Abstract

Keterangan saksi merupakan salah satu alat bukti yang memiliki kedudukan sentral dalam sistem pembuktian perkara pidana di Indonesia. Dalam praktik peradilan, dikenal istilah saksi verbalisan, yakni penyidik yang memberikan keterangan di persidangan untuk menjelaskan proses pembuatan berita acara pemeriksaan atau menanggapi bantahan terdakwa atas keterangan yang termuat dalam berkas perkara. Keberadaan dan penggunaan keterangan saksi verbalisan menimbulkan perdebatan yuridis, khususnya terkait dasar hukum pengaturannya dalam Kitab Undang-Undang Hukum Acara Pidana (KUHAP), implikasinya terhadap perlindungan hak terdakwa, serta kesesuaiannya dengan prinsip peradilan yang adil (fair trial). Penelitian ini bertujuan untuk menganalisis pengaturan hukum keterangan saksi verbalisan sebagai alat bukti, mengkaji implikasi yuridis penggunaannya terhadap hak terdakwa dan prinsip keadilan, serta menelaah pertimbangan hakim dalam Putusan Pengadilan Negeri Kisaran Nomor 177/Pid.Sus/2023/PN Kis dan Putusan Mahkamah Agung Republik Indonesia Nomor 5645 K/Pid.Sus/2023, khususnya ketika saksi verbalisan tidak dihadirkan dalam persidangan. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa keterangan saksi verbalisan tidak diatur secara eksplisit sebagai alat bukti dalam KUHAP, melainkan berkembang melalui praktik peradilan dan doktrin. Penggunaan keterangan saksi verbalisan berpotensi menimbulkan persoalan perlindungan hak terdakwa apabila dijadikan dasar pembuktian utama tanpa dihadirkan dan diuji secara langsung di persidangan. Pertimbangan hakim dalam kedua putusan menunjukkan kecenderungan untuk tetap menilai keterangan saksi verbalisan secara terbatas dan tidak berdiri sendiri, serta harus didukung oleh alat bukti lain yang sah. diperlukan penegasan batasan yuridis penggunaan keterangan saksi verbalisan guna menjamin kepastian hukum dan keadilan dalam proses peradilan pidana.

Abstract

The application of the law by judges in criminal cases, especially for child victims of sexual abuse, is very important. Children have the right to protection that can endanger or hinder their normal growth and development. Therefore, it is imperative for the state to respect and protect children's rights by realizing them in legal regulations to protect children facing legal problems. This study aims to examine the role of judges in the juvenile criminal justice system in Indonesia and how judges apply the law in providing legal protection to child victims of sexual abuse and whether judges have provided legal protection to child victims of sexual abuse related to Decision Study No. 25/Pid.Sus/2021/PN Tbk, Decision Study No. 129/Pid.Sus/2021 PN Team and Decision Study No. 31/Pid.Sus/2022/PN Trg). The research method used is normative juridical with data collection techniques namely literature study. From the results of this study, the role of judges in the juvenile criminal justice system in Indonesia is to apply positive law and find laws that include justice, benefits and legal certainty by applying the application of law in accordance with the criminal acts committed by the defendant by providing protection for child victims of sexual harassment as stated in Law of the Republic of Indonesia No. 35 of 2014. Judges in applying the law with the facts in the trial in the study of decision No. 25 / Pid.Sus / 2021 / PN Tbk, decision No. 129 / Pid.Sus / 2021 PN Team, and decision No. 31 / Pid.Sus / 2022 / PN Psp, the judge decided that the defendant legally committed an innocent crime committed by the adoptive parents against the victim's child in the decision, however, in his decision the judge did not provide legal protection for the rights of the victim's child such as restitution as part of the victim's recovery.

Abstract

Village fund corruption presents a complex challenge for criminal law when the unlawful use of public funds arises from substantially different motives. This study examines judicial reasoning and sentencing in two village fund corruption cases involving contrasting circumstances: the use of village funds for personal enrichment and their use to finance urgent medical treatment for a village head’s seriously ill spouse. It aims to determine the extent to which mens rea should influence criminal liability and sentencing in village fund corruption. This normative legal research employs statutory and case approaches by comparatively examining Decision No. 8/Pid.Sus-TPK/2021/PN.Kdi and Decision No. 138/Pid.Sus-TPK/2025/PN.Mdn within the framework of Indonesian anti-corruption law and principles of criminal responsibility. The findings demonstrate that personal enrichment accompanied by unlawful intent justifies criminal liability when the objective and subjective elements of corruption are established. Conversely, unlawful village fund expenditure motivated by an urgent humanitarian circumstance requires a more nuanced assessment of culpability, particularly regarding mens rea, motive, and the degree of blameworthiness. The study concludes that adjudicating village fund corruption should not rely solely on financial irregularities but should integrate legality with substantive justice through a comprehensive assessment of the defendant’s culpability and the circumstances underlying the offense.
