Abstract

The regulation of castration criminal sanctions for the protection of children as victims of sexual violence is not based on the value of justice. Castration punishment can only be imposed on perpetrators of child sexual violence who fall within the criteria determined by Article 81 paragraph (7). If it does not meet the existing criteria, castration cannot be imposed. This discriminatory attitude shows the government's lack of seriousness in making policies for child protection. Sexual violence against children is a very fatal crime, damaging the future of children and causing disgrace to this nation. For this reason, it is necessary to reconstruct the regulation of castration criminal sanctions in order to protect children as victims of sexual violence based on the value of justice. The reconstruction includes the reconstruction of values and the reconstruction of legal norms. The reconstruction of castration regulations aims to protect all children in Indonesia, especially children who are victims of sexual violence. So that children do not become victims of sexual violence again

Abstract

Trafficking of children is an act that takes away the human rights of children. Trafficking in children seizes children's freedom, destroys the period of growth and development of children. Child trafficking is closely related to solicitation and persuasion from perpetrators. On the other hand, child trafficking is also accompanied by acts of coercion and violence by actors against children. As victims of trafficking in persons, children are unable to fight back, both physically and mentally. Children experience helplessness that can damage their future. For this reason, it is necessary to provide legal protection for children as victims of trafficking in persons. The legal protection provided is in the form of punishment for perpetrators of child trafficking. The legal protection provided aims to ensure that children are guaranteed security, peace and prosperity during their growth and development period, so that children are able to become the next generation of the nation and become leaders of the nation in the future

Abstract

Sexual violence against children is an abhorrent act that profoundly impacts their growth and development. To address this issue, the government has a responsibility to educate teenagers about sexual education, as outlined in article 136-137 of Law (UU) Number 36 of 2009, which focuses on Adolescent Health. However, despite these efforts, the prevalence of sexual violence continues to rise. One contributing factor is believed to be the lack of comprehensive sex education for children at an early age. Therefore, it is crucial to provide age-appropriate sex education to children, tailored to their developmental stage. This education aims to empower children to recognize and prevent acts of sexual violence. It includes teaching children about the importance of safeguarding and protecting their private body parts, establishing boundaries, and equipping them with procedures to protect their body and dignity. By implementing such measures, we can strive to create a safer environment for children and reduce the occurrence of sexual violence.

Abstract

Anak merupakan karunia dan amanah Allah SWT yang harus senantiasa dijaga dan dilindungi karena dalam diri anak melekat harkat, martabat, dan hak-hak sebagai manusia yang harus dijunjung tinggi. Oleh karena itu kita harus bersikap responsif dan progresif dalam menata aturan yang berlaku berkait anak untuk menjaga anak terjauh dari perbuatan pidana, namun pada kenyataannya tidak terjaminnya kelangsungan eksistensi anak dikarenakan masih maraknya kasus-kasus yang melibatkan anak, khususnya kasus persetubuhan terhadap anak yang dilakukan oleh orang yang lebih dewasa. Perlindungan terhadap anak, merupakan hak asasi yang harus diperoleh anak. Sehubungan dengan hal ini, pasal 27 ayat (1) UUD 1945, menentukan bahwa setiap warga negara bersamaan kedudukannya di dalam hukum dan pemerintahan dan wajib menjunjung hukum dan pemerintahan itu dengan tidak ada kecualinya.

