. [Artikel ini mengkaji perlindungan hak narapidana perempuan hamil dan menyusui dalam sistem pemasyarakatan di Indonesia dalam perspektif hukum dan keadilan reproduktif. Meskipun pengaturan mengenai hak narapidana telah diatur dalam berbagai peraturan perundang-undangan, kajian sebelumnya masih didominasi oleh pendekatan deskriptif-normatif dan belum secara kritis mengkaji kesenjangan antara kerangka hukum dan implementasinya, khususnya dalam memenuhi kebutuhan spesifik perempuan terkait kesehatan reproduksi di lingkungan pemasyarakatan. Penelitian ini bertujuan untuk menganalisis secara kritis pemenuhan hak narapidana perempuan hamil dan menyusui serta mengevaluasi keterbatasan implementasinya dalam praktik pemasyarakatan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, yang didukung oleh studi dokumenter terhadap berbagai sumber hukum dan literatur akademik. Hasil penelitian menunjukkan bahwa secara normatif negara telah menyediakan kerangka perlindungan hukum yang memadai. Namun, dalam praktiknya terdapat kesenjangan signifikan antara norma dan implementasi, yang ditandai oleh keterbatasan fasilitas, minimnya dukungan layanan kesehatan reproduktif yang komprehensif, serta belum optimalnya pendekatan berbasis kebutuhan gender dalam sistem pemasyarakatan. Penelitian ini menegaskan bahwa perlindungan yang ada masih berada pada tahap pemenuhan normatif dan belum sepenuhnya mencerminkan keadilan substantif. Secara teoretis, penelitian ini berkontribusi dengan mengintegrasikan perspektif keadilan reproduktif ke dalam kajian hukum pemasyarakatan, sementara secara praktis menawarkan arah rekonstruksi kebijakan yang lebih responsif, inklusif, dan selaras dengan standar hak asasi manusia global.]
