Abstract

This study aims to analyze the legal responsibility of PT. Gojek Indonesia regarding the mismatch of driver identity in the Go-Send delivery service in Serang City, based on Law Number 8 of 1999 concerning Consumer Protection. The main issue examined is the loss or non-delivery of goods due to drivers whose identities do not match the information displayed in the application. The research employs an empirical juridical approach, collecting primary data through interviews and secondary data through literature studies. The findings reveal that PT. Gojek holds legal liability to compensate consumers for their losses, either in the form of money or equivalent goods, as stipulated under consumer protection regulations. However, in practice, the dispute resolution process has not been effective, as consumers have not yet received clear compensation. Consequently, some consumers have escalated the matter to consumer protection agencies. The study concludes that PT. Gojek must improve identity verification procedures for its drivers and enhance the dissemination of information regarding claim mechanisms to users. Additionally, it is recommended to implement a mandatory-read agreement feature to ensure that consumers understand their rights. These efforts are expected to strengthen consumer trust and the overall credibility of Go-Send services.

Abstract

This study aims to analyze the form of unlawful acts in housing sale and purchase agreements and their legal consequences for consumers and developers, with a case study of Decision Number 395/Pdt.G/2021/Pn.Bks involving PT. Hadez Graha Utama. The research method uses a normative legal approach by analyzing secondary data in the form of laws and regulations, court decisions, and relevant legal literature. This study examines the legal aspects of consumer protection and contract law in the context of housing property sales and purchases. The results of the study indicate that the developer has committed an unlawful act by starting construction without having a Building Construction Permit (IMB). The court decided that the developer must pay compensation of IDR 192,730,800.00 to consumers along with court costs. This decision is an important precedent in providing legal protection for housing consumers. The conclusion of this study shows that the court decision provides legal certainty and protection for consumers, as well as a warning for developers to comply with legal provisions in housing development. Further research is needed to examine the implementation of similar decisions and their impact on the property industry and consumer protection in Indonesia.

Abstract

One of the most significant digital developments is online shopping. Online shopping is highly favored by the public because it is considered to facilitate transactions. However, there are negative impacts, including dishonest merchants when marketing products, which results in losses for consumers. Therefore, the author wants to understand how legal protection is provided for consumers who lack government oversight, as well as the legal remedies that can be taken based on Law Number 8 of 1999 concerning Consumer Protection. This research method is normative-empirical law. The data used in this study are secondary and primary data. The technique for collecting secondary data is a literature study and primary data through interviews. Data processing in this study is a literature study and field. This research analysis uses a qualitative approach. The results of the study indicate that sellers are proven to not pay attention to consumer protection because they found discrepancies in the goods received, which harm consumers. It is also explained that consumers will be protected by Law Number 8 of 1999 if the consumer feels disadvantaged by the product being sold. Consumers have the right to receive comfort, security, and safety in using a product being sold to them.