Abstract

Kesehatan merupakan salah satu unsur yang sangat penting bagi kemajuan suatu Negara maka selain memberikan perhatian untuk pelayanan kesehatan Negara juga membuat dan memberlakukan peraturan-peraturan di bidang kesehatan (hukum kesehatan) sebagai pedoman yuridis dalam pemberian layanan kesehatan kepada masyarakat. Hukum kesehatan adalah semua ketentuan hukum yang hubungan langsung dengan pemeliharaan atau pelayanan kesehatan dan penerapannya. Hukum kesehatan merupakan cabang dari ilmu hukum yang secara relatif baru berkembang di Indonesia, hukum kesehatan ini salah satu cakupan dari aspek hukum perdata. Hukum Perdata adalah segala aturan hukum yang mengatur hubungan hukum antara orang yang satu dengan orang yang lain dalam hidup bermasyarakat. Dalam penelitian ini yang digunakan adalah penelitian yuridis normative yang mengolah data dari bahan hukum primer, bahan hukum sekunder serta bahan hukum tersier. Whistleblower mendapat perlindungan dari penguasa untuk mengungkap suatu kebenaran hukum sesuai dengan peraturan perundang-undangan dengan batasan batasan tertentu dalam suatu perbautan. Berdasarkan hasil penelitian yang didapat, Hukum mengatur hubungan hukum. Hubungan hukum itu terdiri dari ikatan-ikatan antara individu dan masyarakat dan antara individu itu sendiri. Ikatan- ikatan itu tercermin pada hak dan kewajiban.Begitupula dengan hubungan tenaga medis dan pasien, dalam hubungan ini kepentingan dari kedua belah pihak dilindungi oleh hukum. Setiap pertanggungjawaban harus mempunyai dasar, yaitu hal yang menyebabkan timbulnya hak hukum seseorang untuk menuntut orang lain sekaligus melahirkan kewajiban hukum untuk memberi pertanggungjawabannya. Secara teoritik kemampuan bertanggungjawab dapat diartikan sebagai kondisi batin yang normal atau sehat dan mampunya akal seseorang dalam membeda-bedakan hal-hal yang baik dan yang buruk, atau dengan kata lain, mampu untuk menginsyafi sifat melawan hukumnya suatu perbuatan dan sesuai dengan keinsyafan itu mampu menentukan kehendaknya.

Abstract

Aparatur Sipil Negara dapat diberhentikan dengan hormat atau tidak diberhentikan karena dihukum penjara berdasarkan putusan pengadilan yang telah memiliki kekuatan hukum tetap karena melakukan tindak pidana dengan hukuman pidana penjara paling singkat 2 (dua) tahun. ASN yang melakukan tindak pidana maka mekanisme penjatuhan sanksi disiplinnya berbeda pula dengan penjatuhan sanksi disiplin terhadap ASN yang hanya melakukan pelanggaran ringan. Penelitian ini untuk mengetahui pengaturan hukum dalam penjatuhan sanksi terhadap ASN, proses penjatuhan sanksi disiplin bagi ASN yang melakukan tindak pidana. Penelitian ini adalah penelitian yuridis empiris, data bersumber dari hukum islam, data primer dan sekunder yang diperoleh melalui wawancara dan studi kepustakaan. Kemudian, data diolah dengan menggunakan analisis kualitatif. Berdasarkan hasil penelitian diketahui bahwa pengaturan hukum dalam penjatuhan sanksi terhadap Aparatur Sipil Negara (ASN) pada dasarnya diatur dalam beberapa peraturan hukum, diatur dalam Undang Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara, Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil, Peraturan Pemerintah Nomor 11 Tahun 2017 tentang Manajemen Pegawai Negeri Sipil, serta Peraturan Kepala Badan Kepegawaian Negara Nomor 3 Tahun 2020 tentang Petunjuk Teknis Pemberhentian Pegawai Negeri Sipil. Proses penjatuhan sanksi disiplin bagi ASN yang melakukan tindak pidana dilakukan dengan beberapa tahap, diantaranya tahap pemanggilan, tahap pemeriksaan, tahap penjatuhan hukuman, dan tahap penyampaian keputusan hukuman disiplin. Kendala dalam proses penjatuhan sanksi bagi ASN yang melakukan tindak pidana yakni terkendala karena lamanya proses pelaporan dari kejaksaan ke Badan Kepegawaian Daerah Pemerintah Kota Medan bagi pelanggar sanksi disiplin khusus kasus tindak pidana

Abstract

Bullying kerap dilakukan oleh anak di sekolah. Sekolah yang dianggap merupakan tempat belajar bagi anak untuk pencapaian masa depannya, dijadikan oleh anak sebagai tempat menindas temannya yang lemah. Jika hal ini dibiarkan, akan berdampak yang sangat serius baik bagi anak sebagai pelaku bullying maupun sebagai korban. Tuuan penelitian ini adalahuntuk menganalisa bullying oleh anak di sekolah serta upaya pencegahannya. Penelitian ini merupakan penelitian yuridis normatif. Beberapa hal yang dapat dilakukan guna mencegah bullying oleh anak di sekolah antara lain menciptakan suasana sekolah yang nyaman, meningkatkan rasa empati, serta peningkatan pemahaman anak tentang bullying

