Abstract

Commonly, people pay their zakāt to aṣnāf groups based on their preferences and considerations. However, in Madura, the distribution of zakāt continues to adhere to the traditional notion, wherein it is mainly allocated and prioritized to kiai. This faces a debatable phenomenon whether Kiai could be zakāt recipients or not. Therefore, this research aims to explore the diversification role of Kiai in zakāt payment and describe the theological and social construction among zakāt payment in Madura. The present study employed qualitative research methodologies, specifically utilizing interviews as the primary data collection technique. The participants in this study included kiai, community members, and leaders from Madurese community. This research study indicates that the Madurese Muslim community designates kiai as mustahīqq zakāt under masākīn, fī sabīlillāh, and amīl categories. The diversification of the Kiai’s role is predicated upon the theological perspective held by Madurese Muslim community which posits that the kiai is a rightful recipient of zakāt. Additionally, Madurese Muslim community keeps a social perception that kiai is a revered individual deserving of compensation. Consequently, even though Madurese people understand the existence of religious doctrine to whom they have to spend zakāt, they still prioritize giving zakāt to kiai as the result of their typical social construction.

Abstract

The application of sharia principles in business activities and services adds to standard compliance and some of them are trapped in the legalistic formality aspect rather than improving business ethics. In hospitals, which main business is providing health services, applying sharia principles may enhance the added value in health services or just a formal aspect. The purpose of this study seeks to reveal the community's response to the application of sharia standards in hospitals. The study used a quantitative research method, through the distribution of questionnaires to 50 patients and their families in three regional public hospitals; Zainoel Abidin Hospital Aceh, Sultan Agung Hospital Semarang, and Bandung Islamic Hospital, and interviews with the management and sharia supervisory board of the hospital. This study describes descriptively, with a Likert scale approach, to see the response toward the application of sharia standards. The results show that the majority of respondents gave a positive response to the application of sharia standards. Sharia standards are added value services in sharia hospitals. The results of this study is implicated in the management of sharia compliance in hospitals and the need for regulatory support for the implementation of sharia in hospitals.

Abstract

Methodology Commentary Ahkam. The perfection of Islam is not the explanation lies in the Qur'an in detail to every problem facinghumanity, but on abortion that contain the basic tenets and principal. For if the Qur'an as a major source of Islamic teachings explain in detail to all the problems facing humanity, then Islam will lose relevance with the community dynamics are constantly changing from time to time. Therefore, the verses of the Koran are generally only contain teachings in the form of basic and fundamental, without further explanation about the details and procedures for implementation. Then the Sunnah of the Prophet provide an explanation of the details and procedures for the implementation of the basic teachings.

Abstract

Nash-nash Alquran atau Sunnah itu disampaikan dalam bahasa Arab. Untuk memahami hukum-hukumnya secara sahih hanya bisa terjadi apabila dalam satu pemahaman itu dipelihara tuntutan uslub bahasa Arab, dan teori-teori dalalah di dalamnya. Selain, dipelihara juga dalil yang menunjukkan bahwa lafallafalnya mufrad atau murakkab. Dari hasil penelitian ini, ulama menetapkankaidah-kaidah dan batasan-batasan yang dengan memeliharanya dapat sampai kepada memahami hukum-hukum dari nash-nash syar'iyah dengan pemahaman yang sahih, sesuai dengan yang dipahami oleh orang Arab.

Abstract

Keadilan dalam waris yang ditunjukkan Alquran memposisikan laki-laki lebih unggul dua kali lipat dibandingkan dengan perempuan. Disamping itu, asas keadilan dalam hukum kewarisan Islam mengandung pengertian adanya keseimbangan antara hak yang diperoleh dan harta warisan dengan kewajiban atau beban kehidupan yang harus ditanggungnya atau ditunaikannya diantara para ahli waris. Oleh karena itu keadilan dalam kewarisan tidak berarti membagi sama rata harta warisan kepada semua ahli waris, tetapi berpihak kepada kebenaran sebagaimana yang telah digariskan oleh Alquran. Jika laki-laki memperoleh lebihbanyak dari kaum perempuan, ini terkait dengan tanggung jawab laki-laki yang lebih besar dari perempuan untuk membiayai rumah tangganya. Perbedaan yang berdasarkan besar kecilnya beban dan tanggung jawab laki-laki dan perempuan berdasar hukum kausalitas imbalan dan tanggung jawab, bukan mengandung unsur diskriminasi. Forsi perempuan yang ditentukan tersebut seimbang dengan kewajibannya. Sebab dalam Islam, kaum wanita pada dasarnya dibebaskan dari memikul tanggungjawab ekonomi keluarga. Oleh karena itu, jika seseorang menerima bagian waris tinggi, berarti hal itu merupakan manifestasi dari tingkat kewajibannya, yang merupakan konsep perbedaan secara sosiologis dalam masyarakat Islam.

Abstract

Artikel ini mengkaji hak waris anak luar kawin dan anak dari perkawinan siri dalam konteks hukum waris Islam dan perkembangan hukum positif di Indonesia. Dengan pendekatan yuridis-normatif berbasis maqashid syariah, penelitian ini menganalisis implikasi Putusan Mahkamah Konstitusi No. 46/PUU-VIII/2010 yang mengakui hubungan perdata antara anak biologis dan ayahnya dalam kondisi tertentu. Ditemukan adanya ketegangan antara prinsip hukum waris Islam klasik—yang umumnya tidak mengakui hak waris bagi anak luar kawin—dan kebutuhan hukum modern untuk melindungi hak anak tanpa diskriminasi status kelahiran. Studi ini menawarkan reinterpretasi kontekstual terhadap hukum Islam agar selaras dengan tujuan maqashid syariah, khususnya perlindungan nasab (hifz al-nasl) dan keadilan (‘adl). Temuan ini berkontribusi terhadap wacana pembaruan hukum keluarga Islam agar lebih responsif terhadap realitas sosial masyarakat Muslim kontemporer di Indonesia.
