Abstract

Pemutusan Hubungan Kerja yang terjadi di Perusahaan Ekspedisi PT. Jalur Nugraha Ekakurir/JNE Perkara Perselisihan Hubungan Industrial yang gugatannya diajukan dua Karyawan tetap yang bernama Jamaludin dan Nanda Setiawan masalah ini berawal dari barang pengiriman elektronik dan sperpat hilang karena dititipkan, penggugat menggugat ke Mahkamah Agung sebagai karyawan tetap tidak mendapatkan haknya sebagai karyawan. Namun tergugat membuat alasan penggugat juga diduga melakukan tindak pencuriankarung dan perbuatan para penggugat tersebut diberikan sanksi Pemutusan hubungan kerja dengan alasan mendesak sesuai dengan Pasal 36 Peraturan Perusahaan. Pasal 170 Undang-undang No.13 tahun 2003 tentang Ketenagakerjaan menegaskan Pemutusan hubungan kerja yang dilakukan tidak memenuhi ketentuan Pasal 151 ayat (3) dan Pasal 168, kecuali Pasal 158 ayat (1), Pasal 160 ayat (3), Pasal 162, dan Pasal 169 batal demi hukum dan pengusaha wajib mempekerjakan pekerja/buruh yang bersangkutan serta membayar seluruh upah dan hak yang seharusnya diterima. Menyatakan Pembentukan UU Nomor 11 Tahun 2021 tentang Cipta Kerja tidak mempunyai ketentuan hukum yang mengikat secara bersyarat sepanjang tidak dimaknai tidak dilakukan perbaikan dalam waktu 2 tahun sejak putusan ini diucapkan. Penelitian ini menggunakan pendekatan yuridis normative dan yuridis empiris. Pengumpulan data dilakukan dengan studi pustaka dan studi lapangan. Analisis data dilakukan secara kualitatif. Dalam penulisan akan membahas dari sudut pandang Hukum Tenaga Kerja dan Undang-Undang Cipta Kerja.

Abstract

Legal protection for song copyrights is needed in order to create a better climate and atmosphere for the growth and development of music in Indonesia. The problem is how is the form of legal protection for song copyright holders for unlawful acts committed by corporations? What are the considerations of legal reasons and legal philosophical considerations by the Panel of Judges regarding Tort Towards Song Copyright by Corporations in the Court Ruling of the Central Jakarta District Court Number 19/Pdt.Sus-HakCipta/2020/PN.Niaga.Jkt.Pst. and Court Ruling of the Surabaya District Court Number 4/Pdt.Sus-HKI/HakCipta/2020/PN.Niaga.Sby.? Normative juridical research methods. In conclusion, legal protection for Tort toward song copyright by corporations. If there is a song copyright dispute, the settlement can be carried out through alternative dispute resolution, arbitration, a court where the court is a commercial court. The decision on the lawsuit must be pronounced no later than 90 (ninety) days after the lawsuit is registered. Therefore, the task of the judge to try cannot be separated from legal discovery activities. In the court decision verdict number 4/Pdt.Sus-HKI/HakCipta/2020/PN.Niaga.Sby. November 12, 2020, which rejected the Plaintiff's lawsuit in its entirety, is inappropriate because the Panel of Judges should carry out legal discovery activities by looking at Government Regulation Number 20 of 2017 Concerning Import or Export Control of Goods Allegedly Consisting of or Originating from Intellectual Property Rights Violations.

Abstract

This labor problem is quite complex especially in terms of implementing work agreements. Work agreements made between employers and workers prone to conflict, especially if there are problems with Termination of Employment, wages and conflicts of interest. The arrangement of the work agreement itself is contained in Article 56 up to Article 66 of Act Number 13 of 2003 concerning Employment but for the author the provision is still imperfect considering the format of the work agreement itself is not clearly regulated even though this provision is very important to protect workers' rights. Based on this, the author raised the contents of this study around the issue of work agreements and supervision of the implementation of work agreements, especially Unspecified Time Work Agreements and Specific Time Work Agreements. According to Article 1 number 14 of Act Number 13 of 2003 concerning Manpower ("Manpower Law"), the definition of a work agreement is an agreement between workers/laborers with employers or employers that contains the work conditions, rights and obligations of the parties. An Unspecified Time Work Agreement stipulated in Article 60 of Act Number 13 of 2003 concerning Manpower is a work agreement that can require a period of employment of no longer than 3 (three) months. In the probationary period referred to in paragraph (1), employers are prohibited from paying wages below the applicable minimum wage. Whereas legal protection in work agreements with automotive sector companies in Indonesia as stipulated in Law Number 13 of 2003 concerning Manpower aims to ensure a harmonious working relationship between workers/laborers and employers without any pressure from strong parties to weak parties.