Abstract

The rapid development of technology has resulted in the emergence of various sites that not only discuss positive things, but also offer negative thing, namely the business of selling human organs. It is very easy accessed by teenagers, and inflicted crime on the teenagers. The form of crime committed by the teenager is to get rid of a life. This research is a normative juridical research, with data sources in the form of secondary data. Data collection techniques are documentation studies. Teenagers as the next generation of the nation should do their duty as students, study, read books, play, and fight for their good future. The ease of accessing negative sites results in children easily following what they read from the site and resulted in them falling into the crime of get rid of a life, even though these acts are prohibited in Islamic Law and are very detrimental to teenagers. The crime was committed by teenagers because they were tempted by a very high offer for the sale of human organs of 80,000 dollars, and were supported by the difficult economic conditions of his family.  Negatively charged sites must be stopped, to prevent teenagers from committing crimes.

Abstract

Indonesia is on the highest list of countries targeted for the distribution of illegal narcotic drugs. In several cases there are police officers who abuse their authority as law enforcement officers and are involved in the abuse of narcotics and psychotropic substances, especially storing evidence for buying and selling and using it. The purpose of this research is to find out the modus operandi of police officers who abuse narcotics, to find out the factors that cause narcotics abuse by police officers, and to find out efforts to deal with police officers who abuse narcotics. This research is empirical juridical research. The research data sources are data originating from Islamic Law, primary data and secondary data. Data collection tools in this research are interviews and documentation studies. Based on the research results, it can be understood that the modus operandi of police officers who abuse narcotics is to embezzle evidence by keeping the narcotics found and reselling them. Apart from that, there are also those for personal use. Factors that cause narcotics abuse by police officers are environmental factors, economic factors, family factors, psychological and mental factors, weak faith factors, and weak supervision from leaders/superiors. Apart from that, it is also for fun and increasing stamina. Efforts to deal with police officers who abuse narcotics include preemptive efforts by providing education about the dangers and impacts of narcotics abuse, preventive efforts by carrying out urine tests, spiritual and mental development, and close supervision. And repressive efforts by conducting assessments or rehabilitation of police officers involved in narcotics abuse and providing disciplinary guidance so that they do not repeat their actions again by making an integrity pact

Abstract

The problem of corruption in Indonesia is quite worrying, especially the tax evasion that occurred at the Aceh Singkil bank by using their position to carry out their acts of corruption. Formulation of the problem: what is the mode of tax corruption, the factors that cause corruption, overcoming perpetrators of tax corruption. The research method used is a normative juridical research type with primary, secondary and tertiary legal materials with descriptive analytical research characteristics. This research uses data collection techniques using library research. Based on the results of the research, the modus operandi in the corruption case at Bank Aceh Singkil was that an employee named Joly Rusli committed a criminal act of tax corruption during the 2017-2020 period by borrowing his friend's ID card, making it appear as if he was making a deposit to the bank but actually diverting the money to an account. personal. As a result, the state suffered a loss of 1.4 billion rupiah. Joly Rusli was charged with Article 2 and Article 3 concerning criminal acts of corruption. The causal factor in this case, an employee of Bank Aceh Syariah Aceh Singkil Branch, is suspected of corrupting regional tax funds amounting to IDR 1.4 billion for personal gain, showing a big drive to increase personal wealth as the main motive. This greedy and greedy nature is one of the triggering factors for corruption that originates from within and weak morals and weak internal supervision of Aceh sharia banks can lead to corruption carried out by Jolly Rusly. Efforts to overcome tax corruption include refunding funds: perpetrators who are proven guilty are usually required to return the funds they have corrupted or avoided paying. and weak internal supervision and tightening supervision on banks so that the same incident will not happen again. And the perpetrator has been dismissed by the competent authority in this case, namely the Aceh Singkil regional tax office
