Abstract

One form of utilizing the latest digital technology in Copyright is the Non-Fungible Token (NFT). Using a blockchain system to verify the authenticity of works, NFT can be a promising solution for intellectual property protection. However, due to the development of new technologies, research is still needed on how the legal problems of using Non-Fungible Token technology are related to Copyright. This research is a normative juridicial research using primary and secondary data. Data was collected using literature study and internet access, as well as data analysis using qualitative descriptive methods. The results of the research and discussion concluded that NFT technology still has several problems. The problem that occurs in the use of NFT is that there is no related regulation that regulates NFT, so there is no legal certainty to protect the public. Another problem is the theft of copyrighted works belonging to people who are converted into NFT. This is due to the lack of maximum verification of copyrighted works by the NFT marketplace.

Abstract

Technological advancements have significantly transformed international trade, particularly through the rapid growth of e-commerce, necessitating effective dispute resolution mechanisms. This research adopts a normative descriptive analytical approach to examine Online Dispute Resolution (ODR) as an integration of Alternative Dispute Resolution (ADR) tailored to address disputes arising in the digital marketplace, with a specific focus on its implementation within the Shopee application. The research first outlines the conceptual framework of ODR and its relevance in the e-commerce context, followed by an analysis of Indonesia’s legal landscape, referencing key regulations such as Law No. 8 of 1999 on Consumer Protection, Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution, and Government Regulation No. 80 of 2019 on Trading Through Electronic Systems. A central contribution of this research lies in its exploration of artificial intelligence (AI) as a problem-solving tool within Shopee’s customer service system, demonstrating how AI can enhance the efficiency, accessibility, and fairness of dispute resolution processes. The research highlights the urgency of establishing a clear regulatory framework for ODR in Indonesia, especially in light of emerging AI-driven solutions that are reshaping the dynamics of e-commerce dispute resolution.

Abstract

Hak atas merek merupakan aset tak berwujud yang memiliki nilai ekonomi tinggi, sehingga perlindungan hukumnya termasuk mekanisme pengalihannya menjadi krusial dalam hukum kekayaan intelektual. Di Indonesia, pengaturan mengenai pengalihan hak atas merek melalui waris diatur dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, namun dalam praktiknya masih sering ditemukan kompleksitas prosedural dan ketidakpastian hukum bagi ahli waris. Penelitian ini bertujuan untuk menganalisis dan membandingkan regulasi serta mekanisme pengalihan hak atas merek melalui waris antara sistem hukum di Indonesia dan Belanda guna menemukan formulasi perlindungan hukum yang lebih efektif bagi pemegang hak merek. Metode penelitian yang digunakan dalam skripsi ini adalah penelitian hukum normatif dengan pendekatan perbandingan hukum (comparative approach) dan pendekatan perundang-undangan (statute approach). Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer berupa peraturan perundang-undangan terkait merek di kedua negara, bahan hukum sekunder seperti literatur dan jurnal hukum, serta bahan hukum tersier. Teknik pengumpulan data dilakukan melalui studi kepustakaan, yang kemudian dianalisis secara kualitatif untuk mendapatkan gambaran komprehensif mengenai perbedaan dan persamaan sistem pewarisan merek di Indonesia dan Belanda. Hasil penelitian menunjukkan bahwa meskipun Indonesia dan Belanda sama-sama mengakui merek sebagai objek yang dapat diwariskan, terdapat perbedaan signifikan dalam hal prosedur pendaftaran dan pembuktian hak bagi ahli waris. Di Belanda, sistem pengalihan cenderung lebih terintegrasi dengan hukum perdata umum yang memudahkan transisi kepemilikan, sementara di Indonesia diperlukan pencatatan resmi di Direktorat Jenderal Kekayaan Intelektual agar pengalihan tersebut memiliki kekuatan hukum terhadap pihak ketiga. Perbandingan ini menyimpulkan bahwa Indonesia dapat mengadopsi efisiensi birokrasi dari sistem Belanda untuk memperkuat kepastian hukum bagi ahli waris pemilik merek di Indonesia

Abstract

The enactment of Law Number 1 of 2023 concerning the Criminal Code (KUHP) has brought significant changes to the formulation of sanctions for corruption perpetrators. The implementation of these sanctioning norms has become increasingly urgent to examine following the ratification of Law Number 20 of 2025 concerning the Criminal Procedure Code (National KUHAP), which takes effect simultaneously with Law No. 1 of 2023. The integration of these two regulations marks a total transformation within the Indonesian criminal justice system, necessitating an in-depth analysis of the national legal instrument's readiness to accommodate Islamic justice principles toward corruption offenses. One of the primary controversies is Article 603, which sets the minimum prison sentence at 2 years, lower than the previous regulation. This study aims to analyze the construction of sanctions in Article 603 of the new Criminal Code and review them through the perspective of Islamic Criminal Law (Jinayah). The research method employed is normative legal research with a statutory approach and a comparative approach. The results indicate that corruption in Islamic law is classified as jarimah ta’zir because it constitutes an act that destroys the social order (fasad fil ardh). Normatively, the sanctions in Article 603 of the Criminal Code remain within the realm of the ruler's authority (ulil amri) to determine the severity of the punishment. However, the Jinayah perspective emphasizes that the imposition of sanctions must fulfill the elements of zawajir (deterrent effect) and zawabir (atonement). The reduction of the minimum sanction in the new Criminal Code is feared to weaken the zawajir aspect, thus requiring judicial ijtihad in sentencing to remain oriented toward the public interest (mashlahah mursalah) and the protection of property (hifzh al-maal).