Abstract

In Indonesia and in developed and even developing countries, labor is divided into two, namely, formal labor and informal labor. Homeworkers are considered not to be employed by “employers” directly because they are sub-contracted or in other words informal workers, they are not given the protection provided by law to other workers (workers in the formal sector). The purpose of this study is to determine and analyze the legal uncertainty in providing labor protection guarantees for home workers in Indonesian labor law and to understand and analyze a form of legal certainty in providing home worker protection guarantees in Indonesian labor law. This research method is a normative legal research with a normative juridical approach and analyzed qualitatively. The results of this study provide the conclusion that the current Manpower Law does not specifically and specifically address homeworkers causing legal uncertainty of protection guarantees for homeworkers and efforts that can be made to provide legal certainty for the protection of homeworkers are to ensure that homeworkers carry out their work based on work agreements, and the Government through the Ministry of Manpower must immediately make and pass laws that clearly and explicitly regulate the labor rights of homeworkers.

Abstract

Undang-Undang Nomor 28 Tahun 1999 mewajibkan penyelenggara negara untuk melaporkan dan mengumumkan kekayaannya sebelum dan setelah menjabat, serta diperiksa kekayaannya selama masa jabatannya. Pelanggaran terhadap ketentuan ini akan dikenakan sanksi administratif. Sesuai dengan UU Nomor 19 Tahun 2019 Pasal 7 ayat 1 (a), Komisi Pemberantasan Korupsi (KPK) berwenang mendaftarkan dan memeriksa Laporan Harta Kekayaan Penyelenggara Negara (LHKPN) untuk meningkatkan integritas dan akuntabilitas sebagai upaya pencegahan korupsi. Metode yang digunakan yuridis normativ, yaitu merupakan penelitian hukum yang didasarkan pada bahan hukum yang diperoleh dari studi kepustakaan. Salah satu upaya untuk mencegah korupsi bagi pejabat di lingkungan PT Pertamina Bina Medika IHC adalah dengan Pelaporan Harta Kekayaan Penyelenggara Negara dan KPK tetap melakukan penyelidikan berdasarkan laporan masyarakat yang mencurigai ketidaksesuaian antara kekayaan yang dilaporkan dan kenyataan yang ada. Hal ini menegaskan bahwa proses pemberantasan korupsi membutuhkan pendekatan yang holistik dan beragam, serta kerjasama antara lembaga penegak hukum dan masyarakat.

Abstract

The Power of Attorney to Impose Mortgage Rights (SKMHT) holds a significant position in credit agreements as a binding instrument for mortgage rights guarantees. In this context, the SKMHT serves as a tool to provide legal protection to the creditor's rights over the guarantee. This research employs a juridical-empirical approach, with descriptive analytical specifications. The data sources and types used in this study include primary data in the form of interviews and secondary data, namely primary legal materials, secondary legal materials, and tertiary legal materials. The field research data collection techniques consist of interviews and literature research using legal protection theory and legal certainty theory. The data analysis of this research uses qualitative methods, and from the results of the data analysis that has been collected, conclusions are drawn using inductive reasoning and presented in the form of legal writing. The results of the study indicate that 1) The position of the Power of Attorney to Impose Mortgage Rights (SKMHT) in the credit agreement as a binding guarantee for mortgage rights is very important. The SKMHT functions as a legal instrument that provides legal certainty for creditors and debtors in credit agreements. The SKMHT strengthens the mortgage rights guarantee by granting power to the creditor to register the mortgage rights on the guarantee object. In the context of legal protection, the SKMHT protects the interests of creditors and debtors and ensures balance and justice between the two. 2) In the implementation of the imposition of mortgage rights with the Power of Attorney to Impose Mortgage Rights (SKMHT) based on Law Number 4 of 1996, there are several obstacles that can disrupt legal certainty. Some of these obstacles include ambiguity or deficiencies in the preparation of the SKMHT, administrative problems in the registration process, rejection or obstacles from the Land Office. To overcome these obstacles, several solutions need to be implemented, such as drafting a clear and accurate SKMHT, improving the efficiency of the registration process, clarifying regulations and communication with the Land Office, an effective monitoring and supervision system, as well as counseling and education to related parties.

Abstract

The transfer of land rights refers to the process of moving or shifting land ownership from an individual or a group of people to another individual or group. Based on Article 37 of Government Regulation Number 24 of 1997, the transfer of land rights and ownership rights of a strata title unit, such as through sale, exchange, donation, incorporation into a company, and other legal acts of transfer (except for auctions), can only be officially recorded if proven by a deed created by an authorized Notary Public. Although the regulation doesn't explicitly define 'transfer' and 'transferred,' it clearly outlines the process of transferring land rights or ownership rights of a strata title unit. In practice, many people still buy and sell land without involving a notary or a Notary Public. These transactions often involve only a simple receipt as proof of the sale, without any witnesses. Due to a lack of public awareness about land transfer regulations, many land rights are transferred without any legal validity. This research employs a normative juridical approach, examining laws as they are written (law in books) and as they serve as guidelines for appropriate human behavior. It specifically focuses on the resolution of disputes involving the transfer of individual land ownership to a company, as seen in Supreme Court Decisions Number 852 K/Pdt/2021 and Number 213 K/PDT/2020. These cases highlight the importance of legal certainty when contributing buildings (without the land) as capital to a limited liability company. According to Article 34 of the Company Law, there are specific procedures for contributing capital in forms other than cash. To ensure a clear and legally valid process for contributing immovable property (other than land), a deed of contribution must be created before a Notary Public. This deed serves as official proof of the capital contribution to the limited liability company. Landowners whose land has a building that is contributed as capital to a limited liability company generally only retain ownership rights over the land itself. If there is an agreement between the landowner and the building owner (such as a cooperation agreement, profit-sharing agreement, or lease agreement), all terms, rights, and obligations must be clearly defined to prevent future disputes.

