Abstract

This paper is concerned with two main issues, Indonesian women workingabroad in the informal sector, mostly as domestic workers and the potentialsof other women stakeholders in addressing issues faced by women migrantworkers. This paper is written based on the assumption that an identificationof potential women at various levels and institutions may contribute to thesearch for solutions for the problems faced by the women migrant workersand that women should be seen as active actors that may contribute to theproblem solving. The identification in this paper has been able to identify theexistence of a number of prominent women migrant workers advocates, arguefor their existence in various parts within the labour migration system toguarantee a protected migration for women labour, and suggest for thewidening of the scope and activism of these women migrant workersadvocates, in line with their movements across institutions.

Abstract

Abstrak Riset ini merupakan studi reflektif yang didanai oleh proyek dari Australia Awards in Indonesia melalui skema Alumni Grant Scheme. Judul proyek ini adalah “Tantangan Mewujudkan Kesetaraan Gender di Tataran Lokal. Studi Kasus: Upaya Pemberdayaan Sosial dan Ekonomi Komunitas Perempuan Penyintas Kekerasan”. Proyek ini dilaksanakan di wilayah Kabupaten Bandung Provinsi Jawa Barat. Riset ini memiliki arti penting mengingat angka kasus kekerasan terhadap perempuan di Indonesia masih cenderung tinggi, bahkan angka kasusnya meningkat pada 2017 jika dibandingkan data pada 2016. Selanjutnya, riset ini juga berfokus kepada poin 5 SDGs, khususnya poin 5.2 yaitu penghapusan seluruh bentuk kekerasan terhadap perempuan serta para gadis baik di ruang public maupun ruang privat. Pertanyaan riset yang akan dijawab melalui riset ini: Pertama, efek dari kekerasan berbasis gender terhadap kondisi sosio-ekonomi dari para perempuan di wilayah Majalaya, Paseh, Arjasari, dan Ciparay; Kedua, tantangan-tantangan yang dihadapi oleh para penyintas kekerasan terhadap perempuan; Ketiga, bagaimana dampak dari pendekatan “social entrepreneurship” terhadap pemberdayaan ekonomi dari para perempuan penyintas kekerasan. Riset ini menggunakan pendekatan studi kasus melalui pemilihan empat desa di kawasan Kabupaten Bandung yaitu Majalaya, Paseh, Arjasari, dan Ciparay sebagai lokasi utama dari riset lapangan ini. Para perempuan dari keempat desa ini tergabung ke dalam sebuah organisasi yang disebut Bale Istri yang diinisiasi oleh Sapa Institut. Kata kunci: kekerasan berbasis gender, perempuan penyintas kekerasan, social entrepreneurship, Kabupaten Bandung. Abstract This research is a reflective study from a project funded by Australia Awards in Indonesia through Alumni Grant Scheme. The name of the project is “Social and Economic Empowerment of Women Domestic Violence Survivors”. The project took places in Bandung Regency, West Java, Indonesia. This research is important since the cases of violence against women in Indonesia are still high – even the number of the cases increased in 2017 compared to the data in 2016. In addition, this research also focuses on SDGs point 5 particularly point 5.2 to eliminate all forms of violence against all women and girls in the public and private spheres. This research questions: firstly, the impacts of gender-based violence towards the economic and social conditions of the women in Majalaya, Paseh, Arjasari, and Ciparay; secondly, the challenges faced by the women violence survivors; thirdly, how social entrepreneurship impacts on the economic empowerment of the women violence survivors. Case study is utilized as the design of inquiry by selecting four villages in Bandung Regency including Majalaya, Paseh, Arjasari, and Ciparay as main sites of the field research. The women in those four sites are joined in one organization called Bale Istri initiatied by Sapa Institute. Abstract

ASEAN member countries are migrant-sending and receiving countries. Around 7.3 million ASEAN citizens are migrant workers, more than 740 thousand refugees are from Myanmar, and many ASEAN citizens are victims of human trafficking. Frequently, these migrants get discriminatory treatment, which makes them unable to fulfill their human rights. ASEAN, as a regional organization, is an actor that can implement migration governance in the region. As a governance institution, ASEAN has several migration instruments relating to human trafficking and migrant workers. To implement this regional instrument, ASEAN forms bodies that function to encourage and protect migrant rights. The Rohingya people from Myanmar still experiences forced migration and displacement. However, ASEAN still does not have a comprehensive instrument that can be a source of regional governance toward the issue. This paper will discuss the prospects of ASEAN migration governance in resolving migration issues in the region.

Abstract

Migration, or the movement of people from their country of origin to another country, is not a new phenomenon in human life. Transnational crime occurs not only due to free trade factors and weak law enforcement but also due to the geographical conditions of the country itself. This research aims to analyse and determine Indonesia's efforts to handle irregular migration as an implementation of the Bali Process. This research uses a type of qualitative research that is descriptive analysis. The data collection techniques used in this research are secondary documents and internet-based techniques. The results of the research show that Indonesia's efforts to deal with irregular migration can be carried out with preventive and repressive efforts as stated in Article 89, paragraphs 1. 2, and 3. Cooperation between Indonesia and Australia to deal with irregular migration in the Bali Process has resulted in several equal partnerships in an MOU. Efforts to handle and protect irregular migration in the Bali process are carried out by taking into account the policies of each country with a comprehensive regional approach in accordance with the principles of Burden sharing and collective responsibility. Cooperation between Australia and Indonesia uses the basic assumptions contained in the theory of institutional liberalism put forward by Robert Keohane and Joseph Nye, in the form of: 1. Trust in Cooperation, 2. International regime, 3. Complex dependency, and 4. Interdependence.

Abstract

Child marriage is a violation of children’s rights, and it violates international human rights conventions. Its practice remains high globally and has also increased in Nigeria and Indonesia. The efforts given by international institutions to address child marriage issues are certainly not lacking. Nevertheless, child marriage remains persistent in the global landscape. The prevalence of child marriage tends to be based on solid domestic reasons such as cultural and economic factors. This paper argues that the prevalence of child marriage globally occurs because of the absence of strict international policies to form international norms. This situation indicates the diffusion of norms from the international to the domestic level. Thus, the isomorphism theoretical framework is used to clarify the diffusion process of international norms condemning the practice of child marriage. Isomorphism theory explains that international institutions can set normative standards at the global level, which are then passed down to the regional, domestic, and individual levels. With that being said, international institutions play a crucial role in eliminating the implementation of child marriage. The authors used deductive analysis to utilize a structural approach that encourages a systematic explanation of the factors contributing to child marriage. With the existing theoretical framework, deductive analysis is meant to test the accuracy of isomorphism theory through an actual case study of international norm diffusion. Thus, deductive analysis will determine whether the norm diffusion process has been effectively distributed from the international to the individual level.
