Abstract

Marriage is an inner and outer bond between a man and a woman as husband and wife to form a happy and eternal family (household) based on God Almighty. Marriage is an event that often occurs in human life and society; however, people often do not understand marriage law. Therefore, it is crucial to conduct legal counseling regarding marriage so that the public understands the legal rules surrounding the marriage, including the principles of marriage, the legal requirements of marriage, and the legal consequences of marriage. This counseling aims to understand marriage law, especially one based on the Indonesian Marriage Law. Therefore, the method presents marriage law material, followed by a question-and-answer session. This counseling was online using zoom.us, attended by congregation of Saint Paul Miki Church in Salatiga. This activity provides benefits in the form of increased knowledge and understanding of marriage law for unmarried and married participants.

Abstract

In the making of an agreement, it always refers to 4 (four) terms of the validity of the agreement which is regulated in Article 1320 of the Indonesian Civil Code. There is an important element from 4 (four) legal requirements named the agreement between the two parties. The background of this thesis writing is the development of technology where there are developments in the trade sector, namely buying and selling through vending machines without involving the seller directly or real. This research writing aims to determine the form of sale and purchase agreements through vending machines in terms of the legal aspects of the agreement. The writing of this research uses normative research and a statutory approach as well as a conceptual approach, so that it can be concluded that the agreement in buying and selling through vending machines appears when the buyer puts money into the vending machine and the goods come out.

Abstract

This study examines nature as a legal subject in Indonesian civil law. So far, humans have been colonized by the ethics of anthropocentrism, which considers nature as an object, so human behaviour tends to be arbitrary and detrimental to the preservation of nature. As a critique of the concept of anthropocentrism, the concept of ecocentrism emerged, which views nature as having sovereignty. So, with the concept of ecocracy, nature can increase from object to subject. This research method compares the natural (environmental) protection regulation in Indonesia with other countries that have recognized nature as a legal subject. Based on the results of the study, there are limitations to the regulation of nature protection in Indonesia and placing nature as a legal subject provides legal implications, namely changes in regulations that place more emphasis on natural rights, the need for a guardian for nature in carrying out legal actions and the addition of legal standing for nature in civil law.

Abstract

The use of social media by children is an action that needs supervision from parents. Social media can support the education sector in children. However, it is not uncommon for children's actions on social media to be unconsciously justified as violations of the law. Therefore, it is important to conduct socialization with parents about the wise use of social media. In addition, this socialization will also provide parents with an understanding of the regulations related to activities on social media. With this understanding, it becomes a provision for parents to supervise their children. The methods used in this activity are presentation and question and answer. Through this activity, it benefits parents in the form of understanding the existence of violations in the use of social media that can ensnare children as well as remind parents of their responsibilities in supervising children, especially in the use of social media.

Abstract

Hypertension is a major health problem among older adults because it increases the risk of chronic disease complications. In Ngrawan Village, 70 older adults were identified as having hypertension during activities at the elderly integrated health post (Posyandu Lansia), while 87.14% of the foods consumed by older adults were classified as high in salt. This condition highlights the need to strengthen the role of community health cadres in promoting hypertension-preventive behaviors in the community. This community service program aimed to enhance the capacity of Posyandu cadres to provide hypertension prevention education based on local food resources. The activity was conducted using a service-learning approach involving 25 health cadres in Ngrawan Village, Central Java, on September 15, 2024. The educational media used included a pocketbook entitled Ngadi Salira Atasi Hipertensi and a DASH diet video entitled Diet Ingkang Atasi Saben Hipertensi, which were developed using local language, attractive visuals, and examples of local foods. Evaluation was carried out using a questionnaire assessing language clarity, visual presentation, and overall media quality. The results showed that all cadres (100%) received the media very positively. This positive reception was followed by increased readiness among cadres to deliver education in a more active, communicative, and contextual manner, as well as to encourage the adoption of healthy behaviors among older adults, particularly reducing salt intake, choosing healthier local foods, and monitoring blood pressure regularly.

Abstract

Seiring dengan perkembangan teknologi, tindakan cover lagu banyak dilakukan oleh pengguna sosial media. Pada dasarnya cover lagu merupakan kegiatan mempertunjukan versi lain dari lagu oleh pihak selain pencipta atau pemegang Hak Cipta. Terhadap hal ini muncul pertanyaan, apakah tindakan cover lagu ini merupakan pelanggaran Hak Cipta. Disisi lain terdapat konsep fair use dalam Hak Cipta yang perlu diungkapkan khususnya terkait cover lagu. Lebih lanjut juga dipertanyakan apakah prinsip fair use tersebut dapat diaplikasikan pada tindakan cover lagu. Penelitian ini hendak mempertahankan argumen bahwa cover lagu di media sosial tidak melanggar Hak Cipta sepanjang memenuhi prisip fair use yang terdapat dalam Pasal 43 huruf d Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, yaitu bersifat tidak komersial, menguntungkan pencipta, dan pencipta tidak keberatan atas kegiatan cover lagu di media social. Artikel ini merupakan penelitian hukum yang menggunakan pendekatan perundang-undangan, pendekatan teoritik, dan pendekatan perbandingan. Konsisten dengan thesis yang dipertahankan, artikel ini menyimpulkan bahwa cover lagu berpotensi melanggar Hak Cipta; prinsip fair use merupakan pembatasan dalam kepemilikian Hak Cipta; Pasal 43 huruf d dapat diaplikasikan untuk tindakan cover lagu, sehingga tindakan cover lagu di media sosial dapat dibenarkan berdasarkan prinsip fair use.

Abstract

This study aims to analyze the alignment of Indonesia’s regulations on electronic contracts with the UNCITRAL Model Law on Electronic Commerce in order to promote reforms to contract law that are more adaptable to digital developments. The digital transformation has made electronic contracts the primary means of conducting cross-border civil transactions. However, Indonesia’s regulations under the ITE Law are considered to be limited to business transactions and do not yet accommodate other civil relationships. The method used is normative legal research employing legislative, conceptual, and comparative approaches. This study analyzes the UNCITRAL Model Law on Electronic Commerce as an international legal instrument serving as a guideline for harmonization. In addition, this study also examines the ITE Law and its implementing regulations as sectoral regulations, as well as the Indonesian Civil Code as the general legal framework that should ideally serve as the overarching regulatory framework for electronic contracts. The novelty of this study lies in its analysis of the relationship between the principle of freedom of contract in the Indonesian Civil Code and UNCITRAL’s international standards, a topic rarely discussed in the national literature. The results of the study indicate that the UNCITRAL Model Law provides a flexible and universal framework consistent with the principle of freedom of contract; however, its application in Indonesia remains limited by the ITE Law’s focus solely on electronic transactions. The conclusion of this study is that harmonization of Indonesian contract law with international principles is necessary so that the regulation of electronic contracts can apply across sectors, not limited to business, and meet the dynamics of legal globalization.