Abstract

Pengusaha sering menggunakan pekerja outsourcing untuk menekan biaya operasional. Sistem PKWT lebih populer karena dianggap efektif dan efisien bagi pengusaha, namun regulasi yang ada tidak memadai dalam melindungi pekerja outsourcing. Perlindungan hukum yang memadai harus mencakup pembatasan penggunaan outsourcing, pengaturan upah dan manfaat minimum, serta jaminan keamanan kerja. Penelitian ini menggunakan metode penelitian hukum normatif untuk menganalisis regulasi terkait dan teori keadilan dan kepastian hukum. Hasilnya menunjukkan bahwa peralihan hak-hak pekerja dari PKWT ke PKWTT sering kali tidak lancar, menyebabkan ketidakpastian status kerja bagi pekerja outsourcing. Perlindungan hukum harus mencakup aturan yang jelas mengenai status kerja, prosedur peralihan status kerja, dan hak-hak pekerja. Negara harus memastikan bahwa pekerja outsourcing memiliki akses yang sama terhadap hak-hak dasar pekerja dan tidak mengalami diskriminasi atau eksploitasi oleh pengusaha.

Abstract

Langkah yang ditempuh pemerintah adalah membuat suatu terobosan baru dalam pembiayaan proyek infrastruktur di sektor perkeretaapian. Dan yang menjadi terobosan baru tersebut adalah dengan penerbitan Surat Berharga Syariah Negara (Sukuk Negara) untuk pembiayaan infrastruktur. Seperti yang tertuang dalam Undang-Undang Nomor 19 Tahun 2008 tentang Surat Berharga Syariah Negara. Permasalahan yang dibahas dalam penelitian ini Bagaimana bentuk pembiayaan proyek infrastruktur di Sektor Perkeretaapian menurut Undang-Undang dari aspek Kepastian Hukum? Bagaimana implementasi serta kendala dan tantangan dalam pelaksanaan pembiayaan proyek infrastruktur di sektor perkeretaapian melalui SBSN? Metode Penelitian yuridis normatif. Kesimpulannya Terdapat beberapa bentuk pembiayaan infrastruktur di sektor perkeretaapian diantaranya dengan menggunakan pendanaan melalui Kerja Sama Pemerintah Swasta (Public Private Partnership/PPP), Surat Berharga Negara Syariah (SBSN), Pinjaman dan Hibah Luar Negeri (PHLN), Penyertaan Modal Pemerintah (PMN). Pembiayaan Proyek Infrastruktur di Sektor Perkeretaapian Melalui SBSN telah dilaksakan oleh Direktorat Jenderal Perkeretaapian di berbagai daerah meliputi wilayah Sumatera, Jawa, dan Kalimantan. Lalu, yang menjadi tantangan dalam pelaksanaan pembiayaan infrastruktur di sektor perkeretaapian melalui SBSN sehingga menyebabkan rendahnya penyerapan SBSN pada Ditjen Perkeretaapian, ialah lamanya proses administrasi dalam tahap penyiapan proyek SBSN dan mengenai pembebasan lahan.

Abstract

Kepailitan merupakan suatu kondisi di mana debitor tidak dapat memenuhi kewajiban finansialnya, yang berujung pada proses hukum untuk penyelesaian utang. Penelitian ini bertujuan untuk mengkaji perspektif hukum terhadap kepailitan pada dua jenis badan usaha, yakni Perseroan Terbatas (PT) dan Persekutuan Firma. Kedua badan usaha ini memiliki karakteristik hukum yang berbeda, yang mempengaruhi mekanisme penyelesaian kepailitan dan dampaknya terhadap kreditor serta pemegang saham atau anggota. Dalam konteks PT, terdapat pembatasan tanggung jawab pemegang saham terhadap utang perusahaan, sementara dalam Persekutuan Firma, anggota persekutuan memiliki tanggung jawab penuh terhadap kewajiban bisnis, baik secara pribadi maupun bersama. Penelitian ini menggunakan pendekatan normatif dengan analisis terhadap undang-undang yang relevan, serta literatur yang berkaitan dengan kepailitan dan hukum perusahaan. Hasil penelitian menunjukkan bahwa meskipun ada perbedaan mendasar dalam pengaturan tanggung jawab hukum antara PT dan Firma, keduanya memiliki mekanisme yang bertujuan untuk memberikan perlindungan bagi kreditor sekaligus memastikan kelangsungan usaha. Oleh karena itu, pemahaman yang mendalam mengenai perbedaan dan persamaan dalam pengaturan kepailitan kedua badan usaha ini sangat penting bagi pengusaha, praktisi hukum, serta pihak-pihak terkait dalam upaya mengelola risiko hukum yang mungkin timbul.