Abstract

Abstrak Tujuan Penelitian ini ialah untuk menjelaskan bahwa negara Indonesia dengan mayoritas penduduk beragama muslim perlu perlindungan konsumen terhadap produk yang beredar dan yang terjamin kehalalannya. Produk es krim Ai-CHA sampai saat ini juga belum memiliki sertifikasi halal, padahal pemerintah sudah memberikan aturan kewajiban sertifikasi halal bagi pelaku usaha. Identifikasi masalah yaitu, bagaimana penegakan perlindungan hukum bagi konsumen terhadap kewajiban sertifikasi halal pelaku usaha produk es krim Ai-CHA, serta faktor-faktor apa yang menyebabkan produk es krim Ai-CHA belum memiliki sertifikat halal. Jenis penelitian yang digunakan normatif empiris, pendekatan penelitian studi kasus. Sumber datanya yaitu data sekunder dan data primer, dengan teknik pengumpulan wawancara serta analisis data yang digunakan yaitu deskriptif kualitatif. Hasil penelitian ini menyatakan bahwa penegakan perlindungan hukum terhadap konsumen terhadap kewajiban sertifikasi halal bagi badan usaha tidak dilakukan berdasarkan Pasal 4 UUJPH, Pasal 2 ayat (1) PP Pangan Bidang JPH saat ini. Hal ini dikarenakan kewajiban yang seharusnya dilakukan pelaku usaha Ai-CHA untuk mendaftarkan sertifikasi halal tidak dilaksanakan. Penegakan hak-hak konsumen dari sembilan hak yang diakomodir dalam Pasal 4 UUPK terdapat enam poin yang terpenuhi dan tiga poin yang tidak terpenuhi. Adapun tidak terpenuhinya poin tersebut karena terdapat permasalahan yang mendasarinya, yaitu kewajiban sertifikasi halal.  Kata-kata kunci: Konsumen, Hak, Sertifikasi Halal Abstract The aim of this research is to explain that the country of Indonesia, with a majority Muslim population, needs consumer protection for products in circulation that are guaranteed to be halal. Until now, Ai-CHA's ice cream products do not have halal certification, even though the government has provided mandatory halal certification regulations for business actors. Identify the problem, namely, how to enforce legal protection for consumers regarding the halal certification obligations of Ai-CHA ice cream product business actors, as well as what factors cause Ai-CHA ice cream products to not have a halal certificate. The type of research used is normative empirical, case study research approach. The data sources are secondary data and primary data, with the interview collection and data analysis techniques used being descriptive qualitative. The results of this research state that enforcement of legal protection for consumers regarding halal certification obligations for business entities is not carried out based on Article 4 UUJPH, Article 2 paragraph (1) of the current JPH Sector Food PP. This is because the obligations that Ai-CHA business actors should carry out to register for halal certification are not being implemented. In the enforcement of consumer rights, of the nine rights accommodated in Article 4 UUPK, there are six points that are fulfilled and three points that are not fulfilled. This point is not fulfilled because there is an underlying problem, namely the obligation to halal certification.  Key words: Consumers, Rights, Halal Certification

Abstract

This study aims to analyze the problem of legal uncertainty for MHA related to the establishment of a Land Bank as mandated by the Job Creation Perppu. This research is a normative legal research with a conceptual and statutory approach. The results of the study concluded that the obligation to involve the Customary Law Community in land use through the Land Bank agency is said to be urgent, especially in an effort to maintain the mandate of the 1945 Constitution of the Republic of Indonesia and the UUPA to provide guarantees for recognition, protection as well as empowerment of the Indigenous Peoples. Efforts to realize legal certainty for Indigenous Peoples (MHA) in land use through the Land Bank agency with reference to grammatical, authentic, and teleological (sociological) interpretations, it is necessary to expand the meaning of the word "community" in Article 8 paragraph (2) PP Agency Land Bank which does not only cover society in general (individuals as legal subjects) but includes the Customary Law Community.

Abstract

Sengketa dapat bermula dari berbagai sumber potensi sengketa, salah satunya adalah dapat berupa masalah bisnis internasional atau penanaman modal asing. Sengketa tersebut harus diselesaikan dengan hukum internasional. Peran yang dimainkan hukum internasional adalah memberikan cara bagaimana para pihak yang bersengketa untuk menyelesaikan sengketanya secara win win solution. Oleh karena itu tulisan ini bertujuan untuk menganalisis mengenai bagaimanakah perkembangan dan prospek penyelesaikan sengketa penanaman modal asing serta bagaimana Implementasinya di Indonesia. Penyajian hasil penelitian ini menggunakan penelitian kualitatif dengan pendekatan yuridis normatif. Hasil penelitian ini menujukkan bahwa Berdasarkan pembahasan dan uraian fakta yang telah dijabarkan sebelumnya, maka dapat disimpulkan bahwa Dalam menyelesaikan sengketa penanaman modal para pelaku usaha lebih menyukai penyelesaian di luar lembaga peradilan (non litigasi) yaitu penyelesaian dengan menggunakan jasa Arbitrase Komersial Internasional karena jalur/metode penyelesian tersebut lebih menguntungkan para pihak. Badan Arbitrase Komersial Internasional yang terkenal adalah ICSID, suatu badan arbitrase yang menangani sengketa-sengketa penanaman modal asing antara negara dengan investor asing. Indonesia adalah salah satu negara anggota ICSID yang diratifikasi dengan Undang-Undang No. 5 tahun 1968 tentang Persetujuan Atas Konvensi tentang Penyelesaian Perselisihan Antara Negara Dengan Warga Negara Asing Mengenai Penanaman Modal. Setiap sengketa antara Indonesia dan perusahaan Asing, dapat diselesaikan dengan menggunakan ICSID.

