Abstract

The conception of Non-Imposing of a Penalty/Rechterlijk Pardon/dispensa de pena was unregulated in KUHP (Indonesia penal code). Conceptually, Rechterlijk Pardon is a modified form of “rigid legal certainty” to “flexible legal certainty”. This paradigm of Rechterlijk Pardon is based on from several cases that’s case have proven to commited crime, but his crimes are not feasible imposed a penalty. To respond the problem, RKUHP have created a new regulation (Judicial pardon), that’s judge may determine in the judgement no punishment, where he deems this case not proper to imposed a penalty. Konsepsi Non-Imposing of a Penalty/Rechterlijk Pardon/dispensa de pena merupakan suatu lembaga baru yang belum dikenal pada KUHP saat ini. Secara konseptual Rechterlijk Pardon merupakan bentuk dari modifikasi atas kepastian hukum yang bersifat kaku, menuju kepastian hukum yang bersifat fleksibel. Hal ini berangkat dari beberapa perkara yang sebenarnya telah memenuhi rumusan delik tindak pidana, namun perbuatannya tidak layak untuk dijatuhkan pemidanaan. Merespon masalah tersebut, RKUHP membuat suatu rumusan baru dengan mengatur dimungkinkannya pemaafan hakim terhadap beberapa perkara yang tidak layak dijatuhkan pemidanaan.

Abstract

ABSTRAKRestorative Justice adalah filosofi, proses, ide, teori, dan intervensi yang menekankan pada perbaikan kerugian yang disebabkan atau diungkapkan oleh perilaku kriminal. Proses ini sangat kontras dengan cara standar penanganan kejahatan seperti yang lazim dilakukan dalam hukum pidana di Indonesia. Penelitian yang digunakan dalam merumuskan materi ini adalah penelitian doktrinal, dimana penelitian ini menggunakan metode penelitian hukum normatif. Keadilan restoratif mendapat pijakan pada filosofi yang mendasari sila keempat Pancasila, yaitu musyawarah prioritas dalam pengambilan keputusan. Tujuan dari penelitian penyelesaian dengan mediasi korban pelanggar ini adalah untuk memanusiakan sistem peradilan, keadilan yang dapat menjawab kebutuhan nyata para korban, pelaku dan masyarakat. Kontribusi penelitian tentang program restorative justice ini didasari oleh keyakinan bahwa para pihak yang melakukan konflik harus dilibatkan secara aktif dalam memulihkan dan memitigasi dampak negatifnya.Keywords: Restorative Justice, Tindak Pidana, pidana. ABSTRACTRestorative Justice is a philosophy, process, idea, theory, and intervention that emphasizes repairing harm caused or expressed by criminal behavior. This process is in sharp contrast to the standard way of handling crimes as is commonly done in criminal law in Indonesia. The research used in formulating this material is doctrinal research, where this research uses normative legal research methods. Restorative justice is based on the philosophy that underlies the fourth principle of Pancasila, namely priority deliberation in decision making. The aim of this research on settlements with mediation by victims of offenders is to humanize the justice system, justice that can answer the real needs of victims, perpetrators and society. This research contribution regarding restorative justice programs is based on the belief that the parties involved in the conflict must be actively involved in recovering and mitigating its negative impacts.Keywords: Restorative Justice, Criminal Offences, crime.

Abstract

The overcrowding of inmates in correctional institutions has raised Indonesia's ranking as one of the top ten countries in the world that have problems related to overcrowding. At least we can examine this phenomenon from 2 (two) points of view, namely overcrowding as a logical consequence of the high number of cases that enter the court (overloaded) and the high number of cases sentenced to prison. This paper aims to analyze the role of the Prosecutor's Office in overcoming the problem of overcrowding. The research uses a doctrinal research method with a qualitative approach through literature studies and legal comparisons. The results of the study show that against the phenomenon of overcrowding, the Prosecutor's Office has a central role to screen cases that can enter the court stage through the implementation of criminal case settlement outside the court even though the current legal framework is very limited. In addition, the Prosecutor's Office also has a central role in determining changes in sentencing policies in order to popularize the criminal justice system through the imposition of the charges that are prepared.

Abstract

The principle of Geen Straf Zonder Schuld faces a paradox when applied to corporations, which, as a legal fiction, have no mens rea. However, the profound impact of corporate crime demands an effective mechanism for criminal accountability. This normative juridical research examines the relevance of the principle of Guilt in Indonesian corporate criminal Law through legislative, conceptual, and case-based approaches. The first findings show that, before the New Criminal Code, the application of the principle of Guilt was pragmatic through the Theory of Identification, which attributed the corporation's mens rea to the management or directing mind. This approach is supported by PERMA No. 13 of 2016 and is evident in decisions such as PT GJW and PT CND. The second finding shows the evolution of the doctrine in two directions: (a) the exclusion of the principle of culld through strict Liability in various lex specialis, especially the Law on Environmental Protection and Management; and (b) the transformation of the meaning of debt through the Corporate Culture Model, which views blame as the failure of the system or organizational culture to prevent crime. The culmination is the codification of the Corporate Culture Model in the New Criminal Code (Law No. 1 of 2023), which marks a shift from treating mistakes as lending errors to treating them as authentic corporate mistakes.

Abstract

This study examines the legal problem of the transformation of due process of law at the investigation stage in Indonesia, where the protection of suspects’ rights continues to conflict with the effectiveness of law enforcement. Normatively, the Criminal Procedure Code (KUHAP) adopts the Due Process Model, yet in practice the Crime Control Model remains dominant, creating a gap between das sollen and das sein. This research employs a normative legal research method through statutory, doctrinal, and case analysis to assess suspects’ rights and oversight mechanisms during investigations. The findings reveal that the right to legal assistance under Articles 54 and 56 of the KUHAP is still weakly implemented, contributing to the persistence of torture to obtain confessions. Internal and external oversight mechanisms have also proven suboptimal. A significant shift emerges from Constitutional Court Decision No. 21/PUU-XII/2014, which expands pretrial review to include suspect determination, searches, and seizures. Normatively, the study concludes that strengthening due process of law requires legislative reform by institutionalizing the Commissioner Judge as a proactive judicial supervisor.
