Abstract

This study aims to analyze the status and validity of the situation drawings issued by the Ministry of Home Affairs, Directorate General of Agrarian Affairs, and examine their strength as evidence in proving land rights. The method used is normative-empirical legal research with a statutory, case, and conceptual approach, using a case study of Decision No. 12/G/2024/PTUN.PLG. The results of the study indicate that situation drawings have an important role as administrative evidence in land cases, especially for land that does not yet have a measurement letter or certificate. In this case, the 1984 situation drawing was proven to be able to reveal procedural flaws in the issuance of certificates by the Land Office. The conclusion of this study confirms that legally issued and administratively verified situation drawings have sufficient evidentiary strength in explaining the boundaries, location, and control of land. Although not the main evidence, situation drawings have strategic value in resolving land disputes and emphasize the importance of procedural compliance in the land registration system in Indonesia. Penelitian ini bertujuan menganalisis kedudukan dan keabsahan gambar situasi yang diterbitkan oleh Departemen Dalam Negeri, Direktorat Jenderal Agraria, serta menelaah kekuatannya sebagai alat bukti dalam pembuktian hak atas tanah. Metode yang digunakan adalah penelitian hukum normatif-empiris dengan pendekatan perundang-undangan, kasus, dan konseptual, menggunakan studi kasus pada Putusan No. 12/G/2024/PTUN.PLG. Hasil penelitian menunjukkan bahwa gambar situasi memiliki peran penting sebagai alat bukti administratif dalam perkara pertanahan, terutama untuk tanah yang belum memiliki surat ukur atau sertipikat. Dalam perkara tersebut, gambar situasi tahun 1984 terbukti mampu mengungkap cacat prosedur penerbitan sertipikat oleh Kantor Pertanahan. Kesimpulan penelitian ini menegaskan bahwa gambar situasi yang diterbitkan secara sah dan diverifikasi secara administratif memiliki kekuatan pembuktian yang cukup dalam menjelaskan batas, lokasi, dan penguasaan tanah. Meskipun bukan bukti utama, gambar situasi memiliki nilai strategis dalam penyelesaian sengketa pertanahan dan menegaskan pentingnya kepatuhan prosedural dalam sistem pendaftaran tanah di Indonesia.

Abstract

The digital transformation of land administration services in Indonesia through the Electronic Land Certificate Program represents a strategic government initiative aimed at improving efficiency, transparency, and legal certainty, as regulated under the Ministerial Regulation of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) No. 3 of 2023. However, its implementation faces multifaceted complexities and challenges at the local level. This study aims to conduct a comparative analysis of the implementation of the electronic land certificate program across four prioritized land offices: Sleman, Bogor I, Bogor II, and Buleleng—by identifying common patterns and specific differences in encountered issues and applied strategies. A descriptive qualitative approach with a comparative case study method was employed. Data were gathered through in-depth interviews, direct observations, and document analysis at each location. The findings reveal shared challenges, including poor data quality, limited human resources, suboptimal information technology infrastructure, and constrained policy and budget dynamics. Nonetheless, differences arise across local contexts: Sleman highlights case backlogs; Bogor I focuses on media conversion issues; Bogor II emphasizes the relationship between data quality and implementation effectiveness; while Buleleng centers on post-disaster archival reconstruction strategies. This research contributes to a more profound understanding of regional implementation gaps and offers adaptive policy recommendations to accelerate sustainable digital transformation within Indonesia’s national land administration system.

Abstract

The issuance of electronic land certificates at the Sleman Land Office represents a key component of Indonesia’s national digital transformation agenda for land administration, formally initiated on May 31, 2024, through Ministerial Decree of ATR/BPN No. 285/SK-OT.01/III/2024. The implementation was carried out in two phases, each generating distinct implications for service performance and institutional readiness. This study aims to assess the implementation process and identify the challenges encountered in issuing electronic land certificates at the Sleman Land Office. A qualitative research method was applied using observations, interviews, and document analysis. The findings indicate several critical issues, including insufficient land data quality, limited human resources, inadequate information technology infrastructure, evolving policy frameworks, and budgetary constraints. Despite these challenges, the office has undertaken several corrective measures, such as improving data quality, enhancing human resource capacity, optimizing technological infrastructure, developing internal SOPs, and prioritizing budget allocation. This study underscores the importance of data readiness, human capital, institutional systems, and regulatory support as determining factors for the successful implementation of electronic land certificates. Keywords: Electronic Certificate, Digital Transformation, Data Quality, Land Services Digitalization, Kantor Pertanahan Kabupaten Sleman   INTISARI Penerbitan sertipikat elektronik di Kantor Pertanahan Kabupaten Sleman merupakan bagian dari agenda nasional transformasi digital layanan pertanahan yang secara resmi dimulai pada 31 Mei 2024 melalui Keputusan Menteri ATR/BPN Nomor 285/SK-OT.01/III/2024. Implementasi dilakukan dalam dua fase yang masing-masing membawa konsekuensi terhadap kinerja pelayanan dan kesiapan kelembagaan. Penelitian ini bertujuan untuk menilai proses implementasi serta mengidentifikasi berbagai tantangan yang muncul dalam penerbitan sertipikat elektronik di Kantor Pertanahan Kabupaten Sleman. Metode penelitian yang digunakan adalah kualitatif dengan teknik pengumpulan data melalui observasi, wawancara, dan studi dokumen. Hasil penelitian menunjukkan adanya sejumlah permasalahan utama, seperti kualitas data pertanahan yang belum memadai, keterbatasan sumber daya manusia, infrastruktur teknologi informasi yang kurang optimal, dinamika perubahan kebijakan, serta keterbatasan anggaran. Meskipun demikian, berbagai langkah perbaikan telah dilakukan, termasuk peningkatan kualitas data, penguatan kapasitas SDM, optimalisasi infrastruktur, penyusunan SOP internal, serta penajaman prioritas dalam manajemen anggaran. Penelitian ini menegaskan bahwa kesiapan data, sumber daya manusia, sistem kelembagaan, dan dukungan regulasi merupakan faktor kunci keberhasilan implementasi sertipikat elektronik.