Abstract

This study set out to address the question, "How is the future legal construction of the pattern of implementing inclusive, specialized, and equal Education for Persons with Disabilities in Indonesia?" The normative issue of how disabled people in Indonesia are often managed inspired this study. The Law on the Education System and the Law on Disabilities both include ambiguous principles on inclusive and special (segregated) education. The Statute Approach method was used to conduct this normative assessment of the law. The study's findings suggest that moving forward, Indonesia will revise legal norms in both laws and the integration of special schools and regular schools by establishing special units in regular schools to accommodate students with disabilities, all with the goal of achieving full inclusive education for people with disabilities. This may be done in increments, on a continuous basis, and using metrics based on the state of Indonesia's infrastructure right now

Abstract

This study aims to examine the role of Article 1367 of the Civil Code in determining the duties of Futures Brokers and Futures Broker Representatives in the context of Indonesian commodity futures trading, with a focus on the consequences for violations of these duties by Futures Broker Representatives. respond to it. This methodology is based on normative legal principles and is based on research into relevant literature and examination of BAKTI rulings in the field of commodity futures trading arbitration. Findings from this study highlight the importance of taking into account the Futures Broker Representative's level of professionalism as well as any applicable rules and regulations when determining the extent to which the Futures Broker is legally liable for the Futures Broker Representative's conduct. In order to provide fairness and clarity in commodity futures trading, this study's findings suggest that current rules need to be revised and adjusted. The study also suggests directions for future research on the dynamics of futures trading's legal aspects.

Abstract

This research aims to describe how the law position of outsourced workers and the law protection of outsourced workers post the law No.2 of 2022 on Job Creation. The use of outsourcing workers has a strategic position for employers in the unconducive business. But not strategic position for law protection of workers, because the impact of outsourcing is very unlack to workers. Therefore, law protection is needed for outsourcing workers to realize social justice in the employment. This research method, normative juridical based on secondary data and descriptive analysis of qualitative. The results showed that the law position of outsourcing workers in agreement of work with the company contracting and  the outsourcing worker on the provision of worker services has a working relationship with the service provider company not to the user/employer. The law protection of outsourced workers post the law No.2 of 2022 on Job Creation has protected outsourcing workers. Because the  law No.2 of 2022 on Job Creation have two models agreement of work, such as: PKWTT or PKWT with TUPE

Abstract

Legal protection of Indonesian Migrant Workers continues to be pursued, especially because of the many rights violations and inhumane treatment experienced by some Indonesian Migrant Workers. So that this phenomenon requires serious attention, both at the national and international levels. The purpose of this study is to examine and find out how the legal protection of the rights of Indonesian workers in national and international law and whether the role of the Indonesian government has been implemented in protecting the rights of Indonesian workers abroad. The research method used is normative juridical, with an approach that focuses on law as a system of norms.  This system of norms includes the principles, rules, and guidelines of the applicable law, including agreements and theories put forward by experts. This research highlights the government's efforts to build and implement a legal framework to support the rights of Indonesian Migrant Workers. However, there are still challenges that need to be addressed, such as improved monitoring and enforcement to ensure the policy is implemented effectively. This research provides greater insight into the dynamics of the Indonesian government's role in protecting workers' rights, with the aim of making this protection more effective and comprehensive.
